This Day in Legal History: Rush-Bagot TreatyOn April 16, 1818, the United States Senate ratified the Rush-Bagot Treaty, a landmark agreement with Great Britain that fundamentally reshaped security along the U.S.-Canada border. Negotiated in the aftermath of the War of 1812, the treaty aimed to de-escalate military tensions between the two nations by significantly limiting naval armaments on the Great Lakes and Lake Champlain. Specifically, it allowed each country to maintain only a single military vessel on Lakes Ontario and Champlain and two vessels on the upper Great Lakes, each restricted in size and armament. The treaty marked a mutual commitment to demilitarization and ushered in a new era of diplomacy.The negotiations were spearheaded by Acting U.S. Secretary of State Richard Rush and British Minister to the U.S., Charles Bagot. The suit alleges that Maine is violating Title IX by permitting transgender female athletes to compete on girls' teams, citing recent examples from high school track events. Attorney General Pam Bondi announced the action days after the administration attempted to cut off Maine's federal school funding and school lunch programs.This legal move follows a standoff between President Trump and Maine Governor Janet Mills, who rebuffed Trump's executive order banning transgender athletes from female sports. Other universities like Columbia, Cornell, and Princeton also saw funding halted, amid GOP claims that schools are failing to curb antisemitism after protests over the Israel-Hamas war.Critics see Trump's move as an attempt to use federal tax authority to punish political opponents. Legal scholars warn that using the IRS in this way echoes past abuses, such as those during Nixon's presidency. Some nonprofits have already started removing diversity, equity, and inclusion (DEI) language from websites to avoid scrutiny, with lawyers reporting a spike in “DEI audits.” Though the IRS hasn't yet changed its enforcement patterns, reduced staffing could make it more susceptible to politicized influence.A recent executive order from Trump targeting “illegal DEI” efforts has heightened fear among nonprofits that their programs, especially those aimed at underrepresented communities, could be labeled discriminatory. Legal experts say programs must be evaluated based on whether they exclude other races, which would likely violate federal law.Trump's Harvard Threat Raises Specter of IRS Nonprofit CrackdownIn my column for Bloomberg this week, I argue that proposals to exempt college athletes' name, image, and likeness (NIL) income from state taxes undermine one of tax policy's core principles: horizontal equity. That principle holds that taxpayers with similar incomes should be taxed similarly—something these NIL exemptions blatantly violate. While some student-athletes now earn six or seven figures, their peers working long hours in campus jobs continue to pay tax on modest earnings. Exempting high-income athletes while taxing low-wage student workers creates a two-tiered system that rewards fame and marketability, not need or effort.These exemptions aren't rooted in sound tax design—they're political moves, often motivated by the desire to curry favor with voters who are fans of college sports. But when states exempt wealthy student-athletes, they're making a value judgment: that celebrity deserves more support than everyday work. Even in states where lower-income students may owe no tax, the policy distinction is stark—exempting income to prevent poverty is not the same as exempting it to boost a football program.Rather than distorting the tax code to chase athletic prestige, I propose a fairer alternative: a progressive income exemption available to all full-time students, tied to the cost of their tuition. If a student pays $12,000 in tuition, they could exempt that amount from tax—regardless of whether their income comes from NIL deals, a job in the library, or a work-study program. This model keeps relief targeted to those bearing educational costs while avoiding regressive giveaways to already well-compensated students. Their recommendations are lightly edited from the audio heard in the player above. Want to be an Art Hound? Submit here.Resting as resistance Folk musician Emily Youngdahl Wright of Minneapolis admires writer and community-space-maker Amọké Kubat. She wants people to know about the final step of Kubat's ongoing project to honor those who mother children by offering them a place to rest — literally. The exhibit features rocking chairs that were created during a community build and then painted, collaged or otherwise re-created by Minnesota artists. “Rocking Chair (Re)Evolution” is a free, drop-in show at the Weisman Art Museum on the West Bank of the University of Minnesota campus in Minneapolis. The exhibit is open Friday, March 28 and Saturday, March 29 from 11-5 p.m., with a ceremony on Sunday from 1-3 p.m. The rocking chairs will be gifted to 12 mothers and grandmothers previously chosen with community feedback. Emily said: The whole project itself is just such a beautiful example of thinking about what kind of rest do you need, and what kind of support do you need? The chairs are an example, I think, of tending to the spirit and the heart and the body [in] this work that really doesn't end when you're a parent and when you're a grandparent, and when you are tending to this world that is in so much need of tending right now.