Political attacks on nonprofit organizations can come in many forms, including legal challenges or public smear campaigns. Given the current political climate, organizations that engage in policy reform and election season advocacy are coming under increased scrutiny. As a result, it is crucial to be proactive and develop a comprehensive strategy to safeguard your organization's reputation and operations. On this episode, we will discuss how your organization can ready itself in advance of potential politically motivated attacks. Other threats include organizations being covertly contacted by those who want to catch them “red-handed” in an illegal act, doxxing, and more! Tips for Preparation: Adopt Clear Organizational Policies: Organizations should adopt policies regarding nonprofit activities, communications, and responses to political issues. Ensure that all staff and board members are trained and aware of these policies, and maintain copies of signed policies for your records. It is a best practice to include these policies in your employee handbook and to require signature during employee onboarding. If you don't already have policies in place, consider their adoption. Election season policy to establish expectations for staff when acting on behalf of the organization vs. in their individual capacity Social Media Policy, including information on how to maintain boundaries between work-related and personal use of social media Prepare Staff and Volunteers: Review and understand the rules for engaging in advocacy, including lobbying and election season advocacy. This should include a review of local, state, and federal laws that may apply to your organization's activities. Schedule training for your team so that everyone is on the same page and understands how to properly track, report, and engage in important public policy and election-related activities. If training is not an option, encourage your staff to review nonprofit advocacy rules on their own time (see resource suggestions below). Train staff on how to deal with questions. Don't let anyone pressure you to say something you don't want to state. Let your staff know that it is always better to report any suspicious activity, and identify who staff should notify if they suspect that something is awry. Have a legal response plan in place that designates legal counsel to address potential challenges swiftly and an organizational leader, who is authorized to respond to accusations made against your nonprofit. Consider requiring staff to participate in IT trainings designed to increase their awareness of potential online threats. Keep Good Records & Remember to Report: Keep accurate and complete records, and ensure your filings are in order. Nonprofits should carefully track their lobbying, ballot measure advocacy, and other projects to comply with lobbying limits and ensure accurate reporting to the IRS and relevant state and local authorities. Remember to timely and accurately file any required lobbying disclosure reports, campaign finance (e.g. ballot measure) reports, and your organization's annual exempt organization return (990). Check out our resource entitled “Keeping Track" to make sure staff are trained to properly track their time. If you are attacked, stay calm. Reassure board members, staff, volunteers, and supporters that you are diligently gathering the facts. Share information with your coalition partners and allies so they are not caught off-guard and can prepare for questions that may arise. Go back to your response plan, and put it into action. At the end of our conversation, Cheri leaves our audience with three key takeaways. 1. Start With The “Why”: There are many new and exciting technologies entering the market, however, we should always be asking ourselves one fundamental question “What are we trying to accomplish and who are we trying to accomplish it for?” Clearly defining your goal with the chosen technology will help to increase company buy in and should be done early and often. 2. Bring Diverse Team Members To The Table? It is important to cast a wide net when seeking input for your AI implementation. By inviting a diverse group, you can gain greater insight into various use cases where AI can be implemented to help both your core business as well as your support staff which leads to an enhanced work product. 3. AI Is Not Going To Wait For You To Be Ready: We are in the here and now, so if you are not already thinking about how to best implement AI, you are likely behind. The good news is that these changes do not have to be grand sweeping changes. Cheri advocates that companies begin by looking at, and potentially amending, their Internet and Social Media Policy to include AI as they are so closely tied together now. In today's episode Guilaine reflects on her relationship with social media. The way she has used social media in the past and transition she is making in how she uses it going forward, and the reasons she is changing how she uses Twitter (or X).She gives some context about what social media has meant for both her and for Race Reflections. She thinks about how Race Reflections began as a blogging venture that was heavily influenced and developed by her writing being shared on social media. It allowed for a direct way to engage with communities and with the wider public and to improve her craft. This led to opportunities that resulted in peer reviewed publications, book contracts, conference invites and more consultancy work. There is no way that Race Reflections would be what it is today without social media. It gives or at least gave a space where radical thinking and marginalised groups could connect and find community, audiences and