This Day in Legal History: LaGrand ICJ CaseOn June 27, 2001, the International Court of Justice (ICJ) made a landmark ruling in the LaGrand case, Germany v. United States, affirming that foreign nationals must be informed of their right to contact their home country's embassy following an arrest. This case revolved around brothers Karl and Walter LaGrand, German nationals who were arrested in Arizona in 1982 for murder and armed robbery. Arizona authorities failed to inform the brothers of their right to consular assistance as stipulated by the Vienna Convention on Consular Relations.Despite a 1999 U.S. Supreme Court decision upholding their convictions, Germany brought the case to the ICJ, which issued a provisional order to stay the executions. Nonetheless, Arizona proceeded with the executions that same year. The ICJ's 2001 ruling declared that the U.S. had violated both the Vienna Convention and the ICJ's provisional order.This decision underscored the importance of consular notification and reinforced international legal standards for the treatment of foreign nationals. It also highlighted the binding nature of ICJ provisional measures and the obligation of states to comply with international treaty obligations.Of course, having said all of that, the brothers LaGrand were still executed in contravention of both the ICJ and the Vienna Convention–so the degree to which decisions by either are truly binding is at least a matter of debate. The families of victims murdered by a Chiquita-funded paramilitary group will receive around $1,300 per victim, while their lawyer, Paul Wolf, is set to earn over $4 million in fees from the settlement. This payout is significantly lower than a recent verdict awarding millions per plaintiff. Colombian President Gustavo Petro criticized the settlement, arguing that it devalues Colombian lives.The settlement, affecting about 2,500 victims' families, came after a landmark jury verdict awarded $38.3 million to 16 victims' families. Chiquita, accused of paying paramilitary groups to quell regional unrest, claimed these payments were made under duress, but the jury rejected this defense. Salvatore Mancuso, a former paramilitary leader, confirmed Chiquita's payments in an interview.The lowest award from the recent verdict was $2 million, much higher than the settlement amount, which must be shared among family members. Wolf will collect over $4 million from the settlement, whether or not his clients accept the deal.This settlement has sparked additional legal actions and court filings in Florida, where other lawyers aim to secure more funds for victims. Senior District Judge Kenneth A. Marra must decide if there will be a cap on payments to families. Chiquita argued that Colombian law limits damages to about $52,000 per victim, while other plaintiff lawyers disputed this, citing a Colombian court ruling against such caps.Wolf defended the settlement, stating it was better to secure something for his clients than risk getting nothing. The 6-3 decision, authored by Justice Brett Kavanaugh, determined that federal law does not criminalize state and local officials accepting gratuities, such as gift cards or lunches, given as tokens of appreciation after official acts. The ruling, supported by the court's conservative justices and opposed by the liberal justices, emphasized that regulating such gratuities should be left to state and local governments, not federal prosecutors.Snyder was initially convicted and sentenced to nearly two years in prison for soliciting a payment in connection with government contracts, which he claimed was a consulting fee. The Chicago-based 7th U.S. Circuit Court of Appeals had upheld his conviction, leading to his appeal to the Supreme Court. Boeing is accused of violating investigative regulations by disclosing non-public information and speculating on potential causes of the January 5 Alaska Airlines door plug blowout during a media briefing. As a result, Boeing will retain its status as a party to the investigation but will lose access to information produced during the probe and will not be allowed to ask questions at the upcoming investigative hearing in August.The NTSB's action has heightened tensions between Boeing and government agencies, especially as the U.S. Department of Justice (DOJ) considers criminal charges against Boeing for violating a 2021 settlement agreement related to previous 737 MAX crashes. For years, political scholars and pundits have claimed that primary elections are exacerbating polarization and with the 2022 midterm elections approaching this year has been no different. With many extremist candidates on both sides of the aisle, it certainly feels like this claim should be true, but does the political science back that up? To find an answer we turn to Harvard political scientist James Snyder and his 2010 paper “Primary Elections and Partisan Polarization in the U.S. Congress”. We