The general election campaign for President is officially underway... Scranton Joe delivers a take-no-prisoners State of the Union that leaves his supporters ecstatic and Republicans sputtering. Spoiler alert: the 2024 Campaign theme is a sequel movie “This Country for Old Men” Super Tuesday was a good day for former athletes who want to be Senators: one-time NFL star Colin Allred wins the Democratic nomination to run against Ted Cruz; in California, Michigan State University alum and All-Star baseball player Steve Garvey survives the jungle primary, setting him up to lose to Congressman Adam Schiff. And it was a great day for Jason Palmer who, just like Mike Bloomberg in 2020, swept to victory in the American Samoa caucus. The Supreme Court effectively decides the 14th amendment prohibiting insurrectionists from seeking federal office is just a suggestion. More turmoil at Michigan State University: as a new president takes over in East Lansing, two trustees face the possibility of being fired and a third could be censured — the aftermath of the firing of football coach Mel Tucker. Our guest this week is University of Michigan professor, former U.S. Attorney and MSNBC contributor Barbara McQuade discussing her new book which amplifies the alarm about the role of misinformation in the 2024 campaign as well as the Supreme Court's ruling in the Trump ballot access case. McQuade served as the United States Attorney for the Eastern District of Michigan from 2010 to 2017. As part of President Donald Trump's 2017 dismissal of U.S. attorneys, she stepped down in March 2017. She is a professor of law at the University of Michigan Law School, the author of "Attack from Within" and a legal analyst for NBC News and MSNBC. Before joining the U.S. Attorney's office, McQuade practiced law at the firm of Butzel Long in Detroit and served as a law clerk for Hon. Bernard A. Friedman on the U.S. District Court for the Eastern District of Michigan. McQuade started her career as an assistant U.S. Attorney in the Eastern District of Michigan from 1998 until becoming U.S. Attorney in that same district. She was also a professor of law at University of Detroit Mercy School of Law from 2003 to 2009. McQuade was appointed by President Barack Obama and started her term as U.S. Attorney on January 4, 2010. Upon taking office in January 2010, During her tenure as U.S. Attorney, the office reached convictions in several high-profile cases, including the case of former Detroit Mayor Kwame Kilpatrick on public corruption charges; the conviction and life sentence of Umar Farouk Abdulmutallab, the would-be al-Qaeda shoe-bomber behind the 2009 Christmas Day bomb plot to destroy an airplane in flight from the Netherlands to Detroit Metropolitan Wayne County Airport; the conviction of former Michigan Supreme Court justice Diane Hathaway on bank fraud charges; and the convictions of former employees for stealing trade secrets from Detroit automakers. In 2017, McQuade became a regular contributor to MSNBC, initially commenting primarily on purported scandals related to President Donald Trump, though the range of topics she analyzes has become broader over time. Since 2021, she also co-hosts the #SistersInLaw podcast with Jill Wine-Banks, Joyce Vance and Kimberly Atkins Stohr. McQuade was born in Detroit. She received her undergraduate degree in 1987 from the University of Michigan and her J.D. in 1991 from the University of Michigan Law School. Like many others, Jon Kung figured law school would be a safe harbor to weather the storms of the Great Recession. But after emerging from the University of Detroit Mercy School of Law in 2011, Kung changed course.Kung, who is non-binary, says the realization the practice of law was not for them hit after they helped the local prosecutor's office achieve a conviction in a murder trial. They received a full-time job offer with that office, but decided to turn down the job offer and look for other work. Over the next several years, they established themselves in the Detroit culinary scene, hosting secret pop-up dinners and dumpling classes, and honing their take on “Third Culture cuisine.” Kung was born in Los Angeles, and spent their childhood in Hong Kong and Toronto before landing in Michigan for college and law school. Their recipes combine elements of Chinese and North American cuisines and cooking techniques. “This new fusion that I'm referring to as ‘third culture' takes a more thoughtful approach to the genre,” Kung writes in the introduction to their new cookbook, Kung Food: Chinese American Recipes from a Third-Culture Kitchen. “Third culture embraces each side as equal, drawing from a lived experience that is immersed in both or multiple cultrues, once again taking the mentality of the American culinary renaissance that came around in the 2010s and granting the rest of us the ability to take part in it.” In this episode of the Modern Law Library, Kung discusses their new cookbook with the ABA Journal's Lee Rawles—who made the Beef & Broccoli Potpie, the Shrimp Paste Dumplings and the Parmesan-Curry Egg Fried Rice from the book—and shares their favorite meal tips for starving law school students. Kung also shares how they went from word-of-mouth pop-ups to social media fame. In 2020, when the pandemic made their pop-up meals impossible and the murder of George Floyd prompted massive protests in their home state, Kung began using their TikTok account @jonkung as a place to find community and share recipes. They quickly began gaining followers, and started being approached to partner with brands on projects like developing recipes based on anime series. Kung shares the story of how they were offered the publishing deal for Kung Food, and what it's like to be a social media influencer.

