NCLA Sues Over CT's New Bar Rule That Chills Free Speech Connecticut has adopted an amendment to its Rules of Professional Conduct for Connecticut-licensed lawyers that includes unconstitutional and impermissibly vague language governing speech by lawyers. The provision, Rule 8.4(7), applies broadly, permitting sanctions even against those who have not knowingly violated the Rule, and supplies only vague definitions of actionable speech on the basis of any one of 15 categories—among them race, sex, religion, disability, sexual orientation, and gender identity. NCLA has filed a complaint on behalf of two Connecticut-licensed attorneys seeking a declaration from the U.S. District Court for the District of Connecticut that the Rule violates the First Amendment and provisions of the Connecticut Constitution. Rittenhouse Trial: Should Cameras Be in the Courthouse? Mark and Vec discuss Judge Bruce Schroeder's recent comments describing the media coverage of the Kyle Rittenhouse trial and whether he might allow cameras in his courtroom in the future.  “I'm going to think long and hard about a live television trial again next time. I don't know. I've always been a firm believer in it because I think the people should be able to see what's going on, but when I see what's being done, it's really quite frightening,” Schroeder said. The Party for Socialism and Liberation joins with millions of people across the country in expressing our complete outrage at the acquittal of Kyle Rittenhouse on all charges. Once again, the U.S. court system has functioned to protect a racist murderer, who went out into the streets of Kenosha on August 25, 2020 to wage war on people protesting the police shooting of Jacob Blake, a 29-year-old Black man. The verdict is an infuriating reminder of the fundamentally white supremacist nature of the capitalist legal system in the United States. The acquittal of Rittenhouse has tremendously dangerous ramifications. It effectively hands a license to kill to right wing vigilantes, who will now feel even more empowered to terrorize people in the name of “law and order”. There is a long and deadly tradition of far right militia-type violence in the United States, and this threat has now been given a huge boost by the state. The kangaroo court presided over by Judge Bruce Schroeder was a disgrace, and greatly enhanced Rittenhouse's chances of acquittal by the nearly all-white jury. The process was rigged from the start, and grew more and more absurd with each passing day. Skeptics Parse NBC News Statement After Employee Accused Of Tailing Rittenhouse Jurors Bus - Skeptics are accusing NBC News of attempting to mislead in a Thursday statement after police alleged an MSNBC freelancer was following the bus of the Kyle Rittenhouse trial jury. Wisconsin circuit court Judge Bruce Schroeder banned MSNBC from his courthouse on Thursday after police caught and cited a man for a traffic violation claiming to be with the network tailing the jury's sealed bus. The man said he was under orders from a higher-up at the network in New York, according to authorities. NBC News, a sister network to MSNBC, admitted that the man involved in the incident was a freelancer for MSNBC. NBC News denied that the man was tailing the bus, contrary to what he told police, according to authorities. NBC News also claimed that the freelancer never intended to contact jurors “during deliberations.” “Last night, a freelancer received a traffic citation. While the traffic violation took place near the jury van, the freelancer never contacted or intended to contact the jurors during deliberations, and never photographed or intended to photograph them,” NBC News said in a statement. “We regret the incident and will fully cooperate with the authorities on any investigation.” The “during deliberations” phrase of the statement received attention and criticism online as reporters and others suggested that NBC was trying to mislead and cover for sending a freelancer after the Rittenhouse trial jurors. “*During deliberations*,” said Erielle Davidson, a senior policy analyst at the Jewish Institute for National Security of America. “Full intent on seeing the jurors and contacting them after deliberations. Given the media's generally grotesque coverage of this trial, at what point does such behavior amount to intimidation?” Radio host Vince Coglianese remarked, “NBC promises the guy they had following the jury never intended to do anything related to journalism.” “He said he was told to follow them. This statement doesn't address that,” Tablet Magazine CTO Noam Blum said, referring to the freelancer's statement to police. NBC News did not immediately respond to a request for clarification from The Daily Wire. Schroeder announced that he had banned MSNBC from the courthouse on Thursday after receiving a report from police. “The matter is under further investigation at this point, and the media has asked questions about it. That's the latest I have,” Schroeder said. “He was ticketed for