Jon Katz in this first Beat the Prosecution episode in a year without a guest, illustrates how he won an assault trial by supporting his client's alibi by illustrating the alleged assault's happening in Club Blah, where the defendant at the time was in Club Ah, and could not bring himself to stepping foot in Club Blah any more than he could bring himself to drinking a cask of prune juice mixed with vinegar. The persuasive story at trial usually is not found overnight, but is discovered with close attention and listening, visiting the incident scene, and bringing the listeners to the scene and the circle and center of the story, often incorporating all five of the human senses. Read more about persuasive storytelling in court, with Jon's article published in the Virginia Association of Criminal Defense Lawyers newsletter, entitled "Story power – DID YOU DO IT? Morton Sherman, PhD, is the retired Senior Associate Executive Director of AASA, The School Superintendents Association, and a long-time educator who is dedicated to assuring learning at the highest possible levels for all students. An educator for 40 years, Sherman has served as a superintendent at schools across the country. He is a founding member of Public Schools for Tomorrow and currently serves on The Executive Committee of the board for the Goldie Hawn Foundation. In the past, he has served as a member of the board of directors with the Scholarship Fund of Alexandria, the Minority Student Achievement Network, Jason Learning, the National Superintendents Roundtable, and the Education Research and Development Institute. Sherman has received numerous awards throughout his career including a national community service award, Virginia Association of Elementary School Principals' Pathfinder Award (2012), the American School Board Journal's Magna Award (2012) and the Outstanding School Administrator Award (2003) by the New Jersey Music Educators Association. Sherman earned his doctorate in educational administration from Lehigh University, his master's degree in English education from the University of Delaware, and his bachelor's degree in English from Pennsylvania State University. In this episode, I answer a question from Danielle in Georgia about a six-year-old child processing grief after the loss of his father. His play includes room wrecking, risk-taking, and sensory-seeking behaviors, and Danielle wanted insight into how these might relate to his trauma. While CCPT doesn't require us to interpret play, understanding the root of behaviors can help us stay present and responsive in the playroom. I discuss how room wrecking often reflects internal chaos, risk-taking may be a form of fear-facing play or dysregulation, and sensory-seeking can serve as self-soothing in response to high anxiety. I also touch on why children experiencing emotional overwhelm often show withdrawal and disinterest in schoolwork. General Douglas MacArthur's iconic cap, one of the most amazing artifacts in our museum, is a finalist for a conservation prize from VAM – the Virginia Association of Museums (VAM).  Currently the cap is on VAM's Virginia Top 10 Endangered List. The list helps raise public awareness of amazing artifacts in Virginia museums and the importance of preserving these artifacts. General MacArthur's cap is an internationally recognized symbol of America keeping promises, of civilian control over the military, of liberation and peace, and of triumph over fascism and militarism. MacArthur wore this cap from 1936 to 1961, through many important moments in American history. In 1942, saltwater exposure caused the cap to shrink as he escaped the besieged island of Corregidor aboard PT-41. Arriving in Australia during one of the darkest periods of the war, he wore the cap as he famously promised "I Shall Return.” When he kept that promise in 1944, he was wearing the cap as he was pictured wading ashore in the Philippines. He was also wearing the cap when he presided over the surrender of Japan, the Occupation of Japan, and the Korean War. VAM invites members of the public to vote for the artifact they would like to see receive a $1000 conservation prize. MacArthur's cap has been assessed by a conservation specialist, and we have a plan for its conservation – but winning this prize would help jumpstart our efforts to fully fund this project. Send us a textCriminal defense lawyers must hang together lest they hang separately. Northern Virginia lawyer Sameera Ali accepted an Alexandria Juvenile & Domestic Relations (JDR) Court request to represent an indigent defendant (for abysmally low pay), let the court know she was not available on the then-pending court date, got the prosecutor's office on board for seeking a very brief court date rescheduling to when Ms. Ali was available, and instead got issued a show cause notice to appear in the same court to address why she should not be held in jailable contempt of court. Once this story hit the Washington Post (with the bittersweet ending of a dismissal of Sameera's show cause case, but only after a one hour hearing), the outpouring of support for Sameera came rushing through. The show cause hearing courtroom was filled with supportive criminal defense lawyers and also included prosecutors and city attorneys. With criminal defense lawyers ready to instantly rally around their mistreated sister and brother lawyers, and with the Virginia Association of Criminal Defense Lawyers' strike force, judges, prosecutors and police should think carefully before trespassing against one of our own. On this Beat the Prosecution episode, Sameera