On this BONUS EPISODE of CASCADE OF HISTORY, Feliks Banel speaks with Lee Reynolds, public affairs officer for the U.S. Army's Center of Military History, the part of the Army that funds and manages Lewis Army Museum at Joint Base Lewis-McChord (JBLM) near Tacoma. In this interview from Tuesday, July 8, 2025, Mr. Reynolds confirms that Secretary of the Army Daniel Driscoll will "any day now" adopt a plan to close Lewis Army Museum and 15 other Army museums. Reynolds responds to questions about the closure, including lack of public process, and the specific criteria that were used in selecting museums for closure. The effort to identify museums for closure or consolidation dates to 2024, Reynolds says, and the closures will save a total of $114 million over the next decade. The total of 16 closures represents about half of the museums funded and operated by the U.S. Army. Reynolds also explains that JBLM officials might choose to create a "heritage center" once the Army museum is shut down. This is Part 13 of the mini-series that covers the story of Bobby Baker. Today we continue to tell the story of Don Reynolds, the Maryland insurance broker who who made Bobby Baker a nominal partner in his insurance agency and engaged in other business with Baker. Today, we tell the story of the performance bond related to the D.C. stadium build, with Baker's portion of the commissions disguised and paid in the form of a loan to avoid questions surrounding his conflict of interest in the commission split. Baker would receive $4,000 from Reynolds commissions which totaled around $10,000. Baker's decision to have the receipt of his portion of the commissions take the form of a loan from Reynolds to Baker, was an attempt at further obscuring the nature of the payment and also turning it into a a scheme to avoid income taxes on the receipt. In its ugliest vernacular, it was simply a kickback that Baker received related to the commissions on the performance bond insurance premium. The story gets more complicated as Reynolds agrees to overbill on the insurance bond and collect an additional $35,000 over the original price of the bond, disguising what turned out to be an illegal campaign contribution to the Democratic party. $25,000 of that amount was allegedly intended to be delivered to the Kennedy Johnson campaign fund but was never proven to have arrived there. This mini-series is part of a larger series covering Billy Sol Estes, Mac Wallace, Bobby Baker and other members of Johnson's Texas inner circle. All of these men were quite intertwined around Johnson at the time of the assassination. They were involved in circumstances that were closing in on Johnson too and that provided him great motive in the killing of the President. The story is extraordinary. We began the story of Don Reynolds in Episode 11 whereby Reynolds crafts an arrangement whereby Baker became a nominal VP of his insurance agency (with a non-voting stock interest) in exchange for Baker's help in expanding sales and profits. Commission payments for referrals were also a part of the deal. Reynolds would become friends with Baker and travel on lavish junkets to New York and Miami, living the high life all while cultivating clients made available through Baker's contacts. His tight relationship would lead him to be a bagman too for Baker. Once these and other scandals were revealed during investigation by the Senate Rule and Administration committee's investigation and the work of senator John Williams, the scandal threatened to take the Vice President down politically. Perhaps, if the tragic events of November 22nd had not occurred, these events might have sent Johnson to jail as other indiscretions were also being investigated. Reynolds testimony regarding the stereo and the television advertising kick backed to Johnson were taking place in closed session at a senate office building literally at the moment that the shots rang out in Dealey Plaza. Informed of the president's assassination as the meeting was finishing up, Reynolds shook with the gravity of the situation and the fact that the man he had just accused of engaging in graph...Lyndon Johnson, had just become the most powerful man in the world. Rumors of Johnson's involvement in the assassination began to swirl almost immediately after the President's murder and there is a defined school of thought within the JFK assassination research community that staunchly believes in Johnson's involvement. His involvement in both the assassination and its cover up. This year's NATO summit was very unusual on multiple levels. Amid the disruption brought by Donald Trump's presidency, and with Ukraine's European allies adamant that continuing U.S. leadership is needed to help the embattled country at the most critical point in its defensive war against Russia, NATO members made an unprecedented commitment to spend 5% of GDP on defense by 2035. Where is NATO headed under Trump 2.0? Will its European members be able to implement the defense spending targets set in The Hague? What lessons is the Kremlin taking from the summit, and how could NATO affect Putin's war optimism?
In this case, the court considered this issue: Can retailers who would sell a new tobacco product seek judicial review of the FDA's denial of a manufacturer's marketing application under the Tobacco Control Act?The case was decided on June 20, 2025. The Supreme Court held that the Tobacco Control Act's provision that “any person adversely affected” by the FDA's denial of a marketing application may seek judicial review extends to retailers who would sell the new tobacco product, not just the manufacturers who applied for approval. Justice Amy Coney Barrett authored the 7-2 majority opinion of the Court.The phrase “adversely affected” is a term of art in administrative law that the Court has consistently interpreted broadly. When Congress uses variations of this phrase across different statutes, the Court presumes it carries the same meaning as in the Administrative Procedure Act—covering anyone “arguably within the zone of interests to be protected or regulated by the statute.” Congress reinforced this broad interpretation by using “any person” rather than limiting review to “the applicant.” The Court's precedents from other contexts, including employment discrimination and fair housing cases, confirm that “adversely affected” encompasses more than just the direct recipient of agency action. Retailers face a direct, significant impact from denial orders because they lose the opportunity to profit from selling the product and face criminal penalties if they sell it without authorization.The statutory structure confirms Congress intended different scopes for different provisions. While the Act limits challenges to withdrawal of existing approvals to only “the holder of the application,” it uses the broader “any person adversely affected” language for initial denials. This deliberate use of materially different terms creates a presumption that Congress intended different meanings. The FDA's arguments focusing on the application process and confidentiality provisions cannot override the plain language Congress chose for the judicial review provision.Justice Ketanji Brown Jackson authored a dissenting opinion, joined by Justice Sonia Sotomayor, arguing that retailers fall outside the statute's zone of interests because the premarket approval scheme involves only manufacturers and the FDA, with no mechanism for retailer participation.The opinion is presented here in its entirety, but with citations omitted. In the early 1960s, R.J. Reynolds, one of the largest and most profitable tobacco companies in the U.S. at the time, wanted to diversify its business. Its marketing strategies had been highly successful in selling its top brands, like Camel, Winston and Salem cigarettes, and executives thought, Why not apply the same strategies to, say, the food industry?So in 1963, R.J. Reynolds acquired Hawaiian Punch. It marked the beginning of the tobacco industry's entry into the food sector. In the following decades, R.J. Reynolds and Philip Morris expanded aggressively into the food industry, acquiring major brands, like Del Monte, Nabisco, General Foods, Kraft and 7UP, where they produced hyperpalatable, chemically-engineered foods now known as ultra-processed foods, or UPFs. These products were marketed especially to children and other vulnerable groups. In Berkeley Talks episode 229, Laura Schmidt, a professor of health policy in the School of Medicine at UC San Francisco, discusses how ultra-processed foods — like cookies, sodas, instant noodles, fish sticks and cereals — are a direct legacy of the tobacco industry, and are responsible for a dramatic rise in obesity, diabetes and other chronic diseases across the country. “About 60% of the calories in Americans' diets are from ultra-processed foods,” says Schmidt, who spoke at a UC Berkeley event in May. “In the mid-'80s, when we see ultra-processed foods starting to scale up in the American food supply, we also see obesity starting to really rise. Warren: Reynolds was employed at the school until February 2024 after Swinson went to police. Reynolds allegedly sent hundreds of emails and text messages to Swinson over a long period of time, some of them sexually explicit.
