Gene Burrus, global policy council at the Coalition for App Fairness, discusses how Apple and Google use their dominant position in the app store market to unfairly treat app developers and the legal battle taking place over this. Burrus joined the Coalition for App Fairness – a group of app developers advocating for a competitive and fair marketplace – after his work at Spotify (a CAF member) introduced him to the complex struggle between app stores and apps. CAF contains members from early-stage startups to global powerhouses, including Fortnite developer Epic Games. Burrus explains the various legal challenges made against Apple and Google and the progress from global competition regulators in breaking up the app store monopoly, described by Burrus as being akin to Microsoft's domination of the software market in the 90s before anti-trust lawsuits came into place.

How do you answer what do you do?It's a question that many of us hate because we often don't have a concise answer. It might involve a label that limits us. And it doesn't cover the range of how we do, what we do and makes us special. Yet, I never approached him because I didn't see a clear topic to discuss. He is one of those people who are hard to pigeonhole.

On October 10, 2023 Andre Elijah Immersive filed a $353 million dollar lawsuit against Meta Platforms Technologies and Alo LLC (PDF & Exhibits via UploadVR) claiming both a breach of contract for how Meta terminated a fitness application that it was funding, but also for a broader pattern of anti-competitive behaviors and Sherman Act violations. Elijah is claiming that Meta is giving preference to their own first-party fitness application of Supernatural after the FTC failed to block the acquisition of Within in February 2023. Elijah says that Meta was hedging their bets in the fitness space by investing in other XR apps by taking an ownership stake in different XR projects like the yoga and pilates mixed reality fitness app that he was developing in collaboration Alo LLC. But after the Within sale finally went through, then Elijah claims that Meta found a way to kill off his app in way that breached their contract and represented a broader pattern of anti-competitive practices. The US Federal Trade Commissions (FTC) attempted to sue Meta for alleged anti-competitive behaviors of their 2012 Instagram acquisition, but it was 8 years after the fact in 2020. At the time were a number of indie VR developers who were claiming that Meta was still deploying different anti-competitive practices in how the VR ecosystem was developing. This included BigScreenVR's Darshan Shankar claiming that Meta was preventing his business model of movie screenings in VR while at the same time not preventing their own potential aspirations to do the same. Guy Goodin was forced to remove SteamVR streaming features from his Virtual Desktop application when Meta was working on their own competing product, and Cix Liv claimed that Meta was blocking his application from the app store when Meta had a competing first-party application. Then Meta changed their name from Facebook, and then a day later Meta announced they were acquiring popular fitness application Supernatural made by Within. Then the FTC announced on July 27, 2022 that they're seeking to "Block Virtual Reality Giant Meta's Acquisition of Popular App Creator Within." It wasn't until February 1, 2023 that Bloomberg reported that "US District Judge Edward Davila in San Jose, California, denied the FTC's request for a preliminary injunction to block the proposed transaction." This cleared the way for the Within acquisition to finally go through, and this sets the broader context for Elijah's interactions with Meta in the context of the fitness application space. I had a chance to sit down with Elijah to get a bit more context for what happened, why he believes that Meta is at a minimum in breach of their contract, but also why he's invoking the Sherman Act and alleging some deeper patterns of anti-competitive behaviors. How have you guys really separated yourself from all the other platforms that are out there? What do you see most of the opportunities right now and are you in the game or why not? With a buyer and their due diligence, what are some of the things that they should be digging into, and for the seller to understand where the value is or how to build it? What are some of the traditional ways and outside of the box and creative ways that you're seeing that could be structured in a purchase? What is the overall landscape in your perspective based on the trajectory of the economy, where interest rates are at, and in general from the buyers and sellers' perspective? A great idea can create a better world. Bryan Clayton had an idea he believed in so much that he put it all on the line - and he's so glad he did. Bryan Clayton is the CEO and Co-Founder of GreenPal, an online marketplace that connects homeowners with local lawn care professionals. GreenPal has been called the Uber of lawn care by Entrepreneur magazine and has over 200,000 active users completing thousands of transactions per day. GreenPal makes finding a