With regard to the mitzvah of sending away the mother bird when you come to take the eggs (or the fledgling birds), if one took the mother bird instead of sending her away - what happens? It's a machloket! Either the perpetrator here receives lashes, or he should just send away the mother bird now, and not get lashes. (it's an example of the positive commandment that comes together with the negative commandment, and doesn't (necessarily) get lashes). And there's one other mitzvah that has that same capacity - namely, the rapist who marries and divorces the woman he raped (and can remarry her). Also, on forbidden foods - when does one eats them get lashes? With a focus on creepie-crawlies and water creatures, and eventually land creatures, and those that fly -- all of which are learned out from verses in the Torah. Eight possible violations in total.

Does your nonprofit want to build power and amplify its impact by engaging in robocalling and texting campaigns? Would it surprise you to find out that while this type of advocacy can effectively boost your reach and put you in touch with thousands (even millions) of supporters, it also comes with rules related to opt-out requirements, mandatory disclaimers, prior consent, and more? On this episode, we'll introduce you to our new Robocalling guide and walk through several of the issues your nonprofit needs to think about before you pick up the phone or click send on a robocall or robotext campaign.     Attorneys for this Episode  Monika Graham  Melissa Marichal Zayas  Natalie Ossenfort    Robotext and Robocall Campaigns  Federal Communications Commission (FCC), Federal Trade Commission (FTC), and Federal Election Commission (FEC) each regulate robocalls and robotexts  For example, the Telephone Consumer Protection Act (TCPA), enforced by the FCC, strictly limits when organizations can make robocalls and robotexts. Violations of TCPA can result in stiff fines, so know the rules before you launch your next campaign.  Keep in mind that many states also have their own rules on these communication methods.  Federal Restrictions on Robocalls / Robotexts  What are robocalls and robotexts? Calls or texts made with an autodialer or using an artificial or pre-recorded voice.   Under federal law (the TCPA), a nonprofit organization must obtain an individual's “prior express consent” to: (a) send a call or text to a cell phone using an autodialer, a prerecorded voice, or an artificial voice, or (b) to send more than three prerecorded or artificial voice calls to a landline in a 30-day period.  Express consent requires:  The person gave permission to be contacted at their cell phone number.  The call is within the scope of the consent given.  The person hasn't revoked their consent.  Prior express consent is not the only consideration you need to think about before engaging in robocall or robotext campaigns. Identification, opt-out, and disclaimer requirements are going to be relevant too.  For example, federal law requires that all pre-recorded voice telephone messages to cell phones or landlines must include a specific identification disclaimer. Disclaimer must:  Clearly state at the beginning of the message the official registered name of the organization initiating the call, and  The telephone number of the organization (not the number of the vendor who placed the call, a 900 number, or a number for which charges exceed normal local or long-distance transmission charges).  Disclaimers may also be required if a non 501(c)(3) organization expressly advocates for or against a federal candidate or solicits contributions in relation to a federal election --> triggering federal campaign finance law, which is enforced by the FEC.  This type of disclaimer should not apply to 501(c)(3)s which are prohibited by the Internal Revenue Code from supporting or opposing candidates for public office.  Likewise, the IRS may require a disclaimer if fundraising solicitations are made by non-501(c)(3)s reminding the potential donor that contributions are not tax deductible.    Remember: State Law Matters Too!  Many states restrict certain types of calls, like robocalls. When they do, they often apply to both cell phones and landlines.  In many instances, state laws are similar to the federal rules, but variations between state and federal law do exist, and some states restrict calls that would otherwise be allowed under federal law.  Consult with counsel before launching your campaign because common state law requirements include:  Notification or self-identification requirements  Time restrictions  Geographic limits  Permit requirements  Prohibitions on caller ID blockers  And more!  State law may also require lobbyist or campaign finance registration and reporting in some instances.    FAQ New Robocalling guide contains a handy FAQ, where you can find answers to common questions like:  What are the best ways to collect cell phone numbers for these types of campaigns?  Are landlines treated differently than cell phones?  What happens when a cell phone number is reassigned to someone other than the person who provided consent?    Resources  Robocalling Rules: Before You Pick Up the Phone, Hold That Call. This was a really eventful week for AI regulation, with the first rules of the AI Act starting to apply on Sunday, February 2nd and the EU Commission releasing Guidelines on Tuesday (prohibited practices) and Thursday (scope of AI systems). To cap it all, a first-ever class action under the new framework (alongside the GDPR and the Digital Services Act) was filed on Wednesday against X-Twitter and TikTok.  The following conversation with Markus Wünschelbaum, with a particular focus on digital advertising and AdTech, preceded and rightly anticipated these developments.  