This week, lawmakers on the Hill were working on reforms to FISA Section 702, a warrantless surveillance program that allows our intelligence agencies to spy on foreign targets. Though the program was kept alive with a short-term extension, Democrats and a small cohort of Republicans voted against a continuation after raising concerns over the president's pick to serve as his Director of National Intelligence. FOX News Chief Congressional Correspondent Chad Pergram joins The Rundown to go over the drama surrounding FISA and the significance of its expiration, as well as the fight over a new reconciliation bill and this past week's congressional baseball game. Later, Andrew Giuliani, Head of the White House World Cup Task Force, explains the planning and coordination that went into the security surrounding the 78 matches that will be taking place in the U.S. this summer. Trump/Republicans are clear: government power over all things is paramount to defending liberty, which is why they're working to ensure warrantless government spying lives forever.

Send us Fan MailWatch Full Episode on Rumble: https://rumble.com/c/thetonymichaels Congress just extended the FISA Section 702 fight instead of fixing the real problem: warrantless searches of Americans' communications. This is not just a surveillance debate. This is a constitutional power fight.Article I says Congress is supposed to check the executive branch. Article II gives the president power to run national security agencies. But when Congress keeps handing surveillance authority to the executive without real warrant protections, the people lose. The government says, “Trust us.”The Constitution says: Get a warrant.Tony breaks down the current FISA fight in DC, why Section 702 matters, how Americans' communications can get swept into foreign surveillance databases, and why both parties need to stop treating the Fourth Amendment like a suggestion box. This is about executive overreach, congressional accountability, warrantless surveillance, the Fourth Amendment, and whether Congress will finally do its job.Watch the full show for the deeper breakdown.Watch Full Episode on Rumble: https://rumble.com/c/thetonymichaels
This week on Driving Law, Kyla Lee and Paul Doroshenko break down what may be one of the most consequential Canadian decisions on drug recognition evaluations. The case examines what happens when police fail to follow the required 12-step DRE process, and why skipping even one step can make the entire investigation unlawful. They discuss how drug recognition evaluations function as warrantless searches, why police must stay within the exact authority granted by the Criminal Code, and how tunnel vision and confirmation bias can affect impaired driving investigations. The decision also raises serious questions about the structure of DRE forms and whether they push officers toward predetermined conclusions. Plus, the Ridiculous Driver of the Week involves two teenagers, a riding lawnmower, and a Target store. Donald Trump has executed a complete flip-flop on FISA (Foreign Intelligence Surveillance Act) — after previously campaigning to "kill FISA" when the law was used against him during the Russiagate investigation, he is now demanding a clean extension of FISA 702 without warrant requirements. Jimmy and Americans' Comedian Kurt Metzger argue that FISA allows the government to spy on Americans unconstitutionally without real warrants, and that Trump is betraying his supporters by aligning with the same establishment he once opposed. Speaker Mike Johnson is also called a hypocrite for abandoning his earlier calls for FISA reform after gaining power and receiving classified briefings. The segment concludes by pointing out that Jim Jordan and JD Vance have also flipped, and that Trump's reversal shows he is now fully part of the "uni-party" deep state. Plus segments on Erika Kirk's recent no-show at a poorly attended TPUSA event, Benjamin Netanyahu insisting that the White House reports to him and a Polish member of parliament accusing Israel of being the new Nazis. Also featuring Stef Zamorano and Mike MacRae. And a phone call from Benjamin Netanyahu!
Despite the rhetoric, Republicans love warrantless government spying which means that FISA 702 is likely continue with little or no change.
President Donald Trump says he does not want a ceasefire in Iran and is asked about his post that opening the Strait of Hormuz from Iran's blockade is "a simple military maneuver"; Senate votes down for a fifth time a bill to end the partial government shutdown of the Homeland Security Department. Sen. Patty Murray (D-WA) says the two sides are still far apart in finding an agreement to reform federal immigration enforcement procedures; Senate passes a bill to require Members of Congress to go through the same airport security as everyone else. TSA employees have been working without pay during the shutdown, and security lines in some airports are stretching to a more than two hour wait; Congress will soon be voting on whether to reauthorize the FISA Section 702 warrantless surveillance program or let it expire. A judge rules on warrantless immigration arrests in Oregon. AP correspondent Mike Hempen reports.
