The theme of this episode of the Cyberlaw Podcast is, “Be careful what you wish for.“ Techlash regulation is burgeoning around the world. Mark MacCarthy takes us through a week's worth of regulatory enthusiasm. Canada is planning to force Google and Facebook to pay Canadian news media for links. It sounds simple, but arriving at the right price—and the right recipients—will require a hefty dose of discretionary government intervention. Meanwhile, South Korea's effort to regulate Google's Android app store policies, which also sounds simple, is quickly devolving into such detail that the government might as well call it price regulation—because that's what it is. And, Mark notes, even in China, which seemed to be moderating its hostility to tech platforms, just announced algorithm compliance audits for TenCent and ByteDance. Nobody is weeping for Big Tech, but anybody who thinks this kind of thing will hurt Big Tech has never studied the history of AT&T—or Rupert Murdoch. Incumbent tech companies have the resources to protect themselves from regulatory harm—and to make sure their competitors will be crushed by the burdens they bear. The one missing chapter in the mutual accommodation of Big Tech and Big Government, I argue, is a Rupert Murdoch figure—someone who will use his platform unabashedly to curry favor not from the left but from the right. It's an unfilled niche, but a moderately conservative Big Tech company is likely to find all the close regulatory calls being made in its favor if (or, more likely, when) the GOP takes power. If you think that's not possible, you missed the last week of tech news. Elon Musk, whose entire business empire is built on government spending, is already toying with occupying a Silicon Valley version of the Rupert Murdoch niche. His acquisition of nearly 10 percent of Twitter is an opening gambit that is likely to make him the man that conservatives hail as the antidote to Silicon Valley's political monoculture. Axios's complaint that the internet is becoming politically splintered is wildly off the mark today, but it may yet come true. Nick Weaver brings us back to earth with a review of the FBI's successful (for now) takedown of the Cyclops Blink botnet—a Russian cyber weapon that was disabled before it could be fired. Nick reminds us that the operation was only made possible by a change in search and seizure procedures that the Electronic Frontier Foundation (EFF) and friends condemned as outrageous just a decade ago. Last week, he reports, Western law enforcement also broke the Hydra dark market. In more good news, Nick takes us through the ways in which bitcoin's traceability has enabled authorities to bust child sex rings around the globe. Nick also brings us This Week in Bad News for Surveillance Software: FinFisher is bankrupt. Israeli surveillance software smuggled onto EU ministers' phones is being investigated; and Google has banned apps that use particularly intrusive data collection tools, outed by Nick's colleagues at the International Computer Science Institute. Finally, Europe is building a vast network to do face recognition across the continent. I celebrate the likely defeat of ideologues who've been trying to toxify face recognition for years. And I note that one of my last campaigns at the Department of Homeland Security (DHS) was a series of international agreements that lock European law enforcement into sharing of such data with the United States. Defending those agreements, of course, should be a high priority for the State Department's on-again off-again new cyber bureau. Crows aren't very popular. They're loud and messy, and they're generally thought of as devious pests. According to Greek mythology, though, that wasn't always the case. Originally, crows had silver-white feathers and beautiful voices. But a crow that misbehaved angered one of the gods, who transformed all crows as part of the punishment. The story is told in three constellations: Crater, the cup; Hydra, the water snake; and Corvus, which represents the crow itself. The myth says the god Apollo gave the crow a cup and sent him to fetch some water. As the crow flew toward the nearest spring, though, he saw a fig tree and dropped in for a snack. But the figs were still green, so he had to wait several days for them to ripen. By then, Apollo was mightily displeased, and the crow knew he would be. So the crow grabbed a snake from the river and flew back to Apollo. He told the god that the snake had blocked his way. But Apollo knew the crow himself was to blame. In anger, he gave crows black feathers and raspy voices. He then flung the crow, cup, and snake into the sky, where they remain today. Look for them climbing into view low in the southeast as the sky gets nice and dark. Corvus is the easiest to find, because its four brightest stars form a pattern that looks like a small sail. The cup is to the crow's upper right. And the water snake slithers to their right and upper right, stretching almost halfway across the sky. Script by Damond Benningfield Support McDonald Observatory

Moon Knight recounts his recent confrontation with the escaped Rutherford Winner who visited the Midnight Mission, gun in hand. Recalling the event to Dr. Sterman, Moon Knight tells of how Winner said he wanted to reclaim his doctor - Dr. Sterman herself. Moon Knight and Winner fight it out, Moon Knight unwilling to relinquish the good doctor to a dangerous man. Back to the therapy session, Dr. Sterman is adamant that Winner is a lost cause…a wild dog that can't be saved, but only contained. Sterman goes on to assess Moon Knight and talks about the parallels and differences between him and Winner. Though both have had trauma inflicted on them by others (Hydra for Winner, Khonshu for Spector), Sterman sees Moon Knight as being his own saboteur, when it comes to reaching his potential. She questions his allegiance to Khonshu, and ponders whether Moon Knight should unshackle himself from his overbearing guilt. Moon Knight in turn questions Dr. Sterman, but remains focused and intent on telling his whole story. It turns out that Winner - like Spector - just wants to get better. Sterman's insistence that Winner can't be saved, helps Moon Knight calls out her deception. To Sterman's surprise, Moon Knight threatens her and tells her to reveal her true self. And after calling out his name, the Waxman reveals himself…he took Dr Sterman's place at the behest of Zodiac who told him to break Moon Knight. Waxman decides it all a waste and he and Moon Knight start to fight. With the help of some liquid nitrogen, Waxman is contained and ultimately constrained within a seamless steel sphere created by the living Midnight Mission. . Under threat of being encased in concrete, Waxman gives up Dr Sterman's whereabouts - however, Moon Knight pours the concrete into the sphere anyway, much to the surprise of his congregation - Tigra, Soldier and Winner. Without Reese there to influence him, Moon Knight then sets off to find Zodiac and promises there will be blood. MOON RATING : Rebecca:

In 1973, Leonard Cohen announced he was done with music for good. The same year, in October, war broke out in Israel. The Yom Kippur War would become the bloodiest in Israel's young history—and Cohen was there to witness it. As the war broke out, he left his home on the Greek island of Hydra to fly into the warzone. Leonard Cohen never said much about why he went to the front. What we know is that in the months that followed, he would write “Who By Fire.” Five decades later, on Spotify and in synagogue, you can still hear the echoes of this trip. So what was it that happened in the desert in October of 1973 between this depressed musician and these too young soldiers going off to battle? How did it remake Leonard Cohen? How did it transform those who heard him play? And how did the war transform Israel itself?
