Dr. T and Truth Fairy welcome guest Robert Laurie to the show to talk about radical approaches to medical health and the ongoing fight for the recognition and legalization of cannabis and psychedelic medicines. Robert is a pioneer in psychedelic law and policy, the founder of Ad Lucem Law Corporation, and has been instrumental in advancing medical access to cannabis and psilocybin internationally. Robert shares his insights on the future of psychedelic therapy with Dr. T. and Truth Fairy.Robert discusses how he has represented many cases in the psychedelic space but the focus of his work has primarily shifted to looking at constitutional arguments. He points out such areas as opening dispensaries, operating psychedelic healing centers, and making psychedelics available on reserves through retail dispensaries. He explains that he collaborates with and represents academics, scientists, MDs, researchers and elders in his quest to shape policy in favour of cannabis and psilocybin.  Truth Fairy, Dr. T, and Robert examine the history of cannabis prohibition, how cannabis use compares to tobacco and alcohol use in terms of lethality rates, the rigidity of government views on psychedelics, and how policy aims to combat the ingrained structures that stand against the proliferation of psychedelic medicines. Robert's opinions and outlook are shaped by personal experience, years of study, and legal expertise in the realm of psychedelic use. He sheds light on what he believes is the innate right of humankind to access plant-based medicines and why governments tend to oppose that right.  “I mean, I think it's fair to say that there's probably been tons of scientific research by both military and medical and pharmaceutical. But what it boils down to is, you know, just take smoking cessation and psychedelics, for example. I mean, psychedelics, you know, promise major disruption to these well-established and entrenched hallowed halls, including tobacco, alcohol, pharmaceuticals, and the government isn't, I think, sure what to do with all of this.” - Robert Laurie__ About Robert Laurie:Robert graduated from the faculty of Political Science and International Relations at the University of British Columbia and earned his law degree from the University of Oxford. He has been practicing law since 2006, and is recognized as an accomplished lawyer, international consultant, and public speaker.Part of Robert's practice is committed to improving medical patient access and facilitate drug laws for cannabis, psychedelics, and sacred plant medicines. Robert advised Dr. Bruce Tobin and the TheraPsil Alliance litigation team (first Section 56 CDSA medical exemption for psilocybin in Canada). He was one of the Decriminalize Nature Canada Petition drafters, part of a national campaign to decriminalize restricted plant medicines and fungi in Canada. His goal is to help provide more options for doctors and treatments for anxiety, depression, addiction, and PTSD.Robert is a Special Advisor to Gateway Proven Strategies (GPS Global), [JB1] a Denver-based cannabis management consultancy firm operating globally, and serves as a board advisor to MAPS Canada, the Last Prisoner Project, and the Psychedelic Association of Canada. Alison Myrden began her career as a Corrections Officer in 1988 after working with the Children's Aid Society. In addition to her website, you can find Alison at the following social media:  Twitter  -- LinkedIn -- Facebook -- During her career, Alison worked at troubled youth facilities around Southern Ontario and eventually solidified her niche with Young Offender cases in early 1989 at Community Resource Services. During her career, Alison was responsible for various duties including attending court, facility shifts and as court liaison for Cassatta Youth Custodial Facilities. One of her most challenging assignments included working with Psychiatric Young Offenders at a Secure Custody Facility. While working in the Youth Court Justice system, Alison noticed many Young Offenders were in trouble with the law for simple experimentation with illicit drugs. This seemed very wrong to her. Alison felt it would be better to educate these young people about drugs instead of punishing them. It seemed to her that our youth were being criminalized for no good reason. Around the same time, Alison was diagnosed with chronic progressive Multiple Sclerosis. She began experiencing Tic Doloureux (bilateral trigeminal neuralgia), an excruciating facial pain associated with MS. Soon after retiring in 1992, she was introduced to medicinal cannabis. She found immediate relief with cannabis without the harmful side effects of the other, more addictive medications. It was then that Alison became an activist for drug law reform. In 1995, Alison was prescribed cannabis for pain relief after her legal, doctor-supervised cocaine and heroin therapy, along with other prescription medications that proved to be insufficient. In 2000, Alison received a s.56 exemption from the Controlled Drugs and Substances Act to possess and grow cannabis for medical purposes, but was frustrated at not having her own high-quality, cost-effective supply. In 2004, Alison began working with Law Enforcement Against Prohibition (LEAP), which was renamed Law Enforcement Action Partnership, where she was the first female speaker in Canada to represent LEAP U.S. until 2016, when she branched out on her own. For over 35 years, in over 1,000 interviews, Alison described the "War on Drugs" as a "War on People", calling for its end.  While cannabis was legalized in Canada in 2018, Alison believes the government has not supported those people who need high quality doses of cannabis products at reasonable prices for medical purposes. In 2017, Alison became the first Authorized Pain Patient in the World for Medical Psilocybin for pain relief.  She applied to Health Canada in 2019 for an exemption from the CDSA to grow her own mushrooms with a daily dose of 50 g. Last month, Health Canada denied her request. Alison is now considering her next Thanks to Jeremy Benning, co-producer and sound editor. For more insightful conversations related to cannabis law, listen to our other episodes at https://cannabislaw.ca/pages/russell-bennett-podcast If you're looking for a good text book on Canada's federal cannabis law and regulations with helpful related case law, read Canada's Cannabis Act.And if you need a cannabis lawyer, ask Russell for more information at https://cannabislaw.ca

