Das Landesarbeitsgericht (LAG) Köln entschied über den Fall einer Arbeitnehmerin, der ihr Arbeitsverhältnis durch den Geschäftsführer unzumutbar gemacht wurde (Urteil vom 09.07.2025, Az.: 4 SLa 97/25).Der Sachverhalt: Die Klägerin war seit 2019 als Arbeitnehmerin in einem Unternehmen tätig. Ab Februar 2024 erhielt sie eine Vielzahl von beleidigenden, sexuell anzüglichen und drohenden WhatsApp-Nachrichten von ihrem Geschäftsführer. Die Nachrichten enthielten unter anderem:Aufforderungen, „nichts unter dem Rock anzuziehen“.Beleidigungen wie „dumme Frau“ und „hässliche Fresse“.Drohungen mit willkürlichen Gehaltskürzungen und Kündigung.Nachdem die Arbeitnehmerin ein privates Treffen ablehnte, wurde ihr das Arbeitsverhältnis von der Beklagten gekündigt. Die Arbeitnehmerin erhob Kündigungsschutzklage und beantragte hilfsweise die Auflösung des Arbeitsverhältnisses sowie eine Abfindung, da ihr die Fortsetzung wegen der Vorfälle unzumutbar sei. Die Beklagte argumentierte, die Nachrichten seien Teil einer „freundschaftlich-flirtenden“ Kommunikation gewesen und das Verhalten der Klägerin sei widersprüchlich.Das LAG Köln wies die Berufung der Beklagten zurück und bestätigte die Auflösung des Arbeitsverhältnisses.Das Gericht sah die Fortsetzung des Arbeitsverhältnisses als unzumutbar an. Die WhatsApp-Nachrichten seien kein „Spaß“, sondern ein Machtmissbrauch des Geschäftsführers. Das Gericht betonte, dass für eine Unzumutbarkeit keine Kündigungsgründe im Sinne des § 626 BGB (Fristlose Kündigung aus wichtigem Grund) erforderlich seien. Es reiche aus, dass dem Arbeitnehmer die weitere Zusammenarbeit nicht mehr zugemutet werden könne. Eine Entschuldigung sei nicht ausreichend, da die Kündigung direkt darauf folgte.Das Gericht legte eine Abfindung in Höhe von 68.153,80 € brutto fest.
