Michael Pauley and Chris Motz take a deeper look at the Supreme Court's landmark decision in Dobbs vs. Jackson Women's Health Organization, this time focusing on three concurring opinions written by justices who voted to uphold the pro-life law in Mississippi that was challenged. While all three justices agreed that Mississippi's statute limiting abortions after 15 weeks gestation should be deemed constitutional, there were stark differences in the reasoning that each justice used to reach the same conclusion. First, Michael and Chris look at the intriguing concurrence penned by Justice Clarence Thomas, who offers a vigorous critique of the Supreme Court's history of using “substantive due process” analysis to expand the court's power. Next they examine the concurrence of Justice Brett Kavanaugh, focusing on his argument that the Constitution “does not take sides on the issue of abortion.” Finally, they consider the concurrence of Chief Justice John Roberts, who argues that the court should have upheld the constitutionality of the Mississippi law, but without overturning the prior precedents of Roe v. Wade and Planned Parenthood vs. Casey.

On this episode Michael Pauley, Executive Director of the South Dakota Catholic Conference, and Chris Motz, Chief of Staff for the Diocese of Sioux Falls, provide an initial overview of the momentous decision released June 24, 2022 by the U.S. Supreme Court in the case of Dobbs v. Jackson Women's Health Organization. They discuss the court's decision to overturn its previous cases, Roe v. Wade (1973) and Planned Parenthood v. Casey (1992), that asserted the existence of a federal constitutional right to abortion, and unpack what this means for the state of South Dakota.

There's long been a belief that the Supreme Court rarely departs from precedent. But as the court appears to intend to strike down Roe, we're wondering what the data tell us about how consistent the Supreme Court has been at honoring precedent. And, is the Supreme Court more likely to depart from precedent in constitutional cases than other types? To break it all down, we spoke to Washington University law professor Lee Epstein, about her 2015 paper, "The Decision To Depart (or Not) From Constitutional Precedent: An Empirical Study of the Roberts Court", co-authored by William M. Landes and Adam Liptak.

The Supreme Court has agreed to hear a challenge to Roe v. Wade coming from Mississippi. While the corporate media has focused on abortion rights, this case poses a much deeper threat to the rights of minorities on multiple fronts. This case would use the abortion issue as a way to coronate 'states rights' at the expense of any sort of federal appeal. Without a federal level of law to supersede various state laws; wholesale discrimination could once again be the law of the land with no right to appeal.  Only Justice Sonia Sotomayor has spoken out regarding this danger to any true and diverse democracy. It was dubbed the biggest abortion case since Roe v. Wade as yesterday oral arguments were held in the case of Dobbs v. Jackson Women's Health Organization. --Appearing with Jim to present his evaluation of the case was Mat Staver. Mat is founder - chairman of Liberty Counsel. Mat is a constitutional attorney with over 230 published legal opinions, has authored 8 scholarly law review publications and 10 books. He's filed numerous briefs and argued in many federal and state courts. He has also argued two landmark cases before the U.S. Supreme Court.-The issue presented in this case is whether it would be upheld contrary to all court precedent going back to the 1973 Roe case. This is because Mississippi passed a law that bans abortions beginning at 15 weeks. This is prior to what's termed viability which is the baby's ability to live outside the womb. The controversy is over this viability issue which Mat indicated is considered about 22-24 weeks depending upon the circumstances.--Mat then proceeded to review some legal history beginning with Roe and the trimester system that came forth from that case. In the first trimester the state has no interest in regulating abortion. During the second trimester the state can put some regulations on abortion such as physician licensing or where abortions take place. During the third trimester, when you're well past the 22 week viability period, the state can put even more restrictions on abortion, but even then, they can't completely ban them.