violating a traffic control signal. He is not here today, from what I'm told, and I have instructed that no one from MSNBC News will be permitted in this building for the duration of this trial.” The judge added that the matter would be referred to the “proper authorities” for further investigation. “This is a very serious matter, and I don't know what the ultimate truth of it is, but absolutely it would go without much thinking that someone who is following a jury bus, that's an extremely serious matter and will be referred to the proper authorities for further action,” he said. The Boys got their fill of dolphin hugging last week. Well, at least Scott did. Judge Bruce Schroeder dropped the weapons charge against Kyle Rittenhouse, and the Wisconsin National Guard was activated ahead of Rittenhouse's verdict. According to an ABC poll, the midterms are going to be really bad for democrats, and Winsome Sears is ready to let the wounds of the past heal. It wouldn't be too hard to guess what happened after the Los Angeles school board defunded its police, and Robert Francis “Beto” O'Rourke is officially running for governor in Texas. Disgraced Andrew Cuomo is looking to run for attorney general of New York, and CNN commentators fume after a CNN report of dysfunction in Vice President Kamala Harris' office. With booster jabs being pushed on the people of the world there has been a boost of people power against continuing pandemic powers and restrictions. I look at the world being at another important crossroads on this week's Tim's News Explosion. On Saturday afternoon Melbourne saw another record-breaking turnout for a non-communist protest. The latest kill the bill rally against Dan Andrews' permanent pandemic laws saw 50,000 attended. More have felt comfortable in attending such rallies over the past three weeks with Victoria Police now allowing peaceful protests. The Saturday Age featured an investigative spread on the rising Victorian Police state with the growth in police and prison funding outstripping health and education services. AFL player Liam Jones has decided to retire from the game rather than submit to the AFL and Victorian vaccination mandate forgoing a $500,000 annual salary. AFLW player Deni Varnhagen who is also a registered nurse has given up two careers for not being vaccinated, she has praised Jones. In the Northern Hemisphere where winter is approaching Central European nations are reintroducing restrictions despite high vaccination rates: Austria has announced a lockdown for the unvaccinated and the Netherlands has announced a partial lockdown for both the fully vaccinated and unvaccinated. With Israel flattening its curve again with third booster doses it is highly likely boosters will be mandated in Australia. The UK Johnson Government has resisted a media campaign to reintroduce restrictions instead focusing on its booster rollout. Leaked to the Daily Mail UK is a plan by the Johnson Government to completely dismantle its covid tracing and isolation protocols called Operation Rampdown. The trial of Kyle Rittenhouse has taken place in Wisconsin which has been disastrous for the state prosection as all the evidence shows that Kyle shot and killed two Antifa criminals including known pedophile Joseph Rosenbaum in self-defense. The trial Judge Bruce Schroeder eviscerated the state prosecutors for trying to bring into the trial Kyle doing the okay sign with some Proud Boys with a shirt that said 'free as fuck'. Fresh off of a Michigan Wolverines loss and a last-minute schedule change, Norm calls an audible to provide an update and assessment of the latest developments in the State of Wisconsin v. Rittenhouse criminal proceedings, with jury selection set to begin Monday, November 1, 2021.  During last week's hearing, Judge Bruce Schroeder ruled that the prosecution will be prohibited from referring to the decedents as "victims" during the course of the trial.  Norm takes this opportunity to unpack the premise underlying Judge Schroeder's ruling and to illustrate that, "calling names is not proof." Norm lays out the relevant legal standards attendant to the charges against Rittenhouse and also explains the nature of the self-defense legal burden and where that burden properly resides at trial.  Of course, this discussion would not be complete without an analysis of jury selection, what seasoned defense attorneys are looking for, and what Norm means when he says he looks for "bounce" in determining who is the best fit to sit on a jury.  Rate Law and Legitimacy six buckeyes on your chosen platform. Judge Bruce Schroeder needs to be investigated. He's the judge assigned to the Kyle Rittenhouse case. His actions this week are very worrisome. Rittenhouse killed two protesters & the judge ruled that the prosecutors cannot refer to them as victims. Crazy thing is the defense can refer to them as arsonist & looters. It's very clear that this judge is not a fair judge & has an agenda. Maybe we should look into Schroeder whereabouts on January 6th.
