Israelite is President and CEO of the National Music Publishers' Association (NMPA), a position he has held since February 2005. Israelite is responsible for overseeing all aspects of NMPA's operations, from legal strategy and implementation to government affairs and advocacy. His leadership has produced revolutionary successes on behalf of publishers including the largest CRB rate increase in history, groundbreaking industry collaboration in royalty rate agreements, landmark settlements and model licenses with streaming platforms, and ultimately raising the profile of the publishing community. Additionally, Israelite was instrumental in guiding the effort to modernize copyright laws culminating in the Music Modernization Act (MMA) and the subsequent creation of the Mechanical Licensing Collective (MLC). He has been named to Billboard's Power 100 multiple times and serves on the boards of the Songwriters Hall of Fame, the Country Music Association and Special Olympics DC. He also serves as the President of the NMPA S.O.N.G.S. Foundation (Supporting Our Next Generation of Songwriters) which supports songwriters through funding scholarships and direct services, among other assistance. Prior to leading NMPA, Israelite held senior positions in various capacities for the U.S. government including at the Department of Justice where he served as Deputy Chief of Staff and Counselor to the Attorney General of the United States and was appointed Chairman of the Department's Task Force on Intellectual Property. He also worked in the U.S. Senate where he was Administrative Assistant (Chief of Staff) for Missouri Senator Kit Bond. Previously, Israelite also practiced law in the Commercial Litigation Department at the firm of Bryan Cave, LLP in Kansas City, Missouri. Israelite earned his Juris Doctor from the University of Missouri and his undergraduate degree from William Jewell College.

Our guest on the Performance Leader podcast is Neville Eisenberg. Neville grew up in South Africa, where he qualified as a lawyer. After gaining his Masters in Law from the LSE, je joined the London Corporate Finance Department at Berwin Leighton in 1989. He was made partner in 1995, joined the board in 1996 and was elected managing partner in 1999. Neville oversaw Berwin Leighton's successful merger with Paisner & Co, to become Berwin Leighton Paisner. During his 15 years as managing partner, the firm grew its revenue by more than five times, more than tripled its profit per partner, and grew from two offices to 14 offices in 11 countries. In that time, BLP became known for pioneering innovation in legal services. After stepping down as managing partner in 2015, Neville became senior partner until the firm's US merger with Bryan Cave in 2018. His final act at BCLP was to set up and run BCLP Cubed, a platform for delivering routine legal services at scale. In this podcast, Neville talks about his time as a leader. We discuss his interest in strategy and the value of democratizing strategy in firms. We delve into what made BLP innovative, including how Lawyers On Demand was born. Today we speak with John Alber—retired lawyer, businessperson, and legal futurist. Like many of our guests, John's career path has taken some fascinating turns. He was a partner at Bryan Cave LLP when he was given the opportunity to buy a company, which ultimately became Alber Leland, Inc., a database and software publisher in the transportation sector. John would later return to Bryan Cave as Strategic Innovation Partner—one of the first in the industry—applying his business skills and experience to find innovative ways for the firm to deliver legal services through new technology. Over time, he developed what we now might consider one of the first captive ALSPs. Additionally, John was a futurist for the International Legal Technology Association, where he served as a consultant on different programs and helped the organization focus on business strategies. Today, John dedicates himself to conservation in Florida, particularly the Apalachicola River, which has been called America's most endangered wild river. In our conversation, John tells us about his experience innovating at Bryan Cave, the ways he convinced lawyers to adopt technology, the advice he would give to legal professionals on tech and innovation, and his recent conservation efforts.

Over seven years as a litigator of complex commercial and antitrust cases, Dan Hauck had become frustrated over how difficult it was for legal teams to collaborate around matters. In 2014, he left his law firm, Bryan Cave, to start ThreadKM, a matter-centric legal collaboration platform. As the product evolved, it developed integrations with the document management platform NetDocuments, and in 2017, NetDocuments acquired ThreadKM, resulting in the NetDocuments product ndThread.  Now, Hauck is chief product officer at NetDocuments, where he is responsible for the company's strategic vision, partnerships, products, user interface and roadmap. Robert Esposito spent the first eight years of his career as a litigator at the law firms Morrison & Foerster and Bryan Cave in San Francisco, focusing on intellectual property, consumer protection, and business disputes. In 2018, on the verge of GDPR's enforcement date, Robert made the jump in-house as a product counsel at Facebook, where he helped launch social good products and programs. Later, Robert joined Pandora Media, where he led the development of Pandora's privacy program and worked on digital entertainment services. Robert currently serves as Senior Legal Counsel, Technology and Product Counsel at Hillspire, LLC, which advises a number of initiatives such as Schmidt Futures, which partners with leaders in the public and private sectors to help scale promising new ideas in science, technology, and society. In the past decade, in-house legal departments, primarily at large technology companies, began creating a new role called "product counsel." The product counsel role is amorphous. Most in-house lawyers don't know what product counsel do, let alone the product, engineering, and marketing teams they're meant to serve. Bryan Cave data privacy attorney Christian Auty returns for Episode 36 to talk about the real world implications of the Schrems II opinion from the European Court of Justice. What is Schrems II? It is shorthand for Case C-311/18 Data Protection Commissioner v. Facebook Ireland Limited and Maximillian Schrems. In it, the Court of Justice reaffirmed that generally, transfers of personal data from the EU to non-EU countries are prohibited unless sufficient measures are taken to protect it. The court followed law found in the European Data Protection Directive and the GDPR (General Data Protection Regulation). Both say that personal data of EU citizens may not be transferred to non-EU countries unless proper safeguards are in place and only if the Non-EU country ensures an adequate level of protection for the personal data transferred. In short, Schrems II invalidated the EU/US Privacy Shield Framework that many companies used to legally transfer data between the EU and US. The EU and US governments created the Privacy Shield so companies could become certified to securely transfer data between the EU and US. The Schrems II court did not believe that the Privacy Shield did enough to protect EU personal data because, among other things, even under the program, EU citizens have no right to challenge government requests for their information under the Foreign Information Surveillance Act. As Christian explains, although Schrems II invalidated Privacy Shield, it did not invalidate Standard Contractual Clauses (SCC) and he suggests that if you do not have SCCs in place and you transfer data from the EU to the United States, you should look into them. Standard Contractual Clauses are model contract clauses officially sanctioned by the European Commission that address how companies must handle and protect personal data of EU citizens. Christian says too that companies can bolster their contracts and SCCs by implementing a law enforcement policy–a specific policy about how a company will handle inquiries from intelligence agencies or law enforcement regarding data.

Kathleen Flynn was the former Chief Marketing Officer at Bryan Cave Leighton Paisner based in the firm’s San Francisco office. She is responsible for planning, directing and coordinating the firm’s global marketing and public relations efforts as well as supporting the firm’s business development activities. Additionally, she has significant experience in the areas of general management, strategic planning, brand management and sales and marketing. From a marketing perspective, Kathleen had significant involvement in the 2018 merger between U.S. firm Bryan Cave and U.K. firm Berwin, Leighton, Paisner. The new global law firm now boasts 32 offices in 11 countries, with the largest office in London. Prior to joining Bryan Cave, Kathleen was the Chief Marketing Officer at Sedgwick LLP for more than 10 years. In that role, she built and managed the firm-wide marketing and business development program for the international law firm’s 16 offices. Prior to Sedgwick, Kathleen was founder and president of Marketing Visions, a full-service marketing and public relations agency based in Moraga, CA, and has held marketing leadership positions at Cooley LLP; Fenwick & West LLP; Littler Mendelson P.C. and Coopers & Lybrand.
