When Is AS IS Not Necessarily AS IS... ...Especially when things go sideways without warning The #1 thing that seems to go wrong are issues that pop up during the inspection period that no one could have predicted upfront the seller may not have been aware the buyer didn't see it during the showing the agents didn't notice it during the showing the issue may have occurred after the showing so does that mean the buyer is "stuck" with that issue or is there some recourse for them if they want it resolved most purchase contracts have an inspection period and a buyer can request items to be repaired/replaced the seller is under no obligation to agree to the requests but many will agree to do some/all of what the buyer asks for as the buyer does have the right to cancel the contract and get their escrow deposit back  as long as they cancel within the inspection period AS IS contracts are used in the majority of home sales understanding the nuances of the agreements is critical today's show breaks it all down for you

THE Sales Japan Series by Dale Carnegie Training Tokyo, Japan

Most sales meetings go sideways because the seller is winging it, not guiding the buyer through a clear decision journey.  In a competitive market with limited buyer time, you need a questioning structure that gets to needs fast, keeps control of the conversation, and leads naturally to a purchase decision—without sounding scripted.  Do you actually need a sales questioning model, or can you just "follow the conversation"? You need a questioning model because buyers will pull the conversation in random directions and you still need to reach a purchase outcome. A lot of salespeople have little structure because they're untrained, they're used to winging it, or they hate being "shackled" by a system and want to be a free bird in the meeting. The problem is: you don't have unlimited time, and competitors are offering similar solutions, so you must get to a clear understanding of needs quickly and match a solution precisely. A model gives you a logical cadence and a "track of your choosing" so you can steer back to what matters when the conversation wanders. Do now: Go into your next meeting with a written question flow, not just a list of topics.  What are "As-Is" questions and why do they matter in discovery? As-Is questions establish the buyer's baseline—what they're doing now and how well it's working. You're mapping the current reality: what has the client been doing so far, what's working, what isn't working well enough, and what the situation inside the organisation looks like today. Sometimes buyers jump straight to where they want to be; that's fine, but you still need the "before" picture to measure the gap between current and desired states. Without the baseline, you can't diagnose properly, you can't quantify distance, and you're guessing at priorities. Do now: Ask three baseline questions before you pitch anything: current process, current result, current constraint.  What are "Should Be" questions and how do you uncover real goals? Should Be questions reveal what outcomes the buyer is aiming for—strategic, financial, or operational. Clients have goals whether they publish them or keep them private, and you need to know them to judge whether you can help. These goals might be in an annual report, an internal plan, or just in the head of the decision-maker. Your job is to get them into the open so you can measure fit and value. This is also where you start building a clear "destination" so the buyer can see the difference between today and the target state. Do now: Ask: "What does success look like this quarter?" then "What metrics prove it?"  What are implication questions, and why should you always include time? Implication questions create urgency by showing the downside of staying as-is—especially the cost of taking too long. The point is to plant doubt: can they hit the goal by themselves, fast enough, and cost-effectively enough? Time is the accelerator—because even if they could get there eventually, they usually don't have "100 years." Strong implication prompts include: "If things stay the way they are, will you still reach the target fast enough?" and "What happens if you don't meet the goal in the required timeframe?" You're not bullying them; you're helping them face the reality that no action has opportunity costs. Do now: Add one time-based implication question to every discovery call.  What are "Change" questions and how do they uncover your real sales opportunity? Change questions ask the key truth: if they know where they are and where they need to be, why aren't they there already? This is where your value often appears, because their answer exposes capability gaps, speed gaps, political roadblocks, or resource limits—exactly the reasons they may need you. The companion implication here is serious: if they can't make the necessary changes, will it damage the business? Markets don't wait around, and delaying change isn't neutral—it has a price. Your role is to surface that cost clearly, then position your solution as the fastest, safest path to progress. Do now: Ask: "What's stopped you fixing this until now?" and then "What will it cost to delay another 90 days?"                                  