lawn care professional simpler than ever. Customers who want consistent and reliable service love GreenPal for access to high-quality professionals. And lawn care vendors love using GreenPal too - because they receive more work, get paid faster and cut down on marketing costs. Before starting GreenPal, Bryan Clayton founded Peachtree Inc., one of the largest landscaping companies in the state of Tennessee, growing it to over $10 million a year in annual revenue before it was acquired by Lusa holdings in 2013. Bryan‘s interests and expertise are related to entrepreneurism, small business growth, marketing, and bootstrapping businesses from zero revenue to profitability and exit. Always be helpful, no matter what Before Bryan had the idea for GreenPal, he owned a thriving lawn care business. It was doing so well that they were only taking large commercial contracts - turning away anything smaller than airports, malls and developments. He referred prospective clients to smaller lawn care businesses locally completely for free. Bryan believes that we should always be helpful, no matter what. He continued showing up to refer business between vendors and customers - until he realized that he could build a service they would use every day. Seeing an opportunity to make larger and more lasting connections, Bryan developed the concept for GreenPal to make lawn care service seamless. Don't cut corners, put the work in Bryan had never written code in his life. Bryan and his Co-Founders pooled their money to hire an app developing service - which was an expensive lesson. Despite their vision for the app, the development process was painful and ineffective. They realized that they needed to approach their idea differently and pivot. Not giving up, the three Founders got to work in separate spheres to make the business work - Zach Hendrix spent hours every day in an online software coding class, Bryan worked on front end development, and Gene Caballero worked PR and wrote content. They weren't going to let their idea fail because of one expensive hurdle, and they knew it would pay off. Living on rice and beans, the Founders spent all of their time learning new skills. Bryan discusses how painful but important this lesson was. He emphasizes the importance of skill-building, flexibility and customer feedback. In fact, after spending months wasting time on branding and mascot design, he realized that he could have hustled up a hundred customers instead. He encourages entrepreneurs to remember the goal and abandon the fluff. What skills will truly drive your business forward? And are you spending enough time listening to the feedback your customers give? Your brand is a promise When it comes to his approach to brand values, Bryan keeps it simple. He reminds us that a brand is a promise - to keep our word, show up and be helpful always. Instead of focusing on lofty concepts and buzzwords, Bryan focuses on what keeps his business moving: Daily habits. His blue collar attitude translates perfectly into his new role as a tech Founder. Quotes “GreenPal is a 10-year overnight success.” “If we were gonna be in the tech business, we needed to learn how to write code. We needed to literally build it ourselves. If you don't know what it's going to be, you can't outsource it. You have to build it as you're interacting with users.” “We had to pass out flyers all over Nashville Tennessee begging people to use this thing. And then we would meet with every one of them that would use it. And they would all tell us everywhere that the thing sucked. It broke and it didn't work. But they never told us we didn't need this. They were actually disappointed. And we took that as validation to keep going!” “In my Co-Founders…I was looking for two people who could live on rice and beans for a long time. We weren't unicorns, we were cockroaches. You couldn't kill us. We lived very cheaply.” “The first hundred or even thousand of your sales when you start a business should be hand-to-hand, should be manual. Then you know what processes and technology you need to build. You don't know until you hand-crank it.” “It's our job to load up the lawn care provider's schedule with as much work as he or she wants to do. Make their life easier with getting paid quickly, not having to do marketing…basically, it's a business in a box. They can make more money with less hassle, so that it makes sense for them to do business with GreenPal instead of the old way.” “We spent all this time thinking about branding…with no customers. We even designed a mascot, Gary the GreenPal. We spent like three months or longer with zero customer feedback. We wasted way too much time. We should have not worried about any of that. We should have hustled up one hundred customers first.” Links mentioned in this episode: Visit GreenPal online at https://www.yourgreenpal.com/ Connect directly with Bryan Clayton on LinkedIn at https://www.linkedin.com/in/bryan-clayton-a96b33214 Follow Bryan on Instagram at https://instagram.com/bryanmclayton

