Today on the podcast we're having a bit of a change … instead of Suzanne interviewing a guest, she shares her personal experience of what happened in the early days of setting up her own business and how, due to being too busy and not thinking that something would happen, she ended up not having the right legal protection in place, which almost ended in financial disaster.  Suzanne trained and practiced at the world's largest law firm, specialising in mergers and acquisitions and private equity - a field that notoriously involves a lot of hard work, massive amounts of adrenaline, long hours and endless late nights.  Knowing she wanted to start a family, Suzanne quickly realised that working 20-hour days was unsustainable and not conducive to her having the work life balance she dreamed of. Having always had an entrepreneurial streak, Suzanne thought long and hard about what she could do which would work hand in hand with looking after a growing family. So, the Small Business Legal Academy was born … and quickly thrived… as she gained a reputation as the small business go-to legal expert with a primarily female focussed audience gained through a powerful network of mumpreneurs. However, an early spanner in the works – a non-payment of a £5,000 invoice - meant make or break for Suzanne's fledgling enterprise and, ultimately, the possibility of returning to the corporate world – one which made her feel sick to the core. Your newsletter is, effectively, a lead magnet i.e. a piece of content you create to attract your ideal customers/clients (or nurture your relationship with existing ones).  A great lead magnet solves a specific type of problem for a specific type of customer/client, offers a transformation, gives a quick win and (crucially) leads your subscribers towards a paid product/service. Learn how to create an effective lead magnet for your business.  For example, the Instagram expert Sara Tasker has a monthly newsletter where she shares new and interesting Instagram hashtags that will be useful for her audience. I look forward to receiving it because I know I'm going to get some fab new hashtags to try.  It solves a problem for me because researching hashtags take time - and is not the most enjoyable job (which is why I look forward to receiving it). So Sara is saving me time on something I don't like doing. She has an online course specifically for Instagram growth, so her email newsletter is perfectly aligned with one of her paid offers.  Entrepreneur Marie Forleo sends out a weekly email about her latest Q & A Tuesday YouTube video - which contains valuable tips on business and marketing. These free videos add value and build trust, so when she launches her online marketing programme B-School, people are queuing up ready to buy.  Remember an email newsletter isn't just about attracting new customers/clients. It can be about nurturing your relationship with existing ones.  I send an email every Friday morning to update my audience about my latest podcast episode. And anyone who buys my Media Diary - an A4 desk that includes key dates and awareness days you can use to plan out your content for the coming year - also gets a monthly email newsletter. This includes additional awareness dates and news of new films, books and TV shows (things we wouldn't necessarily have been aware of when creating the diary) to spark content ideas. Because this email newsletter is adding value, subscribers often email back to thank us for sending it. You Are the Media founder Mark Masters, sends a weekly email (every Thursday at 6am GMT/BST) with news, ideas and inspiration around content marketing and audience growth. Amongst other things, this email helps him nurture his relationship with existing and prospective attendees of his annual You Are The Media live event. I spoke at the event in Bournemouth in June and it was clear this weekly email was instrumental in filling the room at that live event.  Pro tip: Remember that solving a problem for your subscribers doesn't necessarily have to be offering tips/advice. Solving a problem for your audience could be making them laugh or giving them something beautiful to read during their coffee break (the very reason I subscribe to Alexandra Franzen's newsletter). Whatever adds value for your audience.  How to find out what you should include in your email newsletter? If you already have an email list, ask them what they'd like to hear about. Don't ask them an open question e.g. ‘What would you like me to include in my email newsletter?' If you do this, you're asking them to think really hard - which means it's far less likely they'll reply.  Instead, give them three or four ideas you have for your email newsletter content and ask them to choose the one that feels like the best fit for them. This way, they have to do less thinking, which means they're far more likely to reply. Once you've got them in a conversation, you can always ask further questions to find out if they have any ideas of their own (some will volunteer anyway). If you don't have an email list, follow exactly the same process with five to ten of your ideal clients/customers. And/or ask your social media followers. Do remember that the only way you will truly know what your audience want to hear about is by putting content out there and seeing how they respond. This can be scary, but it's the only way to truly find out what kind of content your subscribers really need.  How long does your email newsletter need to be? The rather unsatisfactory answer is...as long as it needs to be.  I subscribe to some newsletters that are just a few lines long but solve my problems. Others are more in-depth. Make it as a long or short as it needs to be for your audience.  