Daily Halacha Podcast - Daily Halacha By Rabbi Eli J. Mansour
There is a custom known as "Kapparot" which is observed in many communities on Ereb Yom Kippur. One takes a chicken and swings it around his head while reciting a text proclaiming that the slaughtering of the chicken should take the place of any punishments he deserves to endure. Men use a rooster for Kapparot, whereas women use a chicken. (Other people prefer using money for Kapparot and then giving it to charity, and this practice is certainly valid.) The custom of Kapparot requires a pregnant woman to take three chickens – one for herself, and two for the fetus. Since she does not know the infant's gender, she must take a rooster in case it's a boy, and a hen in case it's a girl. If she knows she is carrying twins, then she must take five chickens – one for herself, and two for each fetus. If she knows she is carrying triplets, then she takes seven chickens. The Halachic authorities debate the question of whether a woman may rely on an ultrasound to determine the baby's gender for the purposes of Kapparot. Rav Yitzhak Yaakob Weiss (1901-1989) wrote in a resposum that he consulted with a leading obstetrician who said that the infant's gender cannot be definitely determined based on an ultrasound, and he thus ruled that such a determination cannot be relied upon with respect to Kapparot. Hacham Ovadia Yosef, however, rules leniently in this regard, and allows a woman to rely on an obstetrician's reading of the ultrasound and take just one rooster or hen on this basis. Hacham Ovadia notes that in any event, taking Kapparot for an unborn child is not required according to the strict Halacha, and thus, for example, if a pregnant woman cannot afford extra chickens for her fetus, she may bring only one hen for herself. Therefore, since to begin with we are not dealing here with a strict Halachic requirement, a woman may certainly rely on the ultrasound and bring only a rooster if the doctors say she is having a boy, and a hen if it is a girl. This ruling appears in Yalkut Yosef – Yamim Nora'im (p. 293, in a footnote). A woman who is within forty days of conception, and learned she was pregnant through testing, does not have to bring Kapparot for the fetus. This is ruling of Rav Shemuel Wosner (contemporary), in his work Shebet Ha'levi. Rav Wosner also mentions that if a pregnant woman brought Kapparot on behalf of the fetus before Yom Kippur, and she gave birth before Yom Kippur, she does not have to bring Kapparot again for the newborn infant. Although some Halachic authorities dispute this ruling, Hacham Ovadia Yosef follows the lenient position. Summary: A woman who is more than forty days pregnant must bring Kapparot for herself and for the unborn child. If she does not know the child's gender, she must bring both a hen and a rooster for the child, but if she was informed of the gender through an ultrasound, she may rely on this information and bring only a rooster or a hen. If she did Kapparot for the infant and then gave birth before Yom Kippur, she does not have to bring Kapparot again.

Matthew Farwell, a former officer with the Stoughton Police Department, has been indicted for the alleged murder of Sandra Birchmore, a 23-year-old pregnant woman he had reportedly been sexually abusing since she was 15. Authorities claim that Farwell, 38, strangled Birchmore in her Canton apartment in February 2021, then staged the scene to make it appear as though she had committed suicide. The alleged abuse began in 2010 when Birchmore, then just 13, met Farwell through the Stoughton Police Department's youth program, known as the Explorers, which was dedicated to teaching young people about careers within law enforcement. Farwell was an instructor in the program. By the time she was 15, Farwell, then 27, is accused of initiating a sexual relationship with her, which authorities say culminated in her pregnancy in late 2020. Court documents show purported text exchanges suggesting that the two began their relationship while Birchmore was just 15 years old and that Farwell continued to fantasize about having sex with her when she was still a juvenile. On June 19, 2020, Birchmore and Farwell allegedly texted about his past sexual abuse of her and admitted he could have made her do anything he wanted. 'Lol if I pushed I absolutely could've f****d you without condoms from day one,' Farwell said, according to authorities. 'Probably if you really pushed it,' said Birchmore. 'I was kinda scared to say no in the beginning not knowing how you'd take it so yeah you would've got no comdoms [sic] lol.' On the same day, the two allegedly discussed when they originally began their sexual relationship, with Farwell admitting that he was interested in having sex with Birchmore in 2012, when she was 14. When she discovered she was pregnant in late 2020, she drew the father-to-be a card to celebrate. 