PIE Tribe Exclusive Webinar: https://passive-income-examiner.captivate.fm/amazon-store (https://passive-income-examiner.captivate.fm/amazon-store) Are you ready for a paradigm-shifting episode that is sure to challenge you into a better version of your entrepreneurial self? Click Play! Yes, today is October 31st, in the US and some other countries people are participating in Halloween, a day when children dress up and go door to door saying "Trick or Treat." Most of the time they are rewarded with candy and happily run to the next door. But, did you know you are playing tricks on yourself? If you are less than completely satisfied in any area of your life, that means you have an underlying "Rule" that you are believing that is keeping you from experiencing your greatest potential. In this episode, Lindsay reveals how to unveil the Tricky Rules you are living by and how to transform them into new ideas that further your growth. We all have rules we live by. Some are much less significant than others. And some we did not even invent on our own, they may have been inherited beliefs instilled by our well-meaning parents, teachers, or other adults of influence. Consider these common rules I hear from mothers. "I can't go to bed with a dirty kitchen." "I must make my bed every morning." "I must marry a man that makes a good living." You see, many of these types of rules don't keep us stuck and were likely ingrained in us from childhood. However, there are much spookier rules that we subscribe to day in and day out, often unknowingly. Consider these rules, "I must work hard to make money." "I am not good at technology." "I can't write a book until I have my course created." "I need to be certified before I can start charging for what I know." When we take an honest look at our lives, it is guaranteed, that in any area of our life where we feel unfulfilled, underperforming, or frustrated, we have a verbal script running through our mind that is blocking us from success. The script is some sort of a rule we THINK we have to follow. Today, I challenge you to break your rules, and start imaging the possibility of your life without subscribing to what you have believed is a fact thus far. How could your life change if you believed you could lose weight easily, or could find true love, or could (You fill in the blank.) It is on each of us to take an honest account of the rules we are living by and simply consider the possibility of shifting in the direction we want to go. By changing our focus from the rules we have devoted ourselves to, to shining a light on what could be, we unlock the door of possibility and allow magic to work in our lives. Today, listen to this episode, then pick one rule you intend to break. Treat yourself this Halloween, to being a positive force in your life. Treat yourself by choosing to think differently about what you are capable of. Treat yourself by challenging your long-standing belief systems. Then, friend me on Instagram or TikTok and DM me. Wondering what you should do with your passive income? Today's episode outlines a strategy to take you from earning active income through building legacy wealth that can be passed on to your heirs. Passive Income is income earned with little to no effort, often from investing time or money that works for you and generates a monetary return. Whereas, active income is earned by 'actively' working for it; such as, performing at a job or providing a service. Passive income is sought after because it gives people a chance to earn money while also freeing up their time so they can spend it doing things they love. If you are working in a W2 or own your own business that is draining your time and energy, passive income is a great way to develop a freedom lifestyle. I was able to quit my job when my husband and I began saving money each month. We were smart about it, though, and didn't just stick our money in a savings account, we put our investment in an asset that appreciated which doubled over time and exponentially helped us. If I would have had more time and education, I would have deployed some of those assets into passive strategies, but at the time, I did not have the education I do now. If I could go back and redo my exit plan knowing what I know today, I would have invested in passive strategies because a year after moving I was again in a W2 situation. This is why I recommend the second step of the process be to diversify your investment into passive strategies. If you are just getting started and would like an overview of passive income ideas text the word 'PIE' to 33777 to get your copy of 5 Ways to Earn $5K / month with Passive Income. Sometimes, it's easier to find one strategy to focus on that replaces your income, but I strongly encourage you to expand from there. I like to build micro-businesses. Essentially, each passive project I build is it's own micro-business that I use to diversify my income. To me, this is very important because I don't like to put all my eggs in one basket just in case something fails. The last step is to build legacy wealth. There are a few ways to do this, but one important one is to invest in Real Estate. (Especially if you're in the US) In this episode, I refer to a few key people to help with this step.