We are celebrating our Birthday in a BIG way. Tonight, we are sharing an interview we had with newly appointed Michigan Supreme Court Justice Kyra Harris-Bolden. Justice Kyra Harris Bolden joined the Michigan Supreme Court on January 1, 2023, when she was appointed by Gov. Gretchen Whitmer, making her the first Black woman to serve as a Justice. A graduate of Southfield Public Schools, Justice Bolden received her bachelor's degree from Grand Valley State University and Juris Doctor degree from the University of Detroit Mercy School of Law. While serving as a state representative in the Michigan House of Representatives, Bolden advocated for Michiganders as a member of the Judiciary Committee and focused her work on criminal justice reform, crafting and passing bipartisan legislation to protect survivors of sexual violence. In her interview she shares contemplating a run for Michigan Supreme Court Justice after being asked by retiring Congresswoman Brenda Lawrence. Justice Bolden initially rejected the idea. But gave it some thought after becoming pregnant with her first child. What made her decide to go for it was always wanting her daughter grow up knowing that there as a Black Woman on the Michigan Supreme Court. And, now she has made this new reality a bit more personal; a new mother, becoming the first Black Woman ever to hold a sit on Michigan's highest court. This is an exciting an historic interview that we can't wait to share. PLUS, as we put a bow on "Women's History Month" we have a very special Thought of the Week that's entitled, "A Revelation Worth Sharing" that we believe is not just for women but is for all of us. It originates from the age old missed understanding of the most celebrated and most misunderstood women in history - Mary the Mother of Jesus. It is definitely a revelation worth sharing. We hope you get a chance to share in our special Birthday Edition of the podcast and do us a favor as our birthday wish, share this podcast episode with as many people as you can. The criminal system in Maricopa County, Arizona is missing the Justice. It's the fourth largest county in the nation, and the eighth largest incarcerator IN THE WORLD. The County Attorney's office has been infamous for decades for overcharging, systemic bias, and flat-out corruption. Helping us get Set For Sentencing this week is Julie Gunnigle. She's a democrat running for County Attorney as a common-sense reformer. She is fearless in her assertion that she will never prosecute women or their doctors for abortion. Her opponent would enforce "trigger" laws on the books from the civil war era. She promises to increase diversion programs, regulate overcharging, give line prosecutors more discretion to do justice, and make other needed reforms to reduce mass incarceration in AZ. IN THIS EPISODE: Changing the culture of the historically corrupt, ethically challenged, Office of the Maricopa County Attorney; Giving discretion back to line attorneys to fulfill their obligation to do justice; Fixing the fact that Maricopa County is the 8th largest incarcerator in the world; Proven, data-driven, approaches to reduce mass-incarceration at low, or no cost to taxpayers; Reigning in the (over) charging power of the prosecutor that dates back at least to the time of Rick Romley (including the story of how Rick Romley tried to send a sixteen year old boy to adult prison for 30 years for pointing an unloaded gun at neighborhood bullies); Instituting new policies that would restrict a prosecutor's ability to alleged draconian enhancements that result in long, mandatory prison terms; The importance of clearing the backlog of marijuana expungements by making expungement universal & automatic; Combatting disparate racial outcomes in Maricopa County; Goals for meaningful police reform; Promoting diversity within the office, which is currently seriously lacking. LINKS: For a deeper dive into systemic racism, click here to listen to last week's incredible talk with Jelani Jefferson-Exum, Dean of the Detroit Mercy School of Law. We talked about a terrible example from the Rick Romley era of gross overcharging of an early client of mine, Jefferson Stackhouse, a 16-year-old boy who pointed an unloaded, antique, shotgun at some neighborhood bullies. They charged Jeff as an adult and tried to put him in prison for decades. It was a sickening example of the unfettered charging power and inhumane treatment that is still commonplace for this office. Talking to Julie Gunnigle brought back a flood of bad memories about this historically horrible office: Click here to watch a riveting 60 Minutes story about Jeff's case. Click here to read, "The Maximum Security Adolescent" a NYT Sunday Magazine article about Jeff's case. A great example of a County Attorney model that involves transparency around racial disparties and data-driven reform, from, as always, BERMAN'S SENTENCING BLOG!