'Congrats, we are going to be parents! 2021,' it read. She sent a picture of the card to Farwell, which prompted an argument over whether he would sign the birth certificate. 'You are truly the worst person on the face of the earth,' Farwell told Birchmore. Initially ruled a suicide, Birchmore's death was re-examined after a pathologist hired by her family argued that she had been murdered. Federal authorities later supported this conclusion, leading to Farwell's indictment. Farwell has denied the allegations of abuse but admitted to having sex with Birchmore after she turned 16, the age of consent in Massachusetts. Farwell is one of three police officers accused of molesting her. His brother, William Farwell, and Robert Devine were also named in a wrongful death lawsuit filed by Birchmore's family. All three officers resigned from the department in 2022, but as of now, no criminal charges have been filed against them. Farwell is known to be the last person who saw Birchmore alive. Surveillance footage from Birchmore's lobby, taken just three days before her body was found, shows Farwell arriving with a hood over his face and later leaving alone. The indictment charges Farwell with killing Birchmore "with malice aforethought, willfully, deliberately, maliciously, and with premeditation." The charge against Farwell carries a minimum sentence of life in prison and a maximum penalty of death. Prosecutors have not said if they will pursue the death penalty. A former Massachusetts police officer has been indicted for the murder of a pregnant 23-year-old woman he allegedly began sexually exploiting when she was a teenager. The federal indictment, unsealed in Boston on Wednesday, accuses former Stoughton police officer Matthew Farwell of strangling Sandra Birchmore to death in February 2021 and staging her death to look like a suicide. According to the indictment, Farwell, 38, killed Birchmore after she informed him she was pregnant with his child. He then allegedly staged her apartment to make it appear as if she had committed suicide. Farwell was indicted by a federal grand jury on one count of killing a witness or victim. “We allege that Sandra Birchmore survived years of grooming, statutory rape, and then sexual violence all at the hands of Matthew Farwell, who was employed throughout their relationship as an officer and then detective with the Stoughton Police Department. And when it became clear to Mr. Farwell that he could no longer control Ms. Birchmore, he silenced her permanently,” acting U.S. Attorney Joshua Levy said during a press briefing on Wednesday. Farwell was arrested Wednesday morning at a shopping center and is scheduled to appear in federal court in Boston on Wednesday afternoon. ABC News has reached out to Farwell's attorney for comment. Prosecutors allege Farwell befriended Birchmore after she joined a Stoughton Police Department youth program he was an instructor for and “essentially groomed her.” The indictment states the two began a sexual relationship when Farwell was 27 and Birchmore was 15. Farwell allegedly engaged in sex acts with Birchmore while on duty as a police officer and “falsely represented that he had worked certain hours” to conceal the activity, according to the Department of Justice. Their affair continued up until her death on February 1, 2021, while Farwell was married with children, prosecutors said. Birchmore was found dead in her Canton apartment on February 4, 2021. Prosecutors allege that after Birchmore told Farwell in October 2020 that she wanted a child of her own, the two “reached an agreement”: He would try to impregnate her “in exchange for her silence about his criminal conduct (i.e., child sexual abuse) and years-long extramarital affair,” according to a motion in support of pretrial detention. When Birchmore informed Farwell in December 2020 that she was pregnant and wanted him to be more involved in planning the birth, he allegedly became angry and “was losing control.” “The information she possessed about his illegal conduct was in danger of slipping out,” Levy said. “In fact, word started to get out about their relationship.” Less than two weeks before Birchmore was found dead, a friend called the Stoughton Police Department and disclosed the sexual relationship between Birchmore and Farwell, according to the DOJ. Farwell allegedly became “visibly angry” upon learning about that call and “started to lose his patience.” Birchmore had also disclosed to friends that he had become physically violent with her, Levy said. In one instance, Farwell allegedly held a pregnant Birchmore in a headlock and told her that he wished she were dead, prosecutors said. “Then it all came to a head on February 1, 2021,” Levy said. Prosecutors allege that Farwell went to Birchmore's apartment that evening wearing a mask “despite being well known as a resistant to COVID-19 