Ready for the sad part? She did all of that while under constant personal attacks. Her political opponents tried to impeach her. They spread a rumor that she hadn't been born in America. Read our USA TODAY Best-Selling Book, The Score That Matters https://amzn.to/4bNbVcO Full show notes at www.LearningLeader.com Notes: John Quincy Adams once said, “Gratitude… when it takes possession of the bosom, fills the soul to overflowing and scarce leaves room for any other sentiment or thought.” Ask yourself the question, “What good shall I do today?” When you're upset that your social media post didn't get as many likes as you thought it would stop and think, ‘What good shall I do today?” It can reframe how you approach others and be more servant-based (which is a mark of a great leader) The fox mindset versus the hedgehog mindset. A hedgehog has a single lens. It's more rigid thinking. A fox sees the world through many different lenses. It's more flexible and adaptive. That is a theme of this conversation. Be open, be less judgemental, and be more curious about the way others view the world. “The older I get, the less certain I get of my opinions.” “It's easier to act your way into a new way of thinking than think your way into a new way of acting.” AJ shared that when he was dedicated to the thank you project even on a bad day when he was focused on saying thank you, his mind eventually caught up to his body. Change Your Mind – the founding fathers did this a lot. Daniel Kahneman said, “No one enjoys being wrong, but I do enjoy having been wrong because it means I am now less wrong than I was before.” Be Humble In Your Opinions – Ben Franklin told a short parable. He said, there was a “French lady, who, in a dispute with her sister said, I don't know how it happens, sister, but I meet nobody but myself that is always in the right. The point is that we are all that French lady. We all believe we have a monopoly on the truth. (Remind yourself that you're wrong sometimes) Flexibility of mind: Many of the Founding Fathers were open to the idea that they might be wrong, and more willing to change their minds than leaders are today. At the Constitutional Convention, Benjamin Franklin summed up this open-mindedness: “The older I grow the more apt I am to doubt my own judgment.” Think Slow – There are parts of modern life that would benefit from an enforced speed limit. We need fewer hot takes and more cold takes. We need more slow thinking. Writing in depth letters by hand forced ideas to be more nuanced. Thumb-texting acronyms have the opposite effect. Slow down consumption. Forced self to read the news just once a day. The value of slow thinking: For the year, AJ wrote a letter with a quill instead of using social media or texts. It was a revelation. It led to a less impulsive, slower style of thinking – a waiting period for his thoughts. Embrace Virtue – In the founding era, virtue was a cherished ideal (now it's often used in the phrase virtue signaling which is not a compliment). “A virtuous person puts the interests of others before their one. They focus on those two key words in the Constitution's Preamble, “General Welfare.” We Control the Sun – The sun carved on the back of George Washington's wooden chair at the Constitutional Convention. The sun was cut in half by the horizon. Was it rising or setting? At the end of the convention, Ben Franklin said he was convinced it was rising. America had a bright future (the world is built by optimists) Whether the sun sets or rises on democracy, that's up to us, we the people. In The Autobiography of Benjamin Franklin, Benjamin Franklin tells a story about his father criticizing his writing."About this time I met with an odd volume of the Spectator," Franklin wrote, "I thought the writing excellent, and wished, if possible, to imitate it." AJ's goal was to try to understand the Constitution by adopting the mindset and lifestyle of the Founders for a full year. He committed to living as the original originalist as a new way of searching for answers to one of the most pressing questions of our time: How should we interpret America's foundational document today?