collaborators.Then she considers how over the years her experience of social media has changed, and challenges around others using her intellectual property without consent or plagiarising her content have become more common, she wonders if people see content shared on social media is to be less respected, particularly when shared by a Black woman. And by this point the balance between the advantages and disadvantages of using social media in this way have changed. This is related in part to peoples attitude to online content, partly due to the social and political climate we are currently within and also due to the change of leadership within this particular platform.She thinks about the different strands of herself and her thinking that she used to share on her personal account, her Race Reflections focused work, her commentary on news, politics and social events, and her personal experiences moving through the world as a Black woman. She argues for the value of showing your whole self and being open about your process of trying to learn about and make sense of the world. For people to connect to your ideas, particularly when those ideas are challenging you need to allow your readers to connect to you. If you want people to be open and vulnerable and transparent and compassionate you need to embody this in your work and practice. This is the liberatory case for this approach. But this needs to be balanced against avoiding self-sacrifice, to guard against necropolitics, the politics of the masters and of colonialism, that expect you to be extracted from and for your life to not be valued. And she thinks about this in this present context of multiple genocides and patriarchal whitelash. So this change of approach is not just related to protecting her work but also to prioritising safety.She ends by talking about the vulnerabilities that people carry and that she carries and that thinking about this during her recent trip to the Congo helped to clarify all of this and to see that to embody her politics she needs to also protect herself and respect her vulnerabilities and find new ways to be safe and sustainable. Social media platforms have evaded heavy regulation on their content moderation practices so far, but the jig may very well be up. Many U.S. states are considering enacting laws to rein platforms in. To date, two states—Florida and Texas—have passed laws that significantly limit social media companies' ability to moderate their platforms, and the measures look very likely to be up for Supreme Court review soon. Labor Law Insider host Tom Godar welcomes two new Labor Law Insiders as they discuss the shifting standards applied by the National Labor Relations Board (NLRB) to traditional employment policies found in almost every employee handbook, including social media policies. Tom is joined by two new California-based Husch Blackwell attorneys, Tyler Paetkau and Olga Savage. These experienced labor counsel review employer policies that are under greater NLRB scrutiny, which is currently dominated by Biden Administration appointees. Tyler and Olga present a compelling argument that the world of labor law will change at a far greater pace than what might be expected by a mere change of administration from Republican to Democrat. This sea change has been almost exclusively through administrative action rather than through federal legislation, although some state legislation is changing the picture in various jurisdictions, such as California. In August of 2021 General Counsel Abruzzo set forth a blueprint for these pro-labor changes, which called for changes related to confidentiality policies, union access, and many more employer handbook rules. That blueprint is now being followed in still more GC memorandums, as well as ALJ decisions, which show a sharp turn from the policies that the Trump NLRB had initiated. See the contrast in the two NLRB cases in less than one year, one decided by the Trump-majority NLRB, and the other by the NLRB with the new Biden appointments. One of the more frustrating results for employers is the lack of predictability as to how facially neutral policies might be reviewed and found in violation of the National Labor Relations Act.This makes it difficult for employers to know what to do when they see highly derogatory comments on Facebook or in social media regarding their company when it seemed unlikely these were within the context of what traditionally had been identified as protected concerted activity but is now being seen in exactly that light. Essentially, the Board is—one policy at a time—undoing the more employer-friendly standards that had been in play under the Trump and Obama administrations. As the podcast closes, Olga Savage gives a brief but compelling description of how the standard of reviewing policies has changed. If an employer adopts a neutral policy, not targeting traditional organizing activity or activity related to concerted discussions among employees about wages, hours, working conditions, the review of that policy and its application revolves around the potential to chilling impact on employee expression. Such a policy that could be interpreted as having that impact, regardless of employer intent or the express disclaimer regarding protected concerted activity, i.e., Section 7 rights of employees, will itself be seen as a violation and give rise to the possibility of NLRB violations and remedies. Tyler and Olga discuss how these NLRB changes will affect employers reviewing handbook policies that relate to such standard areas as confidentiality, discussion of individual wages, rules for employer investigations, or use of the internet to criticize the employer or its agents.
