In episode 9 of The Caregiving Soul, Dannelle speaks with C. Grace Whiting about initiating difficult conversations about your medical needs and planning for later in life.Based on the work of The Conversation Project, which is an organization that helps people talk about their wishes for care through the end of life, as well as based on our own experiences, we know these discussions can be very difficult and overwhelming to initiate and to receive. So, let's go through it in steps. Step One: Think about what matters. Start with good questions, which may include, “What does a good day look like?” Is it quality time with loved ones or doing certain activities or even creating a certain environment? This helps us to better understand how our loved ones would like to spend their day. We can also ask, “What does support look like in hard times?” Is it going to your place of worship or spending time with family or friends? The answer can help give insight into what our loved one feels they need most when life is hard. We can also ask, “What matters most in life for you right now?” As well as “What matters most through the end of life?” It could be the question of what do you want your family and others to understand about you? Consider what the priorities are when imagining what a good death looks like. Step 2: Plan Your Talk It's so important for all of us to have a say in our care. While certain circumstances may not allow all requests to be honored, conversations can give us a stronger understanding and greater certainty in honoring our loved one's wishes. And frankly, it's not going to happen in one conversation. This is an ongoing conversation so that we can better understand how much our loved one wants/needs to know about potential diagnoses and conditions; how involved they want to be in their medical decisions, who gets to be involved in making decisions on their behalf, as well as concerns about potential interventional treatments.Step 3: Start Talking Regardless of whether or not we have a close relationship with our care partner, it's just not possible for us to know everything unless we ask. Clarity helps give peace of mind. Think about some of the preparations to have these conversations and where would they feel most comfortable having this kind of discussion. Such as, who would our loved one like to have these conversations with? Who else should be in the room? Make a clear decision about when you would like to hold this conversation and write out a list of the most important things to cover. We can always practice having conversations to feel better prepared. The more we talk about it, the more informed decisions we can make. Step 4: Keep Talking When we make the courageous and important decision of initiating these conversations, keep going! Who else might need to be part of the conversation? As we continue to ask questions and listen, we build confidence that we understand what matters most for our loved one. Reflect on past conversations and decide when you would like to speak again, what might be important to revisit or clarify and what might be important to cover in the next conversation. Uno de los grandes éxitos del cantante colombiano Rodolfo Aicardi vino incluido en el álbum “La pena de mi viejo” de 1978, canción que lleva por título “Naila”. Así la escuché yo… Rodolfo Aicardi en realidad realizó una nueva versión de la canción grabada por el Grupo La Amistad de México en la voz de su líder y cantante Pepe Ramos, quien la interpretó en 1978 con el nombre “Naila”. Dos años antes, ya La Única Sonora Maracaibo originaria del Estado de Guerrero en México había grabado su propia versión en 1976 en la voz de su cantante Toño Almonací, bajo el título “Naela”. La primera grabación conocida de esta canción la realizó el Trío Montalbán de México, incluida en su álbum “Llorona” de 1969, composición del mexicano Chuy Rasgado, quien la escribió con el título “Naela”. El propio Trío Montalbán grabó otra versión en zapoteco, una lengua indígena de México de donde se especula proviene el nombre “Na'Ela”. Como dato curioso, hay que decir que las versiones del Grupo La Amistad de México y la del colombiano Rodolfo Aicardi incluyen dos poemas de autores españoles… En primer lugar se oye “La casada infiel” de Federico García Lorca. Y luego se escucha el poema “La profecía” de Rafael de León. ¿Y tú, conocías otras versiones de esta canción? Naela is an ex-occultist with a background in womb worship, menstrual magic, psychic mediumship, yoga and goddess work both personally and professionally before Jesus saved her from the deception she was living in. She pulled a complete 180 and gave up her business over a year ago, and has lived in stewardship to the Lord ever since.   In this conversation, Naela shares her coming-to-Christ testimony, leading us into discussion of the God-shaped hole in all of us. We talk about how every person on this planet has an innate longing within for God because He designed us to need Him; however, we live in a secular, global society that benefits and profits from convincing the masses that this longing can be self-fulfilled with what the world has to offer. Consequently, us humans attempt to fill the void with sex, sport, food, drugs, alcohol, intellectualism, porn, music, personal-actualization, or new-age spirituality as Naela and both fell victim to.   God created every being that has ever or will ever live. We are made in His image, in His likeness, in His love, and therefore we need Him, as children of the Heavenly Father. But because God's love is unconditional, He will never force us to accept this truth. He has declared free will for His children, and therefore we have been given the personal responsibility to recognize that need for Him.   Because we are designed to need, love and serve Him — for He loves and delights in us — we are inherently programmed to worship something. Therefore, if it's not God we rightfully choose, we will try fitting square pegs into round holes and find something to worship. We are wired that way. A Way to Connect the Disability Community Annette opens the episode with a little explanation as to why she began this podcast.  