Guest Deena Peck is a senior manager of expert witnesses for The Round Table Group, which wrangles experts for attorneys in cases nationwide. She's joined by Dan Elms, a shareholder and veteran litigator with the law firm Greenberg Traurig. Let's dig in. It starts with the CV, but there's more to it. Don't be afraid to start with a video interview. Experts may look good on paper, but it's important to know if they can convey their expertise to a jury in a clear, relatable manner. Presentation and communication can be as important as expertise and authority. Your client's case may hinge on the experts you select. Don't be shy about challenging them (because opposing counsel sure will). The jury must trust your witness, but that can be a delicate dance. Too aloof, you lose your audience. Too casual, the jury may wonder if your witness is really an expert. And don't forget the practicalities, you need an available witness, not someone with a planned lengthy vacation on their calendar. The Indian Self-Determination and Education Assistance Act (ISDA), which allows Native tribes to administer their healthcare programs instead of the Indian Health Service (IHS), also requires IHS to pay “contract support costs” (CSCs) to tribes to offset overhead costs incurred by the tribes while administering their healthcare programs. Becerra v. San Carlos Apache Tribe (consolidated with Becerra v. Northern Arapaho Tribe) asks whether the IHS must pay CSCs not only to support IHS-funded activities but also to support tribes’ expenditure of income collected directly from third-party insurers.The San Carlos Apache Tribe, exercising its sovereignty in Arizona, managed its healthcare programs and billed outside insurers directly. However, the Tribe encountered difficulties funding the additional healthcare services from third-party revenue because IHS would not pay CSCs for these transactions. The Tribe sued the U.S. Department of Health & Human Services, IHS, and the United States for the CSC for the years 2011–2013. Environmental law is a dynamic field that evolves rapidly with new challenges as they emerge but also against the backdrop of the politics of state and federal administrations. Regulatory focus shifts from administration to administration and crisis to crisis, creating a challenging area of law for those who practice it.  Our guest, David Mandelbaum, is a shareholder with the firm of Greenberg Traurig and has practiced environmental law since 1984. He's seen a lot, from focusing on solid waste landfills decades ago to today's challenges created by a changing climate.  Legal procedures vary from state to state in addition to how the federal government oversees environmental issues, challenging practitioners to understand the law and the issues and the procedural process. Laws and statutes are in constant flux. For newer lawyers, Mandelbaum says the constant changes in the field of environmental law level the playing field between experienced attorneys and those getting out of law school. Changes come so fast that a new lawyer who has studied the latest regulations and cases can be on equal footing with someone who has practiced in the field for decades. A Civil Action (1998) is based on Jonathan Harr's critically acclaimed book of the same name. Written and directed by Steve Zaillian, the film starts John Travolta, and features supporting performances by Robert Duvall (who was nominated for an Oscar), William H. Macy,  James Gandolfini, John Lithgow, Kathleen Quinlan, and Tony Shalhoub. The film tells the true the story of the court battle over environmental pollution in Woburn, MA, in the 1970s and 1980s, where trichloroethylene (TCE), a solvent used in industrial operations, contaminated the local water supply, leading to numerous fatal cases of leukemia (including in small children) and other health problem for Woburn residents. Personal injury lawyer Jan Schlichtmann, brought suit on behalf of a group of victim families against two large corporations, Beatrice Foods and W.R. Grace, to hold them responsible for the pollution (a third company previously settled). But the suit ran into dogged resistance from large and powerful law firms on the other side, including WilmerHale (then Hale and Dorr) and one of its star litigators, Jerome ("Jerry") Facher (Robert Duvall). The film offers a dark view of the U.S. legal system's ability to uncover the truth and provide justice to victims. On this day in legal history, September 8, 1974, President Ford pardoned President Nixon, establishing the doctrine of “we haven't held our elected leaders accountable to this point and we sure as heck aren't starting now.”So, on this day in history, we revisit September 8, 1974, when President Gerald Ford issued Proclamation 4311, granting his predecessor, Richard Nixon, a full and unconditional pardon for any crimes he might have committed during his presidency, particularly concerning the Watergate scandal. Ford believed this step was necessary to heal the nation, stating it was a move to write an end to a national tragedy. Interesting how that works, often times people speak of holding wrongdoers accountable as being the mechanism for closure–here it seems the argument was to just let the whole thing go. This decision was met with widespread criticism, with many alleging a secret deal between Nixon and Ford, leading to Ford's testimony before the House Judiciary Committee, a rare occurrence for a sitting president.In the aftermath, Nixon faced a life of scrutiny and health issues, while Ford's presidency was marred by the controversial pardon, contributing to his defeat in the 1976 elections. Despite the initial backlash, Ford's decision was later viewed by the public with