México acaba de entrar en una “nueva era judicial”. Así lo estima el nuevo presidente de la Corte Suprema, Hugo Aguilar,  electo recientemente por voto popular, junto a unos 2000 ciudadanos que ejercen desde este 1ero de septiembre como jueces o magistrados. Son los primeros así electos desde la controvertida reforma judicial iniciada por el expresidente López Obrador y concretada por la presidenta Sheinbaum. Para el partido en el poder, se trata de sanear una institución gangrenada por la corrupción. Pero para los detractores de la reforma, el poder judicial se verá aún más debilitado. Con esta controvertida reforma judicial, impulsada en el 2024 por el presidente López Obrador, México se convierte en el primer país del mundo en someter al voto popular la elección de todos sus jueces. Para Morena, el partido que lo lidera, se trata de abrir una institución a los ciudadanos, promover cierta austeridad y luchar contra la corrupción. Argumento que refutan miles de magistrados, que han perdido su trabajo al ser remplazados por los recién electos. Es el caso de la exmagistrada Edna Lorena Hernández Granados, que conoce como la palma de su mano una institución que ha sido profundamente sacudida por esta reforma. "El riesgo de la reforma es que se extinga el contrapeso, la división de poderes y la independencia judicial. El gobierno mexicano actualmente está presidido por un partido político que se llama Morena. A través del Estado, despojó al poder judicial, a sus jueces, magistrados y a ministros. Nos eliminó de la carrera judicial para poner nuevos jueces, magistrados y ministros. Sin la experiencia de años como nosotros la tenemos, de 30 a 35 años, 25 años en el conocimiento especializado de la carrera judicial del derecho", explica Hernández Granados. Los nuevos magistrados, así como la Corte suprema, han sido electos por los mexicanos. Sin embargo, la participación a esta primera votación fue solamente de un 13% y menos en votos efectivos: "Es como si 9 personas de 100 hubieran votado". El papel del crimen organizado La exmagistrada vaticina una cooperación complicada entre los nuevos jueces y aquellos que se han quedado, precisamente por esta disparidad de competencias. Otro temor de Hernández Granados: el papel que puede jugar el crimen organizado al implementar esta elección directa. "No solo se cambiaron no jueces y magistrados federales, sino de todos los estados de la República y es conocimiento del mundo que hay estados en nuestro país que están infestados por el narcotráfico como Sinaloa, Culiacán o Jalisco. Obviamente también hubo jueces y magistrados de esos Estados que por cuotas les dieron un lugar en el acordeón para que fueran votados por la población. ¿Y qué implica esto? Pues que si son amigos o ya tienen un servilismo a quienes los pusieron como candidatos para apoyar a quienes ellos les digan." Cabe mencionar que antes de esta reforma, el Senado, a través de comisiones aprobaba estos puestos. Al dominar Morena el Senado, la reforma parece "inútil". Entonces, ¿por qué impulsarla? "Muchas resoluciones de mis compañeros jueces y magistrados detenían las obras que no estaban licitadas, que no estaban estudiadas y planeadas conforme a las leyes ordinarias en cuanto a las leyes ambientales, al financiamiento, en cuanto a intereses, tanto para protección de la naturaleza del país como protecciones económicas y de no corrupción. Esas resoluciones de los jueces y magistrados y aún de la Suprema Corte, molestaban al presidente anterior a López Obrador. De ahí la necesidad de quitar el poder judicial a los jueces y magistrados", analiza, temiendo que por ahora ninguna palanca permita restablecer la separación de poderes necesaria para garantizar el funcionamiento democrático. Para el nuevo presidente de la Corte Suprema, Hugo Aguilar, se trata al contrario de un gran avance para el país que cuenta con una Corte en su mayoría femenina y con el primer presidente indígena dejando atrás una Corte "refugio de políticos", según las palabras de López Aguilar. Originario de Oaxaca lleva treinta años defendiendo los pueblos originarios. Es licenciado en Derecho por la Universidad Autónoma Benito Juárez de Oaxaca y tiene una maestría en Derecho Constitucional. Pero no es por ello "que tenga el conocimiento y la capacidad para ejercer un cargo tan importante como el que él va a ejercer. Debe conocer de constitucionalidad, de controversias constitucionales, resolver recursos de revisión. Es muy técnico, es muy especializada su verdadera función".  Colectivos de magistrados y oenegés como Defensorxs, estiman que el oficialismo busca "capturar políticamente al Poder Judicial". Edna Lorena Hernández Granados va más lejos: "Morena es un Estado autoritario.
