During the hunts, WVDNR Police officers from each of the agency's six districts taught special needs, underprivileged and community youth about firearms safety, ethical hunting practices and personal responsibility in the outdoors. Youth hunts are a key component of the WVDNR's Law Enforcement Section efforts to promote responsible hunting and conservation education. In September, the agency earned the Association of Fish and Wildlife Agencies' Conservation Law Enforcement Award for excellence in public relations and youth outreach. West Virginia Regional Technology Park Executive Director Matt Ballard said the park's main mission centers on economic development, which it achieves in part by providing its tenants with a safe and valued campus that allows them to grow. Ballard said they're focusing primarily on STEM industries and recruiting in those areas, which is important to help create a skilled workforce of people living and spending money here. This past spring, Gov. Jim Justice announced a $250 million consolidated laboratory facility, which is predicted to be built in the tech park and finished in 2027. The facility will hold the labs for the Department of Health's Office of Laboratory Services, the Division of Labor's Office of Weights and Measures, the West Virginia State Police and the Department of Homeland Security forensics lab and the state Medical Examiner labs. Then, Ralph and Mr. Spector take questions from our live audience.Shanin Specter is a founding partner of Kline & Specter, one of the leading catastrophic injury firms in the United States. Beyond winning substantial monetary compensation for his clients, many of Shanin's cases have prompted beneficial societal changes. He has also taught law for many years and this academic year is teaching tort and trial courses at UC Law SF, Drexel Kline and Stanford Law Schools.Last week, I found myself in Washington DC at the Federalist Society debating the resolution that America should abolish the right of trial by jury, which is being advocated by an otherwise distinguished professor at George Washington University School of Law, Professor [Renée Lettow] Lerner… You don't have to scratch the surface of her argument very much to see that it is based upon the statistics of the American Tort Reform Association and the like. It's essentially a Trojan horse for the Fortune 500.Shanin SpecterWhy don't you describe this assault on the tort system by lobbyists who don't want to argue their case in court— that's too open, too full of cross-examination, too fair in terms of the procedures. They want to lobby lawmakers in states all over the country so the lawmakers, in effect, enact laws that tie the hands of juries and judges— the only people who actually see, hear, and evaluate the cases in the courtroom.Ralph NaderIn Case You Haven't Heard1. The FTC has issued a statement regarding the proposed merger between CalPortland & Martin Marietta. Chair Lina Khan tweeted that this deal “would've resulted in a single firm owning half of all cement plants serving Southern California, enabling the firm to hike prices.” Following an FTC investigation, the firms have abandoned the deal.2. AP reports that Colorado has become the first state to pass “Right to Repair” legislation, which “compels manufacturers to provide the necessary manuals, tools, parts and software,” to “ensure farmers can fix their own tractors and combines.” This idea has drawn support from left and right factions including at the national level. In a similar move regarding home repairs, Senator John Fetterman is pushing to expand Pennsylvania's "Whole Home Repair" program – which “helps Pennsylvanians with needed repairs and eliminate[s] blight” – to the nation.3. Former U.S.-backed Venezuelan opposition leader Juan Guaidó has been ejected from Colombia after attempting to “gatecrash” a summit on the future of the Bolivarian republic, the Guardian reports. Guaidó has fallen out of favor among Venezuelan dissidents and, while some western nations still recognize him on paper as Venezuela's president – despite never winning such an election – many have quietly reengaged with the Maduro government to negotiate for oil. The Guardian added that Mr. Guaidó has now relocated to Miami.4. Slate reports that automakers are finally beginning to backpedal on digital displays in cars. David Zipper writes “The touch screen pullback is the result of consumer backlash, not the enactment of overdue regulations or an awakening of corporate responsibility. Many drivers want buttons, not screens, and they've given carmakers an earful about it. Auto executives have long brushed aside safety concerns about their complex displays—and all signs suggest they would have happily kept doing so. But their customers are revolting, which has forced them to pay attention.” Zipper goes on to pin the blame for the proliferation of these expensive and unpopular displays on one culprit: Elon Musk's Tesla.5. From the Tampa Bay Times: State legislators in Florida are leading a crusade to shred local tenants rights laws, which set standards regarding rent increases, applications and evictions. The recently-passed HB 1417 and its companion SB 1586 would strip away these protections. Rep. Tiffany Esposito, of Fort Myers, who sponsored the House bill, is quoted saying “This bill protects tenants, this bill protects property owners and this bill protects capitalism.” Rep. Angie Nixon of Jacksonville responded “This bill is designed to help corporate landlords at the expense of tenants, many of which are already struggling to stay in their homes.”6. Ben & Jerry's announced that it has reached an agreement with workers at its flagship store in Burlington, Vermont on rules to ensure a fair union election, after workers announced last week that they are seeking to unionize, per the New York Times. “The agreement is likely to pave the way for the store to become the only unionized Ben & Jerry's location in the United States. All of the nearly 40 workers eligible to join a union at the store have indicated their support for doing so.”7. The Hill reports that a War Powers Resolution to pull U.S. troops out of Somalia, introduced by Rep. Matt Gaetz of Florida, has been defeated. The resolution garnered the support of 47 Republicans and 56 Democrats but failed by a margin of 103-321.8.  