Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in Warner Chappell Music, Inc. v Nealy. In this case, the court considered this issue: Under the discovery accrual rule applied by the circuit courts and the Copyright Act's statute of limitations for civil actions, 17 U-S-C § 507(b), may a copyright plaintiff recover damages for acts that allegedly occurred more than three years before the filing of a lawsuit? The case was decided on May 9, 2024. The Supreme Court held that the Copyright Act entitles a copyright owner to obtain monetary relief for any timely infringement claim, no matter when the infringement occurred. Justice Elena Kagan authored the 6-3 majority opinion of the Court. The Copyright Act's statute of limitations provision establishes a three-year period for filing a copyright infringement suit, which begins to run when the claim accrues. This case assumes that a copyright claim accrues upon discovery of the infringement (the “discovery rule”), rather than when the infringement occurred, although the Court has not definitively resolved which rule applies. If a plaintiff has a timely claim under the discovery rule, the Act's remedial provisions do not impose any separate time limit on the recovery of damages. Those provisions state, without qualification, that an infringer is liable for either statutory damages or the owner's actual damages and the infringer's profits. The Second Circuit's view, relying on language from the Court's decision in Petrella v MGM, that damages are limited to the three years prior to filing suit, even if earlier infringements are timely under the discovery rule, lacks textual support and effectively nullifies the discovery rule. The Court's decision in Petrella does not support such a damages cap, as the Court merely described how the limitations provision works when a plaintiff, as in that case, has no timely claims for infringing acts more than three years old. In contrast, if a plaintiff like Nealy in this case has timely claims for earlier infringements under the discovery rule, he may obtain damages for those infringements, as the Copyright Act contains no separate time-based limit on monetary recovery. Justice Neil Gorsuch authored a dissenting opinion, in which Justices Clarence Thomas and Samuel Alito joined, arguing that the discovery rule of accrual, which the majority assumes without deciding in this case, is decidedly incorrect, and thus that any decision that relies on that rule is likely to soon become a “dead letter.” The opinion is presented here in its entirety, but with citations omitted. His career began singing at biker bars in North Carolina until he landed a spot playing local gigs with Luke Combs. What would soon become a collaborative duo, Josh and Luke started taking monthly trips to Nashville where they frequently played at some of Nashville's bars like Winners and Losers. Josh talks about how outside of Winner's bar Luke said to him, “Man, our angels are working overtime.” Co-written by Josh Phillips, Luke Combs, and Josh Thompson, “Angels Workin' Overtime” now has over 35 million streams on Spotify. Josh and I talk about this song in our conversation, as well as how this was a pivotal moment in his career. After flipping an early 20th century farmhouse with his wife, Josh wrote “Dirt Cheap,” and we discuss how this song went from a frustrating indefinite hold to becoming a Cody Johnson (and TLR!) favorite. You'll hear how we was on a trip to Boston and got in a fight with his girlfriend - now his wife - and how he ordered red wine, watched tears roll down her face and walked out the door...and how the entire song is basically exactly what happened to him in Boston - later changed to Austin by Bailey. We talk about how he got his start as a Christian artist and traveled all over, got a label deal and then how his band broke up at the table signing that deal. But then how that moved him to Nashville to focus on songwriting, how he met The Warren Brothers by introducing himself to Brett Warren at the YMCA and how that led to a publishing deal with Warner Chappell Music. We had the pleasure of interviewing Liddy Clark over Zoom video!There's a word that comes up whenever Liddy Clark talks about her music – “connection.” Currently based in Los Angeles, the Plano, Texas native relocated with her family to South Florida (Parkland), just before first grade. This was a pivotal move for Liddy, as theatre is very important in the area and the move put her in a position to grow up on the stage. Inspired by artistic family members like her cousin, Drew Womack (formerly Sons of the Desert and writer of Kenny Chesney's first number one hit “She's Got it All”), she amassed the resume of a seasoned entertainer. During her last summer in high school Liddy won a scholarship to join the esteemed Berklee Five Week Summer Program, additionally earning a spot on the coveted Performer Singer-Songwriter Showcase and praise from professors like famed singer-songwriter Melissa Ferrick.But even as she began fronting her own band at 15 – opening for major artists like Scotty McCreery and performing for major radio stations in South Florida – she was searching for something deeper than fame or fortune.Out of the gate, Clark was finding connection through tender, personal lyricism, earning praise from heavyweights like Garth Brooks after seeing Liddy perform at the iHeart Country Music Summit in 2017. In 2018, Liddy contributed a mystical rendition of “Do You Hear What I Hear?” to the Cracker Barrel exclusive Country Faith Christmas, Vol. 2, joining the likes of Carrie Underwood, Kelsea Ballerini, Darius Rucker and Brenda Lee on the album's track list. She went on to win a songwriting scholarship with former Senior Vice President of Creative at Warner Chappell Music, Judy Stakee (Katy Perry, Sheryl Crow, and Gavin DeGraw) who quickly identified Clark's talent and invited her to a songwriting retreat in New York's Catskill Mountains.In 2018 the tragic school shooting in Clark's hometown of Parkland, Florida, gave her a sense of clarity about her mission. By then, a freshman at the University of Southern California's Thornton School of Music, she knew many of the families affected, and indeed, her own family still lived just a few blocks from the school.Later that year she was invited to perform at Parkland's Wear Orange gun-violence awareness event. Clark delivered the emotional anthem she had written the week prior at the Catskill Mountain retreat “Shot Down (Stand Up),” boldly speaking truth to power and voicing the concerns of her peers. “This problem has answers that won't be found / If every time we try to stand up, we get shot down,” Liddy has a brand new single, "Potential," out now with plans for a full album out later this year.We want to hear from you! We had the pleasure of interviewing Bekuh Boom over Zoom video.Bekuh Boom recently released her single "Anime Eyes”. Bekuh has spent most of her career songwriting for some of the biggest names, having signed her first publishing deal to Warner/Chappell Music at the age of 18, and now we're finally getting new music from the legendary artist. "Anime Eyes" was in the works for almost a year until Bekuh brought it to the producer Cook Classics (Panic! At The Disco, Beyonce, Machine Gun Kelly). Bekuh elaborates "The song is about liking someone so much that they can make you feel every emotion to the extreme. When you look at them you get heart eyes, and when they make you mad you get flames shooting out of your eyes, and when they make you sad you get teary eyes. They give you Anime Eyes. It's borderline toxic. Haha. But we've all had at least one of those. There's a lot of my favorite Animes referenced for my anime lovers. Even if someone doesn't watch Anime I think they can still relate to and love this song.”Bekuh has songwriting credits across multiple genres (Jordin Sparks, Madison Beer, JLO) BUT is most prominent in K-Pop. She has co-written over 10 songs reaching the #1 position on various music charts, not to mention the billions upon billions of views/streams these songs have accumulated. She's credited on multiple wildly successful Blackpink songs: "Ddu-Du Ddu-Du" "Kill This Love" "Ice Cream" ft Selena Gomez "Pretty Savage" (and many more) as well as Lisa's solo projects "Lalisa" and "Money".