Black Americans and other minorities are disproportionally represented in the numbers of those charged, the kinds of charges they face, and the length of sentences imposed. The question is WHY? The answer is far from simple, but it's one that everyone needs to better understand. Helping us get Set for Sentencing, Dean of the Detroit Mercy School of Law, Jelani Jefferson-Exum. Dean Jefferson-Exum focuses her research, writing, and teaching on sentencing and systemic racism. She is dedicated to introducing new ways to think about the goals of punishment in order to alleviate the consequences of built-in bias in our American system of justice. IN THIS EPISODE: What we really mean when we talk about systemic racism; How the undeniably racist origins of policing render African Americans “presumed punishable”; The important difference between crime “bolstering” vs. crime “revealing” statistics; Empathy and connection as a first step towards antiracism; The opioid crisis and the “de-otherization” of drug addiction; Taking control of the “defund the police” narrative; Some examples of putting antiracism into practice at sentencing; Practical takeaways from Dean Jefferson-Exum's research interviewing judges about what influences their sentencing decisions; How Dean Jefferson-Exum can serve as an expert at sentencing to put guidelines and other issues in the proper context. Today's show rundown: Chuck starts us out asking did the Mar-a-Lago raid take place with Trump NOT in Florida on purpose. With his Secret Service members that are with him, would the FBI still have gone in and snatched some stuff out? We hope The American people have had enough of this, it has just gone too darn far. Chuck wants to throw his shoe at the TV when we keep hearing the Left say they are "protecting Democracy" while weaponizing wings of the government. Mark welcomes in our guest Matthew DePerno - who is running for Attorney General in the state of Michigan. He is running against another George Soros employees named Dana Nessel. Nessel is using everything in her power to go after her opponent - by using the LAW. She is calling for a special prosecutor to investigate him and try to get him arrested and taken out of the race. Matthew starts off and tells us about him and how his sitting opponent is trying to go after him legally instead of the voting booth. Companies are leaving Michigan including auto because they are saying the government is broken and can be weaponized against people. After Dana Nessel leaked confidential documents to the news, she's been conducting this investigation using taxpayer funds that will benefit her campaign. She has been shopping this case to friendly prosecutors in Oakland County. She is trying AGAIN to weaponize her office and position. She will not back down, even at the discouragement of people around her. Tamer attended Detroit County Day School before attending the University of Michigan and the Stephen M. Ross School of Business. He also received a Doctor of Law degree from the University of Detroit Mercy School of Law.The history of how Big Boy was founded is as follows. In 1936, Bob Wian sold his prized DeSoto Roadster to purchase a hamburger stand in Glendale, California. He named it Bob's Pantry. Six months later, Bob sliced a bun into three slices, added two hamburger patties and, voilà, the very first double-decker burger was born!Customers couldn't get enough of Bob's new creation. One fan, in particular, a chubby six-year-old boy named Richard Woodruff, loved the double-decker. His devotion inspired Bob to name the new burger Big Boy® after his nickname for Richard. The Big Boy® burger craze that ensued prompted Bob to change the stand's name to Bob's Big Boy® and to introduce the now-iconic Big Boy® mascot.

Suchi Reddy is a poet of space. Long before I met Suchi, I fell in love with her work when I experienced the Connective Project in Prospect Park, Brooklyn, an installation of 7,000 glorious, yellow, flower-like pinwheels that filled me with happy. Years later when I met Suchi through our mutual friend, Stacy Fass, Suchi dropped the phrase form follows feeling into the conversation and right then and there I asked Suchi to be on the podcast. I needed to explore this idea and share it with you. Form follows feeling - a design ethos informed by neuroaesthetics (the study of how the brain responds to the design of our surroundings) - is the guiding design principle for Suchi and her firm, Reddymade Architecture and Design. This strong belief that good design, calibrated carefully to the human, positively influences wellbeing, creativity, and productivity informs all of Suchi's projects from conception to details. She believes in the power of joy and whimsy and making the invisible, visible. Suchi really made me think about my home space and my work space, and how important it is to ask myself how I want to feel in those places; that they are living and breathing, in order to support me every day. Suchi's curiosity and sense of possibility are inspiring as is her diverse range of work from the aforementioned Connective Project to Me + You, Suchi's interactive installation blending emotional AI, sculpture, physics, neuroscience and data technology at the Smithsonian, to the Google store in Manhattan to beautiful, serene residential spaces which I love to follow on her instagram. Suchi was appointed the Plym Distinguished Professor at the University of Illinois School of Architecture, Champaign–Urbana for the Fall 2019 semester, where her work focused on contemporary architectural experience through the lens of neuroaesthetics, neurophenomenology, and sensory design. She sits on the board of the Design Trust for Public Space, Storefront for Art and Architecture, and Madame Architect; and she is a member of the Dean's Board of Advisors at Detroit Mercy School of Architecture. Dr. McKinley’s daughter Brittany joined the practice in the summer of 2011, upon her completion of her dental degree from The University of Detroit, School of Dentistry. Dr. McKinley remains on the cutting edge of technology, striving to provide