Over 20 years ago, as a special needs mom, Annette struggled to find the information she needed for her daughter Elizabeth.  Elizabeth was born with mitochondrial disease, had a profound brain injury and was wheelchair bound.  Annette would constantly find one piece of information she needed in one place, then would have to hunt down another piece somewhere else.  There was no one place to gather all the information she needed.  This podcast was a way to try to help connect resources with families, professionals, and other interested parties in the disability community – to connect everyone together in one way, one group. Annette also created Special Needs Companies and the Facebook group Circle of Care to offer resources and a way to connect the disability community as well. Terminate a Guardianship The first guardianship question Annette goes over is how do you terminate a guardianship?  Annette explains this will require a trip back to court and medical documentation.  This medical evidence is needed to prove to the court that the previous incapacity the individual had that necessitated the guardianship before, is now changed and that person is now capable of making decisions for themselves.  A full guardianship may now be able to go to a limited guardianship, or a guardianship may be able to be terminated completely or go to an alternative form of guardianship.  Many states have gone from not having any alternatives to guardianship to now having supported decision making laws.  These allow a person with capacity to have a group of supporters assist in their decision making but the ultimate decision is left to the disabled person rather than left to the guardian in a guardianship situation.   Right To Counsel Annette also goes over the question regarding “right to counsel” within a guardianship case.  Unfortunately, this varies from state to state and there is no uniform right.  An individual may not automatically be appointed counsel because they are the subject of a guardianship petition.  The individual would need to understand that they need to hire their own counsel at their own cost if they wanted to fight the guardianship action.  This is not something that someone with diminished capacity may understand.  Nationally though, several organizations are trying to come up with best practices and guidelines where each state would have right to counsel available in all circumstances, though this would be challenging due to time and financial issues.  Find Assistance in Your State Annette would like to encourage each listener with guardianship questions to seek legal support in your own state.  There are a few networks to go to find an attorney:   NAELA, Special Needs Alliance and the Academy of Special Needs Planners.  You can also possibly find answers to your guardianship questions at the National Guardianship Association.   Please Leave a Podcast Review As Annette mentioned, please consider leaving a podcast review for Parenting Impossible – The Special Needs Survival Podcast on iTunes.  More positive ratings and reviews mean more new listeners are introduced to this informational and inspirational podcast.  Look at the bottom of this page for the purple oval that says “Enjoying the podcast?  Leave an iTunes review here.”  This will take you over to the iTunes site/app where you will be able to login and leave a review.  We really appreciate it! Today’s reading is from the first few pages of المولودة Al-Mawluda (the newborn) by Nadia Kamel, which was published in 2018 and written entirely in Egyptian ‘aammiya. In this biography-memoir-novel, Nadia Kamel tells the story of her mother in her own words: Naela was born Mary Elia Rozenthal to a Jewish Turkish-Ukranian father and a Christian Italian mother. She eventually converted to Islam and changed her name to Naela when she met and married Nadia’s father, Saad Kamel. The story is written from the mother’s perspective, so the first person “I” which you’ll hear in the extract is Naela/ Mary herself. Naela’s recollections, which are faithfully rendered by her daughter, deal with her childhood, family, friends, political activism, imprisonment and marriage, but they also paint a picture of the multicultural Egyptian society of the 1930s, 40s and 50s. As you might expect, because it was written entirely in عامية there was a backlash from those who feel that books should only ever be written in فصحى (with some exceptions allowed where dialogues are concerned), but Nadia Kamel was adamant that the colloquial is the language that we use to communicate our thoughts and feelings every day, so that it’s appropriate to use it in writing as well. The reading was once again kindly provided to me by Amani Hassan (with whom I collaborated two episodes ago), who also proposed the questions I ask after the reading. And once again my contribution consists in providing the intro, the answers to the questions, as well as the فصحى version of the extract, which you’ll find in the downloadable document below (one row in مصري followed by a row in فصحى, followed by the questions). Hopefully we can make more episodes on this delightful book in the future! Kevin also serves as National Director of the Academy of Special Needs Planners (ASNP), a national organization of special needs and settlement planning professionals. Kevin is a Certified Specialist in Estate Planning, Trust, and Probate Law by the California State Bar Board of Legal Specialization. Kevin is also a fellow of the American College of Trust and Estate Counsel (ACTEC). In 2013, Parenting Magazine named Kevin as one of the nation’s Top Child Advocates for his work in fighting for the rights of children with special needs. In May 2011, Kevin was presented the NAELA’s Presidential Recognition Award for his work in special needs planning. In each year from 2010 to 2017, Kevin was named a Northern California Superlawyer. Welcome Medicare Nation!  Today’s discussion spells out the essential elements of Elder Law, and how the specialty is necessary for so many circumstances.  