Send us a textThis week's podcast guest is Joseph Margulies, an accomplished civil rights litigator, author of three books and many online articles, and Cornell University professor. Joe was counsel of record in Supreme Court litigation that established the right of Guantanamo inmates and Americans detained abroad by American forces to challenge their detentions. He describes one of his current clients as having been “imprisoned and tortured in CIA black sites.”Joe and Fairfax criminal lawyer Jonathan Katz graduated from their respective law schools a year apart. Joe's father, Irv, was a great lawyer who was a key mentor to Jon when the litigation partner at Jon's first law firm. Detours about Irv in this interview include his sharp mind, and Joe's and Irv's commonality about the importance of strong persuasive writing skills for litigators. Jon witnessed Irv's taking even complex issues and getting right to the heart of the persuasive matter, with appropriate word imagery and emphasis. Irv's persona shines through in his combat veteran oral history.Starting with doing indigent criminal defense, Joe eventually shifted from mainly wanting to fight in court, to adopting a more client-focused approach that seeks to know his clients as people, as well as what happened in their life path that preceded their arrest and prosecution. That approach develops trust between a lawyer and client that cannot be substituted any other way, and enables the lawyer to persuasively advocate for their clients all the better.  Joe aptly says on his main professional webpage: “If history and science teach us anything, it is that any of us can do monstrous things, and if all of us can be monstrous, then none of us are monsters, which is why I do not believe in the Other, that mythical creature we are so quick to find and eager to cast out.”Asked about approaches to beating the prosecution, Joe admits that he has suffered defeats (as do all criminal defense lawyers), and focuses on the importance for a criminal defense lawyer to sharpen their writing skills, process, and re-writing. ANOTHER GREAT INTERVIEW THIS WEEK, REFINER!!No 'Severance' production person is safe! Vinny P. is tracking them down and locking them into interview slots for the show. This week we talked to a legendary figure in the world of 'Severance' props and set dec. We've got "Penko the Sculptor"!!Penko's last name, Platikinov, is a bit of a mouthful. Rather than say it incorrectly, the folks around the 'Severance' set have gone to referring to this incredibly talented man as "Penko the Sculptor".  This is also a succint description of what he does around here. If it's a thing that's a little off...like say the Irv-head melon, or the statue of Kier in the town square...Penko probably had something to do with it. Penko is the 'anti-CGI' guy. Much of what he does I have attributed to CGI throughout my re-watch of the show. Nope! Those amazing visual tricks...like a dead seal carcass along the path, or a big statue in the town square...are all practical effects. Penko is that good. He's creating things you would believe were CGI if you didn't know any better. You're gonna love this guy! Hit 'play' Refiner! We meet Jamaican sprinter Derice running through town. It's November 1987, and Derice is preparing to qualify for the Olympics. He runs until he reaches the pushcart competition, where his best friend Sanka competes in the big pushcart race. Sanka crashes, but no problem—Derice keeps running.It's time for the qualifying race. Derice is the clear favorite. The top four finishers will represent Jamaica in the Olympics. Unfortunately, the runner next to him, Junior, stumbles and takes Derice down with him.Derice tries to convince the Olympic committee leader to rerun the race, but it's a no-go. On his way out, he notices a picture of his late father standing next to another man. He asks who it is, and learns that it's Irv Blitzer, a fellow gold medalist who once competed in bobsledding. Irv lives in Jamaica now, working as a bookie and living a miserable life.It takes a while, but Derice finally wears him down, and Blitzer agrees to give him a shot. They gather a group of people together, but Blitzer scares them off by showing a reel of bobsled crashes. By the time it ends, the room is empty—except for one of the other runners who fell with Junior, a grumpy guy named Yul. The problem is, there's no such thing as a three-man bobsled team. That's when Junior shows up. Yul tries to fight him when he walks in, but—like it or not—that's their squad.They get to work, and after a lot of crashing and falling, they finally manage to get into the bobsled in under six seconds.Now they need funding. After failing to land a sponsor, they try random fundraisers, but still fall short. Junior steps up and sells his fancy car to cover the rest of the costs.To Calgary they go. Blitzer registers the team and borrows a rundown bobsled from a former teammate. The Jamaicans struggle to adapt to, well, ice. Derice talks to an opponent who warns him that Blitzer is holding him back—that he hasn't been the same since he was caught cheating.Meanwhile, the other teammates get into a bar fight at a honky-tonk. Derice gives them a pep talk about locking in and focusing.It's time for qualifying, and Blitzer surprises them with their very own uniforms. They need to make it under 60 seconds—and THEY DO IT!They celebrate by painting their sled and naming it Cool Runnings. But soon after, they receive a letter: they've been disqualified. Blitzer storms into the rules committee meeting, insisting they not penalize the team for his past mistakes. After deliberation, the committee reinstates them.It's Olympic time. Back home, everyone watches as they march in the opening ceremonies. Junior's dad tries to pull him back home, but Junior stands up to him at last.The team's first run on the track is a disaster, and they finish dead last. Derice tries copying the Swiss team's methods, but Sanka pushes back—telling him they need to be themselves. On the second day, they race in their own style and finish eighth.During their final race, a loose screw causes one of the bobsled's blades to detach, sending the sled crashing and flipping over. Determined to finish, the team lifts the sled and carries it across the finish line. The crowd erupts in applause—including Junior's father.The epilogue explains that the team returned to Jamaica as heroes, and came back four years later to the Winter Olympics to compete as equals.