Payout questions identify what's personally at stake for the buyer if the project succeeds—or fails. The company expects outcomes, and the buyer is under pressure to deliver results. When you know what the buyer personally gains (reputation, promotion, risk reduction, credibility), you can frame your solution around what matters to them, not just the organisation. There's also an implication question here, but it requires diplomacy: "In the worst-case scenario, what would be the personal impact for you if this can't be fixed fast enough?" Done well, it makes you an ally in their success—not another vendor chasing a contract. Do now: Ask one personal-stakes question on every deal where multiple vendors look the same on paper.  Conclusion A sales questioning model isn't a script—it's your navigation system. As-Is questions define the baseline. Should Be questions clarify the target. Implication questions add urgency with time and consequence. Change questions expose why progress hasn't happened. Payout questions reveal personal stakes that drive decisions. Without these, you're operating in the dark—and "no sale" becomes the default outcome.  Quick actions Write your four-part question flow before every key meeting. Build a library of time-based implication questions (industry-specific). I am the captain on this journey called life,I've sailed through storms, struggles and strife.I protect my passengers, cargo and crew,What's best for them is what I will do.☉Sawasdeeka New Paradigmers!All aboard!  The mighty vessel, 2026, is leaving the harbor of 2025 and the past behind.  It's time to decide what comes and what goes, who and what stays behind and what's essential for the journey ahead.  It's time for, drum roll please, you guessed it, CAPRICORN. It's interesting that the Sabian symbols for both the Sun and Full Moon have to do with what is permanent (truth) while Capricorn, ruled by Saturn, has dominion over this temporary, physical, third dimensional realm.  The big word that comes to me for Capricorn is RIGHT.  Right versus wrong, right action, right thought, righteousness, inalienable rights, etc.  When in doubt, or whenever we need to make a decision, it would seem the obvious choice is simply to do what's right. Right? Sometimes it's hard to determine what's right.  However, in the case of Capricorn (and these times) what's right is based upon what's best for the whole, the group, the community, those people and things that we have taken responsibility for, and our DUTY.  Some duties we have taken on voluntarily and committed to (another keyword for Saturn/Capricorn) while others have simply been given to us, hence the association of this archetype with “karma.”  One way or the other, as we move through life, we end up with responsibilities toward others and the outside world (financial comes to mind here too) and these increase as we get older.  But, no matter how old we are, we have decisions to make, and these first two months of 2026 will be full of big ones for many of us.  It's probably important to keep in mind here that not making a decision is a decision!  When in doubt, CHOOSE, you cannot make a wrong choice, as when you are in your integrity you are simply doing the best you can with what you've got.  We're all wounded, we're perfectly imperfect, we're all learning, we're all afraid.  We come to each and every decision carrying all of these, and, RIGHT ACTION, under these circumstances, is to humbly accept ourselves and life AS IS, going on a whim and prayer that what we do will, in some way, help it.  Knowing that we're all doing the best we can with who and what we are, our karmic past and our soul's intentions, can not only assist us in having mercy on ourselves but having compassion for others.  Let's all go forward together and create a happy new year! This week's song is "Shine On You Crazy Diamond!" https://youtu.be/lKJ8n8xYd-Q?si=Cs1_whVAOLi892AeSo Much Love,Kaypacha

PAZ Y BIEN!…¡SANTA ALEGRÍA!Paz y Bien…Santa Alegría!!  Dicen algunos que este saludo viene del mismo San Francisco de Asís cuya fiesta celebramos hoy. Puede ser que algunos de Uds. traerán sus mascotas: perros, gatos y otros animales para que los padres de tu parroquia los bendigan hoy. Viene o no viene este saludo del mismo San Francisco sabemos que él era un hombre, un santo hombre lleno de la paz y la misma alegría de Jesús. El evangelio de hoy dice esto: En aquella misma hora, Jesús se llenó de júbilo en el Espíritu Santo y exclamó: "¡Te doy gracias, Padre, Señor del cielo y de la tierra, porque has escondido estas cosas a los sabios y a los entendidos, y las has revelado a la gente sencilla!  