When federal agents kill civilians and public outrage sweeps the nation, who gets to define justified force and who gets to hold power accountable? The killings of Renée Good and Alex Pretti have sparked protests, national shutdowns, and fresh debate about what security should look like in America. Elizabeth Neumann, former assistant secretary for counterterrorism at the US Department of Homeland Security, joins Mark Labberton for a wide-ranging conversation about fear-based governance, moral responsibility, constitutional guardrails, and what faithful leadership looks like in a moment of political crisis. "Cruelty is a deterrent." In this episode with Mark Labberton, Neumann reflects on how Christian faith and public service shaped her national security career and why recent forceful immigration enforcement and lethal encounters challenge constitutional limits and moral clarity. Together they discuss the moral and political meaning of the Minneapolis killings, trauma and vocation, immigration enforcement and democratic consent, fear-driven leadership, and how citizens and faith communities respond when institutions break down. Episode Highlights "Cruelty is a deterrent." "I realized how much my hope and trust had been in man." "We wrapped the flag around the cross." "We see sufficiently, but not transparently." "This is not normal, and this is not okay." About Elizabeth Neumann Elizabeth Neumann is a national security expert and former assistant secretary for counterterrorism at the US Department of Homeland Security. She served across three presidential administrations, including senior roles during the George W. Bush and Trump administrations, and worked extensively on counterterrorism, prevention of political violence, and domestic extremism. A frequent public commentator and congressional witness, Neumann has become a leading voice on the moral and constitutional dangers of fear-driven governance. Her work bridges public policy, trauma studies, and Christian ethics, particularly where political power collides with faith commitments. She is the author of Kingdom of Rage, a deeply personal and analytical account of extremism, nationalism, and the cost of unexamined allegiance. This Day in Legal History: Treaty of Guadalupe HidalgoOn February 2, 1848, the Treaty of Guadalupe Hidalgo was signed, officially ending the Mexican-American War and significantly altering the legal and territorial landscape of the United States. The treaty ceded vast swaths of land to the U.S., including present-day California, Arizona, New Mexico, and parts of several other western states—about half of Mexico's territory at the time. In exchange, the U.S. paid Mexico $15 million and assumed $3.25 million in claims by American citizens against Mexico. Legally, the treaty promised to protect the property rights and civil liberties of Mexican nationals living in the newly acquired territories, but these promises were inconsistently honored in practice. The treaty's ratification triggered significant legal and constitutional debates about the extension of slavery into new territories, setting the stage for the intensifying sectional conflicts that led to the Civil War. It also marked the beginning of long-standing disputes over land grants and water rights that would shape western property law. Moreover, the treaty's vague wording left many issues—such as tribal sovereignty and citizenship—unresolved, leading to future litigation and policy struggles. The treaty was signed in the town of Guadalupe Hidalgo, near Mexico City, and ratified by the U.S. Senate in March 1848. It remains a foundational document in U.S. legal history, frequently cited in discussions of land rights, citizenship, and the limits of treaty enforcement. Our first story today is a bit off topic. In today's digital world, every click, swipe, and login happens under a legal regime you didn't negotiate—Terms of Service, Privacy Policies, and community guidelines that quietly shape your rights and obligations online. These documents form a system of private lawmaking, where companies act as legislators, drafting rules users must follow, often with little recourse or transparency. You don't sign them, but courts often treat them as binding contracts. Clauses about arbitration, content ownership, surveillance, and data sharing carry real legal weight. Yet these terms can change overnight, unilaterally, and without notice.TOSTracker was created to bring transparency to this ecosystem. It's a non-commercial research tool that tracks and archives the evolution of digital contracts over time. With over 150 companies and nearly 250 historical versions of key documents thus far, TOSTracker offers timestamped, hash-verified, and citable records of how these texts change. It provides full version histories, detects redlines at the word and section level, and supports programmatic access through an API. Whether you're studying arbitration creep, GDPR compliance, or how moderation rules evolve, TOSTracker gives you the empirical backbone to do it.All content is normalized and archived via the Internet Archive's Wayback Machine, with cryptographic hashes ensuring document integrity. Importantly, it doesn't interpret the law—it captures the text and structure so you can. For legal researchers, privacy advocates, and