Does an email newsletter have to include pictures/or have a fancy layout? If you've got the resources to do it and you think it would work for your audience, go ahead and do it. But plain text is absolutely fine. In fact, there is a lot of research to show plain text emails actually perform better than those with images.  And remember an email newsletter doesn't have to be completely text-based. You can share video, audio, infographics, for example.  It all comes back to what your audience needs from you.  How often should you send out your email newsletter? The rather unsatisfactory answer is: as often as you feel that you need to and probably more often than you think.  The key thing is that you're adding value and you're tracking your results and tweaking and adjusting as necessary.  For example, Kennedy teaches entertainers to get booked out with clients. He sends a daily email to his followers and makes a paid offer for his membership/events in pretty much every email. It's delivering consistently good results for him.  Your email newsletter is only too frequent if it's not delivering results for you.  Don't panic if you get a few unsubscribes from your newsletter (or even one or two people who email to say your emails are too frequent for them. What is too frequent for one person is often fine for another). You only need to worry if it's happening regularly.  Bonus tip: Always try to provide an opportunity for people to ‘talk back' to you if possible e.g. ‘hit reply and let me know what you think about x or y.' The more conversation you can generate, the more effective your newsletters will be.  How do you get people to subscribe to your email newsletter? The key thing to remember is that no one wants to subscribe to a newsletter. Another piece of junk in their inbox that they probably won't open. So don't ask people to subscribe to your newsletter. Instead, sell the value e.g. ‘Sign up for my monthly hashtag newsletter and save yourself tons of time on hashtag research.'  or ‘Register for our monthly Media Diary newsletter to get additional awareness days and key dates you can use to help with your content planning.'  Here's 39 surprisingly easy ways to get people to join your email list.  What kind of email newsletter can you create if you have a product-based business? Many product-based business owners think the only email newsletter they can send is one with discounts/offers. If the only thing you're doing is offering discounts, you'll have no trouble getting people to sign up to your email newsletter. But you may struggle to get people to build the kind of loyalty that results in repeat sales.  A more savvy approach can be to think about how people might be using your product. A good example of this is my Media Diary newsletter.  Sending a monthly newsletter with additional awareness days and ideas not only adds value, it also reminds people that we exist - so other relevant products go on sale, I'm already top of mind. So don't just send information about your products, send information about how people can use your products (or products like yours).  For example, if you sell garden offices, send tips on how to style your garden office, how to keep it warm in winter or cool in summer. This is a practical content for past clients and aspirational content for prospective clients. If people see you as a source of useful information - rather than someone who is trying to sell them stuff all the time -  they're far more likely to want to buy from you. If sell homeware and gifts like my client Penelope Hope founder Nadia Newton, you can create seasonal content that helps your subscribers - and helps you make sales.  The great thing about a newsletter is that you can make it seasonal. For example, Nadia recently launched a range of beach bags. Creating a summer newsletter than includes a round-up of the most stylish beach accessories of the summer (that includes her beach bags) would be a great way for Nadia to add value and sell more of her beach bags.  She could also do similar round-ups for Mothers' Day gifts, Teachers' leaving presents and, of course, Christmas gifts.  Bonus tip: Don't be afraid to include competitors' products in your round-ups. While it might sound counter-intuitive, if you position yourself as a helpful person/brand, you'll build loyalty and trust - making people far more likely to buy from you.  If you have a product-based business position yourself as an expert in the type of products you sell - rather than someone who sells stuff. That is what will keep your customers coming back to you - time and time again.  Should you sell in your email newsletter? Absolutely yes. If it's appropriate, do make offers in your newsletter. As you all know by now as of May 25th, 2018 the new data protection laws - GDPR came into effect Europe-wide. There has been a big panic all over the world and a big confusion to what this means to us small business owners. A lot of false information has been circled around and everyone has been scrambling. Unless you are a lawyer who understands the jargon, most people where just left being confused really. Enter people like Suzanne Dibble. Suzanne is a lawyer who specialises in small businesses and she set herself the task to demystify GDPR for us. She established a Facebook Group for small business owners, which has since exploded to over 33k members and Suzanne made it her mission to post one video a day until the deadline May 25th. She also interviews people to discuss certain GDPR related topics that she herself is not an expert on ie. IT security. Over the last few months, I've