That’s why I am talking to an expert in the field today, who can help us clarify some common misconceptions, and also point us to the right resources to make sure you and your family are protected.   My guest today is Andrew Brusky, who is an attorney who specializes in elder law, offering services designed to provide greater options and security for the elderly and disabled.  Mr. Brusky regularly handles cases and is a frequent speaker on issues involving Medicaid eligibility, health care and financial powers of attorney, trust documents, as well as long-term care options for the elderly.  Andrew has worked for Legal Assistance to the Elderly in San Francisco, California and as an intern with the Center for Public Representation in Madison, Wisconsin.  Mr. Brusky received his Undergraduate degree in psychology and gerontology from Santa Clara University and his law degree from the University of Wisconsin Law School.  He is a member of the Milwaukee and Wisconsin Bar Associations (State Bar Elder Law Section Board Member and Past Chair, founding member of the Milwaukee Bar Elder Law Section serving as its Past Chair), the National Academy of Elder Law Attorneys, past chair and board member for the Greater Milwaukee Interfaith Older Adult Program, and is currently a member of the Life Navigators trust committee in Wauwatosa.  Andrew has been listed in The Best Lawyers in America in the specialty area of Elder Law and Wisconsin Super Lawyer.   What is Elder Law and the difference between estate planners, etc?   Elder law attorneys are looking at your estate, looking at what counts and what doesn’t.  They determine what needs to be spent down, and what steps you need to take for estate recovery.  There are also considerations for post-eligibility estate planning as well.  There are so many nuances to the law for each specific situation, such as considering what happens if the healthy spouse passes prior to the nursing home spouse, so it really is imperative to have a specialist to make sure there are no surprises down the road.  You want to leave yourself and your estate in the best situation possible in regards to taxation, etc.   What is Divestment and how is that associated with Elder Law?   It helps to think of it in terms of gifting, because you are not getting anything in return for the asset you transfer.  It’s problematic because it can be a barrier to qualifying for Medicaid.  Currently there is a 5 year period prior to eligibility that you cannot conduct these transactions.  An elder law attorney will be able to do things on the front end to make sure you aren’t losing your option for Medicaid.  There are many mitigating actions if this isn’t done correctly from the start, but it takes more time and money than if you did it the right way from the beginning.   Can Financial Powers of Attorney be helpful in the context of Elder Law?   Yes, many times the spouse who has all or part of ownership, isn’t able to administer it themselves, so someone else will need to do it for them.  Many of the pitfalls can be alleviated with a well drafted Financial Power of Attorney.   Are there times when a court guardianship may be necessary?   In cases of abuse, this frequently happens.  If there is mismanagement , there isn’t any family to handle the responsibility or even if there is a dispute about the existing Financial Powers.  It is always a last resort when there are problems with the administration of the directives.   Can having all the documentation in place ahead of time avoid Probate court?   Yes, and no, but while you are already putting steps into place, there is no harm in putting probate avoidance tactics into place.  Good advanced directives and financial power of attorney documents can go a long way in avoiding probation.   Will Medicare cover Long Term Care?   Medicare was not designed for long term care.  It is rehabilitative, and designed to help short term with injury or illness.  It doesn’t have the funds to pay for it ether.  The chronic issues that require custodial care are generally not going to be covered by Medicare.  Lawyers, discharge planners, and geriatric case managers can all be helpful in navigating these complex issues.  If you need monitoring of the care provided, these case managers can be extremely helpful.  It’s as if they are your eyes and ears on the ground, when you can’t always be present to intercede for your loved one.   You can pay your relatives to provide care for you.  Many times it has to be structured and done at fair market value, but there is no reason not to utilize it.  You cannot give away money to your children, but you can pay for them to take care of your, without ruining your eligibility.     What does the future of Elder Care look like?   Baby boomers are just now starting to retire.  Government is trying to get out of the business of providing long term care.  So, there are lots of changes on the horizon.  As more people become eligible, it may bring down the cost of providing care.  It’s important to have funds available to get yourself into an institution, if necessary.  Families are becoming more fractured and living in different locations, so more than ever we will be dependent on these types of programs.  The spectrum continues to swing back and forth between, people needing help and private planning for the financial burdens associated with these services.   Resources:   You can reach Andrew at apb@bruskylaw.com   NAELA - National Association of Elder Law Attorneys lawyers.com - referrals Local bar association can provide referrals Alzheimers Associations will have referral lists Consult neighbors and friends for referrals    Andrew speaks and the NAELA chapters and the Local Bar Association in the Milwaukee area.   Got questions about elder law?  Send them to support@medicarenation.com.  We will address them in future episodes.   Thank you for listening! Prior to joining ElderCounsel, Valerie was a practicing elder law attorney in Ft. Lauderdale and Miami, Florida as the owner of Peterson Law Office, P.A.