the highest quality of dental care available today. He is a member of the American Dental Association, the Michigan Dental Association, and the Macomb County Dental Society. He has also served as member of the Michigan Dental Association Peer Review Committee. This year, Dr. McKinley continued his 12 year tradition of teaching a class to a group of wonderful juniors and seniors at Lutheran High North called Business Character Values. Several of his staff members join him in teaching this class by mentoring a student. Born in Detroit, Ray is one of 12 children born to Dr. Otis and Phyllis McKinley, of Fraser. Ray, along with all of his brothers, followed in the footsteps of his father and became a dentist. Dr. McKinley’s daughter, Brittany, graduated from the University of Detroit Mercy School of Dentistry in 2011 and is now continuing the family tradition into the 3rd generation! The McKinley Family has provided dental care in Macomb County and throughout the State of Michigan for over 65 years. Ray is part of a family with a history of hard work, including building McKinley Airport in Fraser, learning to fly solo by age 16, the development of Pine Valley Golf Course in Romeo, past president of the Romeo Chamber of Commerce, former president of the Romeo Kiwanis Club, a delegate to Washington DC’s Conference for Small Business, and building numerous dental offices throughout Michigan. Ray continues to stay involved in growing and developing his community. Ray and his wife Lynn have six children, and five grandchildren. Ray has written the book, "Ride the Elephant". Ride the Elephant calls out the elephant in the room that holds you back, that has been hiding in plain sight, then challenges you with questions and answers you have never considered before. You will dive very deep, if you allow yourself to go that far, into why we act, think and behave as we do. You will likely see that today’s normal daily reactions are really creating a waterfall event with those around you. The interplay of so many feelings and reactions like hate, blame, excuses, accountability, judgment, fear, and pride are examined. You will begin to consider how this juxtaposition of emotions are creating havoc in your life – like “the elephant in the room.” https://raymckinley.com

Being Black Or Brown In The Green Rush With Ingrid Joiya-Warrick. Being Black Or Brown In The Green Rush is A practical guide for women and people of color to make money in the legal marijuana industry. Awarded the Authority in Aspiring Entrepreneurs award by New York Times bestselling authors, Jack Canfield and Raymond Aaron, Ingrid has been an entrepreneur for more than 30 years. Raised in Chicago, Ingrid was always quick to recognize untapped opportunities. She launched a luxury sugar-free chocolate company in the height of the decadent 80s and started a prepaid cellular company (before there was such a thing) in the late 90s. Ingrid later earned her law degree from the University of Detroit Mercy School of Law, receiving many awards while a law student. Ingrid relocated, with her teen daughter, to Arizona to join her family in the early 2000s. She enjoyed the fruits of the real estate market in 2006 and unfortunately experienced the bust in 2008. Ingrid became involved in the cannabis industry in its infancy in 2010. As this book outlines, she faced many of the trials and tribulations that are inherent in the industry, particularly as a woman of color, in a conservative state, whose politicians don't support any sensible drug reform, including cannabis legalization. At the time she started in the industry, Ingrid was one of the few minority women for several years. The award-winning author lives in Phoenix, Arizona, with her significant other, Eddy. She is currently focused on the Illinois market, working with women and people of color to get involved in the state's ground-breaking social equity program.

Drafting a Special Needs Trust is only the foundation of sound planning. On that foundation are additional documents and steps to take. In this episode we discuss two. First, the memorandum of intent which gives direction on wishes and day to day care. This episode covers what to put in the memo of intent, ensuring it is easy to find, being bold yet discreet in wishes that others may not like, and why you should not store it in your safe at home. The second consideration discussed is the importance of funding the trust via retitling to avoid probate. Former MSU great Blair White talks about earning his way on to Michigan State’s football team, becoming a star and then playing with Peyton Manning and the Indianapolis Colts before giving it all up to go back to school to become an orthodontist. Also: The Tinder Box, building fences, and DickPicks (Jay-Z cheated on Beyonce? WTF!) BLAIR WHITE Not highly recruited coming out of Saginaw, Michigan, Blair White went to Michigan State as a freshman in 2005 hoping for a spot on the football roster. He got one – listed 8th on the depth chart as a receiver. By his junior season he was a fulltime starter who became a star. His senior year, he was the Spartans leading receiver and tied for the Big Ten lead in touchdown catches. Undrafted out of college, the Indianapolis Colts signed White in 2010. That season, he caught his first pass in his first game for a touchdown from future Hall of Famer Peyton Manning. It would prove to be one of the highlights of a short career, as Blair suffered back injuries that forced him into retirement at age 25 during only his second season in the NFL. Undaunted, he returned to school to become a dentist and next month will graduate from University of Detroit Mercy School of Dentistry. Dr. Blair White will go back to school for two more years to become an orthodontist. There is no better example of perseverance and successfully reinventing oneself in the face of adversity. Blair shares some stories of playing with Manning - one of the all-time greats, the bitter rivalry between MSU and UM, playing for Coach Jim Caldwell (now head coach of the Detroit Lions), and finding out there’s more to life than football.