embarked on this massive task of understanding GDPR and really deriving with an action plan of what I need to do to make myself compliant. When I first started with this task, I understood I needed a Privacy Notice on my website and apparently some check boxes, but that sure can't be all, can it? No it can't. There is lots more to GDPR than this. However, ones you get more into the nitty gritty of GDPR, it is actually not that complicated, just a bit of work to do on our end to make sure we are in compliance. So,I started by watching all the videos Suzanne provided in her Facebook group and researched lots of more info on the ICO website itself. However, once I've acquired all this knowledge, I kind of felt like I need to put it somewhere. So I've decided to do a podcast episode about it and share my findings with all of you. :) Even if this topic is the most dry topic it can be for photographers, this is essential and affects all our couples, our clients and our business. So I can only highly encourage you to take it seriously, not just because you can be fined and your reputation can be destroyed, but also just to increase your awareness and put your customers at east and their minds at rest knowing you are on it. I am sure that you’ve heard about General Data Protection Regulation (GDPR) which it came into effect on May 25th, 2018. It’s basically a stronger set of rules on EU data protection, which changes how businesses handle their customers' personal information and as a result, people have more control over their personal data. But what does it mean for your online business? When GDPR came into effect, everyone was freaking out about it because nobody really understood what it meant. So, to ease everyone’s fears and clear up some of the confusion, I invited data law protection expert, Suzanne Dibble, onto the show. Suzanne used to work as a business lawyer at the largest law firm in the world – literally. In 2010, she switched her focus from keeping household names and huge multi-nationals out of trouble to helping small business owners protect and scale their business. She’s a natural entrepreneur at heart and always provides practical and relevant advice to each of her clients. Essential Learning Points From This Episode: GDPR is a supercharged data protection law that replaces the previous 1995 Data Protection Directive Data is the world’s most valuable asset – so it’s important to protect it The maximum fine for a GDPR data breach is €20m or 4% of your global turnover in the last 12 months You must have a lawful ground for processing data which includes consent, contractual, legal and legitimate interests You don’t necessarily need to get an “opt-in consent” from existing customers to continue to market to them Your privacy notice must clearly state that people can object to the processing on the grounds of legitimate interests Use this opportunity to clean up your email list and sort out the subscribers who engage with you from those who never open your emails GDPR has amplified the standard of consent. There must be an affirmative action by the individual that signifies their consent It’s not mandatory that you need to have a double opt-in, but you may need it when dealing with special category data or sensitive data (such as health information) Don’t bundle all of your consent boxes together - you need to give people real choice and control Controllers can only use processors and virtual assistants outside the EU if they are GDPR compliant Much, much more! I’m super excited to talk to today’s guest, Suzanne Dibble the small business law expert based in The UK. She’s got 20+ years experience and has worked some big time entrepreneurs, like Richard Branson. She has been living, breathing, and consuming everything related to GDPR and how it affect small businesses for the past 3 months. Suzanne is on the show today to explain the ins and outs of GDPR so you can keep your agency in compliance and continue to generate leads despite stricter guidelines. What is GDPR? The GDPR (General Data Protection Regulation) is a set of rules imposed by the European Union (EU) who seek to create a harmonized data protection law framework across the EU and aims to give back to data subjects, control of their personal data. GDPR imposes strict rules on businesses hosting and processing this type of data, anywhere in the world. Suzanne says GDPR comes from a place of good intention, and isn’t just a new set of regulations to make our lives miserable. The good news is that there’s just a few steps to take that will keep you compliant by May 25, 2018. And the really good news is that there’s no enforcement agency waiting to haul you off to prison for non-compliance. :) What Does GDPR Mean for Agencies? Basically, this will affect your lead magnets and automated marketing campaign sequences. It’s all about transparency. Under these regulations, when people opt-in for something (like a lead magnet) that’s the only thing you can send them. If you want to continue to use their email address for marketing purposes, this will require additional consent. 