A city once shunned by the league will now become the center of the world's attention and host to one of the most highly wagered-on events every year. Both Dan and Justin discuss this weekend's event and how it changes the narrative on the legitimacy of legalized sports betting in the United States. They discuss the shift in attitude the leagues have taken when it comes to sports betting. Starting with their opposition to legalization as it was proposed in Murphy v. NCAA to 2024 and the multitude of sports betting partnerships within the league. They also discuss the suspensions the NFL has handed out for sports betting policy violations and why it seems much more prevalent in the NFL as compared to the other major sports leagues. Finally, they discuss the Jaguars' ongoing saga with FanDuel as they look to recoup some of the $22 million in funds stolen from their organization by Amit Patel, a former finance manager for the team. Patel used the funds on daily fantasy and sports betting. Professional football writer Howard Balzer (@HBalzer721) sits down with Dan Wallach to discuss the recent news surrounding Terry McDonough and the Arizona Cardinals. Pat McAfee and his team of lawyers have moved the defamation case brought by Brett Farve to federal court. (1:59) A step discussed by the Conduct Detrimental crew in the past as a step that would seemingly be a no-brainer for the McAfee side. This move to federal court seems to give McAfee some advantages as he seeks to defend himself in the defamation case brought against him by Brett Farve. The Dans discuss the differences between state and federal courts as well as how these differences change the power each side will have as the case continues. Former Cardinals executive Terry McDonough filed an arbitration claim against the Arizona Cardinals. (26:51) McDonough is seeking damages for emotional distress and breach of contract. The arbitration claim alleges gross misconduct, including cheating, harassment, and discrimination. Included in the claim is a story surrounding the use of burner phones to communicate with the Cardinals' General Manager Steve Keim while he was serving a five-week suspension. McDonough claims that following his discussions with the owner Michael Bidwell about this plan, opportunities for advancement in the NFL evaporated. The Arizona Cardinals responded to the claim saying "We are saddened to see that Terry is now lashing out at our organization with disparagements and threats that are absurdly at odds with the facts. This unnecessary and vindictive action by Terry was intended to malign his co-workers, our owner Michael Bidwill, and our team with outlandish accusations." *** Have a topic you want to write about? Welcome back to THE Sports Law Podcast! We keep you up to date on everything at the intersection of sports and the law! In this episode, The Dans reunite to take the reins to discuss the Brett Favre defamation lawsuits. The lawsuit centers around three different plaintiffs, Pat McAfee, Shannon Sharpe, and Shad White. While the first two names are fairly recognizable, White has been brought into this case for his role as a Mississippi auditor. Favre claims that these parties defamed his name through statements they made related to the alleged theft of public funds that Favre has been connected to in the state of Mississippi. Favre is currently facing a welfare fraud lawsuit brought by the Mississippi Department of Human Services. The Department connected Favre to alleged misappropriation of funds. (10:12) This included public appearances, speeches, and autograph sessions. The allegations also included that Favre attempted to use some of the public funds to build a volleyball facility for the University of Southern Mississippi, his alma mater. Dan Lust breaks down the legal basis by outlining the legal definition of General Defamation. (20:20) Brett Favre, in this case, will be held to the higher standard of a public figure. Because of this status, he will have to prove actual malice in the statements made by the three parties being sued. The Dans make sure to differentiate each claim and note the important differences between the claims that could lead to different outcomes for each defendant. (54:52) They also point out the way that Favre bringing these claims could cause a further investigation into whether or not these allegations are true. Dan Wallach breaks down the doctrine of a liable proof plaintiff and how he believes that this will not be applicable to this case. (59:02) Citing a Mississippi case he notes that this doctrine cannot be used pretrial, meaning this doctrine would have to come in once the case reaches a jury. The Dans also break down Anti-SLAPP statutes. (1:01:32) These statutes are in place to allow someone who believes they are facing a frivolous lawsuit to counter claiming that this suit was brought to wrongly suppress free speech. Welcome back to THE sports law podcast!! This episode Dan Wallach is joined by Ryan Butler (@ButlerBets). On the ballot this year in California are two sports betting initiatives for either online sports gambling or in-person sports gambling. (4:52) The first option is ballot initiative 26 which would legalize in-person sports gambling at Native American casinos and licensed racehorse tracks.  The second option is ballot initiative 27 which would legalize online sports gambling.  Ryan Butler of iGaming NEXT (@iGamingNEXT) joins to help break down what the future landscape of California sports betting will look like. A recent polling shows that both ballots are not favorable and are projected to fail. Online sports books have already pulled advertisements from California. Due to some tension, Ryan doesn't foresee legalization until possibly 2030 unless drastic compromises are made. Ryan also gives insight into news on the Texas sports gambling front. Dan Wallach and Dan Lust are at the epicenter of Sports Law. This episode is the Around the Horn equivalent of the intersection of Sports and the Law. Not so similar to Around the Horn, we start with final thoughts on the Deshaun Watson saga. (1:05) NFL and the NFLPA came to an agreement on the Watson punishment with an 11-game suspension and a $5 million fine. Arbitrator Peter Harvey did not have to issue a decision and there will not be Federal Court proceedings. Is the punishment too light? Should the games Watson missed last year count as mitigation for his overall suspension? Alvin Kamara has been accused of assault and the alleged victim is being represented by Tony Buzbee. (10:35) Kamara was charged with a felony battery from the incident. The injuries sustained here are serious and there is video evidence of Kamara striking the victim. Buzbee is going to keep the pressure on Kamara and his legal