Interview by Kris PetersAustralian melodic death metal machine Be'Lakor began to reach an international audience following the release of their third studio album Of Breath & Bone in 2012.It is an album the band themselves admit "helped us to grow and find new audiences as a band" and one which laid the platform for a global assault that continues to gain traction to this day.A worldwide success which garnered rave reviews from both fans and critics alike, Of Breath & Bone remains a turning point of Be'Lakor's career and will now be officially commemorated with a one off special performance at Max Watts in Melbourne on February 24 to celebrate its 10th anniversary.Be'Lakor - for the first and probably last time ever - will pay homage to the album by playing it in its entirety, mixing popular tracks such as Abeyance, In Parting and Remnants with some of the other lesser known tracks that combined to create something special.Keyboard player Steven Merry joined HEAVY to talk more about the show."It was gonna be November last year, which would have been officially ten years since the album came out," he began, "but then we had to move it to February this year which technically means it's a slightly late birthday for it. Merriam-Webster's Word of the Day for May 4, 2022 is: abeyance • uh-BAY-unss • noun Abeyance means "a state of temporary inactivity." The word itself is commonly preceded by the preposition in. // The misdemeanor charges are in abeyance while the suspect is being prosecuted for the felony. See the entry > Examples: "The consensus of analysts is that the crisis may be in abeyance for the moment, but is far from over." — Fred Weir, The Christian Science Monitor, 13 Dec. 2021 Did you know? Abeyance comes from Old French baer, meaning "to have the mouth wide open," which was joined with the prefix a- to form abaer, a verb meaning "to open wide," and, in later Anglo-French usage, "to expect or await." There followed Anglo-French abeyance, which referred to a state of expectation—specifically, a person's expectation of inheriting a title or property. The word, in English, was then applied for the expectation to the property itself: a property or title "in abeyance" is in temporary limbo, waiting to be claimed by a rightful heir or owner.

Abeyance is a noun that refers to ‘a state of disuse or suspension.’ Our word of the day began in Latin as the word Baer (BUY er) which meant ‘having ones mouth wide open,’ a condition we associate with being suspended or waiting for something. By the late 16th century, the word became adopted into English where its meaning shifted into a state of not being used. Example: The abeyance of that field put a few ideas in my head. I figured that because it wasn’t being put to use, no one would mind if our soccer team used it to practice.