a more sympathetic lens, with Senator Ted Kennedy acknowledging the courage it took to make such a decision, and the John F. Kennedy Library Foundation awarding Ford the Profile in Courage Award in 2001–which sounds prestigious, but it's handed out to politicians left and right. Ted Kennedy himself won it in 2009 which is ironic given his history–Google “Ted Kennedy Chappaquiddick” if you don't follow the reference. On April 22, 1994, former U.S. President Richard Nixon passed away at the age of 81 due to complications following a stroke suffered in his New Jersey home. His death was met with a national day of mourning, proclaimed by then-President Bill Clinton, who lauded Nixon as a statesman with a vision for lasting peace and expressed gratitude for his counsel. The announcement of Nixon's death was followed by tributes from various prominent figures, including former presidents and senators, recognizing his contributions and reflecting on his legacy. He was given a state funeral and buried next to his wife in Yorba Linda, California.Justice Brett Kavanaugh recently expressed optimism that the U.S. Supreme Court will soon take significant steps to enhance its self-regulation concerning ethics. During an event in Cleveland, he echoed Chief Justice John Roberts' earlier statements about the court's commitment to addressing these issues. Kavanaugh emphasized the justices' dedication to upholding the institution's integrity and fostering respect among the American populace, despite potential disagreements over their rulings.This discussion comes amidst growing criticism of the court for perceived ethical violations. While Democrats advocate for a binding ethics code for the justices, some members of the court argue that Congress lacks the authority to enforce such regulations on an independent governmental branch. Justice Elena Kagan revealed that the justices are contemplating self-imposed ethics guidelines, acknowledging diverse opinions among them.Recent reports have spotlighted Justice Clarence Thomas for not disclosing financial benefits received from Republican donor Harlan Crow, and Justice Sonia Sotomayor's staff encouraging institutions to purchase her books during her appearances. Furthermore, Kavanaugh suggested that the court should consider more cases in the upcoming term, aiming for around 75 cases, a significant increase from recent years. He also criticized the trend of crafting judicial opinions with potential social media reactions in mind, urging judges to maintain the gravity and respect inherent in the judicial process.We should of course keep in mind the fact that Brett Kavanaugh himself has been credibly accused by three women of assault. Kavanaugh ‘Hopeful' Supreme Court Will Act Soon on Ethics (2)The legal troubles for Peter Navarro, a former advisor to Donald Trump, began in earnest when he was subpoenaed by the House Select Committee on the January 6 Attack on February 9, 2022, to provide documents and testimony regarding the Capitol riot. Despite the subpoena, Navarro refused to comply, publicly defending his non-compliance in media appearances. He claimed that Trump had invoked executive privilege on his behalf, a claim that lacked substantiating evidence and was further undermined as President Joe Biden, who had the sole discretion to assert such privilege, did not do so for Navarro.Navarro's refusal to adhere to the subpoena led to a contempt of Congress charge, which was followed by an indictment on two counts by a grand jury in June 2022. Each count, pertaining to non-compliance with document production and testimony subpoenas, carries a potential one-year imprisonment sentence. Navarro was arrested at Reagan National Airport amidst plans to travel to Nashville, an event marked by allegations of harsh treatment, which were later partially acknowledged by U.S. District Judge Amit Mehta.Navarro's legal defense centered around the assertion of executive privilege, a claim he stated was made at the behest of Trump. However, Judge Mehta rejected this defense in January 2023, highlighting Navarro's failure to provide any evidence supporting Trump's directive to invoke the privilege, a stark contrast to other advisors like Mark Meadows and Dan Scavino who produced letters from Trump instructing them to assert the privilege. Navarro's attempts to dismiss the charges and argue against the procedural validity of the subpoena were also rejected by the court.During the trial, which commenced with jury seating on September 5, 2023, Navarro chose not to testify in his defense or present any witnesses, a strategy that proved unsuccessful as he was convicted on both counts of contempt of Congress after a two-day trial. The conviction, which mirrors that of another ex-Trump aide, Steve Bannon, from the previous year, leaves Navarro facing potential imprisonment of up to a year and a fine of $100,000 for each count, with sentencing scheduled for January 12, 2024.Former Trump adviser Navarro convicted of contempt of Congress | ReutersFormer Greenberg Traurig patent litigator, Allan Kassenoff, has filed a lawsuit against social media influencer Robert Harvey, accusing him of defamation, cyberstalking, and intentional infliction of emotional distress. The lawsuit, which seeks over $150 million in damages, alleges that Harvey's videos on platforms like TikTok, where he has over 3 million followers, portrayed Kassenoff as an abusive spouse and father, leading to his job loss and financial downfall. These videos, which began appearing on May 31, included alleged clips of Kassenoff verbally abusing his ex-wife, Catherine, amidst their divorce and custody battle over their three children. Kassenoff insists that Harvey disseminated