This episode of the ABA-funded podcast, "Mind the Gap: Dialogs on Artificial Intelligence" was recorded at a Continuing Legal Education session. Our subject is, "The Intersection of Cybersecurity and Artificial Intelligence." Our two guests, Candace Jones and Jon Garon, are distinguished lawyers. Candace Jones retired recently from the Federal Reserve Bank of New York. Previously she was a partner at a large law firm in Cleveland and is a former Chair of the ABA Section of Business Law's Cyberspace Law Committee. She is now a member of the ABA Cybersecurity Legal Task Force. Jon Garon is Professor of Law, Nova Southeastern University Shepard Broad College of Law and is the current Chair of the ABA Section of Business Law's Cyberspace Law Committee. Both Candace and Jon have written extensively on artificial intelligence and cybersecurity. We learn more about the MVLP from their Executive Director and General Counsel, Gayla Carpenter-Sanders.If you need a little bit of help with a legal matter that can be handled without an attorney, you might want to attend one of the Mississippi Volunteer Lawyers Projects Self Representation Clinics. There are clinics that discuss: Irreconcilable Differences Divorces, Uncontested Guardianships, Advance Healthcare Directives, Power of Attorneys, Simple Wills, Misdemeanor Expungements, Felony Expungements, and Foreclosure Prevention.The Mississippi Volunteer Lawyers Project has many opportunities for attorneys, law students, college students and paralegals with a willingness to serve. The baby turned blue after receiving an IV for an outpatient renal scan and was without oxygen for 12 minutes because nuclear medicine technicians neglected to immediately issue a "code blue" or to begin administering chest compressions. Despite the defense's attempts to convince the jury that the incident occurred due to pre-existing conditions, an Oakland County, Michigan jury returned a landmark $130.5 million verdict.   Guest Bio: Brian McKeen Brian McKeen began practicing law in 1982. During his career, he has become a powerful advocate for his clients and one of the foremost medical malpractice attorneys in Michigan. He has tried cases throughout the United States. He currently sits on the executive boards of the Michigan Association for Justice (MAJ) and the American Association for Justice (AAJ). Mr. McKeen formerly served as chair of the AAJ Professional Negligence Section, Medical Negligence Exchange Group, and Birth Trauma Litigation Group (BTLG). Since 2001, McKeen & Associates has generated the year's top verdict in Michigan four times, including securing the state's largest medical malpractice verdict on record in 2001, when a jury rendered a verdict award of $55 million in the case of Hall v Henry Ford Health System. Kroll is a founding partner at Kaveny + Kroll, a Chicago firm focused primarily on plaintiffs' tort litigation.  Jeff has been representing victims of negligence for over three decades and has taken cases to verdict throughout the country in the areas of trucking accidents, products liability, premises liability, medical malpractice and transportation negligence.   In 2017, Jeff was a major part of the trial team that won a record-breaking $148 million verdict on behalf of a dancer paralyzed by a collapsed shelter at O'Hare International Airport.  This is the highest compensatory damage award to an individual plaintiff in Illinois history.  Jeff regularly handles complex damage cases and has received multimillion dollar verdicts and settlements. Jeff obtained a $15.2 million verdict on behalf of a man who was seriously injured when he was struck and run over by a forklift at McCormick Place Convention Center in Chicago.  He obtained a $5.25 million dollar verdict in the first U.S. bike share death.   During his career, he has obtained verdicts or negotiated settlements on over 80 occasions where the results have exceeded $1 million, including six cases which have exceeded $10 million.  Jeff has obtained more than $430 million in verdicts and settlements throughout his career.  Jeff is also active in national bar associations where he routinely speaks and writes on several trial topics as part of his commitment to maintaining quality and professionalism in the legal community. He has been asked to lecture on over 160 occasions and has published over 139 articles for lawyers. We have the amazing privilege to have Chris Marohn on this episode where he shares a valuable story from early in his career to remind us to surround ourselves with smart people who are willing to disagree with us. Chris illustrates the value of meeting people where they are while taking the time to communicate to people that they are important and that their voices are heard. He advocates for mental health awareness and reminds us that there is a lot of work trauma in many of our past experiences. He shares that we aren't the person that can reach everyone, but we can show them enough love to get them moving in a positive direction. We don't have to do things the way they have always been done and we need to work harder to recognize our own implicit biases. Many don't want to face or even overcome their biases because it would force them to change or leave their comfort zone. We can lead others even those we don't have authority over by showing interest in them and by asking for their sincere help because people want to feel needed and connected and that is why we need to take the time to get to know them and pay attention to the members on our teams so we can help offer them right opportunities to grow at the most opportune time.    