John MacDonald: Mama Hooch victims being let down

Canterbury Mornings with Chris Lynch

Play Episode Listen Later Sep 26, 2023 5:58

How do you feel about you and I paying the legal bills for the Mama Hooch rapists, while their victims have had to pay for their own counselling?  Because it's been revealed today by the NZ Herald that the Jaz brothers have had nearly $900,000 in legal aid so far. And that bill is just going to increase, now they're appealing their convictions and their sentences.  So you and I are going to cough up more money to pay for them to stand up in court and say all those women are making it up and they shouldn't be in prison.  You probably don't need too much reminding of what these two monsters are in prison for. But here are the main points.  They were jailed last month after being convicted of 69 charges between them. Which included rape, sexual violation, indecent assault, stupifying, disabling, making intimate recordings of women without their knowledge or consent, and supplying illegal drugs. Danny Jaz is away for 16-and-a-half years. Roberto Jaz has a 17-year sentence. Although, they could be out sooner than that because, after they've served half of their sentences, they can be considered for parole.   All this offending happened while they were running the Christchurch bar that their family owned. Which, at the time, was called Mama Hooch. It's called something else these days and the Jaz family has nothing to do with it.  Their father, Michael Jaz - who they were working for - has done a runner to Australia owing creditors 235-thousand dollars. So, overall, they're a “wonderful” family, aren't they?  He owes more than $200,000 to creditors. And his low-life sons - who were born in Australia - have had their noses in the legal aid trough to the tune of $896,000. And their noses are still in the trough, because they're relying on legal aid to fund their appeals.  Now I get the whole legal aid thing. And I get that there will be cases where it just seems outrageous that the taxpayer is paying the legal costs of some absolute low lifes.   The mosque terrorist is another example. We paid more than $392,000 for his legal representation. Another Australian.   And if these Mama Hooch rapists qualified for legal aid, then it is what it is.   The rules say that someone can get legal aid if they can't afford a lawyer and have been charged with something that could end up with them going to prison for six months or more.  You also qualify for legal aid if you're appealing your conviction or sentence.  But what really sticks in my claw is the fact that, while these two were having everything paid for, there were women suffering because of the monstrous way they were treated by these two, who were paying for their own counselling to try and deal with what they'd been through. Let alone recover.  And that's exactly what one of their victims is saying today too. Her name is Sophie Brown. She is  the only Mama Hooch victim who has chosen to drop her statutory name suppression. Meaning she can speak publicly about the case.     She says she feels sad about the amount of legal aid money that has gone into the Jaz brothers. And, as she points out in the Herald story, as a taxpayer she's paying for it too. Just like you and I are.  And she says, apart from being paid for their time during the trial and having travel sorted out for them and getting a bit of counselling from a local charity, the victims have pretty much been left to fend for themselves.  Some have had to move out of town, because of the trauma. No costs covered there. They've had to pay for their own counselling. No costs covered there.  And, as Sophie says: “Why shouldn't the brothers be paying for the counselling services that they've put on these girls.” And who could argue with that?  Someone else who is speaking out on this today is victim advocate Ruth Money.  She says the amount of legal aid money spent on the Mama Hoch rapists is “absolutely obscene”. Again, who could argue with that?   She says if only their victims could get even just 10 percent of that to help with the therapy they need.  Here's how she puts it: “Victims have to wait years and years, and self-fund most of their help themselves. And yet predators receive these extortionate rates of support from the state.”  Could the system be any more degrading? See omnystudio.com/listener for privacy information.