anyone concerned with digital governance, this is a window into how private law is made, revised, and enforced online. It's not a product; it's a dataset, an archive, and a call to look more closely at the legal architecture of everyday tech. We're also actively seeking contributors to help expand the archive. If you come across a consumer-facing legal document—like a Terms of Service, Privacy Policy, community guidelines, or EULA—that isn't already tracked, you can submit it directly through the site. This includes documents behind logins, from smaller platforms, or covering underrepresented industries and regions. Submissions help close coverage gaps, diversify the dataset, and improve the foundation for legal research into how digital rights are defined and redefined over time. Your input directly supports transparency in an area where the law is often invisible.Check it out at tostracker.app if your research overlaps with digital contracts, user rights, or the evolving boundary between public law and platform governance. The U.S. Federal Trade Commission (FTC) has sent warning letters to 42 major law firms over concerns that their diversity, equity, and inclusion (DEI) hiring practices may be anticompetitive. The FTC emphasized that firm-wide agreements to meet diversity benchmarks—particularly those tied to programs like Diversity Lab's certification—could unlawfully restrict competition in the legal labor market by influencing hiring, compensation, or promotions. These letters arrive amid a broader rollback of DEI initiatives under President Donald Trump's administration, which has eliminated related programs in government and targeted private sector efforts.Firms such as Paul Weiss, WilmerHale, Perkins Coie, Skadden Arps, and Latham & Watkins—some of which had previously been challenged by Trump-era executive orders—are among those named. Some reached compromises with the White House, offering pro bono legal work in exchange for eased scrutiny, while others fought and won legal challenges against the orders. The FTC's scrutiny centers on participation in Diversity Lab's voluntary DEI certification, which encourages firms to ensure at least 30% of leadership candidates are from underrepresented groups. Though previously upheld in court as non-discriminatory, the FTC now frames such collective DEI practices as potentially violating competition law.US Federal Trade Commission warns law firms about DEI hiring | ReutersImmigrant rights groups filed a federal lawsuit in Boston challenging a new U.S. Immigration and Customs Enforcement (ICE) policy that allows agents to enter homes without judicial warrants. The suit, brought by the Greater Boston Latino Network and the Brazilian Worker Center, targets a May 2025 memo—recently revealed via a whistleblower complaint—that permits ICE officers to use administrative warrants instead of warrants signed by a federal judge. These administrative forms, issued internally by the Department of Homeland Security, were previously insufficient for home entries under longstanding practice. The plaintiffs argue that using such warrants for home arrests violates the Fourth Amendment, which guards against unreasonable searches and seizures. Legal advocates claim the policy removes a crucial constitutional safeguard just as ICE ramps up enforcement tactics in states like Minnesota, where multiple recent actions have already been deemed unlawful by judges. The lawsuit comes after fatal incidents in Minneapolis during anti-ICE protests, intensifying scrutiny of federal immigration operations.ICE officials defend the policy, asserting that individuals subject to removal have already received due process. However, the lawsuit challenges that rationale, pointing out that due process does not override constitutional protections against warrantless home intrusions.Lawsuit challenges ICE ability to enter homes without warrants from US judges | ReutersFormer CNN anchor Don Lemon is facing federal charges over his role in covering a protest at a Minnesota church opposing President Trump's immigration crackdown. The protest, which disrupted a church service in St. Paul on January 18, was livestreamed by Lemon and targeted the church because one pastor was allegedly also an ICE official. Lemon was arrested by the FBI, spent a night in custody, and appeared in court where he confirmed he plans to plead not guilty. He and six others, including independent journalist Georgia Fort, were indicted under laws prohibiting obstruction of access to houses of worship—a legal framework typically used against abortion clinic protests.Free press advocates and constitutional lawyers are raising concerns about the charges, framing them as part of a broader pattern of the Trump administration targeting critics, including journalists. Lemon's attorneys argue this is a political prosecution meant to suppress press freedom and distract from ongoing crises. In the archived livestream, Lemon is seen documenting the protest rather than leading it, further fueling First Amendment concerns. The DOJ's case hinges on a controversial interpretation of laws rarely, if ever, used to prosecute journalists for protest coverage after the fact. Legal experts say there is no clear precedent for the charges, and press freedom groups are warning of escalating