Our podcast show being released today is part 2 of a repurposed interactive webinar that we presented on March 24 featuring two of the leading journalists who cover the CFPB - Jon Hill from Law360 and Evan Weinberger from Bloomberg. Our show begins with Tom Burke, a Ballard Spahr consumer financial services litigator, describing in general terms the status of the 38 CFPB enforcement lawsuits that were pending when Rohit Chopra was terminated. The cases fall into four categories: (a) those which have already been voluntarily dismissed with prejudice by the CFPB; (b) those which the CFPB has notified the courts that it intends to continue to prosecute; (c) those in which the CFPB has sought a stay for a period of time in order for it to evaluate whether or not to continue to prosecute them where the stay has been granted by the courts; and (d) those in which the CFPB's motion for a stay has been denied by the courts or not yet acted upon. Alan Kaplinsky then gave a short report describing a number of bills introduced this term related to the CFPB. Alan remarked that the only legislative effort which might bear fruit for the Republicans is to attempt to add to the budget reconciliation bill a provision subjecting the CFPB to funding through Congressional appropriations. Such an effort would need to be approved by the Senate Parliamentarian. Finally, Alan expressed surprise that the Republicans, in seeking to shut down the CFPB, have not relied on the argument that the CFPB has been unlawfully funded by the Federal Reserve Board since September 2022 because there has been no “combined earnings of the Federal Reserve Banks” beginning then through the present. (Dodd-Frank stipulates that the CFPB may be funded only out of such “combined earnings”). For more information about that funding issue, listen to Alan's recent interview of Professor Hal Scott of Harvard Law School who has written prolifically about it. On Monday of this week, Professor Scott published his third op-ed in the Wall Street Journal, in which he concluded: “Since the bureau is operating illegally, the president can halt its work immediately by executive order. The order should declare that all work at the CFPB will stop, that all rules enacted since funding became illegal in September 2022 are void, and that no new rules will be enforced.” Joseph Schuster then briefly described what has been happening at other federal agencies with respect to consumer financial services matters. Joseph and Alan reported on the fact that President Trump recently fired without cause the two Democratic members of the Federal Trade Commission leaving only two Republican members on the Commission. He took that action despite an old Supreme Court case holding that the language in the FTC Act stating that the President may remove an FTC member only for cause does not run afoul of the separation of powers clause in the Constitution. The two Democratic commissioners have sued the Administration for violating the FTC Act provision, stating that the President may only remove an FTC commissioner for cause. The President had previously fired Democratic members at the Merit Systems Selection Board and National Labor Relations Board. President Trump based his firings on the belief that the Supreme Court will overrule the old Supreme Court case on the basis that the “termination for cause” language in the relevant statutes is unconstitutional. After the recording of this webinar, the DC Circuit Court of Appeals stayed, by a 2-1 vote, a District Court order holding that Trump's firing of the Democratic members of the NLRB and Merit Systems Selection Board was unlawful. That order was subsequently overturned by the court of appeals acting en banc. Subsequently, Chief Justice Roberts stayed that order. In light of these developments, it seems unlikely that the two FTC commissioners will be reinstated, if at all, until the Supreme Court decides the case. Also, after the recording of this webinar, the Senate confirmed a third Republican to be an FTC commissioner. For those of you who want a deeper dive into post-election developments at federal agencies other than the CFPB, please register for our webinar titled “What Is Happening at the Federal Agencies (Other Than the CFPB) That is Relevant to the Consumer Financial Services Industry?” which will occur on May 13, 2025. Joseph then discussed developments at the FDIC where the FDIC withdrew the very controversial brokered deposits proposal, the 2023 corporate governance proposal, the Change-in-Bank- Control Act proposal and the incentive-based compensation proposal. He also reported that the FDIC rescinded its 2024 Statement of Policy on Bank Merger Transactions and delayed the compliance date for certain provisions in the sign and advertising rule. Joseph then discussed developments at the OCC where it (and the FDIC) announced that it would no longer use “reputation risk” as a basis for evaluating the safety and soundness of state-chartered banks that it supervises. The OCC, also, conditionally