all have theater kid energy! Broadway News: Starting this season, Tony Awards voters must complete unconscious bias training in order to vote in any categories. The news, sent to voters last Friday, requires members to take a free, online training session led by inclusion strategist Vernā Myers. The course is meant to teach viewers how to identify unconscious or implicit bias in their own decision-making processes and how to correct it, according to the course description. Producers Stephen Byrd and Alia Jones-Harvey announced that a new musical stage adaptation of Black Orpheus, featuring a book by Pulitzer Prize winner Nilo Cruz, original music by Grammy Award winner and Brazilian icon Sergio Mendes, and direction and choreography by Tony Award winner Sergio Trujillo, is being readied for its world premiere production on Broadway during the 2022-2023 season. A developmental workshop and an out-of-town regional theatre run are being planned for 2022 before heading to Broadway in 2023. James Snyder, who has been playing the role of Harry Potter in Harry Potter and the Cursed Child since a new, shorter version of the production reopened on Broadway on November 12, 2021, has had his contract terminated. The termination follows a complaint from fellow cast member Diane Davis, who has since also left the production by her own accord, regarding his conduct. The Broadway revival of Ntozake Shange's for colored girls who have considered suicide/ when the rainbow is enuf, directed and choreographed by Tony Award nominee Camille A. Brown will begin performances on Friday, April 1, 2022 at the Booth Theatre. The fully reimagined production will open on Wednesday, April 20, 2022. Casting: Dennis Stowe steps into the role of Jafar in the Broadway production of Aladdin beginning this week at the New Amsterdam Theatre. He succeeds fellow original cast member Jonathan Freeman, who created the role on Broadway after voicing the part in the 1992 animated film. Freeman played his final performance on January 23. NaTasha Yvette Williams will succeed Dawnn Lewis as Zelma, Tina Turner's mother, in Broadway's Tina: The Tina Turner Musical beginning February 4. Lewis is scheduled to play her final performance on January 30. Williams was last seen on Broadway in Chicken and Biscuits and has been a long-time Matron "Mama" Morton in Chicago. A 2017 lawsuit between OJ Simpson and The Cosmopolitan of Las Vegas was finally settled on March 31 in Clark County District Court. The terms of the settlement were not released. Simpson was suing the casino resort for defamation of character. This was related to an incident at a steakhouse and lounge inside that property. Simpson was banned from The Cosmopolitan for drunk and disorderly behavior. He claimed defamation of character when media source TMZ stated he “was drunk and became disruptive.” The casino’s defense was that Simpson’s character was already tarnished due to his criminal record. A Pair of Six-Figure Jackpots Claimed at Lake Tahoe CasinosCaesars Entertainment owns and operates Harrah’s and Harvey’s Lake Tahoe casino and resorts in Stateline, Nevada. This town is located on the southeastern shore of the lake. Both properties were in the local news lately after paying out a pair of six-figure Mega Progressive Jackpots. James Snyder and his wife Annette won $529,000 playing Three Card Poker at Harvey’s Lake. The couple was visiting from Minnesota. The top prize was won on a royal flush. On April 8, Robert Davis of Waco, Texas won $100,840 playing a Blazing 7’s progressive slot at Harrah’s. Both of the big winners are Caesars Rewards members. In-Play Wagers Drives Popularity of Betting on GolfLegal US sportsbooks are seeing an uptick in the weekly betting handle on professional golf. Betting on the outright winner of the current week’s tournament accounts for a small portion of the funds. A driving force in the increase can be tied to in-play bets. This pertains to the amount of money bet on golf after a tournament has gotten underway. A player’s odds to win the round, tournament or head-to-head matchup are constantly in flux as play wears on. Bettors can follow the action. They can then decide how they want to bet based on the changes in the odds. East Alabama Search Warrants Turn Up Illegal Gambling MachinesA recent raid on nine different properties in Calhoun County turned up illegal gambling machines. Firearms and narcotics were also seized in the search. This took place on Friday, April 9. The Anniston Police Department released details of the raid to the general public. Calhoun County Sheriff’s Office also to part in the raid. The Piedmont and Jacksonville Police Department played a supporting role. These raids took place while Alabama lawmakers consider various legal gambling expansion legislation. This ranges from a state lottery to land-based casino gambling venues. Any proposal would be subject to a state-wide referendum vote.
