Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in United States Trustee v John Q. Hammons Fall 2006. In this case, the court considered this issue: Must the U.S. Trustee issue refunds for the extra fees paid by debtors in certain districts to address the lack of uniformity identified in Siegel v Fitzgerald? The case was decided on June 14, 2024. The Supreme Court held that refunds are not required; rather, prospective parity—i.e., requiring equal fees for otherwise identical Chapter 11 debtors going forward—is the appropriate remedy for the short-lived and small disparity created by the fee statute held unconstitutional in Siegel v Fitzgerald. Justice Ketanji Brown Jackson authored the 6-3 majority opinion of the Court. To determine the appropriate remedy, the Court considers what Congress would have intended had it known about the constitutional problem. Congress has demonstrated a strong commitment to keeping the U.S. Trustee program self-funded through user fees, as evidenced by the 2017 fee increase and the 2021 Act maintaining elevated fees. Providing refunds would significantly disrupt the statutory scheme by transforming the self-funded U.S. Trustee program into a $326 million bill for taxpayers. It would also likely exacerbate the existing fee disparity. Moreover, Congress chose not to impose higher fees retroactively on Bankruptcy Administrator districts when it amended the fee statute in 2021, indicating it did not intend such a remedy. Thus, Congress would have wanted prospective fee parity, which is what Congress itself implemented in the 2021 Act. Justice Neil Gorsuch authored a dissenting opinion, in which Justices Clarence Thomas and Amy Coney Barrett joined, arguing that the Court's decision undermines the importance of constitutional remedies and may have far-reaching negative consequences beyond the bankruptcy context. Justice Gorsuch would conclude that under traditional remedial principles, Hammons should receive a refund for the unconstitutional fees it paid. This week, Editors Don Williams and Nic de Sena discuss the new Moto Guzzi Stelvio. It has been around eight years since Moto Guzzi updated the Stelvio, and so expectations were quite high when Nic went to the launch in Spain. Don chats with Nic about his experiences with the new Stelvio, and whether this new version is now a credible ADV bike. In the second segment this week, Associate Editor Teejay Adams chats with Ray Hammons. Despite his mature age, a couple years ago Ray realized a long time dream—to learn to ride a motorcycle. To say that he jumped in with both feet is somewhat of an understatement. Ray was fortunate enough to attend the YCRS Champ Street School when he first got his license, and interestingly, he credits the school with saving his life almost immediately. The topic of whether you should cover the brake when riding is actually quite controversial, and if you do it during an MSF course, you will fail. This is patently wrong, and Ray is clearly hoping the right people wake up, and this change is made to rider training across the country. We love your feedback! Gary Peters (D-MI) and other Michigan leaders at the UAW union hall in Warren in Macomb County to celebrate the union's accomplishments in the last year and its endorsement of Biden's reelection campaign.Biden told UAW members “Supporting you is the easiest thing I've ever done. The single biggest reason why we have unions growing, the single biggest reason the economy is growing … because you are the best workers in the world.” Michigan is expected to play a key role in the November general election, as Biden looks to win the state again. This is the second time in recent months that Biden has come to Michigan to talk with UAW members. He became the first sitting U.S. president in modern history to visit a picket line in September during a historic strike against Detroit's “Big Three” automakers — Ford, General Motors and Stellantis. UAW President Shawn Fain announced the union's endorsement of Biden's campaign on Jan. 24 and drew a sharp comparison between Biden and GOP frontrunner former President Donald Trump.“Rarely as a union do you get so clear of a choice between two candidates. Dominique Hammons, a young and talented violinist with unshakable faith and a praying family has taken him to heights he's only imagined and it's just getting started! In about 2019 I was on a social media platform just scrolling through and I see a young man playing this violin to current music in all genres! I thought, who is this?? He's going far! After that, I began to follow him and just like I thought, I began to see him play at multiple places and now I believe it's safe to say, he's a household name! Dominique picked up his violin early in life and his grandmother (a very integral part of this story)encouraged him to keep God first and continue to practice. With her advice he began playing in front of different audiences and even sharing his gifts by teaching children. Later on, his manager,Jonathan Young (CEO of JPRG Radio) convinced Dominique to set his eyes on the prize, get his passport and boldly walk into his calling! Prior to joining IHG, Paul worked at Marriott International in the company's Brand