IEEPA tariffs are found Unconstitutional, Learning Resources, Inc. v. Trump (2026).Today, Feb 20, 2026, the U.S. Supreme Court ruled in two combined cases that the International Emergency Economic Powers Act (IEEPA) does not give the President the power to impose tariffs on imports. This decision stopped tariffs set by President Trump to fight drug trafficking and trade deficits.Soon after becoming president, Trump declared national emergencies under IEEPA. He cited two big threats: Drug influx & Trade deficits.Businesses and states sued, saying IEEPA doesn't allow tariffs. One case started in a D.C. district court, which blocked the tariffs temporarily. The other went to the Court of International Trade (CIT) and was upheld by the Federal Circuit appeals court. They said IEEPA's words about "regulating importation" don't cover unlimited tariffs. The Constitution gives Congress, not the President, the power to set taxes and duties, including tariffs (Article I, Section 8). The Framers wanted Congress to control "the pockets of the people." Presidents have no natural right to impose tariffs in peacetime. The government argued IEEPA lets the President "regulate... importation," which they said includes tariffs of any size, length, or scope. But the Court disagreed, using these key points:Major Questions Doctrine: The Court is wary of laws that vaguely give away huge powers. Tariffs affect the economy massively, trillions in trade and billions in revenue. Congress wouldn't hide such a big handover in unclear words. In 50 years of IEEPA, no president had used it for tariffs. Past laws delegating tariff power were always clear and limited. This claim was too extreme, especially for the "power of the purse."Word Meanings in IEEPA: The law lists powers like "investigate, block, regulate, direct, nullify" imports or exports. It doesn't mention tariffs or duties. "Regulate" usually means to control or restrict, not to tax. Taxes are separate, Congress always says so explicitly when giving tax powers. If "regulate" included taxes, it might violate the Constitution's ban on export taxes. The other words in the list are about sanctions or controls, not raising money.No Exceptions: Even in emergencies or foreign affairs, Congress must clearly say if it's giving away tariff power. Tariffs aren't just regulation; they're taxes with big economic and political effects.The Court vacated (canceled) the D.C. case for jurisdictional reasons and affirmed (upheld) the Federal Circuit's ruling. IEEPA can't be used for tariffs. This protects Congress's role in trade policy.The opinion was written by Chief Justice Roberts, with parts joined by Justices Gorsuch and Barrett. In a big Supreme Court showdown over trucking accidents, major business groups have filed a friend-of-the-court brief supporting freight brokers. The case, Shawn Montgomery v. Caribe Transport II, LLC, et al., stems from a 2018 crash where a trucker hired through broker C.H. Robinson hit Montgomery's car, causing injuries. Montgomery sued the broker for negligent hiring, claiming CH picked an unsafe carrier. The Seventh Circuit Court said federal law blocks such state lawsuits against brokers. Since taking office in January, President Trump has leaned heavily on tariffs to address trade deficits & drug trafficking, invoking IEEPA — a 1977 law granting presidents emergency economic powers — to bypass Congress. The Worldwide and Retaliatory Tariffs, rolled out via Executive Order 14257 in April, imposed a 10% duty on all imports, with higher rates (up to 50%) targeting 25 countries, including a tit-for-tat escalation with China peaking at 125% & continue to be a moving target. These tariffs disrupted supply chains, jacked up costs for importers, & sparked fears of retaliatory trade barriers. V.O.S. Selections, a group of small businesses, & a coalition of 12 states led by Oregon, argued the tariffs were an illegal power grab, violating IEEPA's limits & Congress' exclusive authority over commerce under Article I of the Constitution. The CIT agreed, handing plaintiffs a clean sweep on summary judgment.Now on appeal before the Court of Appeals for the Federal Circuit, oral argument took place on July 31st, 2025. Total Quality Logistics (TQL), the nation's second-largest freight broker, is under fire in a new federal lawsuit filed on Feb. 25 in the U.S. District Court for the District of Columbia.Pink Cheetah Express LLC, a small Kissimmee, Florida-based motor carrier, alleges that TQL has flouted a 2023 Department of Transportation order mandating compliance with federal broker transparency rules. The suit, which seeks declaratory and injunctive relief, reignites a long-simmering debate over rate transparency in the trucking industry – just as freight markets brace for new tariffs.The complaint centers on TQL's alleged refusal to provide Pink Cheetah with transactional records for 15 loads hauled over the past three years, despite a Nov. 30, 2023, order from the Federal Motor Carrier Safety Administration. That order, issued after an investigation sparked by Pink Cheetah's 2023 complaint, directed TQL to ditch contract language waiving carriers' rights under 49 CFR 371.3 – a regulation guaranteeing carriers access to broker records – and to comply with future transparency requests. Pink Cheetah claims TQL has done neither, accusing the Cincinnati-based brokerage of “arrogantly” acting “above the law.”What does TQL say? If you're following the tariff discussion, you better understand IEEPA. This post aims to make sense of IEEPA, which is a US federal law enacted in October of 1977, & signed by President Jimmy Carter in December of 1977. It grants the President broad authority to regulate international commerce & economic transactions during a declared national emergency.Let me be clear, this is not intended as a pro or anti Trump post. This is simply how I answer a question I have been getting a lot lately: "How can Trump unilaterally implement tariffs absent congressional advice & consent?"As a refresher, the American constitution established three co-equal branches of government: legislative, judiciary, & executive. This separation of powers was a critical concept to the framers. Having lived under them, many framers feared autocrats & believed that this balancing act among the branches would prevent the rise of autocracy. But power accretes more power. And once gained that power is difficult to relinquish. In an emergency, the President gains enormous power, like going Super Saiyan. And you want that. If there is a hurricane or an earthquake, you want the President to act. But what is an emergency & who declares it such? Why the President, of course!Since the founding of our republic, the executive branch has gained enormous power. Democrats & Republicans alike have pushed the envelop ever further with each party greedily waiting to take the reins back. In my opinion, our executive branch has never been more powerful than it is today. We live in a time of perpetual emergency in order to circumvent the switch breakers the framers installed. MyCarrier began a fight with project44 that they could never win. In a closely watched dispute over API services in the logistics industry, the Delaware Court of Chancery has found that MyCarrier likely did breach its contract with project44 both by "building behind" project44 as well as transitioning to an alternative provider, SMC3. Despite the likely breach, the Court determined that project44 failed to show irreparable harm, a key requirement for injunctive relief & denied project44's motion for a preliminary injunction against MyCarrier.

GlobalTranz is accused of misrepresenting transportation costs to business development companies (BDCs), which caused them to lose out on their portion of gross margin splits, the commission payments they were contractually entitled to. These costs included fuel surcharges, cargo insurance, & bad debt reserves. A little bit of extra "juice" for the bottom line. This discrepancy was allegedly brought up to the powers that be. Then things got wild.Freight Essentials' largest customers were allegedly poached by Worldwide Express through an extension of a credit of over $1.5 million to one client & credits of $100,000.00 to another.
