The primary objectives of criminal law include deterrence (general and specific), incapacitation, retribution, rehabilitation, and defining societal norms. Unlike civil law, which aims to compensate a wronged party, criminal law operates on behalf of the state to prosecute and punish wrongful acts in the communal interest.Felonies are typically punishable by death or imprisonment for more than one year, while misdemeanors are lesser offenses usually punishable by a fine or incarceration for less than one year. Murder is an example of a malum in se crime because it violates fundamental moral standards, whereas a traffic violation is an example of a malum prohibitum crime because its illegality stems from statute.General intent crimes require the intent to perform the physical act itself, such as intentionally striking someone in battery. Specific intent crimes require an additional subjective intent to bring about a specific result, such as in theft, where the defendant must intend to permanently deprive another of their property.A state generally has jurisdiction to prosecute crimes that either occur within its borders or produce harmful effects within its territory. Concurrent jurisdiction arises when more than one sovereign has the legal authority to prosecute the same conduct. The doctrine of dual sovereignty under the Double Jeopardy Clause allows both federal and state governments to prosecute the same individual for the same conduct without violating double jeopardy protections, as they are separate sovereigns.Actus reus refers to the physical component of a crime, which is a voluntary act or a qualifying omission. An omission can constitute actus reus when there is a legal duty to act, the person is physically capable of acting, and they fail to do so, such as a parent deliberately withholding food from their child.Recklessness is a subjective mental state involving the conscious disregard of a substantial and unjustifiable risk; the defendant must be aware of the risk. Negligence is an objective standard that applies when a person fails to perceive a substantial and unjustifiable risk that a reasonable person would have recognized, regardless of actual awareness.Strict liability crimes are offenses where no mental state is required; the mere commission of the act is sufficient for liability. These types of crimes are most commonly found in regulatory and public welfare areas such as food safety or statutory rape. For example, a vendor selling contaminated food may be held strictly liable regardless of intent.The principle of concurrence requires that the actus reus (the physical act) and the mens rea (the mental state) coincide in time. This is generally required because criminal liability is predicated on the idea that the wrongful conduct was accompanied by a culpable state of mind.Factual cause, or "but-for" causation, means that the harm would not have occurred but for the defendant's act. Legal cause, or proximate cause, addresses whether the result is closely enough connected to the act to hold the defendant criminally responsible, considering factors like foreseeability. An intervening cause might break the chain of legal causation if it is unforeseeable and superseding, meaning it was not a natural or probable consequence of the defendant's actions.A principal is the primary actor who commits the criminal act, while an accomplice is someone who aids, encourages, or assists the principal with the intent that the crime be committed. Accomplice liability requires both an act of assistance and the specific intent that the underlying crime be committed by the principal.

Yet, their recent handling of the National Nuclear Security Administration (NNSA) layoffs reveals a stark contradiction—one of incompetence and recklessness.According to reports from the Los Angeles Times and MSN, the Trump administration, under DOGE's guidance, mistakenly fired a large portion of NNSA employees last Thursday, only to scramble the following day to rehire them after realizing their error. While most workers were reinstated, 28 employees were permanently dismissed. This lecture covers the core principles of criminal law, focusing on the elements of a crime, crimes against persons and property, and inchoate offenses. Elements of a Crime: Actus Reus is the physical component of a crime, requiring a voluntary act or a legal duty to act. Involuntary acts do not satisfy actus reus. A failure to act can be criminal if there's a legal duty, such as by statute, contract, special relationship, voluntary assumption of care, or creation of peril. Mens Rea refers to the mental state of the defendant, categorized by the Model Penal Code as purpose (intent), knowledge, recklessness, and negligence. Purpose is a conscious objective to engage in prohibited conduct. Knowledge means awareness that conduct will cause a specific result. Recklessness is a conscious disregard of a substantial and unjustifiable risk. Negligence is the failure to be aware of a substantial and unjustifiable risk. Causation must be established for crimes that require a specific result. Actual cause is when the harm would not have occurred "but for" the defendant's actions, while proximate cause means the defendant is legally responsible for foreseeable consequences. Crimes Against the Person: Homicide is the unlawful killing of a human being. Common Law Murder requires malice aforethought, including intent to kill, intent to inflict serious bodily harm, depraved heart disregard for human life, or felony murder. First-degree murder involves premeditation, while second-degree murder includes intentional but unpremeditated killings or deaths caused by an extreme disregard for life. Manslaughter includes voluntary manslaughter, a killing mitigated by adequate provocation, and involuntary manslaughter, an unintentional killing resulting from criminal negligence or during a non-dangerous unlawful act. Crimes Against Property: Larceny is the trespassory taking and carrying away of another's tangible personal property with intent to permanently deprive. Robbery is larceny committed with force or threat of force. Burglary is the breaking and entering of a structure with the intent to commit a crime inside. Arson is the malicious burning of a building. Inchoate Offenses and Accomplice Liability: Attempt is taking a substantial step toward committing a crime with the intent to complete it. Solicitation is intentionally encouraging another to commit a crime with the intent that the crime be committed. Conspiracy is an agreement between two or more persons to commit a crime, plus an overt act in furtherance of the agreement. Accomplice liability extends criminal responsibility to those who aid or encourage the commission of a crime. This lecture serves as an introduction to substantive criminal law, which will be followed by a discussion of defenses to crimes and criminal procedure.

