On Wednesday last week the Victorian Government released its response to the Yoorrook Justice Commission's report entitled ‘Yoorrook for Justice'. The commission is the nation's first formal truth-telling process set up to examine injustices experienced by First Nations people since colonisation. Of the 46 recommendations the report makes, the Victorian Government under Jacinta Allans supports just 4 in full, with 39 supported in principle or in-review, and 3 recommendations outright rejected. The establishment of a new police independent oversight authority, as recommended by the Commission, is being reviewed or supported in principle. The Victorian Government rejected recommendations that include: raising the criminal age of responsibility to 14 and the minimum age of detention to 16; overhauling discriminatory bail laws and creating a presumption in favour of bail for almost all offences; and strengthening the state's Charter of Human Rights to make it more accessible.I spoke with Nerita Waight, the CEO of the Victorian Aboriginal Legal Service to talk about the Victorian Government's response. This is the conclusion the Australian Citizens Party has drawn from its investigation of the case of former US Navy “top gun” pilot, now Australian citizen Daniel Duggan, who has been held in solitary confinement for nine months waiting to see if he will be extradited to the United States. Citizens Party Research Director Robert Barwick said today: “This is a terrible case, which should deeply shame all of us, because our government is destroying a beautiful Australian family solely to please Anglo-American war hawks and their Five Eyes spy network who want to make an example of Duggan for their propaganda war against China.” Barwick cited the following elements of the case: • The AFP arrested Duggan on the 21st of October 2022, designating him “extreme high risk” to hold him in harsh conditions in solitary confinement in very cold Lithgow with insufficient food, blankets, medical care and access to family and legal advice. • Five Eyes agency ASIO possibly broke the law by luring Duggan back to Australia to be arrested, which the Inspector General of Intelligence and Security is investigating. • Attorney-General Mark Dreyfus, who approved Duggan's arrest, is improperly trying to interfere with the Australian court, by backgrounding journalists to harass the court to release the US extradition request which lists all the US allegations against Duggan, but which the court has declined to release in the interests of justice. • Australia only extradites if the charge meets the “dual criminality” standard of being a crime in both the country seeking the extradition (USA) and Australia, but the Attorney-General refuses to say whether Duggan's charges are crimes in Australia–if the Attorney-General can't even claim dual criminality, on what grounds did he approve Duggan's arrest and harsh treatment? • An indictment cobbled together by the Trump administration in 2017, when anti-China hawks Mike Pompeo, John Bolton, and Peter Navarro were ramping up attacks on China, accuses Duggan of training Chinese military pilots at a training school in South Africa between 2010 and 2012, but he vehemently denies they were military pilots, and nobody else associated with that school has been charged. • Even if they were military pilots, the official attitudes of the US and Australian governments towards China in 2010-12 were very different than today–even as recently as 2019 Australia conducted joint military exercises with China! • UK Air Chief Marshal Wigston acknowledged in 1st of February 2023 testimony to the UK House of Commons Defence Committee that such foreign pilot training had been quote “going on for many years and it goes back to a period when we took a different approach to China. … So I can understand why those people … would have felt that it was a reasonable thing to do.” unquote • The 18 October 2022 Washington Post admitted most retired US military personnel ignore the law Duggan is accused of breaching, without consequences: quote “There is no criminal penalty for violating the law. Historically, it's a seat the Liberal Party should hold – they've held it for over 30 years. But when you look at much of the evidence at the moment, it's also a seat that Labor should win. There's a 2.8 per cent margin, the Liberal Party in Victoria is in disarray. And it's not looking very good for the Liberal Party who might be looking for a new leader after Saturday night.

Superannuation is a boring topic of conversation at the best of times, but the government can see that it can save a substantial sum of money by closing off a loophole and has introduced a higher level of tax on superannuation accounts holding over $3 million. And the opposition can see an opportunity to claim that the Prime Minister has broken an election promise. The Liberal Party does have this great skill in being able to magnify the small issues into large scale calamities. There have been some comparisons made with the franking credits campaign from 2019, where they made everyone believe that they were going to lose their franking credits, even for those people who didn't own shares. But it's hard to mount these types of scare campaigns when you're in opposition and the Labor government should probably cut the superannuation benefits even further.The Attorney–General Mark Dreyfus has met with news agencies and media unions to discuss national secrecy laws and improve protections and press freedoms for journalists and people working in news gathering and political reporting. These are important issues, but it's difficult to talk about press freedoms when Julian Assange is still languishing in a British jail – or the fact that Australia's has the least diverse media landscape in the Western world. It would be better for the government to focus on media ownership laws and create a stronger and enforceable code of conduct for the media.The Robodebt Royal Commission continues and the role of the former Government Services Minister, Stuart Robert, has been in the spotlight. The Minister was informed by the Secretary of Human Services that the Robodebt scheme was unlawful, which he ignored and said that he would “double down” on the scheme. Officials within the department who supported the Minister's agenda were rewarded, and the others who provided negative advice were punished. It's one of the biggest scandals to hit Australian politics but, curiously, the mainstream media hasn't had the stamina to report on this Commission.It's one year since Russia invaded Ukraine – it was only meant to last a few days, but it's still going on and unlikely to stop for some time to come. War is an extension of politics by another means and this one is likely to continue until both sides are exhausted and realise there's no point in going on. Russia is still the big loser here and Vladimir Putin's quest to rework European geopolitics hasn't paid off so far. But the bigger issue is that so many people have died – up to 300,000 people on both sides – with around six million people displaced. And, as with most wars, it's not the political leaders who are paying the price: it's the innocent civilians and soldiers.

The government has introduced its legislation for the National Anti-Corruption Commission, which has received the endorsement of opposition leader Peter Dutton and so is assured of passage through parliament. But critics are unhappy that its public hearings will be limited to when there are “exceptional circumstances”. Attorney-General Mark Dreyfus in this podcast strongly rejects the argument this is too high a hurdle. The government has yet to nominate a head of the powerful new body, and Dreyfus says it is open to suggestions. Asked if he has anyone particularly in mind he says, “No I do not. […] We're going to be trying to find someone who's eminent, who has a real standing in the community.” On the question of so-called “grey corruption”, notably misuse of ministerial discretion in grants schemes, Dreyfus stresses it will be completely up to the commission to decide what might justify investigation.
The federal corruption watchdog will be given power to investigate anyone who tries to induce public officials to engage in dishonest conduct, widening its scope to capture “third parties” in the pivotal reform to improve integrity in government.
