This episode is dedicated to Dr. Fethke's father, Walter P. Fethke, in remembrance of the honorable struggle he underwent along with his loving family in the last years and days of his remarkable life.In Episode 30 of The Pursuit of Health Podcast, our host, Dr. Fethke, once again reaches across artificial boundaries to a colleague in the legal profession. His guest, Louis Pierro is an esteemed lawyer based in New York State with over 40 years experience in the field of Elder Law.  After attending college at Lehigh University and obtaining his law degree at Albany Law School, Mr. Pierro went on to become one of the pioneers in the field of Elder Law.  He shares his own personal motivations for shifting his focus from the court rooms to working with people to help make their lives better. With his colleagues, he founded Pierro, Connnor & Strauss, a law firm dedicated to estate planning and elder law. Over the years his team has extended their services beyond the New York Capital region to now encompass New York City, Florida, New Jersey and Massachusetts. Along the way he has joined policymakers and other stakeholders in addressing the issues of aging that have overwhelmed our nation and that we all will inevitably face. This has included his founding the Elder Counsel, a national membership organization of Elder Law and Special Needs law firms that supports the efforts of over 1400 firms amongst all 50 states. He also founded ApolloCare, LLC, a business venture that combines home-based Elder Care (EverHome Care Advisors) with high technology centered in peoples' homes (VivaLynx). During this episode, beginning with the mission set by President Lyndon B. Johnson in 1965, Mr. Pierro takes us through the history of America's struggle to provide humane and high quality care services for our senior citizens. He takes us through the many forms that this journey has assumed including a clear explanation of nursing home, assisted living and home-based care models. He pulls no punches in identifying the past and current hurdles that have hindered America's progress and left us with an overwhelmingly complex and often daunting  system to deal with the ever increasing issues facing a growing population of elderly.Despite the challenges, we are so fortunate that Mr. Pierro and his colleagues continue to fight the good fight and take an offensive approach to addressing Aging in America. Through regular education, advocacy and creative business models, they have clearly begun to break through the dark clouds and let some much needed light into this vital issue that involves us all. He stresses that the task at hand is too complex and important for any one profession to deal with. Any effective effort must be a team approach with the patient truly at the center and caretakers, including, but not exclusively involving, the physicians. He adds, “Hopefully, one household at a time, we will build a consensus that will change and improve the way we care for each other as we get older.”We look forward to your feedback and comments regarding this and any other episodes of The Pursuit of Health Podcast.  We look forward to inviting back guests such as Mr. Pierro to keep up with his progress. The experience of working with the families and seeing the challenges presented in trying to care for a loved one inspired her to focus on Elder Law and related practice areas. “Caring for a loved one during an illness can be such a stressful time for everyone involved, and each individual handles that stress in a different way,” says Deanna. “The fact that I can be there for families during times like these, and provide sound legal counsel about how to pay for and provide the necessary care, is what motivates me every day. I take great satisfaction in helping families address their legal needs, so they can focus their energies on spending time with their loved ones.” As an attorney, Deanna has helped hundreds of families with all levels of planning. She assists families interested in planning in advance for the possibility of incapacity and the need for long-term care. She also helps families in crisis situations—when they have been told that a loved one must enter a nursing home soon or has already been placed in one, and they need to obtain assistance from Medicaid quickly. Deanna and her husband, Brandon, have been married since April 2001. They have two wonderful boys. Deanna was born on Long Island and now lives in Kings Park. Deanna enjoys baking and spending time with her family.