threats to constitutional protections.Ex-CNN journalist Don Lemon faces Minnesota protest charges | Reuters This is a public episode. On this week's episode of the Free Thought Project podcast, Matt Agorist and Jason Bassler sit down with Dylan Schmidt, a digital strategist, founder of Digital Podcaster, and the creator behind Content Clips. Dylan has recently become a vital voice in the liberty movement, known best for his sharp, accessible analysis of the modern surveillance state. He specializes in taking complex, dystopian developments—from AI drag-nets to data harvesting—and breaking them down into digestible, viral content that reaches people far outside the usual echo chambers. The conversation begins with Dylan's origin story, exploring the moment he began to see the system for what it actually is and the compulsion he felt to use his platform to wake others up. We discuss the terrifying new reality of ICE asserting the authority to enter private homes without a judicial warrant—and the disturbing apathy from the public regarding this death blow to the 4th Amendment. Dylan provides a brilliant analogy to explain this shift, comparing the government's encroachment on rights to a "private equity firm taking over your favorite restaurant," gutting the quality and soul while retaining the brand name. We also cover the grim irony of the police state eating its own tail, highlighting recent reports of ICE agents detaining and profiling local police officers. Later in the show, we shift gears to the machinery of control. We dive into Palantir, the tax-funded leviathan of spying that is mapping our lives in real-time, and discuss the dual-edged sword of Artificial Intelligence. We also tackle the myth of crypto privacy, exposing how companies like Chainalysis are tracking "establishment wallets" and what steps you can take to break free from this financial panopticon. Finally, we discuss the rise of Flock safety cameras and how to resist them, before closing with a powerful "White Pill" on why maintaining your composure, connecting with nature, and refusing to participate in online hate is the ultimate act of rebellion. A recent report focuses on the use of “designated area” laws in Victoria and the increasing practice of warrantless searches. The study found that communities with multi-racial backgrounds are targeted up to three-and-a-half times more than predominantly white areas, even when crime rates are lower. This raises concerns for legal and human rights experts, as it may violate the Victorian Charter of Human Rights.
A new study reveals that communities with multi-racial backgrounds are exposed to warrantless searches up to three-and-a-half times more than communities in white-majority areas. According to the analysis of Victoria Police's use of extraordinary search power, this happens even when areas of white-majority communities have higher crime rates.
Federal immigration agents forced open a door and detained a U.S. citizen in his Minnesota home at gunpoint without a warrant, then led him out onto the streets in his underwear in subfreezing conditions, according to his family and videos reviewed by The Associated Press.ChongLy “Scott” Thao told the AP that his daughter-in-law woke him up from a nap Sunday afternoon and said that U.S. Immigration and Customs Enforcement agents were banging at the door of his residence in St. Paul. He told her not to open it. Understanding the Exceptions to the Fourth Amendment's Warrant RequirementThis conversation delves into the complexities of the Fourth Amendment, focusing on the exceptions to the warrant requirement. It explores the foundational principles of probable cause and reasonable suspicion, the nuances of consent, exigent circumstances, and the implications of modern technology on privacy rights. The discussion emphasizes the importance of understanding these concepts for legal examinations and practical applications in law enforcement. The Fourth Amendment is a cornerstone of American law, designed to protect citizens from unreasonable searches and seizures. However, in practice, the landscape is far more complex, especially when it comes to the exceptions to the warrant requirement. This blog post delves into these exceptions, providing clarity for those preparing for exams or navigating real-world legal scenarios. The Fourth Amendment's Noble PrincipleThe Fourth Amendment begins with a noble principle: warrants are preferred, and any search or seizure conducted without one is presumptively unreasonable. This principle serves as a shield against arbitrary government intrusion. However, the reality is that most lawful police activities, such as arrests and car searches, do not involve a warrant. Instead, they rely on a complex labyrinth of exceptions.Key Exceptions to the Warrant RequirementConsent: This exception is straightforward in theory but complex in practice. Consent must be voluntary, and courts consider various factors to determine voluntariness, such as the individual's age, intelligence, and the presence of coercive police tactics.Search Incident to a Lawful Arrest (CIDA): This allows officers to search an arrestee and the area within their immediate control to ensure officer safety and prevent evidence destruction. However, the scope is limited to the arrestee's "wingspan."Automobile Exception: This exception permits warrantless searches of vehicles if there is probable cause to believe they contain contraband or evidence of a crime. The inherent mobility of vehicles and the reduced expectation of privacy justify this exception.Exigent Circumstances: This allows for warrantless entry when practical necessity dictates, such as preventing imminent harm or the destruction of evidence. The scope and duration of the search must be limited to addressing the specific emergency.Plain View Doctrine: Officers can seize evidence without a warrant if it is in plain view while they are lawfully present at the vantage point.Navigating the Legal MazeUnderstanding these exceptions is crucial for anyone involved in criminal procedure, whether for exams or real-world applications. The key is to analyze each situation meticulously, considering the specific exception and its elements. By mastering this complex area of law, you can effectively navigate the legal maze of the Fourth Amendment's warrant requirement.Subscribe Now: Stay informed about the latest legal insights and updates by subscribing to our blog.TakeawaysThe Fourth Amendment protects against unreasonable searches and seizures.Warrantless searches rely on a complex set of exceptions.Probable cause requires a fair probability, not a mathematical certainty.Consent must be voluntary and not coerced by police pressure.Exigent circumstances allow police to act without a warrant in emergencies. The burden of proof lies with the government to justify warrantless searches.Digital data privacy is evolving with technology and court rulings. The third-party doctrine complicates privacy expectations in the digital age.Understanding the nuances of consent is crucial for legal analysis. The balance between law enforcement needs and individual rights is a core theme in Fourth Amendment jurisprudence.Fourth Amendment, warrant exceptions, probable cause, reasonable suspicion, consent, exigent circumstances, digital privacy, law enforcement, search and seizure
A St. Cloud strip mall was the center of what one lawmaker called “chaos and aggression” Monday when dozens of ICE agents showed up. Some protesters were hit with pepper spray, and some community members threw snowballs at agents, according to local media reports.Federal immigration agents illegally broke into a man's home in north Minneapolis over the weekend in what attorneys say was a clear violation of the Constitution. As immigration enforcement ramps up across Minnesota, questions are growing about what to do if ICE agents approach you. Immigration attorneys say it's important for people to understand their rights during encounters with federal agents.Attorney Gloria Contreras Edin says if ICE stops you in a car or on the street, stay calm and don't resist. Contreras Edin also suggests U.S. citizens carry copies of their passports. She said those without passports are required to carry original copies of their documents, such as a legal permanent resident card.
Pottstown (PA) had an ordinance that allowed for the borough to inspect rental units every other year without a warrant and without permission; the IJ brought suit on behalf of two tenants and a landlord and the court unanimously struck the statute down under state law. https://ij.org/
With Melbourne's CBD and other areas now designated a warrantless stop-and-search zone, general practitioner lawyer Banhi Banerjee breaks down what these new police powers actually mean. She explains why residents should not be alarmed, what rights every individual still holds, and the safe, lawful steps to take if approached by police. The conversation also outlines the formal complaint mechanisms available should anyone feel unfairly targeted or treated improperly under the updated regulations.

While Maduro is no doubt a tyrant who has caused great harm via hyperinflation to the people of Venezuela, he is also being targeted by nefarious elements of intelligence agencies. Two sides can he wrong at the same time. The US funded cartels being targeted are simply a proxy and excuse to take over Venezuela which is one of the most oil rich countries on earth. Warrantless attacks on boats killing many under the guise of stopping drugs from entering the United States is an example of the propaganda people are receiving on both sides. Who arms and funds these cartels? What evidence is there that fentanyl is coming from Venezuela? Who makes the fentanyl? Who sells it? As President Trump deploys F-35 fighter jets to Puerto Rico, things are quickly getting heated in Latin America as the United States turns attention from China which they propped up in the first place for the purpose of launching a competing technocratic order in the east to Latin America which they have been manipulating via proxy for decades. The targeting of Mexico and Venezuela is a shift towards creating further Iraq-like chaos in the region and further evidence that the war narrative continues despite Trump being nominated for a peace prize. The president doesn't have actual power. This was all scripted long ago. Trump is threatening to bomb Iran again. The Middle East "peace deal" has within hours lead to Israel leveling more neighborhoods in Gaza. Trump continues to send weapons to Ukraine to attack inside of Russia.