approved a charter for a Fintech business model to be a national bank and withdrew statements relating to crypto currency risk. Finally, Joseph discussed how state AGs and departments of banking have significantly ramped up their enforcement activities in response to what is happening at the CFPB. The podcast ended with each participant expressing his view on what the CFPB will look like when the dust settles. The broad consensus is that the CFPB will continue to operate with a greatly reduced staff and will only perform duties that are statutorily required. It is anticipated that there will be very little rulemaking except for rules that the CFPB is required to issue - namely, the small business data collection rule under 1071 of Dodd-Frank and the open banking rule under 1033 of Dodd-Frank. The panel also felt that the number of enforcement lawsuits and investigations will measurably decline with the focus being on companies engaged in blatant fraud or violations of the Military Lending Act. This podcast show was hosted by Alan Kaplinsky, the former practice group leader for 25 years and now senior counsel of the Consumer Financial Services Group. Riding Shotgun With Charlie #211 Dick Heller Heller v DC Back in 2018, I was heading to hear some friends speak at the Heller 10 Celebration hosted by Second Amendment Institute. I got a call from one of my friends and she said “we're going to Heller's house”. I wondered “who's we? Is it her? Am I part of we?”. She called back and I got to go hang out at the Heller resident. The next day, I found myself being asked/told that I was going to give an impromptu speech on the Supreme Court Steps. I've seen Dick at a number of events and got to film this show on our way to go shoot sporting clays at the M&M Hunting Preserve in New Jersey. He was the keynote at a fundraiser the night before. We shot clays with John Petrolino (RSWC #093), Gabby Franco (RSWC #), and Eric, who was helping get Dick around for the weekend. We've all heard of the Heller decision. We all know what happened in the Heller case. It's been cited and referenced in cases upon cases. It's referenced in the McDonald v Chicago and NYSRPA v Bruen. If you haven't read that “magnificent Scalia decision”, you need to do some homework. The Heller case was ruled in 2008, but it started years before. Getting a case to the SCOTUS takes time and money. And lots of both. Several years before, Dick was friends with a fighter pilot and instructor and Vietnam veteran. He was also an Olympic shooter in 1980. Dick rented him a room. So he came over with a truck full of guns, which was illegal at the time, and said they're all going to jail. The friend got the guns out of DC and decided that he was going to go to law school to fight this nonsense. Heller said he was going to become a cop and they'll give him a gun to protect them, but he won't be able to protect himself. This is the beginning of the case. When the case was done, Heller had to sign 12 more papers for another case just so the lawyers would get paid. He points out that the government pays to fight us with our own money in the form of taxes. And we also have to pay with our own money to fight the government. Heller's team of lawyers were able to win the case despite the unlimited funds that DC has. The case went to a federal court since it was a Constitutional issue. But it didn't rule in Heller's favor the first time. So they appealed to the DC Circuit Court. There they prevail. During one of the trials, the opposing attorney admits to the judge that they just don't want guns in DC. The lawyer hadn't seen or heard the news that crimes in DC at the time was rising and a very violent city to live in. Heller also shares that with his ruling in 2008 and with Sandy Hook happening in 2012, he was posed with what kind of influence his case could have been responsible for that incident. Ultimately, each individual has to be responsible for their actions. His ruling shouldn't, and didn't, have anything to do with other acts of evil people. For years now, Heller has been associated with Gun Owners of America because they are the group that will not compromise our rights away. He's been to a number of the Coalition of New Jersey Gun Owners and Women for Gun Rights events up and down the east coast. And he's been to several of the other national 2A events around the country. If you get a chance to see him and hear him speak, you need to take that. He's a national treasure. Today's Headlines: Out of Israel and Gaza today, the IDF rescued two hostages in Rafah, Gaza, while conducting heavy strikes that reportedly killed nearly 70 Gazans. President Biden, alongside Jordan's King Abdullah, emphasized the need to protect over a million Palestinians in Rafah amid Israel's offensive. The Egyptian government threatened to void the Camp David Accords if the IDF invades Rafah while Netanyahu insists on sending ground troops to defeat Hamas. The IDF also discovered a tunnel network under UNRWA's headquarters in Gaza, suggesting it was