August 19, 2022--Alicia Bales interviews attorney Les Marston. He represents two local Pomo Tribes who just won a David and Goliath ruling in the 9th District Court of appeals against the State of California over the state's bad faith negotiation of their Gaming Compacts. Les is the lead attorney on the case, and discusses the State and National significance of the efforts by the Hopland Band of Pomo and Robinson Rancheria, among a handful of other tribes who fought back against the State of California and won.
Derik Mooberry spent most of his career with Bally/Scientific Games/Light & Wonder, eventually leading the gaming division of Scientific Games. Six months ago, he was named president of Zitro USA, a company founded by Johnny Ortiz and led by corporate CEO Sebastian Salat. Mooberry is charged with spreading the word about the Zitro games in the United States. He spoke with GGB Publisher Roger Gros at the GGB offices in Boulder City, Nevada in June. (See video below). GGB: Those of us who cover gaming know what great games Zitro makes, but there are quite a few operators who didn't get the memo. How are you going to change that? Mooberry: Yes, there are a lot of people who don't know who we are. And now that we're just entering the U.S. market, we need to emphasize that we're a very well established international company with over 1,000 employees around the world. The company started back in 2007, and Johnny Ortiz has a tremendous passion for games and content and making great products that make customers happy. We have bingo roots where we had tremendous success throughout countries in Latin America, primarily in Mexico, and there are still some people who see us as a bingo company. So when did Zitro begin making Class III games? A lot of our recent success and expansion are in the Class III video slot area. It was probably about 2016 that the company started making the transition to doing video slots in addition to bingo games, and that's really taken off. Our goal now is to get customers in the U.S. market familiar with who we are and what our products are. Why do you think the time is right now? It's what we've seen in other markets around the world. In places like Mexico and Argentina and other key markets, we go head to head with the biggest and best—the Aristocrats, the Light & Wonders and IGTs of the world. And we saw that our products could perform and then in some cases outperform those competitors' products. So that gave us the confidence. I think that our content, our games and our cabinet strategy are ready for the U.S. market. Tell us about the Zitro R&D department, which is often the heart and soul of any slot company. Yes, you're right. R&D is the foundation of everything for every slot company. We have over 300 people working in the R&D department primarily based in Spain today. Our products are developed over there, but they're developed in such a way that we have global aspirations when developing the products. So we're looking at what the market requirements are in the different regions of the world that we operate in. And then even here within the United States, within the different states. You can see dramatic differences in how a product needs to get set up within something that might go in Oklahoma versus what might go in a casino in Southern California. So it's a growing R&D team with a number of resources behind it, focusing on all the normal elements you would expect to build the great slot content. Tell us about your cabinets. We saw them at the Indian Gaming trade show in April, and they really popped. Our new Glare product line features four unique cabinets, all different form factors, four different content streams to go on each of those cabinets. The Glare line has enhanced side lighting so you see 4K resolution on the monitors, which really bring the characters to life. I think maybe the ultimate compliment for us was the number of competitors that came to the booth to look at some of our products.

Sequoyah Simermeyer, a member of the Coharie Indian Tribe of North Carolina, was appointed to the National Indian Gaming Commission in 2015 as an associate commissioner. In 2019, he was elevated by President Donald Trump to chairman and confirmed by the Senate. His term will expire in 2023. Prior to his role with NIGC, he worked as an advisor to the Senate Committee on Indian Affairs. He began his career with the National Congress of American Indians, a national intertribal organization focusing on the protection of tribal governments' rights and status. Gabe is skilled at defending Indigenous nations and business against legal attack by governmental or private parties, as well advocating for the human rights of Indigenous citizens. He advocates against tribal disenrollment and other Indigenous human rights abuse. He also assists Indigenous clients with transactions and strategy related to various economic diversification initiatives. Gabe speaks writes frequently about tribal litigation sovereignty and Indian civil rights issues, having been published over 100 times in such other national periodicals as National Law Journal, Business Law Today, Gaming Law Review & Economics, and Indian Gaming magazine. Most notably, he co-authored a law review article titled, “Curing the Tribal Disenrollment Epidemic: In Search of a Remedy,” which was published by Arizona Law Review in 2015. Many people don’t realise that the realm of products that are sold over livestreams in China is incredibly broad. Let’s take a look at some of the latest things sold on Chinese social commerce platform Pinduoduo.On July 13, 600 apartments in the Chinese city of Zhongshan were sold over a four hour livestream, marking Pinduoduo’s first venture into selling real estate on their e-commerce platform. The event got 720,000 views and featured special discounts that viewers could claim if they made the purchase during the livestream. Viewers were able to place refundable deposits and then have two weeks after the livestream to visit the apartments in person. Real estate agents and property developers have been using Chinese livestreaming platforms to sell apartments since the beginning of this year and this will likely continue.Indian Fantasy Sports Startup Dream11 Restarts $200 Million Fundraise 🏏Dream 11, an Indian Fantasy Sports Startup, has announced their intention to raise $200 Million on a $2 Billion valuation. The company had initially suspended the fundraise for a few weeks due to the coronavirus but has now found a new set of investors to reach their target. Dream11 is in the final stages of their restarted talks with the original investors and a set of new investors, including US private equity firm TPG, Indian private equity firm Kedaara Capital, and James Murdoch’s Lupa Systems.Many people are speculating how the coronavirus will change the startup funding landscape in both the short and medium term. This latest investment, after a period of pause, should inspire more confidence in the startups currently looking for investors. Also—fantasy sports, compared to many other verticals, is something that will benefit from the changes in consumer behaviour thanks to the coronavirus. The Indian online gaming industry, under which fantasy sports would be categorised, is expected to nearly triple in size over the next four years.Positive Updates for China’s Film Industry 🎬The film industry has been hit pretty hard by the coronavirus. As I wrote in a previous update, 13,000 Chinese film and TV companies have gone out of business this year. Cinemas were briefly reopened in March, but then shut down again when cases started rising. There may be a silver lining, however. The China Film Association has just announced that cinemas in “low-risk” areas could now begin reopening as of this week.Under the “low-risk” definition, the vast majority of cities in China would qualify as fitting within this criteria. There are additional requirements to the reopening, as theatres can only operate at around 30% seating capacity. Customers will have their temperatures taken before entering and wearing masks will be mandatory for anyone in the theatre. Perhaps the most devastating new rule is that food and drink is not allowed to be served.Charging people for concessions is the highest margin, most profitable part of a theatre. It’s not an exaggeration to say that this would drastically change the entire business model of a movie theatre. We should look out to see how Chinese cinemas are able to adapt and figure out other ways to monetise their customer base. What the Chinese cinemas experiment with may end up being adopted by other traditional theatre chains across the world. This is a public episode. As one of the largest casinos in the world, Foxwoods has been expanding for more than 15 years, the most recent expansion in 2008 created the MGM Grand Resort at Foxwoods. In this episode we start by chatting it up with the Mashantucket Pequot tribes Chairman Rodney Butler who shares the history of how he and his people used to live before casinos changed everything. We also discuss how they got gaming started even as Wall Street said it would never work, who their unlikely financial savior was, and how gaming has transformed the lives of his community. Then we speak with Executive Chef Eddie Allen about how he oversees the about 30 dining outlets at the resort and get critical insight into the trends he is seeing and how the resort is adapting to meet the emerging dietary desires of Foxwoods’ clientele.
Friday, October 17, 2008. Twenty years ago today, the Indian Gaming Regulatory Act was signed into law. This law provided the framework for Native American tribes to run casinos on tribal land, and thus transformed the American landscape. I talk a little about the Act, its impact, and share some of my own perspectives about gambling.
