Que tal saber como é o julgamento dos recursos dos contribuintes na 1ª instância da Secretaria da Fazenda e Planejamento de São Paulo (Sefaz-SP)? Quem explica esse assunto é Afonso Celso dos Santos, que há mais de 30 anos exerce a função de Julgador Tributário, hoje na Unidade de Julgamento de Osasco. Neste 16º episódio do Sefaz Conecta você vai entender como é feita a apreciação das defesas apresentadas contra Auto de Infração e Imposição de Multa (AIIM) lavrado pelos auditores fiscais. ​“Na maior parte das vezes, os autos de infração estão corretos, devido em grande parte, ao alto nível de profissionalismo e competência dos nossos auditores fiscais. Mas isso que não quer que o contribuinte nunca vai ter razão", explica Afonso. “Em ambas as decisões cabem recurso. Se a decisão for favorável ao contribuinte (e contra a Sefaz-SP, eu sou obrigado a recorrer da minha decisão. E se a decisão for contrária ao contribuinte, ele pode recorrer contra a minha decisão", complementa. Ele entrou na Fazenda como contador em 1990. Quatro anos depois, foi aprovado para trabalhar no órgão de julgamento como julgador tributário, começando a trabalhar na sede, na Capital. Posteriormente, se transferiu para a unidade de julgamento de Osasco. E, pasmem. O julgador tributário da Unidade de Julgamento de Osasco já analisou um processo com 100 mil páginas. Antes dessa trajetória, o caminho não foi nada fácil. Mineiro da cidade de Fazenda Guarani, Celso chegou à São Paulo ainda criança e teve que trabalhar em um supermercado no Jardim da Saúde, onde descascava cebolas. Também trabalhou como office-boy em uma empresa química. Foi auxiliar de contabilidade numa fabricante de ração animal. E, contador num escritório de contabilidade. Fora da Sefaz-SP, Celso dos Santos gosta de ping-pong e de dançar, porque “isso aumenta a minha sensibilidade para entender o contribuinte e me colocar no lugar dele na hora de decidir sobre o julgamento do recurso". Essa é a hora de você ficar por dentro do julgamento de um AIIM, hein?!

O ​bate papo deste 14º episódio do Sefaz Conecta é sobre substituição tributária. Ah não, o assunto é crédito acumulado, mas também podemos tratar sobre ciência de dados e inteligência artificial. Pode ser qualquer um desses temas, porque o convidado de hoje sabe o que está falando. É o auditor fiscal José Maurício Bettarello de Lima, lotado na Assistência Fiscal Técnica de Crédito Acumulado e Rural, da Coordenadoria de Fiscalização (CFIS) com vaga flutuante em Ribeirão Preto. E de quebra, ele ainda fala sobre fabricação de cerveja artesanal e maratona. José Maurício está na Secretaria da Fazenda desde 2009 quando entrou na fiscalização direta de tributos (FDT) pela Delegacia Regional de Araraquara. Quatro anos depois, se transferiu para a DRT de Ribeirão Preto, onde está até hoje, mas com vaga flutuante desde 2013 pela Assistência Fiscal Técnica de Crédito Acumulado e Rural, da CFIS. "Moldei minha carreira profissional baseado na substituição tributária, mas agora acabei migrando para o crédito acumulado", explica. Ao longo da sua trajetória dentro da Sefaz-SP, ele também ministrou cursos pela antiga Fazesp, hoje Escola de Governo (Egesp) desenvolvendo aulas de temas como AIIM, Ressarcimento ST, Auditoria Contábil, além de participar dos programas de "Multiplicadores" e de "Educação Fiscal" com palestras para classe de contabilistas e em escolas e universidades. Recentemente, José Maurício concluiu curso de MBA em Ciência de Dados que, de acordo com ele, vai fazer parte do nosso dia a dia, da vida em sociedade. Diz ainda que "inteligência artificial vai ser uma aliada do auditor fiscal". Comenta ainda as mudanças na legislação sobre o crédito acumulado para o produtor rural. Para ele, a nova norma vai facilitar a vida desse contribuinte e ao mesmo tempo evitar possíveis fraudes no recolhimento do ICMS. Nas horas vagas, o auditor fiscal natural de Franca/SP gosta de produzir cerveja artesanal. É um cervejeiro de copo cheio, trabalhando da moagem do grão até o envasamento da bebida. Ele gosta de explorar os sabores das suas cervejas e até criou uma de amora. "Quem gosta de cerveja artesanal estilo ripa, aprova a minha bebida, que é mais amarga e incorporada, com levedura belga", acredita. Outra grande paixão de José Maurício é participar de maratonas. "Já corri os 42 km da competição do Rio de Janeiro, de Florianópolis e participei da Maratona Virtual de Boston (EUA), na época da pandemia do coronavírus. Este