used for intelligence purposes by Hamas. Back on the coup beat, Donald Trump has filed a request with the Supreme Court to overturn a ruling by the DC Circuit Court of Appeals, which determined he is not immune from prosecution for election interference. In addition, Trump and his immigration advisor, Stephen Miller, are planning a potential future presidency with promises of the "largest domestic deportation operation in history," aiming to mobilize a private red-state army for mass deportations. In a separate development, a major special election is underway in New York's 3rd district to replace former Representative George Santos, with Democrat Tom Suozzi facing off against Republican Mazi Pilip amidst challenging weather conditions. Despite the storm, polling locations remain open, and both candidates offer assistance to voters needing transportation to the polls. This week on Ring of Fire! The DC Circuit Court of Appeals ruled in a unanimous decision on Tuesday that Donald Trump does NOT have immunity from prosecution, and therefore the election subversion case against him can, and will, go to trial. But that doesn't mean that the immunity fight is over. Trump still has the option to appeal the ruling to the Supreme Court, which has already been put into motion. But the Appeals Court's ruling might be written in a way that already bypasses the Supreme Court. During an interview with Fox News this week, Kellyanne Conway was asked about Donald Trump's potential vice presidential picks, and she may have let it slip who Trump is leaning towards. After rattling off a few names, Conway then focused in on Republican Senator Tim Scott, praising him for dropping out and actively campaigning for Trump before adding that he "checks all of the boxes." That's not really the case, but if Trump thinks so then he's likely made his pick already. Jack Smith spent 15 pages of a new court filing debunking the lies that Donald Trump has been telling about the charges against him in the documents case. Trump has claimed repeatedly - including in court filings - that he was allowed to take the documents and that he had been given special security clearances to do so. Smith argued that this actually never happened, and claimed that Trump's statements to the contrary were provably false. Jim Jordan's House Judiciary Committee has subpoenaed Fulton County DA Fani Willis (again). This time, Jordan is seeking information about how Fulton County used a federal grant from the Department of Justice, as well as answers about an alleged whistleblower who claims that they were demoted after pointing out the misuse of federal funds by a district employee. Additionally, Willis came out over the weekend and admitted to having a romantic relationship with her fellow prosecutor. All that, and much more, on this week's Ring of Fire Podcast!

As the 50 states continue to decide the question of whether Donald Trump should be disqualified from state election ballots pursuant to the 14th Amendment because he engaged in insurrection against the United States, it looks like one conservative Supreme Court Justice ruled on that issue previously. In the ruling handed down by the Colorado Supreme Court disqualifying Trump from the presidential ballot in Colorado, the court relied on a legal opinion authored by Neil Gorsuch when he was a federal appellate court judge. The issue was whether the states had the authority to ban from their election ballots a candidate who was disqualified under the Constitution. Here are the precise words of then-Judge (now Supreme Court Justice) Neil Gorsuch: "a state's legitimate interest in protecting the integrity and practical functioning of the political process permits it to exclude from the ballot candidates who are constitutionally prohibited from assuming office. "Glenn says: So the only question left is - will Gorsuch remain consistent with his prior ruling and allow Colorado and the other states to disqualify Trump from their state ballots? Then, Donald Trump has asked the DC Circuit Court of Appeals to rule that he is above the law - absolutely immune from being prosecuted for the crimes he committed while in office. This week, Trump filed his opposition to Jack Smith's SCOTUS petition in the immunity case, and the Supreme Court has denied that petition to grant certiorari before judgment.Meanwhile, the DC Circuit Court of Appeals has granted Jack Smith's request for an expedited appeal. Also, Trump has asked for a hearing in front of the full DC Circuit court panel on his appeal of Judge Chutkan's limited gag order. Even though the DC trial has been stayed, Jack Smith filed his exhibit list and discovery with Trump's lawyers, who refused to accept it.There's another perfect Trump call, this time with Michigan canvassers in November of 2020. On Friday, two courts weighed in on the question of presidential immunity. First, Judge Chutkan of the DC District Court ruled that Trump is not immune from Special Counsel Jack Smith's criminal prosecution for his conduct on Jan. 6.