Mike Winther dives into the third part of the Constitution Under Siege. He begins with a brief review of the necessary and proper clause. Then he dives into the controversial interpretation of the general welfare clause in the US Constitution.  While some argue that it allows Congress to enact any law promoting the general welfare, the founding fathers intended for it to limit taxation and ensure the nation's well-being.  He also explores how the commerce clause is often misused to regulate various aspects of society and the concerning trend of executive orders and presidential signing statements which bypass Congress. Ultimately, the conversation revolves around the ongoing debate between those who wish to restrain government power and those who don't.    You'll Learn: [00:41] The second part of the Constitution that is sometimes used as a huge loophole is the general welfare clause. General welfare is found in the Preamble of the Constitution. A preamble is a statement of purpose. [02:07] Article 1 Section 8 of the Constitution says that congress can collect taxes to pay debts and promote common defense and general welfare of the United States.  [03:03] This is the clause that causes so much difficulty. Just like the necessary and proper argument, people who want big government think Congress can do whatever they want as long as it promotes the general welfare. [03:33] This argument violates the enumerated powers concept. [04:42] The founding fathers did not intend for the general welfare clause to be a granting of powers. It's a limitation of power. [05:37] General welfare was not redistribution of wealth for payments to help the poor. It was meant to be about the well-being of the country. [07:19] The difference between local welfare and general welfare or state of well-being. [09:25] The founding fathers often referred to the new republic as the general government. Congress has to pay attention to the general welfare. Powers can't be used to benefit one geographic region over another. [13:48] Thomas Jefferson explained that the general welfare clause was not a grant of power for the general welfare of the people. It was intended to limit taxation. [14:43] Congress will not lay a single tax when it's not to the advantage of the people at large. [15:23] Alexander Hamilton said the welfare of the community States is the only legitimate reason where money can be raised from the community. [17:16] Original intent of the founding fathers will help clear up any misconceptions about the wording. [17:50] General Welfare is not a grant of power, it's a limitation. [18:14] The commerce clause gives Congress power to regulate commerce among the states. The power is there because the states had a tendency to tax goods destined for other states. [23:40] The Roosevelt Administration said the reason for the depression was because prices were too low. They set out laws that forced merchants to raise their prices. [25:25] They also forced farmers to reduce the amount of food that they produced. A case went to the supreme court where a farmer didn't reduce his production. The court ruled that they could regulate his production. [28:34] The Interstate Commerce Commission created the railroad monopolies. Government uses the Commerce Clause as power to regulate everything. [32:58] The real solution should be to fix the cause, not the effect. [37:26] Mike talks about the Article 5 Amendment. The states can bypass Congress. This is a way for the states to go around the federal officials. [46:19] If we allow people to disregard the Constitution without consequence, what makes us think that yelling is going to make a difference? Why would making the Constitution bigger solve a problem? States are going to send people who like big government. [49:02] Convincing people to spend their resources on an ineffective pursuit furthers the opposite cause. [49:48] Article 1 Section 1: All legislative power shall be vested in the Congress of the United States. How much legislative power is given to Congress? [50:37] An executive order is a president's attempt to make legislation without Congress. [51:32] Both parties have gotten more socialist over the years. [53:35] The issue is really about people who want to restrain the government and people who don't want to restrain the government. Both parties got their training in public schools. [55:59] Which article in the Constitution talks about executive orders? None! [57:37] A presidential signing statement is something that presidents do when they don't like a part of the bill. [01:00:34] The House of Representatives and Congress really needs to hold everybody accountable. The Congress shall have Power To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes. The Supreme Court has seldom restrained the use of the commerce clause for widely varying purposes. The first important decision related to the commerce clause was Gibbons v Ogden, decided by a unanimous Court in 1824. The case involved conflicting federal and state laws: Thomas Gibbons had a federal permit to navigate steamboats in the Hudson River, while the other, Aaron Ogden, had a monopoly to do the same granted by the state of New York. Ogden contended that "commerce" included only buying and selling of goods and not their transportation. Chief Justice John Marshall rejected this notion. Marshall suggested that "commerce" includes navigation of goods, and that it "must have been contemplated" by the Framers. Marshall added that Congress's power over commerce "is complete in itself, may be exercised to its utmost extent, and acknowledges no limitations other than are prescribed in the Constitution". The expansive interpretation of the Commerce Clause was restrained during the late nineteenth and early twentieth centuries, when a laissez-faire attitude dominated the Court. In United States v E C Knight Company (1895), the Supreme Court limited the newly enacted Sherman Antitrust Act, which had sought to break up the monopolies dominating the nation's economy. The Court ruled that Congress could not regulate the manufacture of goods, even if they were later shipped to other states. Chief Justice Melville Fuller wrote, "commerce succeeds to manufacture, and is not a part of it." The U.S. Supreme Court sometimes ruled New Deal programs unconstitutional because they stretched the meaning of the commerce clause. In Schechter Poultry Corp. v United States, (1935) the Court unanimously struck down industrial codes regulating the slaughter of poultry, declaring that Congress could not regulate commerce relating to the poultry, which had "come to a permanent rest within the State." As Chief Justice Charles Evans Hughes put it, "so far as the poultry here in question is concerned, the flow of interstate commerce has ceased." The first clause of Article I, Section 8, reads, "The Congress shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States." This clause, called the General Welfare Clause or the Spending Power Clause, does not grant Congress the power to legislate for the general