The Sweden-based telecommunications company, Ericsson, agreed to a pay a total of $1 billion (yes, billion with a “B”) for FCPA violations. Ericsson entered into settlement agreements with DOJ and the SEC. Ericsson agreed to pay a criminal penalty of over $520 million and approximately $540 million to the SEC. An Ericsson subsidiary in Egypt entered a guilty plea to an FCPA conspiracy to violate the anti-bribery, books and records, and internal controls provisions. The parent company entered into a three-year deferred prosecution agreement (DPA), which included the requirement to retain an independent monitor. In this Episode, Michael Volkov reviews the Ericsson FCPA settlement and the lessons learned.
Lawrence Hoskins, a UK citizen and former Alstom executive, was convicted last Friday on 11 of 12 counts for his role in a bribery scheme involving Indonesian officials. Hoskins conviction took years to secure because of jurisdictional challenges and appeals. Hoskins was originally indicted in 2013. The jury deliberated for one day – a resounding victory for DOJ prosecutors. Hoskins' defense team launched an unusual defense, claiming that Hoskins did not act as an “agent of a domestic concern” because he was the principal who made all relevant decisions with regard to the bribery scheme. The jury's quick verdict reflects its rejection of such a technical defense. After a two-week trial, Hoskins was convicted of six counts of violating the FCPA, three counts of money laundering and two counts of conspiracy. The judge set a sentencing date in January 2020. In this Episode, Michael Volkov reviews the Hoskins trial and verdict.

Estamos muy felices de comenzar con la 3ª temporada de “Charlando con zubi”. Después de haber pasado un verano de lo más estupendo, relajándonos y dedicándonos a disfrutar, ha empezado la vuelta al cole. Nosotras llevamos ya casi 3 semanas trabajando, en las que hemos tenido tiempo para planear y organizarnos de cara al nuevo curso. Empezamos la temporada con un post muy especial, en el que os vamos a contar nuestros objetivos del año y cómo va a ser la nueva temporada de podcast. Después de un mes de julio en el que llegamos casi derrapando, haber hecho un break vacacional nos ha servido para darnos cuenta de que queremos hacer las cosas con más calma. Nuestro objetivo este año es profundizar en las cosas y hacerlas sin prisas. Lo primero que queremos hacer con más calma y mejorar son los podcasts, que esta temporada serán cada 15 días, para que nos dé tiempo a prepararlos como realmente nos gusta. Esto tiene que ser un motivo de disfrute, porque a nosotras es algo que realmente nos encanta hacer. Otra cosa con la que contamos para mejorar los podcast es nuestro nuevo espacio, al que hemos bautizado como “La Carbonera”, en el que los ruidos de mensajeros y teléfonos van a brillar por su ausencia. También hemos invertido en micros nuevos, y estamos seguras de que, con esta combinación de micros y espacio, vamos a conseguir el sonido limpio y claro que buscamos para que escuchéis los podcast cristalinos. Uno de los puntos importantes para nosotras este año, es que queremos ser más coherentes con “La Misión” de zubi, especialmente la última parte, en la que hablamos de hacer un Mundo mejor. Esa va a ser nuestra piedra angular este año. Queremos llevarla más allá con un proyecto en el que todos vais a estar involucrados y del que ya os iremos contando más adelante. Desde que empezamos hace dos años, el segmento de los podcast ha crecido mucho, ayudando a que se conozca más el formato. Lo cierto es que, desde el principio, el nuestro ha sido diferente y eso es algo que hemos querido trasladaros con esas charlas que tenemos de manera informal y cercana con amigos, colaboradores y conocidos a los que admiramos y nos gustan. No somos periodistas, ni estamos haciendo entrevistas formales. Hemos tenido la suerte de tener personajes de un nivel espectacular, y los seguiremos teniendo esta temporada, con los que charlaremos sobre temas que nos interesen, de manera relajada y natural. Otra cosa que queríamos dejar clara es dónde podéis encontrarnos siempre, que es en nuestro blog. Ahí tenéis las dos temporadas. Además, también podéis encontrarnos en Itunes, Spotify o Ebooks. También nos preguntáis mucho por nuestra música del podcast, que pertenece a Lullatom. Ellos son un matrimonio que Japón que crean jingles, a los que conocí hace ya 8 años. OFAC's new Framework for Sanctions Compliance Programs is a game changer. When it comes to sanctions compliance programs, most companies are well behind the curve. OFAC's new framework raises the bar by creating a well-crafted framework for companies to assess their current program and then re-design important elements to meet OFAC's standards. To the extent that a company's sanctions compliance program operates as part of an overall ethics and compliance program (which it should), a company should already be well positioned in a number of areas that are generally applicable to all ethics and compliance programs. When it comes to some of the more specific sanctions risks, the definition of these sanctions' risks, and the prescriptive elements of OFAC's framework, that is where companies need to get to work and implement improvements. In the first corporate FCPA action of 2019, Cognizant Technology Solutions Company settled its long-running FCPA case, agreeing to pay the SEC $25 million. At the same time, the Justice Department announced: (1) its declination under the FCPA Corporate Enforcement Policy; and (2) the indictment of Cognizant's former President and General Counsel for criminal FCPA violations. Cryptocurrencies, including Bitcoin, are exploding on the marketplace. Cryptocurrencies are promising huge technological advances in our economy by relying on the new blockchain technology. Initial coin offerings raised $7 billion in capital last year, and this year ICOs are expected to raise over $20 billion in capital. Bitcoin and other established cryptocurrencies have increased in value. Bitcoin reached a high of nearly $20,000 and is now trading just under $7000. Ethereum, a rival cryptocurrency, is trading at just under $400. Bitcoin and other cryptocurrencies are volatile, and investors are suffering significant swings in profits and losses. At the same time, we are witnessing the beginning of regulatory and enforcement actions of the industry and enforcement actions against fraudsters, Ponzi schemes and other misconduct surrounding the cryptocurrency market.
