Severance breaks the unities for the transferred share and converts the co-ownership of that share into a tenancy in common.Tenancy by the entirety provides strong protection against unilateral alienation and individual creditor claims, as neither spouse can sell, encumber, or transfer the property alone, nor can individual creditors reach the property unless both spouses are liable.Partition in kind physically divides the property into separate parcels for each co-tenant. Partition by sale orders the property to be sold and the proceeds divided among the co-tenants.An estate for years is a leasehold estate that endures for a fixed, predetermined period. It terminates automatically upon the expiration of the term without the need for notice.Constructive eviction occurs when a landlord's wrongful acts or omissions substantially interfere with a tenant's use and enjoyment, making the premises uninhabitable or unsuitable for their intended purpose. The tenant may terminate the lease and seek damages if they provide notice and vacate within a reasonable time.The implied warranty of habitability requires landlords, primarily in residential leases, to provide and maintain premises fit for human habitation, meeting basic standards of safety, sanitation, and structural integrity.An affirmative easement grants the right to use or enter another's land for a specific purpose. A negative easement restricts the servient owner from certain uses of their land, such as blocking light, air, or support.Equitable servitudes are enforced in equity by injunction and require intent, touch and concern, and notice, but not privity of estate. There will be no compensation for more than 46,000 people who lost thousands of pounds each when the funeral plan firm Safe Hands went bust 3 years ago. The regulator - the Financial Conduct Authority - was told this week it should consider compensating them after a report by Rachel Kent, the Complaints Commissioner, set out the FCA's failings over Safe Hands. In response, the FCA has said it does not accept it was at fault, that it did not regulate the funeral planning firm at the time, and no compensation would be paid. This month the Government has announced plans to scrap new leasehold flats, replacing it with a system called commonhold already used in Scotland where homeowners collectively own the building and the land. But how will the planned improvements to the rights of existing leaseholders work? The 2024 Leasehold & Freehold Reform Act was one of the few pieces of legislation that was hurried through at the end of the last parliament, however planned changes have been delayed by what housing minister Matthew Pennycook described as 'serious flaws' in the legislation. Ben and Richard are joined by Roger Southam, former Chair of Leasehold Advisory Service, LEASE and NRLA Public Affairs Manager Ellie Bateman, who leads on leasehold for the association to talk about the issues and the challenges when it comes to making changes. With the Renters' Rights Bill moving up to the Lords, Hannah Kenyon who works with our Landlord Support Team, talks us through the latest calls we have been receiving on the new amendments, including questions on rent in advance. And later in the show we are joined by Sue Bryer, a portfolio landlord and NRLA trainer who is looking at the issue of succession planning and what you need to take into consideration when looking to the future. The current system, which dates back to feudal times, sees homeowners purchasing property but not the land it stands on. Instead, they lease the land from a freeholder, often for 99 years or more.  Watch on my Money Tips YouTube channel video - https://youtu.be/i9WAY0qrt0U In theory, this feudal relic has reformed by the Leasehold Reform (Ground Rent) Act which was passed into law by Parliament and granted the ‘Royal Assent' on 24 May 2024, just before it was closed for the forthcoming election. But many feel it has been watered down from its original aims. Read the Act in full - https://bills.parliament.uk/bills/3523/publications  Leasehold Reform Act Summary An Act to prohibit the grant or assignment of certain new long residential leases of houses, To amend the rights of tenants under long residential leases to acquire the freeholds of their houses, To extend the leases of their houses or flats, and  To collectively enfranchise or manage the buildings containing their flats,  To give such tenants the right to reduce the rent payable under their leases to a peppercorn,  To regulate the relationship between residential landlords and tenants,  To regulate residential estate management,  To regulate rent charges and to amend the Building Safety Act 2022 in connection with the remediation of building defects and the insolvency of persons who have repairing obligations relating to certain kinds of buildings. The new law will be good news for most leaseholders, especially those holding short leases. Summary of benefits to leaseholders known as tenants. New rights for leasehold tenants to acquire their freehold; under the new legislation it will be cheaper and easier for tenants to buy a share of their freehold Tenants will no longer have to pay their freeholder's costs when making an enfranchisement claim. Selling new houses on a leasehold basis will be banned in England and Wales (save for in very specific circumstances) All new houses sold will be on a freehold basis. Standard lease extension terms will now increase to 990 years for both houses and flats (was previously 50 years for houses and 90 years for flats). The new legislation will mean that ‘marriage value' will not be split with a freeholder.  Marriage value is the hypothetical profit resulting from the extension of a short lease (being one with less than 80 years remaining). However, deferment and capitalisation rates still need to be set (and will be prescribed when the Act is brought into force).  The deferment rate is the figure used to calculate how much compensation a tenant pays to their landlord when extending the term of their lease. It is a crucial element in calculating the premium an owner must pay to extend their lease (or to secure a share of the freehold) and ultimately any change in the rate could be more costly for those with more than 80 years left to run on their leases where they are seeking to extend. Tenants will no longer have to own a property for 2 years (as per the Leasehold Reform Act 1967) before extension of a lease can be applied for, meaning extensions can be obtained from completion of a purchase. Enfranchisement for semicommercial properties will change from 25% to 50%. It has not possible to enfranchise a building which had over 25% of commercial parts; the new Act will qualify more buildings permitting leaseholders a greater opportunity to purchase the freehold or access the Right to Manage.  