Chris started his career in politics. He was encouraged by all those around him to get involved and make the changes he wanted to see in the world. During his high school and undergraduate years, he worked with various political and policy organizations to help farmworkers in the Sacramento Valley. He continued his passion for elimination of bias and anti-racism during his time working at various levels of political campaigning and government. He has served in posts from Washington DC to local city government in the pursuit of equity under the law.   Currently, Chris is working with The Sandra Day O'Connor College of Law as the Director of Employer Relations in the Office of Career and Employment Services. Previously, he was the Director of the Continuing Legal Education program at ASU Law. In his current role, Chris, is responsible for Diversity Summer Clerkship hiring and advising. He meets with students of diverse backgrounds encouraging and mentoring them into achieving their legal career goals, while trying to diversify the legal profession. Chris has recently been tasked with overseeing the pipeline to law school program with Phoenix Unified School District, with the focus of helping underserved communities get the tools needed to be successful in law school.   Chris graduated in 2012 from Monterey College of Law in Monterey, California. THE HONORABLE MARK POWELLLACKAWANNA COUNTY DISTRICT ATTORNEYMark Powell, District Attorney of Lackawanna County, has made combating the opioid crisis a top priority of his administration. He is the co-chair of the Lackawanna Recovery Coalition, which works to reduce opioid overdose deaths in Lackawanna County by connecting people with substance use disorder to treatment, implementing lifesaving harm-reduction strategies, advocating for long-term recovery, and working to reduce stigma surrounding the disease of addiction.   In October 2019, District Attorney Powell established an Overdose Fatality Review Team to study overdose deaths in Lackawanna County to determine the root causes of addiction-related deaths and implement evidence-based solutions. DA Powell also initiated a Fresh Start Program for lower-level drug offenders to supplement Treatment Court. Fresh Start gives offenders the chance to choose treatment instead of jail and avoid having a criminal record. He is also a board member of the Lackawanna County Treatment Court, which established and operates the Recovery Bank in downtown Scranton, a peer-driven recovery support center that focuses on whole-person healing of mind, body, and spirit.DA Powell is on the Pennsylvania District Attorneys Association's Executive Board and serves on its Education and Training Committee. In addition, he was appointed by the Supreme Court of Pennsylvania to serve on the Continuing Legal Education Board, which oversees education programs for attorneys statewide.Before being elected DA, Powell was a partner in the Powell Law firm in Scranton for 27 years. He earned many professional accolades, including the distinction of being a Board-Certified Trial Specialist in both Criminal Law and Civil Law by the National Board of Trial Advocacy. For 12 years, he served as a Hearing Committee member for the Pennsylvania Disciplinary Board and is a past president of Northeastern Pennsylvania Trial Lawyers Association. (https://www.gatriallawyers.net/)   Remember to rate and review GTP in iTunes: Click Here To Rate and Review   Episode Details: Former State Bar of Georgia President Robin Frazer Clark explains how she secured justice for the only son of 75-year-old Jayne Fox, a woman who suffered a traumatic vocal cord injury during intubation for a lung biopsy, causing Jayne to suffer post-surgical aspiration pneumonia and leading to her death. Admitted to Emory University Hospital in Atlanta for a biopsy of a spot on her lung, Jayne was initially intubated with equipment that was much too large for her petite 97 lb., 5-foot frame. Following the surgery, nurses observed Jayne having difficulty clearing secretions, and an Ear, Nose and Throat (ENT) specialist found abnormalities indicating aspiration pneumonia.  However, the ENT and nurses failed to report their observations to the attending physician, Dr. Roy Rajan, who also failed to properly supervise Jayne's medical care or visit her in person. As a result, Jayne's treatment plan was not adjusted to treat her condition, and she passed away at Emory University Hospital nearly six weeks after her surgery. Despite the defense's attempts to blame Jayne's age, her son and the rarity of her post-operation condition, a Dekalb County, Georgia jury returned a verdict of $2,350,000 in damages against Emory Clinic and Dr. Rajan.   