3 Steps to GDPR Compliance Compliance does not have to be an overwhelming process. Suzanne top lined the three steps we can take to make sure we stay compliant: 1. Decide whether GDPR is relevant to your agency. It affects businesses who either (A.) process data of people in the EU with the intent to offer goods or services, and (B.) businesses monitoring the behaviors of those in the EU. If you’ve answered yes to either of these criteria, then you need to send a re-consent email to your lists to those recipients in the EU. 2. Determine if you have lawful grounds of processing data. There are 6 criteria that fall under the definition of being lawful under GDPR, though most small businesses will fall under one of the first four. Consent. The real issue is obtaining re-consent after May 25. With that, you have lawful grounds. Contractual agreement. If you’re already under contract with a client, you’re all set and new consent is not required. Compliance with the law. Record keeping or maintaining data on clients, employees, and contractors is consensual and therefore no new consent is required. Legitimate interest. Many of us will fall into this category, where you’re marketing to someone with legitimate interest in your service you can lawfully process their data with consent to do so. Vital interest. Public interest. 3. Write a new privacy policy and a cookies notice. Under GDPR you must be completely transparent about what you data you’re holding and why. Additionally, you must rationalize what you’re doing with any data, where it comes from, where you’re transferring it to, etc. GDPR has 13 points that must be addressed in your privacy policy so be sure you’re fully covered. Cookies are considered an extension of personal data. Therefore, businesses are also required to be transparent with their use and handling of cookie data with a cookies policy. What Happens If You’re Non-Compliant? As Suzanne explained, there’s no governing agency that’s enforcing these regulations or hunting down offenders. Basically, it just all comes down to a risk analysis. The real risks are to your brand reputation. Breaking compliance may upset people who are knowledgable on the subject. They may choose to take direct action and make a legal claim. And even if they don’t take action, you risk losing their trust and respect. There are over 250 pages to the Articles and Recitals of GDPR. I’ve invited on my friend Suzanne Dibble, who’s a business law expert in the UK, to break down what you need to know and do about the EU’s new General Data Protection Regulation. It seems as though not many people in the United States are talking about GDPR, but for those of us with online businesses, this is something we need to understand and act on. In this bonus episode we depart from our normal format and share the highlights from our recent virtual conference On The Tipping Point LIVE! where we talked to 13 extraordinary female entrepreneurs to discover their stories of getting past the tipping point in business. There was SO much helpful advice and experience shared that it’s impossible to get it all into one episode, so here we reflect on five of the most consistent messages we heard from our speakers about building success in business.  We hope you find them helpful too! IN THE SHOW … We start with a few moments discussion to put our own thinking into context, in particular looking at what makes these five messages relevant to both of us.  (1.27 – 6.20) 1 - Being You – be more you than you have ever given yourself permission to be before. This popped up in everyone’s interview in some way, and the specific examples that stand out for us are in the following interviews (6.20 – 9.20): Lucy Whittington: how to recognise your ‘thing’ in business and the difference between running ‘a’ business and running ‘your’ business. Susan Payton: owning your story and being who you really are in your business. Alison Jones: choosing to lead, being more of who you are and being ‘unapologetically you’. 2 - Stepping Up – the continual expansion of your comfort zone through being prepared to lean in to your fear and take action regardless. So many examples of this one! Here are some of the key stories that stood out for us (9.20 – 22.30): Alison Jones: the moment she discovered no-one gives us permission to lead in our business – we have to make the decision to step up. Cara Sayer: being prepared to make mistakes and learning from what doesn’t go to plan. Lottie Moore: celebrating what we want to replicate in business, no matter how small the win. Also remembering that everyone’s ‘Everest’ is a different height. Sarah Arrow: choosing between a rock and a hard place. Lindsey Fish: never settling – being willing to fail in order to learn how to succeed. Bryony Thomas: anything of long term value has a component of struggle. 3 - Taking Action – the importance of making opportunities happen, not wait for them to come to you. Here we also reflect on the many wonderful discussions during the conference about what we can learn from nature – from cultivating potatoes to building fire! Our key stories for taking action are (22.30 – 34.35): Lindsey Fish: being persistent and consistent in the face of adversity and not giving up. Kat Dever: the years of work that go into being an overnight success, and the importance of building our business in the right Nicola Huelin: what we can learn from planting and cultivating potatoes, and the learning that comes from a burning platform. Sarah Arrow:  how she tripled her income by showing up consistently in her business. Vee Smith and Veronica Pullen: taking action when perhaps you feel stuck, and how to move forward from a place where you can imagine all your emotional and material needs are already met. 4 - Masterminding – the importance of challenge and support, in growing both yourself and the business – and the business benefits of gathering high quality, collective wisdom and new perspectives.  This was or had been a key factor for all of our speakers – and the key stories for the benefits of masterminding are (34.36 – 45.35 ): Suzanne Dibble: the personal value gained through investing in business mastermind groups – the shared journey between like minded people.