Keeping an eye on out of control cops, the LA Times reports that during a "reverse-buy" sting operation, undercover deputies with the Riverside sheriff sold 60 pounds of meth to a narcotics trafficker. According to the author Noah Goldberg, the dealer then got in a car and fled, resulting in 60 additional pounds of meth being introduced into the community. And in West Virginia, WTRF reports that “42 women, including 10 minors, plan to file lawsuits against West Virginia State Police for [installing] hidden cameras in junior troopers locker rooms…[engaging in] rampant sexual misconduct,” and admitting to destroying evidence in criminal investigations.  9. From Common Dreams: Reps. AOC and Ro Khanna, along with Senator Ed Markey, have reintroduced the Green New Deal. Along with the resolution, which is unlikely to move in the current Congress, the sponsors released “a guide for cities, states, tribes, nonprofits, and individuals about how to help bring the Green New Deal to life."10. From the Economic Policy Institute: April 28th marked “Workers Memorial Day, the date the Occupational Safety and Health Act (OSH Act) took effect in 1971. Signed in 1970, the OSH Act has made a tremendous difference, and, after more than 50 years, over 668,000 workers can say their lives have been saved by its passage… [yet] In 2022, 343 workers died each day on average from hazardous working conditions, and last year's fatality data show especially troubling trends: The rate of death on the job for Black workers rose to its highest number in more than a decade, and fatality rates for Latino workers have increased 13% in the past decade…grim as these…numbers are, the reality is likely far worse. Government Accountability Office…reports show that a majority of employers fail to report workplace injuries due to [OSHA]'s limited resources and procedures. Official statistics also do not include the untold numbers of worker deaths linked to preventable workplace coronavirus exposure. ONE will use a 40,000 sq. ft. industrial building already located on the Ravenswood site to assemble Aries Grid, a lithium iron phosphate (LFP) utility-scale battery system that can serve as long-duration energy storage.  “The BHE Renewables microgrid project, estimated at 420 MWh, in Jackson County represents a historic transition to renewable energy-based manufacturing in the U.S. and establishes a standard for others to follow,” said Mujeeb Ijaz, CEO and Founder of ONE. ONE expects the manufacturing facility to be operational in 2025, with hiring to start next year. On the eve of January 18, 1970, Mared Malarik and Karen Ferrell, two (2) freshman students at West Virginia University, disappeared while hitchhiking back to their dorm after attending a showing of the movie, Oliver! at the Metropolitan Theater in downtown Morgantown. Initially the girls were believed to have run off on their own free will, but soon authorities would learn the true nature of the fate of the young Co-Eds. On January 6, 2012, law enforcement and firefighters responded to a house fire west of Glengary, West Virginia. Inside the home were the remains of 56 year old David Hutzler and his nine year old son James "Macky" Hutzler. Initially, police classified the case as a murder-suicide. David Hutzler was believed to have shot his son, set their home on fire, and then killed himself. Police reported that the father and son both died from gunshot wounds to their heads, and the boy suffered a second "glancing" gunshot wound on his chin.Kelli Hutzler, David Hutzler's daughter, refused to believe this. She insisted that her dad could not have committed such a heinous act. I asked Kelli why law enforcement ruled the case a murder suicide. She told me that her dad had no reason to kill himself and her brother. She also revealed that there was no murder weapon at the scene. According to her, the law enforcement theory that it was a murder suicide is incorrect because there was no weapon present. Kelli has taken issue with the West Va. State police for their initial ruling. For over a year, locals and the public believed David had murdered his son before killing himself. Eventually, law enforcement realized their mistake. The case was then ruled a double homicide. Kelli told me she finds it disturbing that some people still believe the case was murder suicide, even a year after the case was reclassified as a double homicide. Currently, there is an individual who is walking around unpunished after shooting a 9-year-old cub scout to death. This week, Drewby and Yergy travel to the mountains of West Virginia to discuss the case of Cassie Renee Sheetz - a case that's not getting the type of attention that it very much so deserves. Cassie Sheetz has been missing since March 11, 2021. On the day of her disappearance, Cassie had allegedly been hiking with two male friends at Spruce Knob, West Virginia. The trio allegedly became separated at some point during the hike, and while the two men eventually emerged from the trail, Cassie did not. At the time of her disappearance, Cassie was wearing camouflage pants, and a hoodie. Per the photographs taken in the woods, Cassie also may have been wearing boots and a black tank top. Cassie has several tattoos including the names Rubie and Bella on her upper chest,  along with a heart. Cassie also has multiple facial piercings - including those on her ears, lips, eyebrow, and bellybutton. She stands at 5'2 and weighs between 120 and 140lbs, with brown hair and blue eyes. On the evening of January 12, 2018, 15-year-old Michael Dillard disappeared from his home in Calvin, West Virginia. He was helping his mom carry