misleading videos recklessly, disregarding the truth. The lawsuit, representing Kassenoff and his children, also includes another plaintiff, Constantine Gus Dimopoulos, Kassenoff's attorney, who accuses Harvey of defamation and harassment. Kassenoff maintains that his ex-wife collaborated with Harvey to fabricate a story about her having terminal cancer, which further fueled the defamation campaign, resulting in his resignation from Greenberg Traurig. In the last two episodes of Counsel to Counsel, I spoke with a lawyer who left corporate practice for management consulting and a trial lawyer who has built a trial consulting business but continues to try cases. In this episode, I speak with a corporate lawyer who cut his teeth at international law firms, went in-house, moved into a business role, and is back again at an international law firm. Carl Berglind is a Shareholder with Greenberg Traurig's Health Care & FDA group. He is based in Denver, Colorado. He focuses his practice on M&A and other complex transactions in the healthcare industry,  representing both sellers and investors. In his business roles, Carl served as the CEO of an early stage animal health / AgTech company.  He was also VP of M&A of a private equity backed ophthalmology platform, and Senior Vice President of Strategic Transactions at a Fortune 500 diversified health care services company. Carl was born in Sweden, and grew up in New York, Copenhagen, and Brussels. He speaks fluent Swedish and conversationally fluent French and Danish. On this day in history, July 20, 1990, Supreme Court Justice William Brennan retired. William Joseph Brennan Jr., an influential American jurist, served as an Associate Justice on the Supreme Court of the United States from 1956 until 1990, making him the seventh-longest serving justice in history. To add some color to that run, he was appointed by President Eisenhower and his successor was appointed by George H. W. Bush. Brennan, originally from Newark, New Jersey, pursued economics at the University of Pennsylvania before studying at Harvard Law School, later practicing law privately in New Jersey and serving in the U.S. Army during WWII. He was appointed to the Supreme Court of New Jersey in 1951 and was placed on the Supreme Court by President Dwight D. Eisenhower in 1956 via a recess appointment.On the Supreme Court, Brennan was recognized for his progressive stance, opposing the death penalty, advocating for abortion and gay rights, and dissenting in over 1,400 cases where the court declined to review a death sentence. Brennan penned several landmark case opinions such as Baker v. Carr, Eisenstadt v. Baird, Craig v. Boren, and New York Times Co. v. Sullivan, significantly influencing American jurisprudence. His ability to negotiate votes and shape varied opinions led to his recognition as one of the court's most influential members, with Justice Antonin Scalia naming him "probably the most influential Justice of the [20th] century." He retired in 1990 and was succeeded by David Souter. Justice Brennan passed away in 1997 Senator Tom Cotton, a prominent critic of progressive initiatives, has cautioned law firms and their clients regarding their use of Diversity, Equity, and Inclusion (DEI) programs. Following the US Supreme Court's decision to nullify affirmative action in higher education institutions, the Arkansas Republican issued warnings to 51 national and global law firms, stating that their continued endorsement of DEI programs could potentially breach federal law. Cotton, who sits on the Senate Judiciary Committee, predicted that both Congress and private entities would use their respective powers to examine the surge in race-based employment practices.He also communicated to the firms, including Allen & Overy, Greenberg Traurig, and Hogan Lovells, that they should be prepared to answer to Congress if they persist with race-based programs. The notice extended beyond law firms, with Republican Attorneys General from several states also cautioning Fortune 100 CEOs against racially motivated hiring and recruitment practices. Cotton has previously issued similar warnings, including a communication to Target's CEO, advising against the company's DEI practices. Alongside other Republicans, Cotton had issued a warning in November to the same law firms concerning the risks associated with their Environmental, Social, and Governance practices.Big Law's Diversity Efforts May Be Illegal, GOP Senator WarnsDoorDash Inc., a major player in the gig economy, is testing a new hourly wage option for its drivers, which could potentially reshape their classification under federal labor laws. Currently, most gig economy companies, including DoorDash, categorize their workers as independent contractors, who do not receive the same protections as employees under federal employment laws. This new pay model might suggest DoorDash exercises a significant amount of control over its drivers, a key factor in determining whether a worker is an employee or a contractor.DoorDash maintains that the new payment structure gives drivers more choices and control over their pay, signifying an independent contractor status. This comes amidst ongoing debates about worker classification, with claims that companies exploit the independent contractor model to avoid the obligations associated with hiring employees.It's worth noting that both the Internal Revenue Service and the Department of Labor (DOL) suggest hourly pay may indicate an employment relationship. This discussion arises as the Biden administration seeks to define the independent contractor status under federal wage laws. However, it's too early to predict how the DOL or courts will interpret DoorDash's move and