Having returned to Austin after a day in Dallas (dallas't place you wanna be) and Fort Worth (fort what it's worth), myself, Sloane and Felix found ourselves in a familiar formation around the kitchen table mic in hand, ready to welcome to the show for the first time Madison Clapp!  Together the four of us recap on our yester-day trip, making sure to sprinkle in some of the artist's work we bore witness to at a museum in Fort Worth ('bore' being the operative term). Leerburg's One Odor Scent Kit This new scent kit was designed by Ed Frawley and manufactured by Leerburg. Patent Pending. All of the civilian style nose work dog sports use 4 or 5 odors. Ed specifically designed this one odor kit for several reasons: -Law enforcement searching for pedophile hard drives and thumb drive -Civilian trainers who start their training with only one odor -Civilian trainers who want to keep their 4 or 5 odors in separate scent kits Sport dog trainers can also use these kits with the goal of keeping their training aids/odors separate. Some training protocols recommend starting detection dogs on one odor. When the dog has reached fluency on that first odor the dog can then be introduced to second, third, or fourth odor. We also offer a new five scent kit of this same design. This new kit has two newly designed odor boxes. Scent items are placed in these odor boxes. These boxes have a sliding top with air vents and a magnet compartment. They learn that a patent is a legal document that gives inventors rights to protect their inventions from being made, sold, or used by others. The process of getting a patent involves writing a patent application and submitting it to the Patent Office for review. It can take several years to obtain a patent due to the backlog of applications at the Patent Office. The cost of obtaining a patent, and more. Once you have a patent, you need to mark your product as patented when selling it. This notifies others that you have the exclusive rights to the invention and discourages them from copying it. If someone does copy your invention, you can send them a letter asking them to stop. If they refuse, legal action can be taken by filing a lawsuit in federal court. Overall, patents are important for protecting inventions and preventing others from copying them without permission. What is the difference, and when should you think about these concepts in your patent journey. Introduction to the podcast (00:02) Hosted by Samar Shah and Jamie Brophy Catching Up (00:08-00:50) Topic: Differences between patentability and patent infringement (00:51) Initial discussion of the two concepts (01:13-02:41) Just because you get a patent on something does not mean that you're not infringing on something, so you could still be infringing on somebody else's patent. Is having a patent a good defense to infringement? ⁠4:02⁠ A client has a patent and they can still infringe on somebody else's patent, both of which can happen simultaneously. Having a patent is not a good defense to patent infringement. Courts may not allow you to present that kind of evidence to a jury. The different types of opinions that practitioners can draft: patentability, non-infringement, and freedom to operate. Patentability opinions are straightforward, while infringement opinions are more complicated. The importance of a patentability opinion. 7:57 Patentability analysis gives a good idea of whether a patent application will be rejected or not. It also gives an idea of what elements to focus on in the application to get a patent. Litigation can cost upwards of $100,000 on the search itself. The patentability opinion and the infringement opinions are very very different. In infringement, you have to interpret the claim language and determine what is meant by each of those terms in the claims and that is kind of complicated. The importance of non-infringement opinions. 12:09 When writing a non-infringement opinion letter, the quality of the opinion letter becomes very important, and the level of analysis that has been done is very important. What to recommend to clients who want to know if they are infringing on something, and how to handle it. Advice to those who want to do an initial search to see if they infringe someone else's patent before launching something. Information disclosure statements ⁠16:50⁠ Software patents are written often in a way that is indecipherable to clients. It is hard for the client to make a decision on whether the disclosure is relevant to their invention. Information Disclosure Statements: The information disclosure statement is an ethical obligation to tell the patent office about references to the invention. Kim mentions speaking to Instagram's Kevin Systrom on a phone call about how much he needs David's Censorgram product, so it's not such a stretch.  I learn about the Kardashian's MO in business. What they are like in a deal. The games they allegedly play. The most shocking thing is they have done this before to another  Company  called Kung Fu Factory and this gets me thinking about a list of all of the Kardashian business scandals since becoming famous, and its over 10. Could it be a pattern?  David tells me the story around the  settlement sent to him by Marty Singer and how his life fell apart fallowing what Kim did to him. Fascinating considering how much Kim Kardashian has. This episode holds a very special place in my heart, not half because my guest is a stellar chap (not even a quarter of why I like this episode) but also because his name is ALSO Peter and I finally get to use a title I've had for longer than I care to admit. I'm going to type it again because it's such a ruddy humdinger of a title and typing it means I have to say it in my head and I get to realise its brilliance all over again.  Peter Rugman is my guest this episode and with him he brings the novelty of the same name and also some riveting contributions to the segments.  We start as we don't mean to go on and dissect a Strypes fanfiction about bearing our children. From there we talk through the preceding days drinking and dancing and our Pokemon trainer history, (Rugman, who Peter will be referred to as from now on to save confusion) critiques and evaluates O' Hanlon's current Pokemon crystal squad) before we crack on into the segments.  We circled around Sonic Seconds and cover ground from Flyte to Labi Siffre to Kath Bloom to Klaatu to Matthew Sweet to The Raspberries and finally Brian Wilson. Coming into land we don't settle the debate between YouTube app vs YouTube in-browser (Rugman's answer will disappoint you) before hurtling headlong into Vox Pas and take off soaring again into Pete's Patent Pending which enjoys a welcome return (if some sub-standard offerings). After gliding through our shared memories of canine cartoons we careen into Have I Got Tunes For You (recommendations on our end involving 'Novelty Island' and 'The Merrymakers' before we engage the landing gear and round out our time together for an Acoustic Corner for the ages.