ano, quero fazer a prova de São Paulo", planeja já com ritmo intenso de treinamentos e outros cuidados com a saúde. Ah, nos finais de semana ele também pratica wake-board, um esporte aquático onde uma prancha é puxada por cabos ligados a uma lancha. "Todo dia o que me deixa mais orgulhoso é trabalhar ao lado de pessoas incríveis aqui na Sefaz", conclui o cervejeiro e especialistas em substituição tributária/crédito acumulado, José Maurício de Lima. Marty has served as President of the NJ Chapter of AIIM. Marty graduated from Farleigh Dickinson University in 1975 with a BS in marketing and has been an ARMA member for the past 18 years. Marty founded Innovative Document Imaging (IDI), LLC twenty years ago, and IDI quickly became a leader in digital imaging conversions and system solutions for pharmaceutical, companies, publishers, government projects, and libraries. The company's mission is to supply the best service (at their facility or on location) possible at a reasonable cost for the digital conversion of paper documents, newspapers, maps, books, bound materials, microfilm, and microfiche. Pessoal, hoje vamos falar de mais um tema importantíssimo para a ADVOCACIA TRIBUTÁRIA: Ação Anulatória de Débito Fiscal 1) Ação anulatória de débito fiscal A ação anulatória de débito fiscal está prevista no art. 38 da Lei n. 6.830/80: “A discussão judicial da Dívida Ativa da Fazenda Pública só é admissível em execução, na forma desta Lei, salvo as hipóteses de mandado de segurança, ação de repetição do indébito ou ação anulatória do ato declarativo da dívida, esta precedida do depósito preparatório do valor do débito, monetariamente corrigido e acrescido dos juros e multa de mora e demais encargos” (original sem grifos). Seu objetivo é promover judicialmente a extinção do lançamento tributário ou da autuação fiscal se tais atos administrativos estiverem eivados de ilegalidade. Daí o nome de “ação anulatória”, que revela a pretensão do autor de anular o ato administrativo que fundamenta a cobrança do tributo: lançamento ou auto de infração. Assim, a propositura da ação anulatória pressupõe o lançamento ou a lavratura do AIIM. O prazo prescricional da ação anulatória é de 5 anos (art. 1º do Decreto n. 20.910/32). Mas, quando a ação anulatória for precedida de decisão administrativa que denegar a restituição do indébito, o prazo será de 2 anos (art. 169 do CTN). 2) A ação anulatória pode ser proposta mesmo após iniciada a execução fiscal. Importante destacar que o art. 38 da Lei n. 6.830/80 enuncia que a propositura da ação anulatória deve ser “precedida do depósito preparatório do valor do débito, monetariamente corrigido e acrescido dos juros e multa de mora e demais encargos”. Embora o dispositivo sugira que o depósito constitua requisito indispensável para a admissibilidade da ação, a jurisprudência pacificou o entendimento de que a realização do depósito prévio na ação anulatória é mera faculdade do contribuinte Proposta a anulatória, sem depósito, pode o Fisco intentar a execução. Mas, realizado o depósito em sede de anulatória, ocorre a suspensão da exigibilidade do crédito, desautorizando a instauração da execução fiscal. 3) O Fisco devedor, automática suspensão da exigibilidade e certidão tributária No julgamento do REsp 1180697/MG, a 2ª Turma do STJ entendeu que, nas ações anulatórias e de embargos propostas pela Fazenda Pública, sendo seus bens impenhoráveis, não há necessidade de depósito prévio ou garantia do juízo, ficando automaticamente suspensa a exigibilidade do créditoSTJ com a simples propositura da demanda. Assim, a Fazenda, nesse caso, tem direito de obter certidão positiva com efeitos de negativa (STJ, REsp 1.180.697/MG 2010/0022086-0, rel. Min. Castro Meira, j. 17-8-2010, 2ª T.)

Regina and her team still work with a lot of paper.  In fact, they scan over 1 million pages of paper every year; and this is on top of also managing a variety of electronic files. But perhaps most interesting is to hear Regina describe how Howard County is now ingesting audio files from 911 calls, and how those are records. She describes some of the challenges there. Rikkert Engles joins the show as well. Rikkert is a member of the AIIM leadership council and CEO and Founder Xillio based in the Netherlands. He shares his advice and recommendations for migrating to and leveraging the Microsoft Teams environment, and says that the launch of Cortex in MS365 is perhaps the most important development to watch this year.