what influence it might have on other gig economy companies.DoorDash Tests Gig-Economy Model With New Hourly Wage OptionGun rights advocates are challenging Massachusetts' firearm regulations, sparking scrutiny from the US Supreme Court. These challenges follow last year's Supreme Court decision, New York State Rifles & Pistol Association Inc. v. Bruen, which altered how firearms laws are evaluated and left many questions unresolved. Four active suits are currently testing the interpretation of this decision.In one case, Granata v. Healey, gun owners and manufacturers are challenging the state's restrictions on malfunctioning handguns. Another case seeks to have Massachusetts' ban on assault weapons and large-capacity magazines declared unconstitutional.At the state level, one lawsuit argues that the law allowing a licensing authority to revoke a person's gun license if it deems them unsuitable is too vague under Bruen. Another case aims to apply Bruen's test to the state's law prohibiting people from carrying switchblades.The Supreme Court has agreed to hear United States v. Rahimi, a case concerning the constitutionality of a federal law barring persons subject to a domestic-violence restraining order from possessing guns. This case could provide more guidance on the implementation of Bruen. However, attorneys note that it will take years for courts to refine Bruen's boundaries, and many details, especially concerning weapons that did not exist in the 18th century, remain unresolved.Gun Rights Battles Brew in Massachusetts in Supreme Court's WakeA U.S. judge has denied former President Donald Trump's attempt to move his criminal case from New York state court to federal court. The case is related to hush money payments made to porn star Stormy Daniels before the 2016 presidential election. Trump was indicted in April in Manhattan on 34 counts of falsifying business records to conceal a $130,000 payment to Daniels, facilitated by his then-lawyer Michael Cohen.Trump, currently a front-runner for the 2024 Republican presidential nomination, argued that the case should be in federal court as it relates to his 2016 presidency and involves federal election law. However, Judge Alvin Hellerstein refuted these claims, stating that the case involves a personal matter unrelated to Trump's official acts as president.The judge also dismissed the argument that Trump has immunity and that the state charges were pre-empted because they were intended to defraud the voting public during a federal election. Trump's trial is set for March 2024 in the New York State Supreme Court, and it is yet to be confirmed whether he will appeal. Trump continues to argue that the case is politically motivated.Trump loses bid to move New York hush-money case to federal court | ReutersTesla has been instructed to turn over some of CEO Elon Musk's emails to JPMorgan Chase as part of an ongoing lawsuit. The case originates from a dispute over a bond contract that came about after Musk's 2018 tweet about potentially taking Tesla private. JPMorgan claims that Musk communicated about this plan through his SpaceX account. The bank has accused Tesla of breaching a 2014 contract related to stock warrants that it sold to JPMorgan, which it alleges increased in value due to Musk's tweet.The bank has sued Tesla for $162.2 million, arguing it had to reprice the warrants after Musk's tweet, and the subsequent increase in Tesla's stock price necessitated payments that Tesla has not made. Tesla counter-sued JPMorgan, accusing the bank of seeking a "windfall" when it repriced the warrants.Musk, who bought Twitter for $44 billion in 2021, agreed as part of a 2018 deal with the U.S. Securities and Exchange Commission to get preapproval for certain tweets from a Tesla lawyer. Some people predict that by 2025 half of legal teams will be staffed by non-lawyers. Will that be perceived as a threat or an opportunity? Do lawyers need to learn legal tech, or can they just hire people who specialize in it but are not lawyers? Do you need to be a lawyer to effectively use legal tech? Some Republicans believe that Trump and DeSantis would be a formidable team. They argue that Trump's charisma and DeSantis's popularity would be a winning combination. They also believe that the two men are ideologically aligned and would be able to work together effectively.As to SCOTUS:A nearly $2 million sale of property co-owned by Supreme Court Justice Neil Gorsuch to a prominent law firm executive in 2017 is raising new questions about the lax ethics reporting requirements for Supreme Court justices.Property records from Grand County, Colorado, show that the Walden Group LLC – a limited-liability company in which Gorsuch was a partner – sold a 40-acre property on the Colorado River to Brian Duffy, chief executive officer of the prominent law firm Greenberg Traurig.One of the most serious ongoing accusations is that Justice Gorsuch has used his position on the court to benefit his wife as well, who is a lobbyist. According to reports, Justice Gorsuch has allowed his wife to use his office to meet with government officials and to lobby for her clients. This is a clear conflict of interest, and it raises serious questions about Justice Gorsuch's ability to remain impartial on the court.Other justices have also been accused of taking material benefits. Justice Clarence Thomas has been accused of accepting lavish gifts from a wealthy donor. Justice Samuel Alito has been accused of using his position on the court to benefit his son, who is a lawyer.

And remember, as the trial begin, when Trump defends himself in the E. Jean Carroll rape case by saying "she's not my type" what he's really saying is "she's not my type TO RAPE."
