Some people spend their whole lives affirming the fact that they shouldn't get any more than what they have. They are told to be quiet and be grateful that they have more than their parents, and to forget their own aspirations. They believe what is essentially a lie, a spell to keep you complacent. But it doesn't have to be this way! You can break the spell and get everything you've ever wanted. And to do that, I've invited an author who has broken the spell of unworthiness so many times and given herself the life she's always dreamed of. Christine Gutierrez, MA, LMHC, is a Latina licensed psychotherapist, self-worth expert, and thought leader. Gutierrez is also the author of the book I Am Diosa: A Journey to Healing Deep, Loving Yourself, and Coming Back Home to Soul and the affirmation deck Wisdom Del Alma. Christine has a Bachelor's degree from Fordham University in human behavior and development and a Master's degree from City College of New York in mental health counseling with a focus on prevention and community. In 2017 Katy O'Neill Gutierrez was keen to get outdoors with her newborn daughter. When she searched for local mum and baby groups that combined a love of the outdoors with meeting other new parents, she couldn't find anything that fit the bill, so she decided to start her own. This conversation is full of knowledge, history, and wisdom. I'm excited to share this beautiful talk with Sandra Gutierrez, a bilingual, award-winning journalist, food historian, professional cooking instructor, and author of six cookbooks. She is considered one of the top national experts on Latin American Foodways and on the United States Southern Regional cuisine. Sandra discovered the New Southern-Latino culinary movement in 1996, a rare and impressive achievement. In 2021, Gutierrez was honored by the Smithsonian Institute as a Woman to Know and as one of the seven Latinas Who Shaped American Culture. Sandra also has a permanent exhibit at the Smithsonian, which features Kate Blohm Photography. Her most recent book, Latinísmo: Home Recipes from the Twenty-One Countries of Latin America is the first of its kind. Carrying on our tradition of covering civic elections, Episode 40 is an interview with Abel Gutierrez, one of the hopefuls looking to succeed the late Jason Schreyer as the representative of Elmwood- East Kildonan.4.40 Part 2- Born in northeastern Mexico, Abel Gutierrezcame to Canada when he was 3 years old and grew up in North Kildonan. As an adult he chose to raise a family in Elmwood and build a career as a construction project manager. He says he's running to show “my deep appreciation for the working class families in this ward,” many of whom he's met through his volunteering with the East Side Eagles football club. Included in his resume is a brief time working for the City Of Winnipeg with the traffic signals control centre project. “There is definitely some things to overcome when itcomes to our city services,” such as road construction contracts, says Gutierrez. “If we're not taking opportunities on the weekends we need to do something about that,” suggesting evening shifts instead of work sites becoming “ghost towns.”16.20- Getting the Louise Bridge reopened is a priorityfor Gutierrez. “That artery is crucial especially when it comes to emergency services,” he says, and he disagrees with Mayor Gillingham spending tax dollars on reopening Portage and Main to pedestrians this year instead of maintaining the bridge. 23.15 Part 3- While door-knocking so far, Gutierrez has heard from residents who worry about vacant and derelict commercial buildings and homes. His solution: “why don't' we just knock them down? Anempty lot looks better than a derelict building there.” He believes rehabilitating those buildings would be too costly and that developers would “love to have one of those lots and turn it into something beautiful.”29.00 - Regarding the veteran's housing provided on Talbot Avenue at Legion Gardens, Gutierrez tells how he lives close by but “was unaware of the crisis that they've faced” with repair and maintenance costs- including expensive city water and waste requirements.“When it comes to a veterans housing program running outof a lower income constituency, we need to work with those organizations. That's it, bottom line.”34.00 - Elmwood has problems caused by crime and homeless encampments that isn't well publicized - and Gutierrez says Coun. Jeff Browaty has the right idea about removing encampments from major routes. Having grown up in Manitoba Housing, he was shocked to learn that some of the criminals stay in encampments actually have subsidized housing units. He says that's denying honest families their chance at a step up. 41.05- Gutierrez does not support the exclusive contract the Gillingham administration awarded to Main Street Project for mobile services to deal with the homeless. "I think we need to diversify our approach in this... I don't know when the last time you had a chance to drive by the Main Street Project, but it's not good. If that's what we're funding, I have to avoid that area when I bring a client to the city." “I don't like the image we portray as a gritty city,” Gutierrez asserts. “We need to take pride. We need to clean up our back yard.” He believes his workaholic nature will enhance hisability to work with the community, and if elected on October 25th, “I'm gonna roll up my sleeves for you at City Hall.” 50.05 Part 4- Marty Gold wraps up the episode with a pitch to support the Season Six funding drive, now at $2650. Alfredo Gutierrez, a nationally known migrants-rights activist and prominent politician, has died. At 79 years old, he succumbed to esophageal cancer on