The criminal case is ongoing but likely nearing an end. Boeing was found in violation of the deferred prosecution agreement but the judge rejected the negotiated plea deal. The families of the victims are unhappy because the criminal case focuses on the single charge of defrauding the FAA, and not on those who lost their lives. Erin maintains a robust practice of litigating tort claims governed by the Montreal Convention, the global treaty governing international commercial flights. She teaches a popular aviation CLE course for other attorneys on how to litigate personal injury claims for international airline passengers. Erin has published a comprehensive update on the law governing international aviation claims in the highly respected legal journal of McGill University, “Annals of Air and Space Law.”  Erin serves as Co-Chair of the New York City Bar Association's Aeronautics Committee, Vice Chair of the American Bar Association's Aviation and Space Law Committee, and is an active member of the American Association for Justice and the International Aviation Women's Association. Aviation News Russian Air Defence System Caused Azerbaijan Airlines Plane Crash On December 25, 2024, an Azerbaijan Airlines ERJ-190 flying from Baku Azerbaijan to Grozny in Russia's Chechnya crashed in Aktau Kazakhstan leaving 38 people dead. The plane diverted from Grozny due to dense fog and ultimately made an emergency landing an hour later in Grozny. On final approach, the Embraer lost altitude and impacted the ground off the runway. Twenty-nine people, including the cabin crew, survived. Thirty-eight, including the flight crew, did not IATA Statement on Azerbaijan Airlines Flight 8243 says, in part: "Civil aircraft must never be the intended or accidental target of military operations. The strong potential that Azerbaijan Airlines flight 8243 could have been the victim of military operations, as indicated by several governments including Russia and Azerbaijan, places the highest priority on conducting a thorough, transparent, and impartial investigation. The world eagerly awaits the required publication of the interim report within 30 days, in line with international obligations agreed in the Chicago Convention. And should the conclusion be that this tragedy was the responsibility of combatants, the perpetrators must be held accountable and brought to justice." Boeing - one of the world's largest airplane manufacturers and once its most well respected - has seen  a string of concerning incidents have tarnished that reputation.   This year alone, we've seen a door plug blow off mid-flight on an Alaska Airlines Boeing 737 MAX 9 in January, while closer to home, a LATAM Airlines flight from Sydney to Auckland plunged mid-air – injuring at least 50 passengers, some seriously.  It comes only a few years after two fatal crashes involving Boeing 737 Max plans only five months apart. 189 people died when Lion Air Flight 610 crashed into the Java Sea in October 2018, and in March 2019, an Ethiopian Airlines Flight 302 crashed, killing 157 people. One of those people was Graziella de Luis y Ponce, a United Nations interpreter.   Her brother is Massachusetts Institute of Technology's Department of Aeronautics and Astronautics lecturer, Javier de Luis. It's been nearly two years since the crash of Ethiopian Airlines Flight 302 and with that, nearly two years since the grounding of all Boeing 737 Max aircraft. Now after all that time, the 737 Max will fly again with WestJet being one of the first Canadian airliners to use the aircraft since the fatal crashes that grounded them in the first place. Now this is going to be an interesting topic as we look at some of the ramifications. Plus we ask the real hard hitting question that really defines the situation. Every product manager job is different. Some are easy and some are hard. Right now, being the product manager at Boeing who is responsible for the 737 MAX jet would defiantly fall into the difficult category. The reason that this would be such a hard job to have right now is because this airplane has experienced a set of disastrous crashes. In October, Lion Air Flight 610 crashed just minutes after taking off from Jakarta, Indonesia. It was the first fatal accident involving a 737 Max. 189 people died. This was followed in March when Ethiopian Airlines Flight 302, involving the same Max jet model, also crashed minutes after takeoff, killing all 157 people on board. According to the Associated Press, a senior Ecuadorian official countered the claims of a WikiLeaks source, saying that no decision had been made to force Assange out of the London embassy, but the official's Tweet has since been removed. This to me is a goofy story, because there are a lot of baseless allegations made by unnamed sources. On Thursday, they reported that some of special counsel Robert Mueller's investigators have told associates that Attorney General William Barr failed to adequately portray the findings of their inquiry and that they were more troubling for President Donald Trump than Barr indicated, according to government officials and others familiar with their simmering frustrations. The Washington Post reported Thursday, "Revelations that special counsel Robert S. Mueller III's still-confidential report may contain damaging information about President Trump ignited a fresh round of political fighting on Thursday, ushering in a new phase of the nearly two-year-old battle over the Russia probe."Boeing, the world's largest commercial aircraft manufacturer, is being investigated by the Department of Justice in response to two deadly crashes fewer than six months apart. The company's best-selling plane in the world, the 737 MAX 8, has crashed twice in the past several months: the first was a Lion Air flight leaving Jakarta, Indonesia, in October, and the second was an Ethiopian Airlines flight leaving Addis Ababa, Ethiopia, in March. CAPE TOWN — When vested-interests close ranks and reassure the public that all is well, that’s often exactly the signal for just how wrong things may have gone. A case in point is Boeing admitting that a software fault was responsible for both 737 Max crashes that took 346 lives - after the entire US aviation industry closed ranks to say it was safe to fly the plane. The US was the last nation to ground the 737 Max as most other countries opted for this guaranteed, no-risk approach - long before the Ethiopian black box revealed its feared confirmation. The Federal Aviation Administration, FAA, hardly covered itself in glory. The cause of the Lion Air tragedy five months earlier, was (also) the Manoeuvring Characteristics Augmentation System, known as MCAS, “activating in response to erroneous angle of attack information.” Boeing techno-speak for the pilot, despite following override protocols, being unable to pull out of a fatal nose dive automatically induced by the software mis-diagnosing the plane as stalling. Boeing quotes its pilots as saying MCAS dysfunction “can add to what is already a high workload environment”, opening the door for a legal argument that a pilot may have been able to over-ride the system. It’s all about reducing culpability while showing maximum contrition and restoring profitability (aka plane safety). Meanwhile budgets are surely being quietly adjusted for pre-emptive offers to victim’s relatives. - Chris Bateman

Vinny shares his story of showing up at work in YEG and finding out Jetsgo (SG) was bankrupt...and then having to tell the pilots they were out of a job and deal with the craziness of spring break travellers. Once wasn't enough though for Vinny...he was at work at YYC and had to tell the Zoom Airlines (Z4) pilot that the ground handling would not service the plane due to bankruptcy. Wait to hear what YYC did after the grounded plane was parked. If you're stuck with a bankrupt airline, what do you do? What were underlying causes of WOW's demise?
