In this episode of Measured Justice, we'll be discussing criminal justice reform at the twilight of marijuana prohibition, and, in particular, securing the release of those incarcerated for non-violent marijuana related offenses. The issue has received increased attention given the sea change in state and local marijuana law occurring across the nation, as more and more states opting for regulation and taxation over crime and punishment. We are fortunate to be joined by two individuals directly impacted by the ups and downs of marijuana reform, as well as one of their attorneys: Luke Scarmazzo co-founded one of the nation's first licensed medical cannabis dispensaries in California in 2004 which he successfully operated until 2006 when he arrested by federal authorities. Although his business was completely legal in California, he was convicted under federal law and sentenced to 22 years in prison, serving nearly 15 years before his release by a federal Judge in February 2023. We are also joined by Kerrie Dent counsel with King & Spalding in its Special Matters and Investigations practice in Washington, D.C., where she focuses primarily on white collar criminal defense, complex civil litigation and internal investigations. Ms. Dent successfully represented Mr. Scarmazzo in obtaining his recent release. Finally, we are joined by Weldon Angelos, president of the Weldon Project, co-founder of Mission [Green], as well as a music producer and leading criminal justice reform advocate. Mr. Angelos received a full presidential pardon after serving more than a decade of a 55 year mandatory federal sentence for low-level marijuana transactions. This is an eye opening episode on what happens when bad drug policy goes wrong.

El autismo es un trastorno del desarrollo que afecta la comunicación y el comportamiento, con diferentes niveles de gravedad. A music producer who has worked with legends like Snoop Dogg, Tupac's Outlawz, Nas, and Pink,, Weldon's case became a symbol of the racism and injustice that plagues our criminal justice system. But as you'll hear in this interview, from the moment he arrived at a maximum security prison—to serve a virtual life sentence—he began advocating for himself and other non-violent cannabis prisoners. Now head of The Weldon Project, he's built a truly bi-partisan coalition—Cory Booker, Rand Paul, Charles Koch, Alicia Keys—that pushed President Barrack Obama to commute his sentence in 2016, followed by a full pardon from President Donald Trump in December 2020. Missouri Governor Mike Parson says federal door-to-door vaccination campaign is NOT welcome in the Show-Me State. A writer at The Hill actually blames the scamdemic for an increase in drownings across the States because kids were not able to be taught how to swim. WEED Senate Majority Leader Chuck Schumer, Senate Finance Committee Chairman Ron Wyden, and Senator Cory Booker are holding a press conference tomorrow (Wednesday, July 14, 2021) to unveil a preliminary version of a bill being referred to by journalists as the Cannabis Administration and Opportunity Act . It is expected to remove cannabis from the Controlled Substances Act, impose a federal tax on the herb and bring about restorative justice to communities affected by the War on Drugs while allowing states largely in control of how to approach legalization. Last week, the Cannabis Freedom Alliance backed by Charles Koch, Snoop Dogg, and Weldon Angelos (as previously discussed on Bowl After Bowl Episode 76: Thanks Your Old Pass) released a white paper urging removal of cannabis from the Schedule I classification under the Controlled Substances Act. Last Wednesday (July 7, 2021) the Nevada State Athletic Commission joined the Florida State Boxing Commission after voting to no longer discipline fighters for using cannabis. Unlike Florida, however, the NSAC - which regulates all unarmed combat including boxing, kickboxing, and MMA - will still test for marijuana to collect data over the next six months. The new policy begins tomorrow and is not retroactive. The Cannabis Control Division of the New Mexico Regulation and Licensing Department more than doubled the maximum number of plants growers can produce, boosting the cap from 4,500 plants to 10,000 in response to concerns about supply shortage among medical patients when recreational purchases being in early 2022. Solar Therapeutics is being sued for copyright infringement, false advertising, and misappropriation of Sacha Baron Cohen's right of publicity after using a picture of Borat giving the thumbs up on a Massachusetts interstate billboard while exclaiming, "It's Nice!" States with home delivery will likely join in as it allows customers to peruse a grower's full catalog and helps the grower test new products while gathering consumer trend data. A lawsuit over spam text messages between two consumers and Eaze reached a settlement. It's the second lawsuit of this type that Eaze has