Dr. Markus Wünschelbaum currently serves as Policy and Data Strategy Advisor to Hamburg's Data Protection Commissioner Thomas Fuchs. In this role, he advises on key data protection & AI policies and strategic initiatives. Previously, he was responsible for imposing fines, fundamental GDPR issues, and freedom of information. Leviticus 2 outlines the laws concerning the grain offering, also known as the meal offering or cereal offering, which was a key aspect of Israelite worship. Unlike burnt offerings that involved animal sacrifices, the grain offering consisted of fine flour, oil, and frankincense, symbolizing thanksgiving and dedication to God. Key Elements of Leviticus 2: 1.Types of Grain Offerings (Verses 1-10): The chapter describes various ways the grain offering could be presented: •Uncooked flour offerings (v.1-3): Fine flour mixed with oil and frankincense, offered with a portion burned on the altar while the rest was given to the priests. •Baked offerings (v.4-7): •Cakes or wafers baked in an oven, without yeast, and mixed with oil. •Offerings cooked on a griddle or in a pan. •Handful Offered to God (v.8-10): A portion of the offering, called the “memorial portion,” was burned on the altar, while the remainder belonged to the priests. 2.Prohibitions in the Offering (Verses 11-13): •No leaven (yeast) or honey could be included in the grain offering, as these substances were associated with fermentation and corruption. •Salt was required in every offering as a symbol of God's covenant, representing purity, preservation, and faithfulness. 3.Firstfruits Offering (Verses 14-16): •The first produce of the harvest, particularly green heads of grain roasted in fire, could also be offered. •A portion was burned as a pleasing aroma to the Lord. Significance of the Grain Offering: 1.Symbol of Dedication and Gratitude: •The grain offering was an act of thanksgiving and acknowledgment of God's provision in daily life. It symbolized the dedication of one's labor and sustenance to God. 2.Dependence on God: •Bringing the best of the harvest reflected the Israelites' trust in God for future provision and sustenance. 3.Holiness and Purity: •The prohibition of leaven and honey underscored the need for purity and sincerity in worship, while the inclusion of salt symbolized the enduring nature of God's covenant. 4.Support for the Priests: •Part of the offering was given to the priests, showing the provision for those who served in the tabernacle and reinforcing the communal responsibility toward spiritual leaders. Application in Biblical Context: The grain offering highlights that worship is not limited to sacrifices of atonement but includes acts of gratitude and dedication of one's daily life to God. It teaches the importance of offering our best to God and recognizing His role as the provider of all resources. The Ben Ish Hai (Rabbi Yosef Haim of Baghdad, 1833-1909), in Parashat Ki-Tese (12), discusses a number of prohibitions regarding the way one speaks to others. First, he addresses the prohibition of "Genebat Da'at" (literally, "stealing one's mind"), or misleading another person. The Torah forbids misleading another person even if the misleading information will not cause a financial loss, but will leave the other person feeling indebted. The Ben Ish Hai gives the example of an extending an invitation to one's fellow knowing full well that he has already made plans to eat somewhere else. If a person knows that his friend is eating Friday night dinner with his parents, for example, it would be forbidden to extend to him an invitation so that he would feel a debt of gratitude. Similarly, the Ben Ish Hai writes, if a person knows that his friend is observing a fast, such as on Ereb Rosh Hodesh, he may not offer him food or a drink, misleading the person into thinking that he is sincerely making a genersou offer. The Ben Ish Hai adds, however, that this prohibition applies only if one extends the invitation in a persistent manner. Simply stating one's desire that his fellow join him for a meal is often done as a common, salutary greeting, much like saying, "Good morning" or "How are you." People will often say, "Why don't you come by?" as a friendly greeting, and not necessarily as a sincere invitation. The Ben Ish Hai writes that one may extend a perfunctory invitation such as this even if he knows that the other person cannot join him, since the "invitation" is stated simply as a friendly greeting. The prohibition of "Genebat Da'at" applies only if one asks persistently that the other person join him, knowing full well that he had already made other plans. The other prohibition addressed by the Ben Ish Hai in this context is that of "Ona'at Debarim," or verbal abuse. He writes that just as the Torah forbids "Ona'at Mamon," cheating other people by overcharging for merchandise, it similarly forbids causing a person pain through words. In fact, he adds, causing a person harm with words is a more grievous sin than overcharging, since the latter can be rectified by returning the money. Words, however, cannot be retrieved once they are spoken, and the harm they cause cannot be undone. Moreover, causing harm through words hurts a person directly, as opposed to "Ona'at Mamom," which affects only his finances. For this reason, insulting one's fellow is considered a more severe Torah violation than cheating him financially. The Ben Ish Hai notes that "Ona'at Debarim" is not confined to berating and shouting explicit insults at one's fellow. It includes any speech that causes one's fellow distress, including calling him by a nickname to embarrass him. The Ben Ish Hai emphasizes that even if a person has grown accustomed to a certain nickname and is no longer ashamed by it, one who calls him by that name for the purpose of embarrassing him transgresses the Torah prohibition of "Ona'at Debarim." Summary: It is forbidden to mislead another person, even if there is no financial loss entailed. For example, if a person knows that his friend had already made plans for lunch, he may not persistently request that he join him for lunch, since this request is insincere. It is, however, permissible to extend a brief invitation as a courtesy or as part of a friendly greeting. It is strictly forbidden to say something insulting to one's fellow, and this is a more grievous sin than cheating one's fellow financially.