Drafting a Special Needs Trust is only the foundation of sound planning. On that foundation are additional documents and steps to take. In this episode we discuss two. First, the memorandum of intent which gives direction on wishes and day to day care.  This episode covers what to put in the memo of intent, ensuring it is easy to find, being bold yet discreet in wishes that others may not like, and why you should not store it in your safe at home. The second consideration discussed is the importance of funding the trust via retitling to avoid probate. How can you become one?Partial Transcript:- All right, welcome back to another one of our Expert Interview sessions with Bambiz. Today we've got Greg McIntyre of McIntyre Elder Law. He's got a couple of different locations in the Charlotte, North Carolina area. Welcome to the Expert Interview, Greg.- Charlotte metro area, I'm metro, let's go. Thanks, man, I appreciate that.- Awesome. Well, give us a little bit of an overview of your practice.- I'm an Elder Law attorney with McIntyre Elder Law and I'm one of our attorneys. Our practice has multiple offices in the Charlotte metro area and we're very big into elder counsel, love elder counsel. I'm a huge believer in systems and processes and being able to provide next level services. What does that mean? I mean really great services, fix any problems, provide great Estate Planning and Elder Law services to our clients in a timely manner. Companies like Krause Financial, Elder Counsel, Bambiz Marketing help us put in place systems because I'm one guy. I am one person with like, maybe, so much time at work. I was going to say eight hours in a day but that's a joke. With 12-13 hours in a workday, no, with 24 hours a day, right, and I've got sleep eight of them, spending a little, some time with my family, and not feel too guilty that I'm neglecting my kids, my wife, too much. Then it goes back and forth. Or not feel guilty that I'm neglecting my practice too much. So that's always the juggle and the struggle but with our Elder Law practice, we have, Elder Law to me, we have three departments. We have Estate Planning, which I call pre-planning, because with Elder Law, you're always looking at the long-term care piece and that's a big issue. A little different from traditional Estate Planning with someone in their 30s, early 40s, with two kids. That's the easy stuff. Then there's probate, which is when someone passes away. It's probably our busiest department, even though we tell people how to avoid probate all the time they don't listen. So we continue to service them and we want to do that, provide great services there when they're in need. We also do probate litigation in that department and guardianships in that department. I like to get in court and do those things, our attorneys do, we have attorneys who go to court and do those. Then we have Medicaid crisis planning and veterans benefits planning, which is a really, really, I think that's where we have the most fun, which is planning to save assets that maybe other attorneys and street lawyers they talk to, their friends tell them, social workers tell them, you just have to spend every dime that you've ever earned down on care. There's many, many other ways to go with it. I thoroughly enjoy what I do, I love it, it's my passion and I hope it shows.- Yeah. Well, one of the things that I remember you telling me, we actually met together at one of, a business growth conference at the beginning of the year and you were kind of telling me your story about how you kind of got into practicing law. If you could, just briefly kind of give us the short version of that because it's a pretty good story.- Yeah, so, I mean, it's the cheesiest story ever, man. I mean, literally...For the entire transcript visit: lawyergreg.com

On today's episode, John talks Holland McBurns of Evergreen Elder Law about how they help seniors, veteran's and their surviving spouses for long-term care without going broke. Holland and her collegues emphasize protecting assets of their clients while qualifying for Medicaid or Veteran's benefits. She also shared their goal to help seniors put a flexible, thoughtful plan in place that protects as much of their estate as possible. They always knew that seniors worked hard to build up their estate and understand how hard it is to just let it go to pay for long-term care. Evergreen Elder Law's team is dedicated to these particular issues affecting seniors and senior veteran's. Attorney Holland McBurns began her career in law to give back to her community and help those in need. She grew up in Spokane, earned a BA, Cum Laude, in Women's Issues from the University of Washington, and a Juris Doctorate, Cum Laude, from Gonzaga School of Law. With her husband, she is now raising three girls in Spokane, along with their two dogs, and three chickens. Holland opened her firm in 2000 with the goal of providing clients exceptional services using a holistic and team centered approach. She and the staff at Evergreen Elder Law provide pre-planning and crisis planning for Medicaid and long-term care, special needs planning, estate planning, estate administration, and guardianships. To give back to her community and help people better understand their options, she has authored a book on elder law and estate planning in Washington State. She plans to disseminate them free to the elderly community in the hopes that they will help people as they consider their long-term care and estate planning goals. Holland has earned many awards for her exceptional work in the Spokane area including the 2017 Top Lawyers featured in Spokane Coeur d' Alene Living, the 2016-2017 10 Best Attorneys by American Institute of Legal Counsel, the 2016 Client Satisfaction Award from The American Institute of Legal Counsel, and the 2004, VLP award for legal representation of indigent clients.