Episode 19:  In late April, Calloway County attorney Jeff Roberts presented an oral argument before the Kentucky Supreme Court.  It's not his first time; he's taken cases to the KY Supreme Court multiple times.  In this episode, he'll give us an inside view into the experience. Arguing before the KY Supreme Court is not what you typically see on TV.  Instead of 1 judge, there are 7 justices.  They can ask questions at any time and you have to be prepared for whatever they ask.  Surprisingly, each attorney is only given 15 minutes to present their side of the case.  This includes the initial presentation and a possible rebuttal to the other side's argument. How a Case Gets to the KY Supreme Court Jeff's case involved a constitutional question in regard to a workers' compensation claim.  These cases are initial presented to an administrative law judge.  If either side appeals the decision, it goes to the Workers' Compensation Board.  Either side can then appeal to the KY Court of Appeals.  Again, either side can then appeal to KY Supreme Court. The case Jeff argued involved an issue about the retroactivity provision of a new statute.  If the statute is found to be constitutional, it will negatively impact many KY workers' compensation claims and the money the injured workers would then lose.  The decision will apply to all pending cases. The law in Kentucky is generally applied based on the date of injury.  If this new statue is upheld, it will violate this law (in Jeff's opinion) and make it more favorable to the employer (or the employee) after the injury has already occurred.  What Happens when a Case is Placed in Abeyance? This can happen to a case for several reasons.  In Jeff's situation, there are several pending cases which all have the same/similar issues.  The court can put those cases “on hold” until one of the group of cases is actual decided on.  That decision would impact how the other cases are ultimately treated.  Abeyance is a way to help make the judicial system more efficient. Small Town Service, Big City Results Jeff uses this statement often.  He has built a strong reputation across the state and among his peers.  The Roberts Law Office is located in Murray, Kentucky.  However, Jeff handles many cases from outside of the local area.  Many are sent on referral from other attorneys. What is a Legal Brief? While the case Jeff argued before the KY Supreme Court only took 15 minutes, it's not the first time the justices have learned about the facts of the case.  Attorneys write extensive arguments, called legal briefs, which explain the point in question and the supporting proof as to why the attorney feels the court should rule in a certain manner.  Both sides submit briefs. The justices review the briefs, prior to hearing the case, and may decide to question the attorneys, based on what they submitted in the briefs. The case Jeff argued may be decided in 3-4 months. STUDENT will give his best effort in all of his subjects every day. That subjective condition-statement was extracted from a school district's boilerplate one-page abeyance agreement. It's codified by the district's school board policy. With suspensions racing to extinction, this is in the new embodiment of student discipline and it's not just a second chance to follow the rules. WHAT IS AN ABEYANCE AGREEMENT (AA). In public schools, an AA sets forth the conditions under which the school agrees to not impose discipline (detention/suspension/expulsion). AA is a practice wrangled from the legal system (not from education policy) where it's often associated with a plea deal. AAs are also referred to as pre-expulsion agreements or a first offenders program. PURPOSE OF AN AA. School leaders champion AA's as a tool of discretion that offers a second chance for students who have violated the code of student conduct. However, implicit functions of the AA include: (a) having a conclusive action to an investigation; (b) avoiding creation of a reportable data as AAs are not reported to local, state Department of Public Instruction, or federal agencies; (c) avoid convening the IEP team if the child has a disability (to discuss services and placement); and (d) shield the school board from an abrasive student expulsion. WHAT ARE THE PARTS OF AN AA? A Google search will surface countless AA templates - some as short as a page. AAs include, (a) period of time that the AA is in effect - often a semester; (b) attendance requirements; (c) requirement that the student follow the school rules; (d) statement that the student will give his/her “best effort” in school; and (e) signatures by student, parent and school administrator. Many include the following clause, “By executing this agreement the undersigned acknowledges that they voluntarily and without any undue influence agree to waive their right to appeal.” ...That last sentence. Yep, an AA is a slight-of-hand maneuver that separates students from their right of due process. IS AN AA REPORTED TO THE STATE OR FED? There is no requirement that an AA be reported to a school board, state department of instruction or federal department of education. In fact, most AAs are expunged from school databases after they expire unlike school suspensions and expulsions which must be reported to state and federal government. FIVE INCENTIVES TO ENTER INTO AN AA. Reasons that drive AAs: (1) keeps the district's actions “off the books.” (2) has FERPA (privacy) shield; (3) if a student has a disability, or might have a disability that hasn't been diagnosed, an IEP team would be convened to hold a manifestation determination and consider services and placement. AA might preclude convening the IEP; (4) simple and quick; (5) parents go along with them most of the time because an AA leverages the positionality (perceived power) of the school. The school often includes its lawyer to craft the AA or be present at the meeting with parents. THE PSYCHOLOGY OF PERSUASION: WHY PARENTS ALWAYS AGREE TO AN AA. A parent might be intimidated by the school (as it is a powerful government institution) or overwhelmed by school authorities with advanced degrees and initials after their names. In these instances, parents perceive the AA as a “gift” from the school and sign it to bring the matter to a close and clean their child's record. Other times, parents believe they pressured the school into making a deal due to their status in the community or making it known that they could unleash a “complaint campaign” or bring advocates to meetings. Regardless of the parents' perception of why they are being offered the AA, the school gets what it wants - the signed AA. SIX SHORTCOMINGS OF AAs. (1) no oversight, efficacy research or reporting requirement; (2) less incentive for exhaustive investigation; (3) low threshold to fulfill the AA / no learning objectives; (4) privacy law keeps them secret; (5) denies due process to students [with disabilities]; (6) destroys a student record that might reveal a skill deficit, pattern of behavior or even bring light upon a systemic practice of institutional bias. We welcome Cait Simpson, singer, writer, and founding member of the band The Greys. As the band evolved from a duo into a four members group, they are currently working on their first full-length album, Abeyance. For this purpose, they have a Kickstarter campaign, and Cait shared a piece she wrote, and the dates of their upcoming shows, including First Night in Northampton, and a show on January 18th at Gateway City Arts with Jakals, and Ex-Temper.

Keeping it in the family this week we are happy to have Awaken back with us as we get ready to release a brand new remix package from his debut album with PUZL records. With remixes coming from Xinobi, Pascal Pur, Franks Serin and Silly Nova we get to revisit the amazing release from earlier this year. The French producer is always very mindful of the overall message that his music conveys. Even his mixes take on that same philosophy. We go by number here at LAMP and as such the mix is titled #254 and don't usually have mixes submitted to us with a title. Awaken has given this mix a title "Abeyance" which I would feel bad for neglecting as it is part of the art he is making. There are a few meanings that can be derived from that word after listening to the mix. If you don't know what Abeyance means, look it up and see if you agree.
