Building Must Actually Fall Down for Collapse to be Covered Windcrest Owners Association filed a lawsuit against Allstate Insurance after the company declined a claim for property damage to a building in its condominium development. Allstate moved for summary judgment, alleging that the property damage was not covered as a "collapse" and was excluded from coverage because it resulted from faulty construction and maintenance. The trial court granted summary judgment dismissing Windcrest's claims. In Windcrest Owners Association, a Washington nonprofit corporation v. Allstate Insurance Company, an Illinois company, State Farm Fire And Casualty Company, an Illinois company, No. 82836-3-I, Court of Appeals of Washington, Division 1 (December 12, 2022) Windcrest sought payment to repair a building in severe distress as a result of wear, tear, and defective construction under a "collapse" coverage. The Court of Appeals read the full policy and applied its language to the facts presented by construction experts. FACTS Windcrest Condominiums, which consists of 15 units in two buildings, was completed in 1995. Allstate provided a commercial property insurance policy from November 2002 through 2017. Allstate, conducting a good faith investigation of the claim, retained construction consultants from Madsen, Kneppers & Associates, Inc. (MKA) to conduct an inspection and evaluation of causation of the damage at Windcrest. MKA concluded that there were sites of noted decay of structural components but no evidence of collapse "defined as an abrupt falling down or caving in," as required for coverage by Allstate's policy. Windcrest sued Allstate, alleging breach of contract and bad faith. Allstate moved for summary judgment; the trial court granted the motion and dismissed the claims with prejudice. ANALYSIS An insured has the burden of proving that coverage is triggered, while the insurer has the burden of proving that an exclusion applies. Remember to pick that team when signing up! :) Debbi (00:54): But first, let me put in a good word for Blubrry podcasting. I'm a Blubrry affiliate, but that's not the only reason I'm telling you this. I've been using Blubrry Podcasting as my hosting service for my podcast for years and it's one of the best decisions I ever made. They give great customer service, you're in complete control of your own podcast, you can run it from your own website, and it just takes a lot of the work out of podcasting for me. I find for that reason that it's a company that I can get behind 100% and say, "You should try this." Try Blubrry. It doesn't require a long-term contract, and it's just a great company, period. It also has free technical support by email, video, and phone, so you can get a human being there. Isn't that nice? If you want to podcast, try out Blubrry. No long-term contract, excellent distribution, and great technical support, too, by email, video, and on the phone. I've included an affiliate link on this blog. Here's a downloadable copy of the interview. Debbi: Hi, again, everyone. Today, I have as my guest, the author of a series of thrillers featuring a New York City detective, Lt. John Driscoll. His work has been translated for publication in at least six countries outside the US. He's also a native New Yorker, so that's a plus because so am I. I'm pleased to have with me today, Thomas O'Callaghan. Hi, Thomas. Thomas: Hello, Debbi. Debbi: I'm so glad you're here today. Thomas: Yeah, nice to be here. Very nice to be here. Debbi: Awesome. I love your bookshelf there in the background. It's so neat and beautiful. Thomas: Thank you very much. Debbi: I wish my shelves were so beautiful. Thomas: Thank you. Debbi: What prompted you to write this series? Thomas: Interesting question. I never thought of writing. In college, I studied history and planned on perhaps going to law school. After that, I began working for an insurance company, Allstate Insurance Company, and I had a pretty good career with them, sales agent. Everything was going well and I figured I'd retire as a sales agent, only I didn't think I'd retire at the age of 49. They changed the way they paid us, and if I wanted to stay on, it meant I was no longer an employee, but I was a franchise agent and I had to pay for secretarial help and other support staff and whatnot. The option was to sell my book of business and leave or retire or stay on as a franchise, so I sold my book of business, and that carried me for about three years. Thomas: But at age 49, I needed something to do. I spoke to a friend of mine who had a similar circumstance. She asked me what did I like to do. If you're going to have a second career, it might be something you might like doing. I said, "Well, I like to take photographs." This was before the advent of the old iPhone. I had an old 35-millimeter camera and I went out and I snapped some pictures. I lived near Prospect Park in Brooklyn at the time and I snapped some pictures and I enjoyed it. Thomas: The enthusiasm waned after about a month and I said to her, I said, "Well, it's not a career choice." She said, "Well, what else do you like to do?" I said, "Well, to be honest with you, I always thought I'd be an actor." I wanted to be a thespian when I was in high school and in college and I performed in theater groups and I did some off-Broadway shows. I said, "That's what I'd like to do," so she recommended I go down and have some training because it had been a while and I went to HB Studios down in Manhattan and that was fun, two months working with a group of other actors and some professional trainers. Thomas: I enjoyed it very much, but again,

The Empire Club of Canada Presents: Tony Irwin, President & CEO, Federation of Rental-housing Providers of Ontario On No Vacancy: Tackling Ontario's Rental Housing Supply Crisis With low rental vacancy rates across the province and continued uncertainty about Toronto's volatile housing market, it's becoming more difficult to meet the increasing demand for quality long-term rental options for Ontarians. The increase in demand for rental housing is being led by two groups: millennials, who rank urban location as more important than home size or type and are less likely to purchase a home than any other generation in modern history, and boomers, who are downsizing in their later years and looking to rent, while retaining the equity from their former home. For the second year in a row Toronto's rental vacancy rate is just 1.1% and 1.8% across Ontario. Many believe that more needs to be done to keep up with the demand from new housing-seekers and new immigrants. Ontarians need policy solutions from all levels of government that will stimulate vital new rental supply, and reduce pressure on prices for both traditional home ownership and rental. FRPO's President & CEO Tony Irwin will address the issue of Ontario's insufficient rental housing supply head-on, discussing potential short-term and long-term solutions. Tony Irwin is President & CEO at the Federation of Rental-housing