On July 27, 2016, defendant Steven Morris was driving a delivery vehicle to deliver Domino's food when he made a sudden left turn into oncoming traffic, crashing his vehicle into David and his motorcycle. David suffered severe physical and emotional injuries from this incident. After numerous operations, he was left with the decision to either amputate his left leg or experience permanent and progressive pain. Despite the defense's attempts to claim that Domino's did not have control over a franchisee's operations and therefore could not be held accountable for the actions of a franchisee's employee, Mangiaracina established that Domino's and the franchisee have a “master-servant relationship,” arguing that Domino's did, in fact, have control over the franchisee and therefore should be held responsible. The jury agreed, and on August 13, 2021, a Philadelphia County jury returned a $2,009,553 verdict in favor of plaintiff David Coryell.     Click Here to Read/Download Trial Documents   Guest Bio: Frank Mangiaracina Frank Mangiaracina focuses his practice on catastrophic personal injury. He is a staunch advocate and proven trial lawyer who helped compile more than $60 million in recoveries in the five years before coming to Kline & Specter.  Most recently, in a COVID-era trial during the summer of 2021, Mangiaracina won a $2.1 million verdict against Domino's Pizza for a client who suffered severe and permanent injuries to his leg when his motorcycle was struck by a delivery driver. As co-lead counsel at trial, Mangiaracina gave a closing argument that helped convince the jury that Domino's was responsible for the actions of a franchisee.  He was also co-counsel in litigation that achieved a $44 million pre-trial settlement in a product liability case for an oil rig worker who was left a quadriplegic after he was struck by a falling light fixture.  In medical malpractice cases, among others, Mangiaracina helped win settlements of $5.5 million, $5 million and $3.5 million for, respectively, failures to timely diagnose stroke, diagnose and treat sepsis and to treat an aortic aneurysm.  These recoveries were made with Mangiaracina's prior firm, Sheridan & Murray LLC in Fort Washington, Pa. He also worked as an attorney at Berger & Montague in Philadelphia and as a law clerk with the Philadelphia firm of Saltz, Mongeluzzi & Bendesky.  Because of his litigation success, Mangiaracina has been named a Pennsylvania Rising Star by Super Lawyers for four consecutive years (2019-2022). The independent lawyers survey group recognizes the top 2.5 percent of attorneys in the state who are 40 or younger.  Mangiaracina earned his law degree at the Temple University Beasley School of Law, where he graduated magna cum laude, in the top five percent of his class and was a member of the Order of the Coif honor society. He was, simultaneously, staff editor for the Temple Law Review and a member of Temple's renowned National Trial Team, which placed in the semifinals of the National Institute of Trial Advocacy's “Tournament of Champions,” an invitation-only competition.  At Temple, Mangiaracina won several awards and scholarships, including the Integrated Trial Advocacy Graduation Award, the Benjamin and Natalie Levin Memorial Scholarship, the Class of 1978 Scholarship and the Faculty Law Scholarship. Notes and Links to Timothy Welbeck's Work     Timothy Welbeck, Esq., is an affiliated faculty member in the Department of Africology and African American Studies, where he previously served as an Assistant Professor of Instruction. There he teaches an array of popular courses, including a course he developed entitled Kendrick Lamar and the Morale of the m.A.A.d city. More broadly, Timothy's scholarly work focuses on contemporary issues of racial identity in America, the intersection of racial classifications and the law in the American context, contemporary African American culture, and hip-hop as a microcosm of the Black experience. Timothy has also written several peer-reviewed journal articles including “We Have Come Into This House: The Black Church, Florida's Stop W.O.K.E., and the Fight to Teach Black History.” He also authored “Specter of Reform: The late Sen. Arlen Specter's Criminal Justice Reform, the Violent Crime Control and Law Enforcement Act of 1994, and its Role in Expanding the Modern Prison Industrial Complex,” explores the impact of the infamous 1994 Crime Bill in providing the infrastructure for mass incarceration within the United States. The research, funded by the Arlen Specter Center fellowship, examines how the federalization of criminal law, pursuant to the Commerce Clause, has led to expansive growth in federal law enforcement, imprisonment, and thus setting the foundation for the modern