and Erin Smith tell about the events following the unjust issuance of this show cause order against her, Erin's immediate departure from the Alexandria JDR court's indigent appointment list, and what happened at the hearing where the show cause order against Sameera got dismissed. Longtime public defender lawyer Lauren Whitley talks about the importance for lawyers to speak out about judges' wrongful actions. Sameera's law partner Jim Magner talks about the importance for people to recognize the devotion and talent that so many lawyers demonstrate in representing indigent defendants. Not present for this show is Christopher Leibig, Sameera's lawyer who filed this great motion to dismiss the show cause matter against Sameera. Striking is the absence of anger nor any agenda in Sameera nor Jim, and just Sameera's getting right back in the saddle and urging criminal defense lawyers to accept court appointments to represent indigent defendants. Many criminal defense lawyers are unsung and undersung heroes. Being a firm believer and advocate for community collaboration, Sager serves as the Chair of the Family Youth Initiative (FYI) for Shenandoah County, the Skyline Regional Criminal Justice Academy, and the Northwest Virginia Regional Drug & Gang Task Force. As the trees came back, the deer came back, as the deer came back, the ticks came with them. And then the pathogens, of course, come along for the ride as well. I think about it from an ecology perspective, that what we did not bring back was also those top predators. We are so glad you joined us to help you start your new year! This episode's guest is Matthew Rathbun. Matthew will be discussing business suggestions, strategies, and ideas to help you make your plans for success in 2024. This is the first part of a series on Business Planning with Matthew this month. The second part will launch later this month.   [2:55] Matthew is the EVP of a Coldwell Banker company with 10 or 11 offices in the D.C.-Maryland-Virginia area.   [3:40] Matthew started teaching and has been teaching ever since. He is currently the president-elect for the Real Estate Business Institute, a good partner for CRD, providing lots of education to agents.   [4:20] There has been attrition in the industry. A lot of agents are not seeing a lot of production right now. When you plan for next year, you have to base it on reality. [5:33] We are knowledge workers more than salespeople. The buyer hires you as a buyer's agent for what you know. How do you provide clarity on your value as a buyer's agent?   [7:00] A knowledge worker will say, “I know the market, what my capabilities are, and what my consumer base is and I'm going to build a strategic plan.”   [7:37] You can be a knowledge worker to your consumers and demonstrate that value to them. You can use your knowledge and say, “I'm the CEO of me.”   [9:21] What are we changing for 2024? Agents need to be much more precise with their goals to be able to look back and see what they've accomplished and why this is a good career for them.   [11:12] Matthew goes over tips and tools on how to interject your goals. Substantial industry changes are coming but most of our chaos is controllable.   [13:00] You're controlling whatever chaos you can. Putting systems in place is so important. “You do not rise to the level of your goals, you fall to the level of your systems.” — James Clear   [15:48] With industry changes, Matthew says training will be a core part of any successful agent's business.   [18:33]. Change is good. A bad change can be corrected to something better. Have a healthy mindset on addressing change. Lean into change and what it means.   [23:06] It's time to add to your listing kit and improve the buyer consultation kit on your website. Market your value proposition for buyers. Matthew discusses what to do in the next 30 to 90 days.   [25:45] Agents need a better consumer persona. Who do you want to work with? Just saying you want to work with sellers or with buyers is not focused enough to reach the core consumer that you want.   [30:18] Matthew cites Atomic Habits, by James Clear as the most transformative book. Dr. Desi Williams, PT, DPT is the Administrator and co-owner of A Plus Care, a mobile physical therapy and occupational therapy business servicing the Los Angeles Area.  Desi is also a television host, actress, and. reality television personality with a Doctorate degree in physical therapy and a past life as a college professor. Desi is the winner of CBS's THE CHALLENGE: USA Season 2. She was also a finalist on THE CHALLENGE: USA Season 1 and a castaway on Season 35 of Survivor on CBS.  Desi passionately believes that good things come to those who seize the day—and every opportunity. And her experiences have proven that opportunity combined with preparation create luck.  Not blind luck, but instead purposeful luck created by growing, learning and connecting with people.  From that philosophy alone, Desi has been met with great success.  In alignment with her passion for health and fitness, Desi was the spokesperson for Newport News' Annual One City Marathon, the race director for Hampton University's Annual 5k by the Bay, and in late 2014 co-authored and published a book entitled, Love Affair with my Hair:  Why Black Women Cheat on Health. Additionally, Desi served as keynote speaker for several organizations throughout Virginia including Riverside Health System's Leadership Conference, Virginia State Conference of the NAACP, and state convention for the Virginia Association of Health for Health, Physical Education, Recreation and Dance.