mask mandates” and strangled her using a duffle bag strap. He then "used his knowledge and experience as a law enforcement officer" to stage her death as a suicide, Levy said. Farwell allegedly lied multiple times to Massachusetts State Police detectives investigating her death about the nature of their relationship, according to FBI Boston Special Agent in Charge Steve Kelleher. He told detectives their sexual relationship began in 2020, while text messages with Birchmore indicated it started in 2013, prosecutors claimed. He also allegedly stated they last had sex in October 2020, attempting to avoid suspicion about whether he was the father of Birchmore's unborn child. However, text messages indicate that Farwell met Birchmore for sex after that date. Before Birchmore's death, Farwell allegedly directed her to delete evidence of their sexual relationship, according to court filings. "He attempted to cover his tracks to literally get away with murder, and he almost did, until today," Levy said. Initially, state officials ruled Birchmore's death a suicide, but Levy stated that over the past year, federal investigators uncovered "critical new information" that led to the indictment. Kelleher said investigators reviewed tens of thousands of text messages, emails, financial records, conducted dozens of interviews, and analyzed the crime scene as part of their investigation. The investigation "uncovered evidence inconsistent with someone dying by suicide," including that Birchmore had contacted a photographer to book a newborn photo shoot and asked a friend about obtaining baby clothes shortly before her death, Kelleher explained. Birchmore was also in the middle of doing laundry when she died, he added, calling the alleged murder "depraved." If convicted, Farwell faces a minimum sentence of life in prison. The charge is also eligible for the death penalty, though the Department of Justice has not yet decided whether to seek it. Farwell served as a police officer and then detective for the Stoughton Police Department from March 2012 to April 2022. Stoughton Police Chief Donna McNamara stated that the department supported the FBI in its investigation leading to the indictment. "The alleged murder of Sandra is a horrific injustice," McNamara said in a statement. "The allegations against the suspect, a former Stoughton Police Officer, represent the single worst act of not just professional misconduct but indeed human indecency that I have observed in a nearly three-decade career in law enforcement." When Birchmore informed Farwell in December 2020 that she was pregnant and wanted him to be more involved in planning the birth, he allegedly became angry and “was losing control.” “The information she possessed about his illegal conduct was in danger of slipping out,” Levy said. "The allegations against the suspect, a former Stoughton Police Officer, represent the single worst act of not just professional misconduct but indeed human indecency that I have observed in a nearly three-decade career in law enforcement." A former Massachusetts police officer has been indicted for the murder of a pregnant 23-year-old woman he allegedly began sexually exploiting when she was a teenager. A woman calls police saying that she has been held prisoner for five years, by a man who offered to help her at a time when she was panhandling. Police first made contact with her in April of 2023. Using the texting app TextNow, she called 911. According to KPRC, Police rescue the woman from the garage. Reportedly the approximately 30-year-old victim weighed about 70 pounds and according to officers looked extremely malnourished and filthy. She stated she had not showered in two months. Investigators went inside the garage and found a broken toilet, a dirty mattress covered in fresh vomit, a box of chips, a few Twinkies, clothes and diapers. The woman told police there was no shower in the garage, so she would be taken inside the home from time to time. Police took the woman to the hospital for treatment, but reports say the man showed up and took her back to his home. The suspect has been identified as Lee Carter a Houston rapper known as "The Viper." His 2008 song “You'll Cowards Don't Even Smoke Crack” garnered over 4 million views on YouTube. Reportedly he is also a real estate broker. According to corporate records and the Texas Real Estate Commission, he owns and operates a moving company in Houston. That company is registered to the address where he allegedly held the woman. Fox News reports a warrant was filed against Carter in April, but his arrest at a local motel did not happen until the last few days. Carter, 52, has been charged with aggravated kidnapping. Officials have not given a reason for the nine-month gap between the April incident and the arrest. It is unknown what happened with the victim's pregnancy while she was held captive.