The Hard Ons special with Peter Black in conversation with David Eastaugh The Hard-Ons are an Australian punk rock band which formed in 1981. Founding members included Keish de Silva on guitar, vocals and Peter "Blackie" Black on guitar, Ray Ahn soon joined on bass guitar with de Silva switching to drums. The group issued eight studio albums before disbanding in 1994. They reformed in 1997 to release further material. In 2002 de Silva was replaced on drums by Peter Kostic, who was replaced in turn by Murray Ruse in 2011. De Silva returned as a guest vocalist in 2014 and permanently rejoined the band in 2016. During their first 12 years, the group issued 17 consecutive number-one hits on the Australian alternative charts. During that time they became Australia's most commercially successful independent band, with over 250,000 total record sales. The Hard-Ons' origins are traced to Western Sydney's Punchbowl Boys High School, where three founding members were students.[1][2] In 1981 the first version of the band, then-known as Dead Rats, included Peter "Blackie" Black on guitar, Brendan Creighton on drums and Shane Keish de Silva on guitar and vocals.[1][3][4] In 1982 Creighton left to form Thrust and Raymond Dongwan Ahn joined on bass guitar with de Silva taking over on drums, the group began playing as The Plebs before being renamed as The Hard-Ons by the end of the year.[1][3][4] Initially being too young to play in pubs, the band featured at birthday parties and school dances.[2] On 20 June 1984, The Hard-Ons played their first official show at the Vulcan Hotel in Ultimo.[2]Black later recalled "We wanted to be punk rockers ... We didn't want Keish's parents to see so we had bags full of these jackets and chains and stuff and went around the corner of the street and put all these clothes on. Keish's dad busted us".[2] Quickly gaining a considerable following, in August 1985 the band released its debut extended play, Surfin' on My Face, on ViNil Records.[1][3] This was the beginning of a series of releases for the band that netted them a run of 17 consecutive No. 1 listings on the Australian alternative music charts.[1] The band demonstrated an independent punk spirit, with the members deliberately controlling their own careers: recording, booking and promoting themselves, creating their own artwork (mostly by Ahn), choosing support bands and even managing the merchandise stand whilst on tour.[1][4] During 1987 the group were promoted as part of the Australian skate boarding scene.[5] While maintaining a solid if underground following in Australia, The Hard-Ons were popular in Europe, scoring a Top 10 hit in Spain and a Top 5 slot in Greece with their 1989 album, Love is a Battlefield of Wounded Hearts. It also reached the Top 5 on the NMEchart; this made The Hard-Ons the third Australian band after Nick Cave and the Bad Seeds and the Go Betweens to do so. In 1989 the group recorded a split EP with British band The Stupids. Two years later they teamed up with Henry Rollins and released a cover version of AC/DC's hit, "Let There Be Rock", which was released in a limited edition on 10" vinyl. In January 1992 the group performed at the inaugural Big Day Out and were joined on-stage by Rollins on four songs. Following the release of 1993's album, Too Far Gone, and after recording a live album for Your Choice Records, the band announced their break up, to pursue projects outside The Hard-Ons' style of music: "after more than ten years of playing the same songs, they were just not interested in doing so any more".   In 2012, the band began re-issuing their early catalogue as bonus re-packagings featuring unreleased songs and live tracks. The first to be released was a new 60-track version of Smell My Finger and The Hard-Ons promoted it with a national tour. While working a shift as a taxi driver between legs of that tour on 18 May 2012, Black suffered a severely fractured skull when he was assaulted with a skateboard. Several fund-raising shows were held to raise money for his care and recovery, including special Hard-Ons shows in Sydney and Newcastle on 1 and 2 June that featured the line-up of Ahn, Kostic and de Silva on vocals and guitar. Within three months, Black had recovered sufficiently to perform a short tour in support of his solo album No Dangerous Goods in Tunnel that was followed by a Hard-Ons tour of Europe and Japan. Another Australian tour to wrap up the previously cancelled shows was completed in October, with a 51-track re-release of Dickcheese coming out around the same time.

137 - Business Name Strategy & Protection

It's No Secret with Dr T.