faced. The first suit was filed in 2018 and sent to arbitration. This one was pending on a Supreme Court case regarding Facebook and auto-dialing telephone systems, where it was unanimously ruled that random or sequential number generators must be used. One plaintiff signed up for texts from Eaze while the other received messages becuase of a third-party error. Missouri Governor Mike Parson vetoed legislation last Friday (July 9, 2021) which would have allowed medical marijuana companies to deduct business expenses on their taxes, saying the decision came down to a section lawmakers included in the bill which would have provided tax relief to businesses impacted by city-or county-wide public health restrictions. California could decriminalize psychedelics except for peyote because that belongs to Native Americans in an incredibly limited federal capacity. On April 28th, the voter-approved recreational amendment will finally have its day in the South Dakota Supreme Court after being declared unconstitutional by a district judge in February. Virginians will also be able to cultivate, possess and use weed legally this summer, although they'll still have to wait until 2024 for the commercial market to roll out. A recreational bill in Delaware had its first committee meeting and patients are now boycotting 4 of the 6 licensed medical facilities for peddling false narrative and offering negative testimony since the bill doesn't grandfather them in to a recreational license. That scarce mentality carried over to Alabama where lawmakers are working to ban Delta-8-THC and Delta-10-THC. Meanwhile, Massachusetts cannabiz regulators are excited to create a statewide product catalog to help cops and parents identify things they find. But the Bay State is also home to a lawsuit over impact fees which are part of the state law's "host community agreements" allowing towns and cities to take up to 3% of cannabusinesses' annual income as long as they justify why the fees are being imposed. Cannabis licensing came to a halt in Detroit due to Crystal Lowe's lawsuit in which her attorney argues the "Detroit Legacy" requirements violate equal-protection provisions of the Michigan Constitution and the commerce clause of the U.S. Constitution. Funny enough, a Pennsylvania restaurant hit with nearly $10,000 in state citations for reopening their business in May was found not guilty because apparently the governor and Department of Health's orders cannot be punished under criminal law.    We mention a Boston doctor's allergic reaction to the Moderna vaccine, how Biden's 33-year-old niece gets no jail time for Pennsylvania DUI, and Bill Gates' proposed sun-dimming technology. Yikes. Meanwhile, a high school senior in Nevada is suing after being forced to take a Critical Race Theory class forcing students to identify as oppressed or oppressors.    Lisa Montgomery's execution date is on hold because of a stay of motion since her lawyers came down with the coof. Initially, the Justice Department had rescheduled it for January 12. Her family may not admire the president, who started taking care of business when it comes to prisoners sitting on death row, but Trump is 2020's most admired man. He even gave a presidential pardon to Weldon Angelos for a federal marijuana conviction, of which he served 13 years of his sentence. A 420 POW was also pardoned under Governor Gretchen Whitmer.   Kansas City made it into a High Times headline after cops suggested pot may have caused this month's spike in fatal car crashes. A major donor to Montana's legalization initiative is facing prosecution related to campaign finance which hedges on whether or not their sole purpose is election interference. But in a sign of normalization, K-12 students in Pennsylvania can learn about making sustainable plastic out of hemp during the state's virtual Farm Show.    NORML published a list of states to watch in 2021 including the likes of Kentucky, Virginia,  Rhode Island, South Carolina, New York, New Mexico, and Connecticut, but *red book prediction*: Maryland should be mentioned in there as well.   To make Cannabis Cups happen in 2020, state dispensary workers acted as judges and shared the best their state had to offer. Next year, New Jersey will be able to participate since their constitutional amendment for a recreational market starts up on January 1st, but a bill proposing decriminalization for everyone -- including anyone under the age of 21 -- has caused a little confusion.   And lastly, CBD could be an antimicrobial treatment for fresh produce after research shows it extends the shelf life and stops mold growth on strawberries. It could prove effective for mouthwash,too.    The Washington, D.C. City Council decriminalized possession of drug paraphernalia as part of the broader Opioid Overdose Prevention Act earlier this month and signed it into law this week while the New Hampshire Supreme Court ruled unanimously in favor of spiritual psilocybin use. Healthcare professionals in Canada will be able to legally use magic mushrooms too, the health minister said.    