team. The NFL has not stated whether they are investigating Kamara yet. The precedent shows that Kamara could be facing a 6-game suspension. Aqib Talib was going to be Amazon's in studio analyst for their new NFL broadcasting platform. (20:25) Talib has since stepped away from this role amidst his brother being accused of and charged with murder. Talib has not been charged with anything but only involved in the brawl prior to the gun shots. Nick Kyrgios is being sued for defamation by a female fan who was removed from a match Kyrgios was playing. (23:38) Kyrgios told the ump that there was a woman in the crowd who was distracting him while he was serving, and she was removed. Kyrgios accused her of being very intoxicated. However, the woman claimed to have only had one drink and was able to return to her seat after approximately 15 minutes. The woman bringing this suit is also an attorney. Kyrgios claimed she had "700 drinks" but does that rise to the level of a factual assertion? Vanessa Bryant is finishing her invasion of privacy trial against LA County Sheriff and Fire Departments. (32:26) Vanessa is claiming that the police officers and firefighters took pictures of the helicopter crash and disseminated them unlawfully. Since recording this the jury deliberated and awarded $31 million to the plaintiffs, which was $$16 million to Vanessa and $15 million to Chris Chester who was another family member of a victim. Dennis Rodman has stated he would go to Russia to discuss the release of Brittney Griner. (45:35) The Biden administration stated that they believed any other type of negotiation would hinder the current talks between D.C. and Russia. Since that statement Rodman has reversed course and said he would not go. Florida Sports Betting was legal for a brief period with their online sports betting compact, but a D.C. Federal Judge overturned that citing a violation of the Indian Gaming Regulatory Act. (49:35) The first briefs have been filed in appeal of that D.C. federal court decision. The D.C. Circuit Court of Appeals is hearing the appeal where the Seminole Tribe is arguing that the compact is not reviewable under sovereign immunity. The U.S. Department of Justice has filed an opening brief on behalf of the Department of the Interior, who approved the compact, arguing that the compact never authorized online sports betting and that the compact allocated jurisdiction from Florida state authorities to tribal authorities to determine and regulate how betting outside of Indian land is to take place. Unless there is a ballet initiative, online sports betting might not be possible until 2024 while this appeal is ongoing. *** Have a topic you want to write about? Welcome to the corner of sports and the law, with your hosts Dan Wallach and Dan Lust. This week was a busy one, so sit back and enjoy. The Dans start with the Deshaun Watson appeal. (3:15) The NFL has appealed the punishment decision by Judge Robinson. Commissioner Goodell decided to use a neutral party handle the appeal and selected Peter Harvey, who is the former New Jersey attorney general. However, Harvey has previously been an arbitrator for the league, was on the NFL advisory committee, and helped create the language of the personal conduct policy. The reasoning for Judge Robinson's decision and the number of games is the issue at hand. The Dans analyze the reasoning she may have used and what Harvey may use based on NFL's recommendations for punishment. Where will the punishment have to land so this case doesn't end up in federal court? 12 games? A full season? The Dans also break down what happens after the decision by Harvey, and which court does the federal appeal end up in as both parties race to the courthouse. Another issue to break down is whether Watson has waived his right to a temporary restraining order (TRO) because he and the NFLPA failed to appeal the ruling by Judge Robinson. (35:30) Dan Wallach gives three reason why Watson won't get a TRO: 1) Waiver of irreparable harm; 2) the NFL appeal is for the modification and extension of the 6 games, not amending and restating; and 3) there is no argument that wipes out the entirety of the punishment. Dan Wallach sits down with Massachusetts Senator Eric Lesser (@EricLesser) to discuss the Massachusetts sports gaming bill. (59:55) The Governor is expected to sign the bill into law. Senator Lesser discusses the movement towards kiosks as well, and that this is just the beginning for sports gambling in MA. *** Have a topic you want to write about? California (2:15) has two competing bills on the ballot for CA residents to vote on in November of 2022. The key here is can both survive, we say no. Massachusetts (14:35) has collective agreement to legalize sports gambling but the House and the Senate cannot agree on language of the bill, and are disagreeing over allowing college sports betting, tax rate, and advertisements. The end of the regular session for their legislature is July 31, so keep a close eye on this. Georgia has a deadline for tomorrow (4/4/2022) for their legislative session to legalize gambling. There is a lot left on the table to discuss and figure out in time for this deadline. It does not appear possible to achieve in a state where casino and horse racing gambling is not yet legal. Kansas and Missouri are still a month away from their deadlines and are much closer to legalizing sports gambling. The rivalry between the two states is driving each other closer to legalization in an effort not to fall behind their neighboring state. Cannot help but believe a missed opportunity for Kansas with their men's basketball team playing in the championship game on 4/4/2022. New York has a similar deadline by tomorrow for their state budget bill to be passed. Within that bill we could see an acceleration of the 2023 date for three downstate casino licenses. Also, within the NYS budget bill is going to be the determination of the amount of public funding going towards the new Buffalo Bills stadium. Looking at $850 million dollars, this will be the largest publicly funded stadium of all time. With the July 1, 2023, expiration of the Bills current stadium lease, this is the second to last chance to pass a budget that the Bills ownership will agree to before the possibility of relocation. New York also just had the ruling come down on the issue of whether daily fantasy sports is constitutional under NY State's constitution. NY's highest court, the Court of Appeals, ruled that DFS are games of skill and thus constitutional. They also gave the legislature deference to determine the constitutionality and define DFS. This a key case that can be used against future constitutional challenges with other skill-based games. *** Have a topic you want to write about?