Providers of Ontario. Before joining FRPO, Tony was President & CEO with the Canadian Consumer Finance Association; a national trade association representing businesses that provide a range of financial product to Canadians. Previously, Tony was Vice President, North American Government Affairs, with Dollar Financial Group, Inc., where he served as Chairman of the Canadian Payday Loan Association and was active with the Community Financial Services Association of America. From March 2009 to July 2012 Tony was Manager of External Affairs & Consumer Relations with Allstate Insurance Company of Canada, where he implemented a national government relations strategy and served as official company spokesperson. Prior to joining Allstate, Tony served as Executive Director of the Justin Eves Foundation, a non-profit organization granting scholarships and bursaries to learning-disabled and disadvantaged young people to assist them to achieve a post-secondary education. Tony has also held key political roles and was Senior Advisor to an Ontario Premier and Executive Assistant to the Leader of the Official Opposition. Harriet Harty is the CHRO for Allstate Insurance Company Harriet Harty is the CHRO for Allstate Insurance Company. She is responsible for developing their talent strategy and the tools and programs to enable the enterprise to attract, develop and retain engaged and talented employees. Since joining Allstate in 1995, Harty has held a number of key human resources positions. She was senior vice president, with responsibility for executive, broad-based and sales compensation; benefits; communications; finance; talent and leadership effectiveness; and home office client partnership. Previously, she led the human capital solutions function, which included strategy, employee value proposition, workforce relations, workforce insights, workforce technology and the AskHR call center. Harty began her career in the compensation area, working her way up to leadership of the compensation and executive compensation function. Allstate was founded in 1931 and is the largest publicly held property and casualty insurer in the US. It serves more than 16 million households. It is a company with 35 billion dollars in revenue with 43000+ employees globally - most in US and about 8000 outside of US. Differences at Allstate in the last 20 years from her experience? Innovation – it is part of their everyday “business as usual” now as compared to years ago when it was something considered out of the box thinking Less ‘silo’d’ – you can see the power of working across teams. They have defined their purpose in a more articulate manner. Added technology – the ability to quickly react is much larger due to technology. Changes to physical space – they have revamped offices. They wanted space to be more collaborative, instead of high walled cubicles This change brought down the hierarchy and changed the culture. It made supervisors much more available to employees Harty has been at Allstate for more than 20 years for 2 main reasons. First, she has always had the opportunity to grow and develop herself, through different assignments, a project, etc… And secondly, because of the people. She considers the people of Allstate her second family. Some trends Harty is paying attention to at the moment are, the changing workforce (the demographics, how many baby boomers will be retiring) and disruptive technology that will have an impact on jobs. Allstate is beginning to focus on training employees skills that will help them in their job today, but also 5, 10, 15 years in the future. What skills will leaders need in 2025? Agile mindset – being able to act quickly and decisively to conquer something Innovative – someone that can think out of the box, challenge the status quo and take a lot of risks Versatility– knowing how to motivate your group and team. To leaders, Harty says, “It’s ok to be uncomfortable – there is likely a lot of uncomfortable coming.” This is where you can learn and move forward. Her advice to employees is similar to the advice for leaders– be uncomfortable. Also, take advantage of the training available, talk with your leader about your aspirations, and jump in – rather than be on the side lines. What you will learn in this episode: Allstate’s HR department structure Traits of future leaders Six leadership principles for all employees at Allstate How Allstate has evolved over the last 20 years What it’s like to work at Allstate and why Harriet has been there 22 years Skills leaders and employees need for the future

In this edition of our podcast, we present a telephone interview with Cheryl Procter-Rogers, president of the Public Relations Society of America, the world's largest professional organization for public relations practitioners. In a February speech to PR students at Ball State University, Procter-Rogers addressed three critical issues for shaping the future of the public relations profession. Diversity, ethics and risk are becoming increasingly critical to the financial success of businesses, she said. Cheryl also spoke to the students about the dangers of succumbing to "confirmation bias," a kind of complacency in which mass media audiences only pay attention to news and opinion content that matches their own belief system closely. With more than 25 years experience in the public relations arena, Cheryl Procter-Rogers is currently corporate affairs director for Home Box Office (HBO), where she is responsible for the development and implementation of public relations and integrated marketing communications strategies across 11 states in the Midwest. Before joining HBO, she worked as a communications consultant in the Chicago area, assisting such clients as Sears Roebuck & Co., Nissan North America, Inc., Allstate Insurance Company, McDonald's Corporation, and HBO in developing and implementing internal and external communications strategies supporting critical business objectives. Cheryl holds an M.B.A. from Keller Graduate School of Management, Chicago, IL; a B.S. in English and Journalism from Bradley University, Peoria, IL; an E-Business Certificate from the School of Business Administration, Loyola University Chicago; and a professional designation in public relations from UCLA Extension. She was the youngest member of the Los Angeles Public Relations Society of America (PRSA) in Los Angeles to earn the Accreditation in Public Relations (APR), and the first African American woman to earn that honor there. In 2000, Cheryl became the youngest member ever to be inducted into the Public Relations Society of America's College of Fellows, a distinction held by a little more than 400 individuals in the field of public relations. She, along with Dr. Debra Miller, was the first African-Americans inducted into the College. She was the first African-American elected as president of the 500-member Chicago Chapter of PRSA. She is a charter member and past president of the Black Public Relations Society of Southern California.