Tuesday, July 29. Through his long service in the state, Gutierrez exhibited an activist's DNA despite his role inside the government. He sought social justice with his dual passions of civil rights and educational access, especially for immigrants. On June 6, 1986, a single mom of three awakes to find her 4-year-old daughter has been abducted from her bed near Lexington, South Carolina. The family is desperate to find her. The girl's sister tells law enforcement she saw a man in a ‘magic hat' carry her sister out the window. However, there is no sign of the youngster. The days, weeks, months, and years pass without answers as the missing girl's mother battles racism, corruption, and a bungled police investigation that ignores key evidence. Finally, decades after the abduction, and with the involvement of a private investigator, an arrest is made. The young girl's family is entirely unsurprised at the perpetrator's identity - it was someone they suspected all along. In this case, the court considered this issue: Does a Texas death-row inmate have standing to sue the state over its refusal to grant access to DNA testing under a law that allows such testing only when the person can demonstrate that exculpatory results would have prevented their conviction?The case was decided on June 26, 2025. The Supreme Court held that Petitioner Ruben Gutierrez has standing to bring his 42 U.S.C. § 1983 claim challenging Texas's postconviction DNA testing procedures under the Due Process Clause. Justice Sonia Sotomayor authored the majority opinion of the Court.Prisoners convicted in state court have a liberty interest in demonstrating their innocence with new evidence under state law. When states create postconviction procedures, they can create rights to other procedures essential to realizing those rights. Under Skinner v Switzer, a prisoner may bring a § 1983 due process claim alleging that a state's DNA testing statute unconstitutionally prevents him from obtaining testing, even though he cannot directly challenge state court denials of his testing motions. To bring such a suit, the prisoner must demonstrate judicial standing to sue.The standing analysis follows Reed v Goertz, which requires three elements. First, Gutierrez adequately alleged an injury: the prosecutor's denial of access to DNA evidence. Second, prosecutor Saenz caused this injury by refusing to release evidence in his custody for testing. Third, if a federal court declares Texas's procedures unconstitutional, that judgment would eliminate Saenz's justification for denying testing, thereby removing the barrier between Gutierrez and the evidence. The declaratory judgment would change the parties' legal status and redress Gutierrez's injury by eliminating the allegedly unlawful basis for the denial.The Fifth Circuit erred in two fundamental ways. First, it improperly focused on the limited declaratory judgment the District Court ultimately issued rather than on Gutierrez's broader complaint. Gutierrez's complaint challenged not just Article 64's limitation to actual innocence claims, but multiple barriers the statute creates—including its virtually insurmountable standard for parties to crimes, its refusal to consider new evidence, and its prohibition on testing solely to challenge death eligibility. Standing depends on the allegations in the complaint, not on the particular relief a district court later grants.Second, the Fifth Circuit wrongly transformed the redressability inquiry into speculation about whether the prosecutor would ultimately provide the evidence. Under Reed, a declaratory judgment need only eliminate the prosecutor's reliance on the challenged provision as a justification for denying testing. The Court rejected the notion that redressability requires certainty about the ultimate outcome. That a prosecutor might find other reasons to deny testing—just as the prosecutor in Reed had multiple grounds for denial—does not defeat standing to challenge specific reasons as unconstitutional. Courts regularly allow plaintiffs to challenge improper legal grounds for discretionary decisions even when the decision-maker might reach the same result for different reasons.

EP.249 Onay Gutierrez is a multifaceted artist, collector, and preservationist with a rich background that spans education, ceramics, and historic preservation. Born in Veracruz, Mexico in 1977, Gutierrez began his career as an early elementary school teacher in marginalized communities in his home state. After immigrating to the United States, honed his skills as a ceramic artist. Gutierrez has a deep connection to the Penland School of Craft in the mountains of North Carolina, where he has been a student, patron, and now serves as a board member. This connection has likely influenced his artistic growth and commitment to the craft community. In addition to his artistic pursuits, Gutierrez is a passionate advocate for historic preservation. Alongside Jeffrey Childers PhD, he has restored three National Historic Places in Raleigh, NC. His commitment to art and social justice is further evident in their founding of the Gutierrez Collection, a contemporary art collection that explores themes of mental health, LGBTQ+ rights, Latin and Latinx identities, African and African diasporic cultures, women's art, and activism. The Gutierrez Collection has gained significant recognition, with its first museum exhibition currently on view at the Cameron Museum of Art in Wilmington, NC, until September 7th, and set to travel to the NC Museum of Art's Winston-Salem campus this fall. Through his work, Gutierrez continues to make a lasting impact on the art world, historic preservation, and social justice initiatives.