— Emily Youngdahl Wright21st century opera Composer Eric Heukeshoven of Winona plans to head to Rochester to watch Hometown Opera Company's New Media Opera performance, featuring scenes of new and familiar works staged in a multimedia format. The first act consists of scenes from Rochester composer Kevin Dobbe's “Tempus Fugit.” The second act centers women's voices with scenes from Verdi, Puccini, Dvořák, Wagner and Strauss. Performances are Friday, March 28 and Saturday, March 29 at 7:30 p.m. at the Rochester Civic Theatre. Eric Heukeshoven said the staging is: As 21st century as I can possibly imagine.It is an opera that explores the human experience and time, and it does this by combining live performances of vocalists and dancers with digital projections, what Kevin calls motion-capture ‘metahumans' and singing projected avatars. I've seen a clip that he sent me recently, and it is absolutely mesmerizing.(He adds that Act Two scenes are “fully staged and choreographed, but also using projections that Kevin has created.”)— Eric HeukeshovenMinneapolis hosts breaking qualifier for national competition Kelly Rabe of Champlain started taking hip hop and breaking classes over the pandemic, and she wants people to know that Minneapolis will be in the national eye this weekend when it hosts the Red Bull BC One Cypher One competition. Local and regional b-girls and b-boys will compete in one-on-one battle style for a spot at the National Finals in Denver. The event will be held in a new venue on the Minneapolis scene: Royalston Square, located in the North Loop. There are open qualifier preliminaries on Friday. The main event is Saturday, starts at 7 p.m. and costs $10. Kelly described her experience: This is probably maybe my third year going to the BC One, and I have to say, it is like the most hyped event I have ever been to in the Twin Cities. I mean, it's better than music festivals. It's better than dance parties. There's just an energy like nothing else. The spectators are really supportive of the dancers. They'll be cheering, they'll be screaming, jumping up and down when they see the dancers do amazing things. It's a really welcoming community. Not to mention they have, like, world-renowned DJs that are spinning the tunes for these dancers. So, I mean, it's a full dance and music action. — Kelly Rabe

In the summer of 1673, two now famous Frenchmen and five others who are all but nameless traveled by canoe from the Upper Peninsula of Michigan at the Straits of Mackinac to central Arkansas on the western bank of the Mississippi River, and then back again. Louis Jolliet was a new sort of Frenchman, a natural born North American, having come into this world in Quebec in 1645, now a fur trader and voyageur. Jacques Marquette was the more usual sort, having been born in France in 1637.  By the time of the expedition Marquette was a Jesuit priest, long known to the nations of North America as a “Black Robe.” The episode begins with an overview of New France in the years between Samuel de Champlain's death in 1635 and 1661, when it languished because the Five Nations of the Iroquois had it entirely bottled up. The expedition was a marker of New France's rapid expansion after King Louis XIV began to rule in his own right that year. Along the way, our heroes become the first Europeans to visit Iowa (Go Hawks!), see some extraordinary painted monsters, learn the importance of the calumet, and find a short portage in the eastern continental divide at a place soon to be called Chicago. In the first half, guest host Rich Berra (email) spoke with ufologist and writer Alejandro Rojas about UFO reports and the recent drone sightings in the news. Rojas believes that while the government holds secrets about UAP, the biggest secret may be their own uncertainty. "I think they know less than people assume they do," he speculated. Rojas also expressed frustration over the lack of transparency from the government and academics, stating, "There just doesn't seem to be that motivation in the scientific community [for disclosure]."Rojas also touched on the confusion surrounding the terms UFO and UAP, noting that "UAP represents the scientific investigation of UFOs," but the public often misunderstands this distinction. As for the recent reports of drones over New Jersey and elsewhere, he proposed that many of these incidents are likely misidentified aircraft. Rojas urged for more rigorous analysis of such reports, which is what he strives for at his company Enigma Labs. "What we're doing at Enigma is to analyze these reports and get to the bottom of them," he explained.Rojas continued to emphasize the need for verifiable data over anecdotal stories: "Now we need hard data—and we can get the hard data—we just gotta do the hard work." He highlighted two compelling incidents, the first being the Aguadilla, Puerto Rico case from 2013, where a mysterious object was filmed by border security officers. Despite being dismissed by the Department of Defense as possibly a balloon or birds, Rojas noted, "what's weird about this object is at the end of the video, it breaks into two." Another case involved a bright light over Signal Mountain, Texas, where the eerie illumination started moving in weird, inexplicable ways.