Legal separation (sometimes judicial separation, separate maintenance, divorce a mensa et thoro, or divorce from bed-and-board) is a legal process by which a married couple may formalize a de facto separation while remaining legally married. A legal separation is granted in the form of a court order. In cases where children are involved, a court order of legal separation often makes child custody arrangements, specifying sole custody or shared parenting, as well as child support. Some couples obtain a legal separation as an alternative to a divorce, based on moral or religious objections to divorce. Legal separation does not automatically lead to divorce. The couple might reconcile, in which case they do not have to do anything in order to continue their marriage. A mensa et thoro separation. A mensa et thoro is a legal Latin phrase which means "from table and bed", often translated as "from bed and board", in which "board" is a word for "table". Separation a mensa et thoro is essentially a separation that is sanctioned by a court order, meaning that the spouses may legally live apart, but they are still legally married. The legitimacy of any future child born to the couple remains intact, and the spouses may not legally remarry. This type of separation allows the couple to live apart without concerns about being taken to court for "desertion". (In some jurisdictions, provable "desertion" is legal grounds for a divorce.) There are several reasons why a couple might seek a mensa et thoro separation. In some legal jurisdictions, including certain countries, it can be difficult to get a full and final divorce, but if the spouses are already separated a mensa et thoro for an extended period of time (for example, three years), the court may decide to grant a full and final divorce. When the requirements of burden of proof for a divorce are difficult to meet, in most jurisdictions, an a mensa et thoro ruling assures the couple a slot in the court's schedule whenever they file for a full divorce, by showing that they were both serious about their separation. Sometimes, an a mensa et thoro separation is used when one partner is claimed to be emotionally, verbally, or physically abusive, keeping the marriage in existence while the two spouses are physically separated. This physical separation may give the two of them a chance to work out the problems in their relationship while residing in legally sanctioned separate dwellings. Spouses may also request an a mensa et thoro separation to protect themselves from accusations of desertion or abandonment—such as in cases where one must depart from the other for an extended period of time. United States. In the United States of America, a legal separation may address the division of assets, division of debts, child custody, child support, and alimony. A separate maintenance agreement is not a legal separation and therefore child support and custody are typically not allowed to be addressed. A separate maintenance agreement is often confused with a legal separation which is filed with a court. Separate maintenance agreements are contracts between spouses and not approved by a court. They are similar to prenuptial agreements. Under the law of some states, a separation can occur by judicial decree, or by an acknowledged ("notarized") agreement of the parties. In some states, there must be grounds or a cause of action to get a judicial decree of separation, such as "cruel and inhuman treatment ... abandonment ... neglect or refusal support ... adultery by the defendant, confinement of the defendant in prison ...." Reconciliation is allowed. You aren't technically divorced but you have a legal order that outlines how you interact and co-parent. But you can't get married again without getting a divorce.

Is It Better To Get A Divorce Or Legal Separation?
While Eskom has done everything on its side to achieve the legal separation of its transmission entity by December 2021, the matter also depends on getting legislative amendments and regulatory decisions timeously, according to CEO André De Ruyter. The group chief executive made the remarks during a pre-recorded interview with Enlit Africa, which was published on Tuesday. De Ruyter was highlighting some progress points of the power utility's five-point plan. Among these was the legal separation of the generation, distribution and transmission entities. The divisional boards of each of the three entities has been established - as well as their functional separation. Eskom previously told Parliament the separation would cost R500-million. The separation of the transmission entity is first in line and is subject to approval for a transmission licence from the National Energy Regulator of South Africa (Nersa), as well as lenders, Fin24 previously reported. De Ruyter said that Eskom has made progress with the legal separation for transmission. "We have done everything we can to meet the target date of legally separating transmission by December 2021," he said. But the legislative amendments and regulatory decisions that are required will depend on "choreography" between different departments such as Nersa, the Department of Mineral Resources and Energy, the Department of Public Enterprises, National Treasury and Eskom itself, De Ruyter explained. "From our perspective, we are driving the process. But the date can be at risk if we do not get the regulatory interventions in time for us to achieve the legal separation," he said. De Ruyter added that it will be "regrettable" if it is not achieved. Eskom's other prioritises include reducing its some R400-billion debt burden to a more manageable range of between R150-billion and R200-billion. While Eskom has been a beneficiary of equity injections from National Treasury, there is still more work to be done, he said. There is not a single silver bullet to solve the debt problem, he added. Eskom is considering multiple interventions such as optimising its working capital, addressing municipal debt levels, or converting some debt to equity. Finding a debt solution has been "slower" than Eskom would have liked, he said. Eskom is also making headway in terms of encouraging a "high performance" culture. "We are holding people accountable," said De Ruyter. Eskom has made leadership changes at power stations including coal-fired Tutuka, which was in a "shocking state" following years of neglected maintenance, according to Eskom executives who briefed the media on the state of the system on Monday. A number of key people at the station have been suspended and arrests will be made. De Ruyter added that people have been caught for engaging in corrupt activities. "Have we won the war as yet? No, but more and more the signal is getting out to those miscreants who are seeking to enrich themselves at the expense of South Africa and Eskom that crime does not pay and we will get them in the end," he said. De Ruyter added that Eskom would like to see greater support from law enforcement authorities to see more people in "orange overalls". So far Eskom has been pursuing civil cases to recover monies. Last year the power utility managed to recover R1.56-billion from contractor ABB South Africa. This was linked to overpayments to the contractor for the construction of Kusile power station.

