Rewards programs drive consumer choice and activity in connection with credit cards and other financial services. The CFPB has reported the most important element by far that influences a consumer's decision to apply for a specific credit card is the rewards program associated with the card. Further, rewards can affect the consumer's choice at the point of sale as to which card to use. In this podcast episode, which repurposes a recent webinar, we explore recent trends in scrutiny of credit card rewards programs and other rewards programs by state and federal regulators and lawmakers. We also address laws and regulations, enforcement, emerging pitfalls, and best practices applicable to rewards programs. We open with a review of how rewards have been treated in the CFPB's reports on the credit card market since 2013, and the significance of and learnings from these reports. We then focus on complaints and federal regulators' enforcement activity relating to rewards programs. Next, we turn to state law developments affecting rewards programs, including laws that specifically apply to rewards programs as well as contract, interchange, and UDAP / UDAAP laws. We then delve into other topics including the current focus on airline – credit card rewards programs by the Department of Transportation and the CFPB; the CFPB's May 2024 report about credit card rewards; and important elements card issuers should keep in mind in the context of co-brand credit card rewards programs. We then conclude with a discussion on best practices to consider in mitigating risks and maximizing the benefits of rewards programs. Alan Kaplinsky, Senior Counsel in Ballard Spahr's Consumer Financial Services Group, moderates today's episode, and is joined by Michael Guerrero and Joseph Schuster, Partners in the Group, and Kristen Larson, Of Counsel in the Group.

Reward programs, including birthday freebies and discounts, have long been a way for brands to build loyalty and incentivize spending. But now, some companies are becoming a bit more stingy — and customers are taking notice. Last fall, for example, many balked at Dunkin's decision to stop offering a free drink on their customers' birthdays and instead give them triple loyalty points on their purchases. On June 1, Sephora started requiring a $25 minimum purchase for online customers looking to claim a free gift and 250 loyalty points during their birthday month. Changes to birthday rewards or redemption requirements aren't new. Starbucks, which gives its rewards members a free drink or food item for their birthdays, progressively limited the timeframe for redeeming that gift over the years — from 30 days, to one week, to four days and, finally, to just the date of your birthday in 2018. Some experts say the cost of maintaining loyalty programs, as well as recent impacts of inflation and changes in consumer behavior since the start of the COVID-19 pandemic, are among the reasons why companies may be pulling back. “While we're assessing our own personal expenses, so are businesses,” Marshal Cohen, chief industry advisor of Circana and retail expert, told The Associated Press. “Businesses have to look and say, ‘Are these programs working? Are they working to full capacity? ... (And) is there another way of doing this that wouldn't cost us as much money?'” “What (brands) need to do is not make too many changes so often — because you're going to start rubbing your audience the wrong way and it could backfire — and you should be very thoughtful about it,” Lanz said. “They do need to communicate it so that it's not a complete surprise.” It's possible this could mean a scaling back of more rewards programs. But there could also be an opposite effect, Julie Ramhold, consumer analyst with DealNews.com, said — noting that some retailers could offer “potentially better birthday rewards to encourage a return to spending on frivolous items.” This article was provided by The Associated Press.

Zestful recently conducted a nationwide survey asking people if they would prefer a $130k salary, or a $100k salary plus Netflix, HBO, Hulu, Spotify, Headspace, a meal delivery service, a gym membership, a $20/month allowance to a charity of their choice, and a $100/month “experiences allowance.” 80% of the survey respondents preferred perks over a higher salary. Zestful’s new model is already experiencing high usage rates, with 94% of employees who have a Zestful Perk Card using it every month, with an average monthly allowance of $100. Before joining Zestful, many of its customers had perk program usage rates of around 20%. "Employee happiness is a top priority for so many companies, but the needs of each employee are unique and changing faster than any company can keep up with,” said Zestful CEO and Founder, Mat Vogels. “Individualized perks are becoming a new currency in the workplace, yet there is no easy way for companies to offer their employees what they want in a model that works for everyone.” I wanted to find out more about how Zestful is enabling employers to offer the most customizable employee perk programs so invited Mat Vogels onto the show to learn more about this refreshing approach.

With U.S. airlines expected to carry more than 600 million passengers on domestic flights this year and credit card debt levels exploding, we can expect airfare savings to be increasingly important in the months ahead.   Jill Gonzales is going to fill us in on how to make smart decisions about choosing a frequent flyer program. You will learn the difference between a frequent flyer program and a rewards credit card, and then understand just how the WalletHub study was done. There is a lot of useful information in this episode, so be prepared to take notes!   What You Will Learn in This Episode: To help travelers make the best decisions for their wallets, the personal-finance website WalletHub today released its report on 2018’s Best Frequent Flyer Programs, which ranks the 10 largest domestic airlines based on 23 key metrics, ranging from the value of a point/mile to blackout dates for rewards flights. WalletHub’s report also features a custom calculator that allows users to personalize the results based on their own budgets. You can find a few highlights from those results below.   Delta SkyMiles is the best frequent flyer program for the third straight year.    The average airline rewards program gives frequent flyers 12% off their airline spending. And they’re all free to join.     Hawaiian Airlines offers the most rewards value to frequent flyers ($19.95 per $100 spent), with Alaska Airlines coming in a close second ($19.87 per $100 spent).    Four of the 10 largest airlines are offering more rewards in 2018 than in 2017, sweetening the pot by an average of 20%.    Delta Air Lines and JetBlue Airways are the only two major airlines whose miles do not expire because of inactivity.    The Frontier Airlines Credit Card and the Lufthansa Credit Card are 2018’s best airline credit cards, according to WalletHub’s editors.    For the full report, including the custom calculator, please visit:  https://wallethub.com/edu/best-frequent-flyer-program/25943/   Resources The Seven Stages of Money Maturity