Oh, deer. A deer rescued from frozen lake in Kansas while, over the border, a deer was saved after becoming entangled in Christmas lights.  A third deer repeatedly attempted to break into a New Jersey elementary school and a mysterious gingerbread monolith showed up in San Francisco.   3-3-3 is the winning lottery number for the Pick 3, but three is also the number of weeks a Missouri woman had to agonize over her lost winning ticket before being able to claim her $180,000. The mayor of Atlantic City is hoping to cash in on Trump Derangement Syndrome by auctioning off the chance to virtually click and demolish the former Trump casino. After 13 years of fighting, and many disappointments along the way, he was released in March of 2016 after President Obama commuted his sentence.    Today, his mission is clear. In May 2016 after 13 years in federal prison (including a 3 month solitary confinement) Weldon was released after many requests to the White House, support from the sentencing judge Paul G Cassel, The Constituion Project and celebrities Alicia Keys, Snoop Dogg with a push by Charles Koch and Senator Mike Lee. Weldon decided upon his release that he was going to fight for the inmates he left behind, citing Luke Scarmazzo who is doing 22 years for running a dispensary in California. Mission [GREEN] part of The Weldon Project is dedicated to funding social change and financial aid for those still serving time for cannabis related offenses. Weldon continues his pursuit in cannabis by launching REEForm a California cannabis brand aimed at donating $100 (on an inmates books) per inmate incarcerated for a cannabis offense. Under the moniker "it's time for criminal justice REEForm". Distributed by Calyx Distribution, Angelos looks to provide financial relief to those still left behind bars. Kush Supply Co started a social equity program after hearing about Weldon's story and felt he should be the first recipient of it providing assistance with packaging costs. Can you imagine making a small-time sale of cannabis to someone how happened to be an undercover cop and that sale lands you a 55-year jail sentence. That happened to Weldon Angelos.in 2004, the music producer who had worked with the likes of Snoop Dogg and Tupac found himself in front of a judge with his life in the balance. A $350 bag of weed landed him a 55-year sentence despite the fact that judge in the case didn’t agree with the ruling.After exhausting almost all his appeals, a letter from The Constitution Project signed by 113 celebrities, advocates, former judges and prosecutors, and business leaders, that was handed to President Barack Obama urging him to commute Angelos’ sentence.Thanks to the help from The Constitution Project and Sen. Mike Lee, Angelos is a free man. He now uses his time advocating for prison reform through The Weldon Project.Their top priority now is getting Amir Muhadith from behind the wall. Muhadith is better know as former Bad Boy artist Loon. Today on Felony Friday Weldon Angelos joins John to share his incredible story! In the 90s Weldon launched a successful music career that brought him nationwide recognition. He founded the rap label Extravagant Records and was considered an “up and coming” entrepreneur in the industry. He wrote and produced songs with many acclaimed artists, including Snoop Dogg. Then in May and June 2002, Salt Lake City police set up a series of controlled marijuana buys from Weldon. All told a Confidential Informant purchased ½ pound of marijuana from Weldon on two separate occasions. According to the CI a firearm was present on Weldon during both buys. Weldon Angelos was sentenced to a mandatory 55 years in prison for selling a few pounds of marijuana while possessing a firearm – a sentence so extreme that his judge, unable to go below the mandatory minimum, called on the president to commute his sentence. A Mandatory Sentence is a controversial court decision setting where a judge's decision is limited by the law. Judges lose control over sentencing and cannot apply discretion given the particular facts of a case. It wont matter whether a drug defendant was a kingpin or low-level participant, if convicted for a crime that falls under a mandatory sentence a long and underserved sentence can be given. Billy Ochoa was sentenced to 326 years to life for 13 counts of welfare fraud totaling $2,100. Weldon Angelos was sentenced to 55 years for possessing a handgun while he sold $350 worth of marijuana to a police informant. Mandatory sentencing has increased the number of minorities in prison. So we must ask are these sentencing tactics keeping our streets safe? Are these laws a new way of enslaving minority youth? Would making drugs legal be a more effective way to end crime? Do all people who commit crimes deserve a second chance?