In 2016, Ms. Sharma pleaded guilty to importing two kilograms of cocaine. At the sentencing hearing, Ms. Sharma argued that the CDSA mandatory minimum of two years, and the restrictions on when a conditional sentence is available, or rather not available, were all unconstitutional. The sentencing judge agreed with Ms. Sharma that the two year mandatory minimum sentence under 6(3)(a.1) of the CDSA violated section 12 of the Charter and could not be saved under section 1. Because of this finding, the sentencing judge declined to address the constitutional challenge to the conditional sentencing provisions under the Criminal Code. Ms. Sharma was sentenced to 18 months incarceration, less pre-trial custody. Ms. Sharma is an indegenous woman. The Court of Appeal for Ontario considered the constitutional challenge to the Criminal Code provisions. The Court of Appeal found that sections 742.1(c) and 742.1(e)(ii) of the Criminal Code infringed both section 7 and 15(1) of the Charter, and could not be saved under section 1. The Court of Appeal held an appropriate sentence was a conditional sentence of 24 months less one day. But because at this point Ms. Sharma had completed her custodial sentence, the Court of Appeal substituted a sentence of time served.

In 2016, the respondent Ms. Sharma, an Indigenous woman, pled guilty to importing two kilograms of cocaine, contrary to s. 6(1) of the Controlled Drugs and Substances Act (“CDSA”). Ms. Sharma sought a conditional sentence of imprisonment, and challenged the constitutional validity of the two year mandatory minimum sentence under s. 6(3)(a.1) of the CDSA and of ss. 742.1(b) and 742.1(c) of the Criminal Code, which make conditional sentences unavailable in certain situations. The sentencing judge found that the two year mandatory minimum sentence under s. 6(3)(a.1) of the CDSA violated s. 12 of the Charter and could not be saved under s. 1. The judge therefore declined to address the constitutional challenge to s. 742.1(b), and he dismissed the s. 15 challenge to s. 742.1(c). Ms. Sharma was sentenced to 18 months' imprisonment, less one month for pre sentence custody and other factors. Ms. Sharma appealed and, with the Crown's consent, also brought a constitutional challenge to s. 742.1(e)(ii) of the Criminal Code. A majority of the Court of Appeal allowed the appeal. Sections 742.1(c) and 742.1(e)(ii) were found to infringe both ss. 7 and 15(1) of the Charter, and the infringement could not be justified under s. 1. The majority held that the appropriate sentence would have been a conditional sentence of 24 months less one day, but as the custodial sentence had already been completed, a sentence of time served was substituted. Miller J.A., dissenting, would have dismissed the appeal and upheld the sentence of imprisonment. For the past 27 days, Southeast Side residents have been on a hunger strike to demand the City of Chicago deny the final permit for an environmentally destructive recycling plant owned by General Iron. The hunger strikers are denouncing environmentally racist policies that continue to allow polluting industry to accumulate in Chicago's communities of color. The city has lacked transparency, participation and fairness in its permitting process for the proposed relocation of General Iron. The hunger strikers say they are willing to risk their well-being during a global pandemic to put an end to racist zoning policies that have continued for decades. The proposed site for the massive industrial metal shredder would be next to residential areas, schools, parks, and the Calumet River. Existing pollution threats continue to burden the Southeast Side and residents have continued to express serious concerns about the rushed permitting process that has shut out community feedback. Thank you for joining us for our 2nd Cabral HouseCall of the weekend! I’m looking forward to sharing with you some of our community’s questions that have come in over the past few weeks… Let’s get started! Courtnie: Hi my name is Courtnie and I was just wondering if there was any other detoxes you could recommend to me? I’m having a problem with my bloating and I would love more than anything to do your detox but unfortunately I just can not afford it anytime soon. So if there are any cheaper brands that could help me in the mean time, I would really appreciate any suggestions you may have! Thank you guys so much for your help and all of your hard work! Maya: Hi Dr. Cabral, I love your podcast, and value your opinion and expertise very much. I was wondering what your thoughts are on gluten.. is it good or bad for our (gut) health? I’ve read so many conflicting studies and articles, and I just don’t know what to believe. I would love to know your thoughts. Thanks so much for all you do! Ameliah:  Dr. Cabral I need help. I found you through the elite man podcast my significant other listens to. I love your podcast and I see a naturopathic doctor where I live. My health has been in a really bad place the past 2 years or so. This time last year I went to my Pcp for chronic chest pain and she told me it was