Management, Development and IT departments. We brought someone new into the Hammons family recently; my daughter Taylor married a fine Christian man, and we are thrilled to put an extra chair at the game table for him. In her 40s, Ella was diagnosed with stress urinary incontinence, which caused her bladder to leak unexpectedly. She was implanted with a TVT-Secur and TVT sling and later endured three mesh removal surgeries because the mesh had eroded into her bladder and urethra. Today, Ella is incontinent, wears adult diapers and suffers from frequent urinary tract infections. Using Ethicon and Johnson & Johnson's actions against them, including statements made in internal emails, Kila Baldwin was able to successfully persuade the Philadelphia jury to decide in favor of Ella. In 2017, the jury returned a verdict of $7.1 million in compensatory damages and $50 million in punitive damages, citing Ethicon and Johnson & Johnson's negligent design of the products and willful disregard for patient safety. Baldwin, a partner at Kline & Specter, has been involved in a number of the firm's high-profile cases, including as lead counsel in trials that resulted in verdicts of $80 million, $57.1 million and $41 million against Johnson & Johnson in transvaginal mesh cases. Baldwin was selected as a Pennsylvania Super Lawyer for 2019 and 2020. From 2011-2018 she was named a Pennsylvania Super Lawyer — Rising Star and for 2014-2019 as a New Jersey Super Lawyer -- Rising Star, designating her as among the top 2.5 percent of attorneys in the two states who are 40 or younger. She also was selected for the 2017, 2018, 2019, 2020 and 2021 editions of the peer-review publication Best Lawyers in America. In her latest major case, Baldwin in February 2020 achieved a $12.75 million settlement with a medical device manufacturer, Monteris Medical Inc., whose NeuroBlate Sidefire broke during surgery and caused brain damage to the patient. (Read article) Prior to that case, Baldwin obtained a $75 million settlement in a wrongful death case, the largest pre-trial settlement in a case in Pennsylvania history. In May 2019, Baldwin was co-counsel in a six-week trial that resulted in an $80 million jury verdict against Johnson & Johnson subsidiary Ethicon Inc. for a Media, Pa., woman injured by a surgically implanted vaginal mesh device. The verdict in Philadelphia Common Pleas Court included $50 million in punitive and $30 million in compensatory damages, making it the country's largest compensatory award to date in a vaginal mesh case. (Read article) A few months earlier, Baldwin won a $41 million verdict -- including $25 million in punitive damages – against a J&J for a Lancaster, Pa., woman who suffered permanent injuries from a vaginal mesh device designed and marketed by a company subsidiary. (Read article) In late 2017, Baldwin won a major jury verdict against J&J for a Pennsylvania woman injured by a vaginal mesh device made by the company's Ethicon Inc. subsidiary. The award included $7.1 million in compensatory and $50 million in punitive damages for the behemoth drug and device maker's reckless behavior in selling the defective product implanted in women across the country. In earlier cases, Baldwin was co-counsel in two trials that resulted in verdicts of $12.5 million and $13.5 million for two other women injured by the surgically implanted vaginal mesh products. He's a hospitality leader in the Luxury, Full Service, Select Service, Branded, and Independent hotel spaces and is well-versed in the various needs and variables in all sectors. Scott Hammons is the President of Design and Construction of HEI. Scott joins the host Dan Ryan to share his journey through the hospitality industry and what it all means to him. Takeaways: The way the market is right now if a hotel is going to acquire that is because there is room to improve the hotel or reinvent it. This can happen when a branded hotel gets bought by another company or when it goes independent. First-party project management is a term that Scott has coined to describe his new company, Ground Floor Hospitality. It's a subsidiary of HEI but he refers to it as “first-party project management” because he oversees the whole project rather than someone he is not affiliated with. The hospitality industry is such a dynamic industry. It evokes so many different emotions and uses all 5 senses in order to create an unforgettable experience. Being in an entrepreneurial environment allows for more flexibility for new operations and provides room for growth in process improvements. Scott is excited about the diverse opportunities in the hospitality industry. There are many different aspects of hospitality that you can branch into and each project is its own experience. You want to find a space where when you go to work every day, it doesn't feel like a typical work day or feel draining. You want to work in a place where you find yourself being passionate about what you do. If you are a mentor, you want to prepare your team leaders or other people in your company for a meeting they are about to walk into but still make them walk in the meeting. This will help them to prepare and feel more comfortable for what will happen during that time.