The International Criminal Court has formally issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Israeli Defense Minister Yoav Gallant for war crimes and crimes against humanity. No such arrest warrants were issued for President Biden or any of the other western officials who've been backing Israel's genocidal atrocities, which is a bit like a judge issuing a warrant for a mass murderer but not for the guy who gave him the gun and stood next to him handing him ammunition and drove the getaway car and lied to the police to cover up the crime. Luke 15:11-32; Exodus 34:6; Numbers 14:18; Psalm 86:5, 15; Psalm 103:8; Psalm 145:8; Joel 2:13; Jonah 4:2; Luke 15:10. This parable is called The Prodigal Son, but perhaps a better name for it is: “Prodigal Son - Prodigal Father.” Why? The dictionary has 2 definitions for prodigal: 1. Wasteful - One who recklessly squanders what he has been given (This is the youngest son in this story) 2. Extravagant - One who abundantly gives and lavishly blesses (This is The Father) The parable is the story of a son who asks for his inheritance early, leaves with it, squanders his newly given wealth in wild living and ends up spending it all and having nothing left. The only job he's able to get is taking care of a farmer's pigs. That's when the regret settles in. As Pastor progresses through the story he uses these words to describe the steps the prodigal son went through: 1. Rebellion - against God's plan for his life 2. Recklessness - in our choices and behavior 3. Ruin - experienced as a result of rebellion and choices 4. Regret - wishing he could start over, a re-do to make different choices, but we can't rewind or redo what's already done; however, we can... 5. Return - to God. How will He receive us back? Will He be angry, accusatory, disgusted? No! The younger son returns, repentant, and the Father opens His arms, comes running towards the son and embraces him, welcoming him home with a heart full of love. This is the Father's heart for each one of us. He stretches out nail-pierced hands and says, “Welcome home!” That's the heart of God and that's the love of God. No matter what we've done, no matter where we've been, no matter how we've wandered - God is a good, good Father and welcomes us back to Himself with open arms of reception. John 3:16 - God loves and He wants us to come home - to come back to Him. We can know for certain - We have a Heavenly Father who is perfect- who loves us unconditionally and who wants only what is best for us. Even difficulties have the intent of drawing us back to Him. Even when we experience sorrows, loss and trials, God's desire is that we wake up and see His incredible love for us in Jesus our Savior and there - no matter what - we will find forgiveness, mercy, love and peace - because God is a good Father. But there's more to this story... So they're having a party celebrating the youngest son's return home - but the older son is jealous, indignant and angry that there is a party for this wayward brother and that the father hasn't ever thrown a party for him and he's been there working and helping the father and never left. The older son doesn't understand the Father's love.... The older son sees the relationship with his father as one of performance and what the son has done for the Father, and how badly his brother has failed. The Father pleads with the older jealous son saying, “You are always with me - everything I have is already yours, but we must celebrate your brother's return, for he was lost but now is found!” The older son doesn't understand the heart of the father. The father is merciful. The younger son is repentant. The older son is prideful. Why did Jesus end the story with the older son? There's a lesson for us all in this story for we all have sinned and fallen short of the glory of God. Not just the younger son, but the older son as well. All of us like sheep have gone astray - but God laid on Jesus the sins of all and by His stripes we are healed. We need to understand the mercy of the Father and like the younger son - we need to recognize our rebellion and recklessness, we need to repent and return to God through Jesus, our Deliverer and Savior. This story is a great summary of the greatest book ever written - the Bible - the Bible shares the story of a God who has loved us even though we rebelled against Him and when we turn around and return to Him there's a celebration party!