---------------------The third hour featured afterlife expert Sandra Champlain, who shared her experience and wisdom on the dying process. Following the death of her father, Sandra's long-held fear of dying spurred her to seek proof of what lies beyond, a pursuit she described as "a secret journey" that ultimately became her life's work. Although initially raised in a household that emphasized "seeing is believing," Sandra recounted a pivotal moment where she overcame skepticism and realized her own abilities. While attending a workshop on mediumship, she was able to accurately describe another participant's deceased grandfather—a Danish fisherman who smoked heavily—which amazed everyone there.This experience encouraged her to continue exploring various facets of afterlife communication, including Electronic Voice Phenomena and near-death experiences. "I have studied so much that has 100% proved to me that not only do we go on, but that who we are as human beings is pretty magical," she insisted. Champlain explained how death is merely "closing our eyes to this world and opening them again." She expressed excitement about the prospect of meeting deceased loved ones in the afterlife, who often appear as "young and healthy" during deathbed visions.Champlain encouraged listeners to remain open-minded, challenging the notion of a singular truth regarding life and death. "There's more to life than meets the eye," she said.---------------------The final hour of the program featured Open Lines, where listeners called in to discuss topics of interest. Cornelius from Louisiana discussed the mental health struggles faced by veterans, especially during the holidays. He emphasized the importance of community support and thanked the show for helping him cope with his father's passing.Angel from St. Louis shared a dramatic encounter from 1969 while crossing the Courtney Campbell Causeway. He described witnessing a massive craft overhead that was loud enough to drown out screams. Jack from South Carolina spoke about his connection with his deceased ancestors through genealogy. He shared how researching his family history led him to feel their presence and establish a deeper connection with them.

La Colonisation Française :La présence du français au Québec remonte au début du XVIIe siècle, lorsque les explorateurs français comme Samuel de Champlain fondent la ville de Québec en 1608, établissant ainsi la première colonie permanente en Nouvelle-France. Au fil des décennies, les colons français s'installent dans cette région, peuplant principalement les rives du fleuve Saint-Laurent. La langue, la culture et les institutions françaises s'enracinent profondément, car les colons venus de France apportent avec eux leur mode de vie, leur religion catholique, et bien sûr, leur langue. La Conquête Britannique :En 1763, à la suite de la guerre de Sept Ans, la France cède la Nouvelle-France à la Grande-Bretagne par le Traité de Paris. Cette conquête marque un tournant dans l'histoire du Québec, mais contrairement à ce qu'on pourrait attendre, les Britanniques permettent aux habitants de conserver leur langue, leur religion catholique, et leur système juridique basé sur le droit civil français. Cette tolérance relative est stratégique pour maintenir l'ordre dans une colonie majoritairement francophone et catholique. Préservation de la Langue et de la Culture :Malgré la domination britannique, les Québécois francophones ont su préserver leur langue et leur culture grâce à des institutions clés comme l'Église catholique, qui joue un rôle central dans l'éducation et la vie sociale jusqu'au milieu du XXe siècle. Taryn Tymus, a 48-year-old retired hairstylist and art-based community activist, serves as the President of Champlain Court Cooperative. Her journey in community activism began over 15 years ago in Ward 7. Taryn is enthusiastic about sharing the knowledge she has gained from her Adams Morgan neighbors in the District of Columbia, all while striving to improve her leadership skills within the cooperative Andrea Tucker is a pivotal member of the Champlain Court Cooperative. Following a rewarding career in nonprofit management, Andi now serves as both a co-op owner and the Vice President of the CCC board. Her home, shared with her daughter Maulani, is a haven of warmth, creativity, and support. Andi's decision to retire early allowed her to homeschool Maulani, nurturing her interests in drama, voice acting, and visual arts. Committed to service, Andi looks forward to contributing to the expansion of CCC's portfolio, utilizing her skills and experience to enhance the community she cherishes.

In podcast time, we've been knocking around the northeast of today's United States for just about two years, starting with the Popham colony episodes back in December 2021.  The recent high water mark, as it were, is 1647 or so, with the recovery of Maryland by the Calverts after the plundering time.  We are not entirely caught up to that date, however.  We need to get back to see what happened to New Sweden since its first year in the late 1630s, and the New Haven colony, which extended its writ to New York, New Jersey, Delaware, and Pennsylvania, deserves a couple of episodes. In the 70+ timeline episodes since Martin Pring's expedition of 1603 and Champlain's St. Croix settlement in Maine, we've talked about English, Dutch, and French settlement and exploration in today's United States as local stories, but we have not looked at the big picture, or at least not very often.