The reason your business name is so important is that its part of your business identity. A good business name can help to set you apart from your competitors and demonstrate the type of business you are, and the clientele you want to attract, and this is why it needs protection using trademarks.   For example, if the word discount appears in a business name you immediately think lower prices, but do you also think they provide a lesser service? I’m not sure. If the words rapid, fast, or speedy are in a business name, I’m expecting quick service, and if I don’t get it, I’d be annoyed. Is Your Business Name Too Cool Everyone wants to have a cool business name, but it’s important to note that your business name is the first image that you put “out there” about your business, so it must be a reflection of the type of business you want to have one day. So when you develop your business name make sure it represents you correctly. Remember, your business name can attract or repel people, so you do need to give it some serious thought, but don’t try to be too clever. You Can Change Your Business Name  Here’s some excellent news though, if you currently have a business name and you’re no longer happy with it, change it. There’s no law against this. This is especially important if your business has changed and evolved of the years. Where your business starts is not where it has to finish. Your business may previously be known for providing a particular service, but if your business now provides different services make sure your name reflects this change. A Simple Business Name Is A Good Business Name  When it comes to creating a business name you should make sure it is easy to remember and easy to say and read. A simple name is a good name, and it should also be unique if possible. Avoid being too generic. And if possible, do not use words everyone else in your industry is using. For example, in the health industry using the word “clinic” or “centre” at the end of the business name is common, but they are what I refer to as nothing words. For example, if a business was called ABC Podiatry Centre or ABC Dental Clinic, you’ll quickly remember the word centre or clinic, so if there are ten businesses all ending in centre or clinic, you can see how your business name may get lost in the crowd. Here’s a quick test for you to try. Look at your business name and remove nothing words and see if it still has the same meaning. If it does, then do it. Check If The Name Is Already Registered Before you go any further with a business name, always check if someone else is using a similar business name to the one you are considering. A simple online business name search in your country will take you to the appropriate websites. In Australia: ASIC - Australian Securities & Investments Commission  You’ll be surprised how many businesses have similar names, and they wonder why there is so much confusion online. More and more people are searching online for goods, services and quality information, so if they type in your business name, or something similar, will they get your business or will they get a competitor’s business that sounds similar to yours? This can be frustrating if you’ve been busting your butt on advertising and marketing and your competitor is simply sitting back and enjoying your efforts. Check The Domain Name Is Available It’s also important to see if the domain name for your business exists. Domain names are valuable real estate, and there would be nothing more frustrating than registering your business name only to find out afterwards that someone already has the domain name and all the variations. When I see a business name, I expect the domain name to be identical to the business name or a slightly shorter version. For example, a friend of mine Nicky Jurd owns a website development company called Precedence, and her website is precedence.com.au, as expected. If the domain name is available, I’d suggest registering both the domain in your country and also dot-com, as the dot-com is popular and universally recognised. So, if you live in Australia purchase the (.com.au) domain, and if you lived in the UK, you’d grad the (.co.uk) as well as the (.com). Can Your Business Name Grow With You Another question to ask yourself is can your business name grow with you and your business? If you’re planning world domination will your business name still work, or does your business name contain your current street address or city where you operate? This will only be a problem if you decide to expand in the future? Odd & Funny Spelling Next, I want to discuss misspelt business names. The jury is still out on business names deliberately misspelled. It may look clever on paper but if you’re having to always spell it out for someone so they can find you online because of odd, incorrect spelling, is it a clever name, especially if it could be spelt correctly and have the same meaning? For example, I’ve spoken to business owners who have used Phyx instead of Fix and 4U instead of For You, and on both occasions, they’ve had to clarify their business name and more importantly their website address. So, be careful. BUT, this doesn’t mean odd spelling business names won’t work long-term, be aware you may have to work a little harder at the beginning for people to understand what you have done with the name. Business Names Hold Value Once you have created your business name, and I cannot stress this enough, you need to protect it because your business name holds a lot of value. Just having it registered in your state gives you no protection nationally, so the best option is to register it as a trademark. Register A Trademark For Real Protection You can register a trademark yourself online, which I have done on eleven occasions, or you can seek legal help, which may be the better option if you have concerns, or you’re planning to go international. Of course, it will cost more using a lawyer, but it will be money well spent.  