in bags of wood pellets from the car when he ran behind the house. His mom didn’t think much of it at first but when she finished carrying the rest of the bags in and couldn’t find Michael, she became concerned. She called family for help and then alerted the authorities. The weather quickly turned that evening as a storm rolled into the area, first bringing rain and then snow. That storm made searching for Michael very difficult that night. Many searches were conducted in the weeks and months that followed Michael’s disappearance but the only item that was ever found was a jacket. S5E9: After 38 Years Still Behind Bars for a Triple Murder that the Real Killer Confessed to on the Day of the Crime: The Unreal Saga of John Moss In December 1979, a triple murder shook the small town of St. Albans, WV. John Moss III was convicted in 1983 and sentenced to life in prison, and he has since served 38 years for this crime that he did not commit. Jason Flom teams up with Georgetown University Professor of Government and Law, Marc Howard, and his student, Jessica Scoratow, to interview John Moss from behind bars in West Virginia and unravel the saga behind this tragic miscarriage of justice. On December 13th, 1979, in St. Albans, WV, twenty-six-year-old Vanessa Reggettz and her two young children, Paul Eric and Bernadette, were strangled to death by electrical cords. The murders were gruesome–Vanessa was brutally beaten and stabbed with scissors, Paul Eric was left in a bathtub, and Bernadette was hung from a door. Paul Reggettz, the husband of Vanessa and the father of Bernadette and Paul Eric, was immediately taken into custody and after being interrogated for hours, he confessed in graphic detail and reenacted the crime for investigators. Reggettz was indicted on three counts of first-degree murder and held in pre-trial detention for eleven months. Charges were dropped, however, when John Moss, a 17-year-old former neighbor, was arrested for the murders instead. In October 1980, West Virginia State Police investigators traveled to interview John Moss in Ohio, where he was being held in juvenile detention for an unrelated crime. John denied any involvement in the murders, and the troopers took a blood sample from him without his parents’ consent or a court order. They returned to pick him up five months later to take him into custody. The policemen in the car claimed that John confessed to the murders. He then gave a tape-recorded confession. The police stated that John confessed again a third time, but there is no recording or written record of the confession. John maintains that he was coerced, beaten, and threatened during interrogations. Armed with these confessions, however, Kanawha County, West Virginia authorities charged John Moss with three counts of first-degree murder and brought him to Charleston to stand trial for the Reggettz slayings in 1985. Importantly, there was blood at the scene of the crime that did not match any of the family members, and the blood was found to match Moss’s blood type. The blood sample was tested by Fred Zain, the infamous lab technician later convicted of falsifying blood evidence in over 134 cases spanning decades, and later destroyed after the conviction. On April 30, 1983, John Moss was convicted of the murders after fourteen hours of jury deliberation and sentenced to three life sentences without the possibility of parole in 1985. He was convicted again in 1990 after his first trial was thrown out for judicial errors in jury polling and prosecutorial misconduct. John Moss has been incarcerated in West Virginia for 38 years, filing numerous appeals alleging ineffective assistance of counsel and challenging Fred Zain's testimony, the validity of his confessions, and arguments about the purportedly stolen items. His appeals have thus far been unsuccessful, and without new evidence, his options for further appeals are limited. Episode 21   The Murder of Paitin Fields   April is National Child Abuse Prevention Month!   Early in the morning of November 13th, 2017, a child was brought into the Emergency Room at the small Pender County Hospital. It was five year old Paitin Fields, and the Emergency room staff was told that she had been found unresponsive.   It didn’t take long for staff to deduce they were not equipped to handle Paitin’s injuries, so after stabilizing her as best as they could, they sent her to nearby New Hanover Regional Medical Center, which is located in the historic city of Wilmington NC, and is about a 35 minute drive. After sending little Paitin on her way, a nurse called the Pender County Sheriff’s Office. The time was 5:43 AM. “I have a five year old that was brought in who is now intubated and headed to New Hanover, with what strongly appears to be strangulation marks on her neck.” Little Paitin never regained consciousness, and she died on Wednesday, November 15th, 2017. Penny Holt is only wanted for questioning in Roegner’s case.  Now he is facing a LOT of charges related to the sexual abuse of three children over the course of several years. Now the cops are saying this guy is armed and dangerous, and he has already made threats to law enforcement. As a matter of fact, he should know how dangerous that is since he is a former law enforcement officer himself. The world of cyber crime is constantly changing according to a new report from IBM.  The company released results of the X-Force 2011 Mid-Year Trend and Risk Report.  It says that whaling is becoming more popular for hackers. They didn’t hack into computers but law officers say they did use the Internet to steal cash from an Indian woman.  Police arrested four Nigerians after they allegedly lured the Indian teacher into a fake ICC World Cup lottery scheme. West Virginia State Police hope to crack down on cyber criminals and they are teaming up to do it.  The police will work with West Virginia University and the National White Collar Crime Center to form the West Virginia Cyber Crime Cooperative.