Service charges and insurance Landlords will now have to demand Service charges in a standard form and provide more clarity. Tenants will have the right to challenge unreasonable charges. A new ban on commissions made on insurance by freeholders and/or managing agents and more transparency on fees for placing insurance. Management of buildings The legislation will require those freeholders who manage any buildings to belong to a redress scheme enabling leaseholders to challenge charges. The Pension Dashboard is intended to provide an online service to millions of people who have paid into a pension at work by showing all their pots and their value in one place. But the National Audit Office this week revealed a 'digital skills' shortage is behind delays, providers now have until October 2026 to connect to it. The costs of the dashboard are also up by almost a quarter to £279 million. Some people hoping to sell their leasehold homes are being charged large amounts by their freeholder to fill out a simple form which helps the sale to go through smoothly. We hear from 'Harry' who was just days away from exchanging contracts on his two bed flat in London when his sale collapsed because his freeholder wouldn't sign an LPE1 form unless Harry paid more than £20,000. The forms contain information such as ground rent and service charges and rules on pets. Also in the programme we answer listener questions about how to protect your money when banks merge, and applications open on the 12th of May for the next round of government funded childcare. Working parents in England with children aged nine months to under two years can apply for 15 hours of subsidised childcare starting from September. Parents have been encouraged by the Department for Education to act as soon as possible to secure their place. Divorce: in England and Wales, the only divorce available now is no-fault divorce, as a result of a law change that came into force last year. As family law solicitor Tracey Moloney points out though, you also need to get a financial order. If not, your ties haven't been fully severed, and your ex-spouse could make a financial claim in future. In Scotland, you need to prove irretrievable breakdown of the marriage to get a divorce, or that one of you is applying for a gender recognition certificate. In Northern Ireland, you need to cite reasons like adultery, unreasonable behaviour or desertion. And: the Leasehold and Freehold Reform Act 2024 was the last bill that became law just before parliament was dissolved for the general election. Under the Act, which covers England and Wales, leaseholders will gain more rights. For example, it will become easier and cheaper for them to buy their freehold, or extend leases to 990 years. There is also a ban on the sale of all new leasehold houses. This feudal relic is under scrutiny as the Leasehold Reform (Ground Rent) Bill moves through Parliament, aiming to address some of the system's inherent unfairness. Leasehold ownership can feel like a trap for many. Despite buying their homes, leaseholders must pay ground rent to freeholders, which can increase significantly over time. Additionally, they often face hefty fees for minor alterations, high service charges, and exorbitant costs to extend their lease. Failure to comply with these terms can lead to severe penalties, including forfeiture of the property. This situation creates a financial burden and an ongoing dependency on freeholders, making it hard for homeowners to feel truly secure in their properties. The Leasehold Reform Bill seeks to abolish ground rents for new residential leases, which is a step in the right direction. However, it does little to alleviate the burdens on existing leaseholders. The bill also does not address other controversial issues like high service charges or the complex and costly process of enfranchisement, where leaseholders attempt to buy the freehold of their property. Critics argue that the current system is outdated and exploitative, designed to benefit freeholders at the expense of leaseholders. The feudal origins of leaseholds, meant to maintain control and extract wealth from tenants, seem archaic in the 21st century. With more than four million leasehold properties in the UK, the impact is widespread, affecting millions of homeowners. Reform is crucial, not just to modernize property ownership but to ensure fairness and security for homeowners. The Leasehold Reform Bill is a start, but comprehensive change is needed. Abolishing leaseholds entirely or drastically reducing the power imbalance between freeholders and leaseholders would be a significant step toward justice for UK homeowners. As the debate continues in Parliament, the hope is for a future where owning a home means true ownership without the strings of an outdated feudal system. Unfortunately, it looks like the legislation will be watered down and leaseholds will continue to plague flat owners in the UK. Around 10 million people across the UK live in a leasehold property. That means they viewed the house or flat, bought it, may be paying off a mortgage to eventually own it outright. However, they are actually tenants of whoever owns the freehold. What they have bought is the right to live in the property for a given amount of time. Sometimes that's for the best part of a thousand years - sometimes it's for much less.In this episode we hear from leaseholders on what some of the issues are, including ground rent and service charges and what can be done about them. We'll also hear from a charity which relies on leasehold revenues.It's a system that even ministers have described as feudal - behind the scenes, work continues on the Leasehold and Freehold Reform Bill, which is being examined by members of the House of Lords this week. Part of the government's commitment to leasehold reform, the Bill was introduced in November 2023 and is now working its way through the Parliamentary process. To unpack its detail, EG's Sarah Jackman is joined by Stephen Jourdan KC, barrister at Falcon Chambers, who sets the scene by discussing the drivers for leasehold reform and recent work undertaken by the Law Commission in the area. He then details the main provisions set out in the Bill, including changes to the lease extension term for houses and flats, as well as covering other elements such as the administration of service charges and buildings insurance costs. He also highlights the Bill's omissions, notably commonhold and a ban on new leasehold property. But with a general election looming, how likely is the Bill to make it onto the statute books in 2024?