Entonces Jesús les dice esto:Alégrense más bien de que sus nombres están escritos en el cielo". En su famoso canto Cántico al Sol San Francisco habla de Sus Hermanos: Sol, Luna, Viento, Agua Fuego y de su Hermana Madre Tierra. Porque Francisco sabía que todos que nos atraen a Dios, todas las cosas de la tierra que nos animan a vivir en Santa Comunión con Dios y en santa y alegre y generosa santa comunión con los demás pues son todas esas cosas motivos de Paz y de Bien para nosotros.  Además de todo eso San Francisco habla de la Hermana Muerte. The eleven years that passed between the 1943 and the 1954 elections were arguably some of the most pivotal in Australian history. This was a period of intense political, policy and strategic transition, which saw a popular Labor Government and its state-led vision for post-war reconstruction toppled by Robert Menzies and his newly formed political machine, the Liberal Party of Australia. Meanwhile, a backdrop of rising Cold War tensions came to dominate domestic and international policymaking, ushering in a divisive communist party ban, the ANZUS treaty, the Colombo Plan, and Australia's own agency of international espionage, ASIS. Five days, five mixes. RA.999 launches with two of the 2020's most exciting techno producers tearing a portal to the future. When it comes to purveyors of contemporary hardgroove, it's hard to top 1morning and Regal86. The duo have emerged from a buzzy, and decidedly funk-oriented techno scene on the American West Coast, repping Los Angeles and Monterrey respectively. Bound by a shared love of old-school flair and intuition behind the decks, you'll often find Regal86 ditching headphones altogether in favour of studying waveforms in real time, while 1morning's vinyl-only sets are steered by the movements of the dance floor and the fire in his heart. So it comes as no surprise that we had to invite them back in session. In the last week before we celebrate the 1000th RA Podcast, we'll drop five back-to-backs over the course of the week. From the NYC Downlow to Berlin's Bar25, what unifies this cohort is a sense that they capture where dance music has been—and crucially, where it's going. Kicking off the week, we have this exclusive recording from the duo's co-headline show at New York's Bossa Nova Civic Club—the "extra special" final stop of their recent US tour. As the first instalment of RA.999, this one-hour set makes a strong case for what it means to achieve ultimate freedom in the booth. Regal86 and 1morning might be known for their raw, swung techno explorations, but here, their more sensual leanings carry the most impact. You'll find hardgroove's very own daddy Ben Sims, Paul Mac's 2002 melodic beauty Struggling Event and the lavish stomp of Percy X's As Is. When you enter the great hall of the Thomas Jefferson building at the Library of Congress in Washington, the first exhibit you will be facing is their Gutenberg Bible. And it is one of the finest Gutenberg bibles around, one of only three surviving pristine copies on vellum. This was the kind of bible that was so expensive to produce, it bankrupted Gutenberg. When the Library of Congress bought it in 1930, they paid $375,000, roughly $7.5m in today's money. But this is not the most expensive piece in the library's collection. That would a work by two Germans, Martin Waldseemüller and Matthias Ringmann. And it is not even a book, but a map. Not a small map, it is 2.3m or 91 inches wide and 1.3m or 50 inches tall. And this map, printed in 1507 claimed to be:A DESCRIPTION OF THE WHOLE WORLD ON BOTHA GLOBE AND A FLAT SURFACE WITH THE INSERTIONOF THOSE LANDS UNKNOWN TO PTOLEMYDISCOVERED BY RECENT MENAnd the authors wrote that the three continents known since antiquity, Europe, Africa and Asis, quote "have in fact now been more widely explored, and a fourth part has been discovered by Amerigo Vespucci (as will be heard in what follows). Since both Asia and Africa received their names from women, I do not see why anyone should rightly prevent this [new part] from being called Amerigen—the land of Amerigo, as it were—or America, after its discoverer, Americus, a man of perceptive character." End quote. This fourth part, they said was “surrounded on all sides by the ocean”. And indeed, in the left lower corner we find a fourth continent, a thin, stretched thing, with few place names and a western shore that hints at the Peruvian bulge, unmistakably, South America and then to north of it a very indistinguishable blob of land.This map, proudly displayed as America's Birth Certificate, is full of the most intriguing mysteries. How did Waldseemüller and Ringmann know that the Americas had a western shore, when it was only in 1513, 6 years later, that a European first glanced the Pacific? How did the name America stick though Amerigo Vespucci had neverled an expedition, not even commanded a ship? But most of all, why was this first map of America drawn not by a Spanish or Portuguese navigator, but by two Germans in the employ of the duke of Lorraine, working in St. Die, which is as far away from the sea as one can get in Western Europe. And then, more generally, what did the Germans have to do with the discoveries, the maps and globes that told the world about them?