my stomach. I tested positive for h. Pylori. Did a strict 2 week regimen of antibiotics twice a day and an ulcer preventive. Went back tested again it was negative. About a week later I woke up with the worst stomach ache of my life and chest was burning so I went back and they put me on a PPI. I took it everyday for 10 months. Knowing I didn't want to be on medicine I tried coming off by myself several times over the course of the 10 months. The Pcp had no intention of helping me get off the meds and actually increased my dosage after 6 months because I went back with the complaint of something feeling stuck in my throat. She diagnosed me with globous sensation and ordered me to get scoped by a GI. I was really scared and have been suffering panic attacks during this entire process and didn't want to see the GI. So the Pcp wouldn't refill my prescription for the PPI and actually dismissed me from the practice. That's when I found the naturopathic doctor this past December and followed her protocol for getting off PPIs. Since I went cold turkey off them I suffered intense symptoms that mainly resided in my throat. My throat felt so strained and made it hard to swallow. I lost 7lbs in 5 weeks from not being able to eat without discomfort. The naturopath put me on zinc carnosine and panplex 2 which has helped a lot. But since December she's only did Amma therapy and ordered a blood test. Her suspicion is leaky gut. But she seems extremely puzzled by my throat. I've eliminated all gluten and dairy the past 6 weeks as doing elimination diets I'm sure I'm sensitive too. I haven't ate meat for almost 2 years . My stomach doesn't hurt I pass normal bowel movements everyday that are very clean. My lymph nodes under my chin constantly feel swollen. My extremities tingle I'm always fatigued. My heart beat accelerates from walking so I haven't been able to work out for months which was a big part of my daily life. I feel lost, hopeless, and desperate. I'm a mother to a beautiful 4 year old and I can barely get through my days for myself. All I drink is tea, water, and fresh juices. I live off fruits vegetables and grains. I don't understand why I'm not healthy I'm 28 years old. Please help me. Shawnna: I have been dealing with chronic yeast infections for over 8 yrs. I've tried to get rid of them myself, and many times I've broke down and taken fungal medications, only for it to return within 2 months. I have also been diagnosed with seborreheic dermatitis, which is frustrating by itself. I heard your podcast #725 on Candida overgrowth.. I loved it! I'm hoping I will finally be able to get rid of the yeast problems I have been dealing with and feel normal again. Can I go ahead and order the protocol without getting the organic acids test? Christina: Dear Dr. Cabral, I live in Germany and I am a really big fan of yours, I listen to your podcast religiously. On episode 730 you answered a question that 1 to 1 translates to my situation. I was on a detox diet for 4 months and I haven't had a migraine ever since. I used to have them every week. My ND had me test everything except for adrenal hormones. During the diet I developed dry skin and and dry eye symptoms and it hasn't gotten better. I looked up fat absorption issues and I definitely have those so i am going to get an enzyme. If I do have adrenal fatigue what would I need to do to get better? Thanks a million! Dan: Hi Dr. Cabral, Thank you so much for all that you do. You are truly changing the world. I am a 27-year-old male and former collegiate wrestler. I have recently become hypothyroid and have extremely low Testosterone. I have been working with a functional medicine doctor who has tested my blood for all deficiencies related to thyroid (Vitamin D, Selenium, Zinc etc.). I also had a CDSA 2.0 stool test, SIBO saliva test, and food sensitivities test. I am still waiting for my adrenal test results. Everything has come back completely normal except that I was slightly low on vitamin D so I immediately began supplementing. I also take a comprehensive multivitamin, fish oil, and curcumin. I have not done any type of hormone therapy yet and I would really like to avoid it if possible. I am desperate to find the root cause and I'm not sure what to do next. Please help. Thank you so much! Mary: Hi Dr Cabral! About 4 years ago, I under went bariatric surgery. The procedure was successful and I lost 180 pounds. I plateaued about a year and a a half ago and have maintained my current weight of 180 lbs. As a result of the procedure, I have some quite a lot of excess skin. I've started the process of looking into plastic surgery to remove the skin. The procedure is costly and the doctors have advised me to be at a weight I am happy with before going through it. I wondering if there is way to know what an ideal weight would be for myself. I've always had a goal of being 160-150 lbs in mind but assumed due to the excess weight to my skin I may not be able to achieve that number unless its removed. Is there a way to figure out what an ideal weight would be for myself before I under go plastic surgery? And if so, which one of you test would you recommend running for me to jump start the process of trying to loose what I need to hit that number. I am 30 year old female, 5'7' and 180 lbs. I would consider myself pretty active. I walk 4 miles a day. I strength train three time a week and focus on cardio 2 times a week. I still monitor and mindful of my eating habits. Thank you in advance!   Thank you for tuning into this weekend’s Cabral HouseCalls and be sure to check back tomorrow for our Mindset & Motivation Monday show to get your week started off right! - - - Show Notes & Resources: http://StephenCabral.com/800 - - - Get Your Question Answered: http://StephenCabral.com/askcabral