Read/Download the Complete Trial Documents   Guest Bio: Robin Frazer Clark Robin Frazer Clark is the owner and founder of the law firm of Robin Frazer Clark, P.C., and has practiced law in Georgia for 31 years. On September 17, 2010, Vaylma sat in her Volkswagen Jetta waiting to make a turn when she saw a cement truck in her rearview mirror that showed no signs of stopping. The 66,000-lb cement truck –– driven by a distracted company employee –– crashed into the back-end of Vaylma's car and propelled her vehicle into a utility pole. As a result, Vaylma endured three spinal fusion back surgeries, hip fusion surgery and shoulder surgery, making her unable to live independently or remain employed. On today's episode, hear how Sarah Stempky-Kime focused on McCoig Concrete Company and the driver's admitted liability at trial and kept the jury's attention on the extent of Vaylma's injuries, while countering defendants' attempts to minimize those injuries. Christina Coleman is a Canadian immigrant who owns her own practice and focuses on employment-based immigration while Katie Vannucci handles the family-based side as shareholder at a mid-sized Chicago firm.They've been friends since law school, and both credit support for each other and in the legal community at large for their fortitude and patience with all a career in immigration law has thrown at them: from difficulties in launching a firm to the tumultuousness in their practice area through the past couple of decades. Two immigration attorneys' journeys in this changing area of law:· The variety of paths in immigration law for attorneys (02:17)· Practicing immigration law under an unpredictable administration (14:20)· Guiding clients through unstable times with shifting rules (29:00)· What Christina Coleman & Katie Vannucci want to see changed in the business of law (53:25) The mentality of immigration attorneys, and their community:Christina: “I started doing immigration in 1998. And I think for the first five years we would have [details] on the postings on the wall. It's like where you file [a] kind of petition, it might have changed once or twice in five years…[since then changes have] definitely been on an accelerated pace….It certainly feels like it's been ramping up and ramping up.” Christina: “One thing I love about the immigration community – and I really noticed it since I went out on my own – is everybody is so collaborative, so helpful. I did corporate defense work for six years, and maybe it was the particular lane I was in at Sidley, but, wow….You couldn't just email a colleague and say: ‘Hey, have you ever had this situation? What should I do?' You know, and it's just been amazing, and I've felt so supported [in immigration law].” Katie: “I think for me one of the things that I am lucky to have – and kind of going back to the fact that we have such a great supportive community – is talking about [the challenges]….A lot of times in our weekly meetings [at Ahlgren] we go around and we just talk about what we've seen that week, and to be able to talk through it with colleagues that understand and can relate to your own feelings- just going through it and processing it….is really, really helpful.” Katie: “The biggest thing is hoping that we actually see some comprehensive immigration reform, that we finally see a way under the law that individuals [we can't help as attorneys]finally have a path to be able to do something. Because that's the problem. It's not because people don't want to legalize their situation. It's because they can't. And so I think [it isn't] until we can recognize that and we can see the humanity in this, that we can finally reach across the aisle and come up with a good bipartisan solution to actually deal with the problem, instead of keeping-on kicking the can down the road and say ‘well, we'll deal with it in another administration.' Kroll focuses primarily on plaintiffs' litigation.  Jeff has been representing victims of negligence for almost three decades and has taken cases to verdict throughout the country in the areas of trucking accidents, products liability, medical malpractice and transportation negligence.     In 2017, Jeff was part of the trial team that won a record-breaking $148 million verdict on behalf of a dancer paralyzed by a collapsed shelter at O'Hare International Airport.  This is the highest compensatory damage award to an individual plaintiff in Illinois, and in the top five nationally, in a personal injury case excluding punitive damages. It is also believed to be one the largest premises liability compensatory awards nationally that does not involve a toxic tort claim.     Jeff regularly handles complex damage cases and often receives multimillion dollar verdicts and settlements. In 2015, Jeff obtained a $15.2 million verdict on behalf of a man who was seriously injured when he was struck and run over by a forklift at McCormick Place Convention Center in Chicago.  During his career, he has obtained verdicts or negotiated settlements on over 75 occasions where the results have exceeded $1 million, including six cases which have exceeded $10 million. Finding out that you, or a dependent family member, may be medically inadmissible to Canada can be one of the worst days of a foreign national's life.
