Res Judicata – Claim and Issue PreclusionRes judicata is a doctrine in civil procedure that prevents parties from re-litigating matters that have already been finally decided in previous judicial proceedings. It encompasses two primary sub-doctrines: claim preclusion and issue preclusion, also known as collateral estoppel.Claim PreclusionClaim preclusion bars the same parties—or those in legal privity—from bringing a subsequent lawsuit arising from the same transaction or occurrence after a final judgment on the merits. Send us a textThere's a new group in the Peak to Peak area that emphasizes their use of the organ, and they play in various lineups. Primarily, the group is called the MMB3 Organ Trio, and it consists of Ryan McCurry playing the Hammond organ, John Massone playing the guitar, Stephen “Steve” Balgooyen playing the drums, and all three of them providing vocals. Occasionally, when McCurry can't make a gig, the trio bills themselves as MVB3, bringing in Todd VanSelus on electric bass and Massone playing organ as well as guitar. Sometimes, though, the stars align and all four can play together in a quartet!In particular, Balgooyen has been interested in starting an organ trio for many years. He's played in many other groups over the years, including the local group Trickster Carousel, and his desire to start an organ trio was shared by Massone, who independently posted a Craiglist ad hoping to start one. Balgooyen responded to the ad and told Massone he knew a few organ players who could join. VanSelus then called to ask Balgooyen to fill in for the usual drummer for his band, The Atom Collective, at St. Julien's. There, Balgooyen met McCurry, a frequent keyboard sub for the band who subbed that night, and asked him if he was interested in playing organ in a trio. In this episode, the American Angus Association's two Young Breeder of the Year honorees share their path back to generational Angus operations. They suggest there's more opportunity for young people than ever before and share the opportunities they've capitalized on as they've come. “There are people looking for somebody to step up. It's going to be work and it could be very dirty work, but there will be a reward at the end,” says John McCurry, Burrton, Kan., who joins Cody Quam, Lodi, Wis., for an authentic discussion on how they're making their ways in the Angus business. HOSTS: Miranda Reiman and Mark McCully GUESTS: John McCurry, McCurry Angus, Burrton, Kan., says he is “double bred Angus.” His parents Mary and Andy McCurry were two third-generation Angus breeders who met at Kansas State University and started their own operation. Today the ranch operates on 2,000 acres of sandhill pastures near Hutchinson, Kan. Also a graduate of Kansas State, John was an energetic National Junior Angus Association member, actively participating in the show ring and attending national conferences. He capped off his junior career in 2003 as he hung up his green coat for the last time. Today he and his wife, Melody, have three children who compete at the National Junior Angus Show every summer and are capable hired hands during school breaks and weekends. Cody Quam, Marda Angus Farms, Lodi, Wis., is a fourth-generation Angus breeder working side-by-side with his family. Cody leads genetic selection and the donor/embryo transfer program as well as sales and marketing. Under his stewardship, the business has earned multiple top honors at the Midland Bull Test. Off the farm, the young breeder stays involved in the cattle industry, as a long-time delegate to the national convention, a graduate of the Beef Leaders Institute and president of the World Beef Expo board. Cody and his wife, Tracy, are raising their two kids, Levi and Paisley, as the fifth generation in the Angus business. Cody was recently awarded the 2024 Young Angus Breeder of the Year award, and he accepted the award at the Angus Convention in Fort Worth, Texas. They reminisce on what they miss about that part of the country before getting into Felicia's story. Felicia was raised in a home that was culturally Chrisitan. There were biblical values and conservative ideas held but the love and grace of God was not something that was shown or understood. She details her childhood and explains that her view of God was heavily influenced by her family environment and that wasn't necessarily a good thing. Felicia craved love and acceptance, and this led her to friendships and relationships that were not healthy. As she grew up, she sought validation and safety in relationships with men but because of the unhealthy patterns she experienced in her family life it led her to men that did not have good intentions. A cycle of finding herself in abusive relationships began. Each time she entered a romantic relationship she hoped it would be different than the last but more often than not it was worse. In the back of her mind, she still had her Biblical values and beliefs, but she was not in an active relationship with God. We appreciate Felicia's candidness in sharing where she was at and where these paths led her. Eventually she found herself married with children and this is where she experienced intense emotional and physical abuse at the hands of her husband. Slowly but surely, Felicia found herself drawing close to God - she needed Him so desperately. This all came to a head one night when Felicia almost lost her life. The Lord saved her, body and soul. That night changed everything, and we thank God for how He protected Felicia and her children. Though she is still healing, she now understands what a thriving relationship with Christ looks like and has hope for the future. We look forward to what God will do in her life and how He will use her.