A parenting plan is a child custody plan that is negotiated by parents, and which may be included in a marital separation agreement or final decree of divorce. Especially when a separation is acrimonious to begin with, specific agreements about who will discharge these responsibilities and when and how they are to be discharged can reduce the need for litigation. Avoiding litigation spares parties not only the financial and emotional costs of litigation but the uncertainty of how favorable or unfavorable a court's after-the-fact decision will be. Moreover, the agreement itself can authorize the employment of dispute-resolution methods, such as arbitration and mediation, that may be less costly than litigation. Legal separation (sometimes judicial separation, separate maintenance, divorce a mensa et thoro, or divorce from bed-and-board) is a legal process by which a married couple may formalize a de facto separation while remaining legally married. A legal separation is granted in the form of a court order. In cases where children are involved, a court order of legal separation often makes child custody arrangements, specifying sole custody or shared parenting, as well as child support. Some couples obtain a legal separation as an alternative to a divorce, based on moral or religious objections to divorce. Legal separation does not automatically lead to divorce. Many people ask about the difference between legal separation vs divorce. Sometimes they ask because they are not sure their relationship with their spouse is irretrievably broken. Sometimes they ask for religious reasons, or because legal separation sounds better to them than divorce. Sometimes they ask because they’ve heard group health insurance can still cover both spouses if they’re legally separated but not if they’re divorced, which happens to be true. Usually they are surprised to discover they will go through exactly the same steps either way. Divorce - DISSOLUTION of Marriage We need to get our terms straight at the outset. The word “divorce” is not in the California Family Code. The Code instead uses the phrase “dissolution of marriage.” (The Code also uses “spousal support” instead of “alimony.”) At the end of a divorce case, you get a Judgment of Dissolution of Marriage. At the end of a legal separation case, you get a Judgment of Legal Separation. The same mandatory preprinted forms are used for both. If you’re getting a divorce, you check the box next to Dissolution of Marriage. If you’re getting a legal separation, you check the box next to Legal Separation. Otherwise, both proceedings look exactly alike. All your assets and debts are identified and characterized as community property or separate property, the community assets and debts are divided in half, child support is awarded if appropriate, and spousal support is awarded if appropriate. If your judgment is for Dissolution of Marriage, you can marry someone else the day after it becomes final. But if your judgment is for Legal Separation, you’re still married, and you can’t marry anyone else unless and until you go back to court, file a petition for dissolution of marriage, and obtain a final judgment of Dissolution of Marriage. If you don’t, your next marriage will be bigamous and can be annulled. (Neither judgment can become final until six months after the court has jurisdiction over both parties. That occurs when, after the petitioner has filed the petition, the respondent is served with the petition and a summons or files a response, whichever happens first. All the necessary paperwork may be completed and filed before six months have gone by, but the effective date of the judgment is written on the judgment form by the clerk, and the clerk will insert the date on which the six months expire.) Legal Separation Do not confuse a Legal Separation with the date of separation. The date of separation is usually thought of as the date one spouse makes it clear to the other that their marriage is irretrievably broken and there is going to be a divorce. Sometimes it’s difficult to decide on the date, particularly when people go through a cycle of moving out and moving back in while attempting to “work things out.” The date of separation is important, because it is the date when community property rights cease to accrue. In other words, earnings after the date of separation are the separate property of the spouse who earned them, not community property owned by both spouses. Likewise, assets acquired after the date of separation with those separate property earnings are separate property, and debts incurred after the date of separation are separate property debts. Deciding to live separately without deciding to become divorced or legally separated does not trigger these changes - you’re still married for all purposes even though you may be miles apart. For purposes of dividing assets and debts, you need a snapshot of the parties’ assets and debts as of the date of separation. Those are the assets and debts that are divided, not the assets and debts of the parties eight months later when the case settles or goes to trial. On the other hand, for calculating spousal or child support, the court uses the income and assets of the parties when the support order is made, not those on the date of separation. Accurate and complete financial records both from before the date of separation and after are therefore essential. As we discussed above, because the same things happen in a proceeding for a judgment of legal separation as in a proceeding for a judgment of dissolution of marriage, establishing the date of separation and obtaining and keeping complete financial records is equally important in both cases. As discussed above, the only difference between legal separation and divorce is that you can only marry again if you’re divorced. San Diego Divorce Attorney Stanley D.
