Trucking Company Hired A Killer. Yaimy Galan Segura, Owner Castellano 03 Trucking LLC, the trucking company that hired Rogel Aguilera-Mederos, gave a deposition after the accident. Segura's deposition was made public recently and we have a partial copy. In the writings, she admitted she knew nothing about the trucking industry. Rather she had a neighbor that owned a small company and was doing well. With advice from friends and researching the internet, Yaimy started her very own trucking company. In an arbitration, also obtained by TalkCDL, she disputed the fines she had received. With barley over $10, 000 in fines Segura went to arbitration to dispute. Records show that she was fined for numerous violations including one count is for violating 49 CFR 382.301(a) (“No employer shall allow a driver, who the employer intends to hire or use, to perform safety-sensitive functions unless the employer has received a controlled substances test result from the [named entities] indicating a verified negative test result for that driver.”). She was also fined for Ten counts are for violating 49 CFR 395.8(e)(l) (“No driver or motor carrier may make a false report in connection with a duty status.”). Examples of these counts involve driver reports indicating that the driver was in a vehicle's sleeping berth, although at such times the driver was driving the vehicle. We recently reported on the Rogel Aguilera-Mederos trial regarding the truck driver who crashed his semi-truck on I-70 in Colorado. The crash caused a fiery scene on the interstate and four fatalities. Justice For Truckers. This past week Rogel Aguilera-Mederos, the trucker that was involved in a quadruple fatality in 2019, was resentenced for the deadly crash. Originally Aguilera-Mederos received 110 years in prison for the charges of vehicular homicide. He was given clemency by the Governor of Colorado and his sentence was dropped to 10 years. With good behavior he could be out of prison at the end of 2026. Some safety violations can turn into misdemeanor or felony convictions Paul O. Rogel Aguilera-Mederos, a Cuban man living in Texas and working for a Houston, Texas based trucking company experienced brake failure while transporting a load through Colorado. The brake failure resulted in a fiery 28 car crash on I-70 in a mountainous section of the interstate. Rogel Aguilera-Mederos was convicted of vehicular homicide Because of the way the law is set up on Colorado, a judge had no choice but too hand down the stiff sentence. Public outcry has been overwhelming for this case. Over four million signatures have have been added to a petition calling for clemency for the trucker. Most agree that the punishment by far exceeded the conviction. More recently prosecutors handed the paperwork for clemency to the courts in Colorado asking for a sentence of 10 to 30 years. Rogel Aguilera-Mederos was sentenced to 110 years in prison for a an accident in 2019 that took the lives of 4 people and left 10 more injured. His brakes failed going down Lookout Mountain on I 70 eastbound, a 6,000 foot drop towards the city of Denver. It's a very dangerous hill that some companies ban first-year drivers from because of their lack of experience. This was Rogel's first solo trip and he was loaded with lumber, making his truck somewhere around the 80,000 lb gross limit. The prosecution argued that he had ample opportunity to avoid the crash and that he ignored all of those opportunities. But what actually led to the brakes failing and what was possibly going through his mind as everything unfolded? I've descended that same hill multiple times, and even did so as a rookie driver. Believe me, it's scary. There is a petition that has gained over 4.5 million signatures to give Rogel clemency. The trucking industry is protesting this lengthy sentence with the hashtag #NoTrucksToColorado. In this episode we take another angle--we talk about how the vast majority of sexual abuse cases are never investigated. Of the ones that are, very few offenders receive a lengthy sentence. Judges are often extremely lenient on sex offenders. We talk about the miscarriage of justice in this episode and what needs to change.
