Privacy as a legal concept has deep historical roots, beginning with English common law's recognition of the home as a protected space. In the U.S., privacy rights began to take shape in the 19th century, as industrialization and urbanization raised concerns about personal autonomy and dignity. A seminal moment in privacy law came with Samuel Warren and Louis Brandeis' 1890 article, The Right to Privacy, which argued for privacy as an independent legal right. This article became the foundation for the modern understanding of privacy, defined as “the right to be let alone.” The U.S. Constitution does not explicitly guarantee a right to privacy, but courts have interpreted various amendments to protect privacy in specific contexts. Landmark Supreme Court cases such as Griswold v Connecticut (1965), Katz v United States (1967), and Roe v Wade (1973) have established privacy as a constitutional right, particularly regarding personal decisions about marriage, reproductive rights, and bodily autonomy. 2. This right was later modified in Planned Parenthood v Casey (1992), which introduced the "undue burden" test, allowing for state regulation of abortion as long as it does not place an undue burden on a woman's ability to obtain an abortion. Current Challenges: Reproductive rights have faced increasing legal challenges, culminating in the Supreme Court's 2022 decision in Dobbs v Jackson Women's Health Organization, which overturned Roe v Wade, returning the authority to regulate abortion to individual states. 3. Right to Marry and Family Autonomy. The right to marry and family autonomy are also protected under the umbrella of privacy rights. The Right to Marry: The Supreme Court has long recognized marriage as a fundamental right. In Loving v Virginia (1967), the Court struck down laws banning interracial marriage, affirming that marriage is a basic civil right. This was further expanded in Obergefell v Hodges (2015), where the Court ruled that same-sex couples have a constitutional right to marry, grounding this decision in both the Due Process and Equal Protection Clauses. Family Autonomy: Privacy rights also protect family autonomy, particularly parents' rights to make decisions about the upbringing and education of their children. In Pierce v Society of Sisters (1925) and Troxel v Granville (2000), the Court ruled that the government cannot interfere with parents' fundamental rights to direct their children's upbringing, unless there is a compelling state interest. 4. My friend Jacob Troxel (who recorded this podcast three weeks after his successful mission in Canada Edmonton) joins us to bravely share his experiences as a gay Latter-day Saint and one of the first openly gay missionaries in the Church (which is noted on his Facebook profile). Jacob (who grew up in Camarillo) talks about realizing he might be different around age 12 and then came out to his Bishop and parents at age 16. Jacob talks about how he probably wouldn't have stayed in the Church without the loving first response from his Bishop. Jacob talks about a powerful spiritual experience where his belief in God shifted from “having a testimony that He doesn't love someone like me—to God is perfectly loving and loves me.” That is the anchor knowledge that has given Jacob peace as a gay Latter-day Saint and his burning desire to serve a mission so others could know that important gospel truth. Jacob takes us on his mission and shares the both the difficult experiences and the positive ones—ones where lives were changed. Jacob talks about the importance of proximity with stories of how companions did a “180” to full love, understand and support Jacob. These stories give me hope. Jacob also talks about how investigators and members concluded from Jacob's example that “if there is room for Elder Troxel in the Church, maybe there is room for me.” Jacob is honest the positive experiences—made possible because he was open—and how those were matched by deeply wounding experiences which reminds me of Zechariah 13:6 “…. wounded in the house of my friends.” Jacob talks about boundaries, being honest with his pain, and finding grace for others. Jacob talks about his supportive parents as he makes his way forward. This is one of the best podcasts we've done as I was so moved listening to Jacob—a very mature soul. We all know the importance of a good night sleep.  Today my guest is Dr. Wendy Troxel.  Dr. Troxel is a Senior Behavioral Scientist at the RAND Corporation and Adjunct Faculty at the University of Pittsburgh and the University of Utah. She is a licensed clinical psychologist and certified behavioral sleep medicine specialist, with more than fifteen years of clinical and research experience in sleep medicine.  Her work has been funded by the National Institutes of Health, the Department of Defense, private foundations, and corporations. The Supreme Court has articulated that parents have the unenumerated right rooted in the Fourteenth Amendment to direct the care, custody, and upbringing of their children since the 1920s in such cases as Pierce v. Society of Sisters, Meyer v. Nebraska, Parham v. J.R. and Troxel v. Granville. However, the precise contours of the right have long been uncertain, as has the level of scrutiny to be applied. In Dobbs v. Jackson Women's Health Organization, the Supreme Court established a clear threshold for unenumerated rights, that they must be rooted in history and tradition and essential to ordered liberty. The Court noted that its decision does not call into question its line of cases on parental rights. Nevertheless, the question remains: do parental rights meet the Court's threshold? Are there reasons to believe that parental rights will be affected by the Dobbs decision? The Dobbs decision comes as a new series of conflicts between parents and the state are arising in education and healthcare around the country. Many of these conflicts over ideas about gender and race. These new conflicts implicate parental rights and are raising questions for courts such as:Who has the primary responsibility for the formation of a child's identity and values?Do parental rights extend beyond the schoolhouse gate to include instruction and policies in schools?And who gets to decide the treatment of a child's mental health, including gender distress?These questions and more have been raised in a series of recent lawsuits against school districts over policies concerning race and gender-based curriculum and policies where challengers have invoked parental rights theories. I'm a big hockey fan so today I'm wearing my Colorado Avalanche jersey in recognition of our Stanley Cup win. Growing up I played hockey quite a bit with my friends, never seriously but I enjoyed it. Football was the sport I took a bit more seriously. Unfortunately, a string of injuries prevented me from continuing to pursue my dream of playing in the NFL. I grew up in Lincoln, Nebraska, which was a nice little college town, but I wanted someplace a little bigger when I went to college. I initially considered law school in Los Angeles, hoping to attend either USC or UCLA. However, when I visited the CU campus in Boulder I fell in love with the area and decided to go there instead. Going into business with friends has its challenges but it is something that works well for Josh and I. Both of us are direct communicators and have thick skin. This helps a lot when we're trying to work through problems or resolve miscommunications. I was always intrigued with entrepreneurship because it is a different approach to living life. Once you've made peace with the risk aspect of being an entrepreneur, I see it as a lot of fun and thus when we opened our firm, we focused on working with clients who were also entrepreneurs. In addition to our law practice, we have a couple of other entrepreneurial ventures on the side.  One of the most common mistakes we see entrepreneurs make is not forming a business entity. A lot of people simply operate under a trade name which essentially means they are a sole proprietor or general partner. However, what most entrepreneurs don't consider is that it is the riskiest way to operate a business. The idea behind limited liability is that it protects your personal assets from being at risk if someone were to sue the business. If you don't take that step, you are not only putting your business at risk, but you are also putting at risk everything else you own. Law is intimidating to most people, so we aim to make it digestible and understandable to our clients.  The biggest mistake I see people make when they are hiring an attorney is to simply price shop for the lowest rate. Unfortunately, because law can be a complex topic, people don't get what they need because they don't understand what they're being asked for or don't know what to look for in the agreement. Your primary goal when you are looking for an attorney should be to find someone you can trust, even if their prices aren't the lowest in town. If you are only looking for the lowest price you will often find yourself less protected than you thought you were, which only adds to your frustration when you're in the middle of a situation.   Resources Shared: Troxel Fitch LawThryv