welfare of the country; that is a power reserved to the states through the Tenth Amendment. Rather, it merely allows Congress to spend federal money for the general welfare. The principle underlying this distinction—the limitation of federal power—eventually inspired the only important disagreement over the meaning of the clause. The Tenth Amendment to the United States Constitution, a part of the Bill of Rights, was ratified on December 15, 1791. It expresses the principle of federalism, also known as states' rights, by stating that the federal government has only those powers delegated to it by the Constitution, and that all other powers not forbidden to the states by the Constitution are reserved to each state. Either James Madison and other supporters of the Constitution were lying when they said the powers of the federal government would be “few and defined,” or people have misconstrued the legal meaning of this clause. This presentation features Bill Binney, Dennis Small and Mike Billington. Is it true that the arc of the moral universe is long, but bends towards justice? Thirty-seven years ago, Lyndon LaRouche was involved, with the full knowledge of the National Security Council, in a back-channel negotiation with the Soviet Union. That process led to the Reagan Administration's thermonuclear war avoidance policy the termed the Strategic Defense Initiative (SDI.) Despite the fact that the senior director of the National Security Council, Norman Bailey, had met with LaRouche, and, as reported by the Washington Post in 1985, had “described LaRouche's organization as "one of the best private intelligence services in the world,“ LaRouche was put through a federal prosecution by the United States Justice Department. Former United States Attorney General Ramsey Clark described the persecution of LaRouche and his movement as constituting “a broader range of deliberate and systematic misconduct and abuse of power over a longer period of time in an effort to destroy a political movement and leader, than any other federal prosecution in my time or to my knowledge.” That LaRouche prosecution from the years 1986-1994 and after, was the seed-crystal for the succeeding decades-long abuse of power carried out, under the guise of “national security,” through illegal surveillance, biased prosecutions, and judicial railroads. This was ultimately done not only against many innocent American citizens, but also against the United States Presidency itself, largely through the actions of British intelligence services and their American assets, as in the thoroughly discredited “Russiagate hoax. The recent visit of Secretary of State Mike Pompeo to London, where he said, “it's great to be back in London to reaffirm the special relationship we share with our closest ally,” illustrates the problem. Now, through the courageous actions of “good Americans” such as William Binney, the former Technical Director the National Security Agency (NSA), it becomes possible to expose the snake-pit of corruption, duplicity and sedition that has prevented the policies of war-prevention and economic growth of Lyndon LaRouche. This is what is now preventing the Presidency from advancing the General Welfare of all American citizens through economic cooperation with other nations, particularly Russia and China, in the pursuit of peace through economic development and scientific progress. common good (also commonwealth, common weal, general welfare, or public benefit) refers to either what is shared and beneficial for all or most members of a given community, or alternatively, what is achieved by citizenship, collective action, and active participation in the realm of politics and public service. The concept of the common good differs significantly among philosophical doctrines.[1] Early conceptions of the common good were set out by Ancient Greek philosophers, including Aristotle and Plato. One understanding of the common good rooted in Aristotle's philosophy remains in common usage today, referring to what one contemporary scholar calls the "good proper to, and attainable only by, the community, yet individually shared by its members."[2] The concept of common good developed through the work of political theorists, moral philosophers, and public economists, including Thomas Aquinas, Niccolò Machiavelli, John Locke, Jean-Jacques Rousseau, James Madison, Adam Smith, Karl Marx, John Stuart Mill, John Maynard Keynes, John Rawls, and many other thinkers. In contemporary economic theory, a common good is any good which is rivalrous yet non-excludable, while the common good, by contrast, arises in the subfield of welfare economics and refers to the outcome of a social welfare function. Such a social welfare function, in turn, would be rooted in a moral theory of the good (such as utilitarianism). Social choice theory aims to understand processes by which the common good may or may not be realized in societies through the study of collective decision rules. And public choice theory applies microeconomic methodology to the study of political science in order to explain how private interests affect political activities and outcomes.

New York, the New Deal Era, and how judicial interpretations of the General Welfare and Commerce clauses changed over time.Why was there no Bill of Rights when the Constitution was drafted? Is an originalist view of the constitution a necessarily antiquated one? (or U.N.A.) that was formed in 1968 in San Francisco, California to Promote the General Welfare of Native Americans. U.N.A was founded by Indians for Indians and is controlled by Indians. U.N.A. has been Labeled a "Militant" organization because of it's Aggressive Stand it has taken and because of the slogan it stresses--"INDIAN POWER", which is defined as Self-Determination, the Right to Run your Own Affairs and to Direct your Own Destiny, which is something Indian People Definitely Need. U.N.A is Definitely an Action Organization and if this means "Militant" then we are Militants. We as Native Americans, in order to perpetuate our Heritage, Exercise Constructive Leadership, and to perfect a Native American Organization which will Respond to the Needs of Native American. The Purpose of United Native Americans, Inc. Shall be: (1) To Actively Participate in Promoting the Health, Education and Welfare of All Native Americans. Quanah is Vice President of United Native Americans, Inc. United Native Americans, Inc (or U.N.A.) was formed in 1968 in San Francisco, California to promote the General Welfare of Native Americans. There are no paid staff or officers in U.N.A. and all work is donated. U.N.A. is not funded and exists solely on the support derived from membership dues, the sale of U.N.A. Merchandise, Tee Shirts, buttons, bumper stickers, and Posters, plus the few donations that have been received. U.N.A was founded by Indians for Indians and is controlled by Indians. UNA has been involved and organized demonstrations for DQ University. UNA Inc. was the first Indian organization to raise to national prominence in 1968.