carceral state. Timothy's article “People's Instinctive Travels and the Paths to Rhythms: Hip-Hop's Continuation of the Enduring Tradition of African and African American Rhetorical Forms and Tropes,” examines hip-hop's continuation of centuries-old African cultural norms and aesthetic values. As an attorney, Timothy has long been an advocate for justice, using his legal expertise to defend society's most vulnerable individuals, including survivors of human trafficking, survivors of police brutality, and the indigent. He has also provided crisis management, guidance, and legal counsel to churches and nonprofit organizations across the globe. In that capacity, Timothy is the Chair of the Board of Directors for The Witness Foundation, and an Advisory Board member of For the Future Organization. Timothy has also served as the Civil Rights Attorney for the Philadelphia Chapter of Council on American-Islamic Relations (CAIR), where he defended the constitutionally protected civil rights and liberties of those who experience discrimination and harassment based on their faith, race, ethnicity, and/or national origin, particularly members of the Muslim community within Pennsylvania.  As a hip-hop artist, he has released four full length recordings, shared the stage with national and international acts (Janelle Monáe, Jidenna, EPMD, Dead Prez, and Immortal Technique), won songwriting contests (Session 1 Grand Prize in 2010 John Lennon Songwriting Contest), garnered high compliments from hip-hop legends, industry taste-makers (Sway) and record executives (VP of A&R at Def Jam, Lenny S).  His latest work, entitled ‘Trane of Thought, is a live recorded hip-hop album that melds songs from his first two albums the musical style of John Coltrane. Timothy presently serves as the Pastor of Formation and a Teaching Elder at Epiphany Church of Wilmington, bringing over twenty years of ministry experience. He fosters spiritual growth through expositional and topical preaching, community engagement, trainings, workshops and spiritual counseling. In his role, he equips Epiphany members to live out their faith practically in their communities and prepare others to do the same. Timothy's work as an attorney and scholar has allowed him to contribute to various media outlets, such as: Axios, BBC Radio 4, CBS, CNN, The Huffington Post, NBC, The New York Times, NPR, The Philadelphia Inquirer, REVOLT TV, The Washington Post, VOX, and 900 WURD AM. Dave Specter didn't pick up a guitar till his late teens, yet in his 20s he was Son Seals' rhythm guitarist for two years, and soon he was a bandleader himself. Specter grew up amid Chicago's blues scene and became one of its great players and ambassadors. Here he recalls the glory days of Chicago's blues clubs and the varying vibes. He recounts the evolution of his sound and his progression of guitars. He explains how he creates a solo and why, after years of playing mostly instrumentals with the occasional guest vocalist, he began singing. He tells how his recently released “The Times They Are Deranging (The Buck Stops Where?)” fits in with the songs of conscience he always has admired. Russian Aggression, NATO Tensions, and the Specter of 1914. Gaius and Germanicus, hosting the Friends of History Debating Society in Londinium, discuss the future of the Roman Empire's inheritor, the United States, and its empire in the 21st century. The conversation, held by the turbulent Thames, focuses on the extreme challenges facing US institutions, both outside and inside its borders. The primary external challenge discussed is Russian aggression against Ukraine and the heightened tensions along the NATO frontier. Gaius is reliably told that any provocation, such as blockading the Russian shadow fleet or shooting down a Russian warplane, could lead to Mr. Putin's removal by his right-wing compatriots who believe he has supervised a bad war. Germanicus notes that while no one plans provocations, accidents happen, and hotheads exist in NATO alongside appeasers. Putin is seen as driven by his right-wing elements, demanding recognition and respect for Russia, with conditions comparing the situation to 1914, not 1939. Germanicus counters that Putin is a "Kaiser" (Caesar), comparable to the emperor in Washington, D.C., and must secure a "big victory." Putin's attack on the Ukrainian electrical grid is viewed as smart, bringing Ukraine to the brink without destroying the whole grid, thereby deterring Western media backlash and demonstrating Russia's capacity against NATO. Gaius observes that Washington (specifically the neocons) thinks it must win. The comparison to 1914 suggests that a quick collapse of the Ukrainian war effort could spark a dangerous "July crisis" if the West loses its head.