I discussed trademarks and business names with one of my past guests, Donna Patane, on Episode 39: Don’t Take A Sword To A Gun Fight, which is worth checking out if you're wanting to learn more about protecting the business name you’ve created. Monthly Checks Online The final point I want to mention about business names is to regularly check online if someone else is using your business name in another state, and this is especially important if you have a registered trademark. It’s also important to do online searches because some companies may try to import products from other countries that contain your trademarked business name. This happened with our Shoe Store Walk Right Footwear. Another Australian company tried to import footwear from overseas called Walk Right, but because we had a trademark, we were able stopped them. Take Immediate Action If you ever find a company or individual has breached your trademark you need to take action immediately, and if you do not feel confident contacting them yourself you need to seek legal advice. Never put it off.  So I hope you find this information helpful and remember your business name is one of your greatest business assets, so protect it. It's time for episode 112 of Love That Album. I've gone walkabout this month, but my great friend and music fiend Dave Blom returns to take over the show. Another Australian band with a massive debut album from possibly the last wave of really big album sales. This 2003 album was the result of a perfect storm of factors for the members of Jet. The success that The Vines had (subject of previous Dave Blom LTA podcast) led to record companies searching for more Australian rock. Jet were in the right place at the right time, they had a sound that was radio friendly, they were visually marketable and they had some really good singles. So Jet cashed in on their opportunity and the result was Get Born. The album itself whilst not overly original or innovative has many highlights and makes for some very good listening. The main thing that this album has going for it is passion. Jet wear their hearts on their sleeves and aren't afraid to demonstrate exactly who influenced their music. It's time to Get Re-born once more. Eric keeps the high energy up for his Album I Love segment to talk about the music of Finnish group The Flaming Sideburns. Has the federal government gone stark raving mad? They have already put the live cattle export on its knees. They completely ignored departmental advice. Foreign Minister Kevin Rudd didn't bother to go to Jakarta. Prime Minister Julia Gillard didn't bother to pick up the telephone to speak to the Indonesian president. But within a few days of the Four Corners program showing terrible cruelty in one particular abattoir, they panicked. MinisterJoe Ludwig suspended the trade for six months. Six months. And including exporters with access to good abattoirs in Indonesia. And now the Indonesians have decided, understandably, that we are not a reliable partner. So they are looking to other sources and they significantly reduced the number of cattle that can be imported. Thousands of jobs are at risk, businesses and property made worthless, and the taxpayers will have to pay the massive damages which the cattle producers are obviously entitled to under any system of decent justice. If that wasn’t enough the Gillard government has decided – to satisfy their green allies -, to create the world's biggest marine park reserves. They are endangering another industry – fishing . And they couldn’t care less. We are talking of an industry with over 36,000 jobs and $4 billion in revenue for the Australian fishing industry. Yes we will still be able to buy fish. But it will be fish imported from Asia. Or perhaps caught by foreign fishermen in Australian waters. You see the government has so run down our defence forces the chances of our being able to protect this new marine reserves is rather limited. And anyway their hands are full, welcoming so-called welcoming the clients of the people smugglers most of whom have deceitfully destroyed were hidden their passports. And by the way who asked for the creation of these reserves? Piers Ackerman points out the government website admits it received almost half a million submissions. “The largest proportion of the submissions received (99.8 per cent) were campaign submissions received via email and post, the majority of which were from overseas. These submissions were generated through organised campaigns and contained various standardized text provided through templates or postcards." So Greens overseas just coincidentally flooded the government with submissions. As a result the Gillard government is prepared to destroy another industry and ensure Australians have to eat expensive imported fish. But it can be sure of continued support from its green allies. And the Prime Minister will be able to go to Rio de Janeiro next week where 50,000 are going on carbon dioxide emitting planes to stay in air-conditioned hotels to hear why Australians will have to pay the highest carbon dioxide tax in the world. Representative democracy has been totally compromised by the politicians. The only way to ensure this never happens again is to empower the people to make the politicians accountable and every day of every week and of every month between elections.
